Crítica à Teoria Subjetiva da Participação
O artigo consiste em texto clássico da autoria de Hans Welzel, publicado em 1947. O autor tece críticas incisivas à teoria subjetiva, demonstrando suas falhas no que diz respeito a delimitação entre autoria e participação. Por fim, desenvolve aspectos atinentes à teria do domínio do fato, desde a ótica finalista.

Abstract: This paper is a classic text by Hans Welzel, published in 1947. The author elaborate a incisive critique of the subjective theory and demonstrates their mistakes, regarding the distinction between authorship and participation. Finally, it develops considerations about the theory of domain of the fact, from the perspective finalist.

O ser humano em Hans Welzel: um olhar além do finalismo ontológico
ResumoO finalismo, ao desenvolver a ação humana como uma atividade final, reestruturou o delito transportando o dolo e a culpa da culpabilidade para a própria tipicidade. O trabalho em referência tem como escopo aprofundar a teoria finalista desenvolvida por Hans Welzel especialmente no que atine a sua tentativa de evitar a repetição do Direito Penal nazista através do que ele entendia como Direito Natural e da natureza humana. Para tanto, deu-se atenção a obras do destacado autor que versavam sobre o seu entendimento do homem, notadamente a sua psicologia. Buscou-se explicar o motivo pelo qual a ação é final e que a resposta é encontrada na própria condição humana, pois somente respeitando a natureza das coisas o Direito age pela persuasão e não pela simples aplicação da força. Ainda, observou-se que certos agentes são incapazes de vinculação ética, restando apenas sanções de caráter indeterminado.Palavras-chave: Hans Welzel. Direito Penal. Finalismo ontológico. Psicologia criminal.AbstractWelzel’s finalist theory restructured the crime by reallocating mens rea from culpability to criminal offence. This paper intends to fully comprehend Welzel’s theory especially his attempts to avoid the Nazi criminal law reoccurrence through natural law and human nature. Books written by Welzel related to man’s psychology were the main source of information in order to achieve that goal. In fact, explaining finalist action and how human condition is the key to understand the whole theory is the major objective of this article. The answer to that is found in human itself, so criminal law may act as persuasion tool and not only by enforcement. Furthermore, there is a special group among offenders who are not capable of moral biding upon whom force alone is the applicable procedure.Keywords: Hans Welzel. Criminal law. Finalist ontology. Domínio do fato em Welzel e em Roxin : critérios de conceito restritivo de autoria
A presente monografia analisa o domínio do fato (critério de delimitação de autoria em direito penal) conforme os autores Hans Welzel e Claus Roxin e demonstra que ambas concepções são critérios de um conceito restritivo de autoria. Para tanto, são esclarecidos os conceitos, os sistemas e os critérios de autoria já sistematizados, são analisadas individualmente as concepções welzeliana e roxiniana de domínio do fato e expõe-se como a doutrina nacional cometeu muitos erros ao tentar importá-las.This monograph analyzes the dominion overthe fact (a criterion of authorship delimitation in criminal law) according to Hans Welzel and Claus Roxin and demonstrates that both conceptions are criteria of a restrictive concept of authorship. In order to achieve such conclusion, the currently systematized concepts, systems and criteria of authorship are clarified, the Welzelian and Roxinian conceptions of dominion over the fact are individually analyzed and it is exposed that the Brazilian legal scholarship made many mistakes while importing them.Die vorliegende Arbeit untersucht die Tatherrschaft als Kriterium für Abgrenzung der Täterschaft im Strafrecht gemäß der Lehren von Welzel und Roxin. Es wird gezeigt, daß die beide theoretische Auffassungen einen restriktiven Täterbegriff als Ausgangspunkt nehmen. Dazu wurden die bereits systematisierte Begriffe, Systeme und Kriterien der Abgrenzung der Täterschaft erklären und die einzelne theoretische Auffassungen von Welzel und Roxin erforscht. Zuletzt wird es festgestellt, daß bei der Umsetzung dieser Theorien zum Bereich des brasilianischen Strafrechts viele Fehler gemacht wurden
Variations on the Author
“Variations on the Author” discusses two of Eduardo Coutinho’s recent films (Um Dia na Vida, from 2010, and Últimas Conversas, posthumously released in 2015) and their contribution to the general question of documentary authorship. The director’s filmography is characterized by a consistent yet self-effacing form of authorial self-inscription: Coutinho often features as an interviewer that rather than express opinions propels discourses; an interviewer that is good at listening. This mode of self-inscription characterizes him as an author who is not expressive but who is nonetheless markedly present on the screen. In Um Dia na Vida, however, Coutinho is completely absent form the image, while Últimas Conversas, on the contrary, includes a confessional prologue that moves the director from the margins to the center of his films. This article examines the ways in which these works stand out in the filmography of a director who offers new insights into the notion of cinematic authorship
Going Beyond Counting First Authors in Author Co-citation Analysis
The present study examines one of the fundamental aspects of author co-citation analysis (ACA) - the way co-citation
counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings
are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that
only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into
account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed. Reasons for these effects are discussed

Dispelling the Myths Behind First-author Citation Counts
We conducted a full-scale evaluative citation analysis study of scholars in the XML research field to explore just how different from each other author rankings resulting from different citation counting methods actually are, and to demonstrate the capability of emerging data and tools on the Web in supporting more realistic citation counting methods. Our results contest some common arguments for the continued
use of first-author citation counts in the evaluation of scholars, such as high correlations between author rankings by first-author citation counts and other citation
counting methods, and high costs of using more realistic citation counting methods that are not well-supported by the ISI databases. It is argued that increasingly available digital full text research papers make it possible for citation analysis studies to go beyond what the ISI databases have directly supported and to employ more
sophisticated methods
