    This article discusses about the prosess of conflict escalation in Jatigede Dam construction esspecially in pre-construction period from structural and processual point of view using conflict theory. However, height of conflict decreased (deescalation) in empowerment period through community participation and agreement that accomodate community interests. This article emphasizes on the importance of ensuring the rules, policies, and budgets on possibility of problem arising (structural).     Informal economic has a big proportion which absorbs 58% of the workforce in Indonesia. In urban areas, it easily can be seen as street vendors (SV). Several previous studies on informal economic about street vendors see them from negative perspective (as the source of urban irregularity) and positive perspective (for contribution to national economic development). By using the literature review, observation, and depth interview with the SV at Jalan Salemba Raya (Jakarta City) and Jalan Raya Sawangan (Depok City), this article particularly shows with the second perspective of previous studies that SV contributes to economic activity in urban.     Penelitian ini dilatarbelakangi oleh pembentukan MKMK sebagaimana tertuang dalam PMK Nomor 1 Tahun 2023 yang bersifat Ad Hoc telah menimbulkan polemik kepastian hukum dimana Ketua Mahkamah Konstitusi telah melakukan Abuse of Power dengan secara sengaja menunda untuk melantik anggota MKMK Ad Hoc sehingga lembaga MK berjalan tanpa adanya pengawasan dan secara sadar para hakim MK mengabaikan tuntutan untuk dibentuknya MKMK permanen. Penelitian bertujuan untuk mengetahui : 1). Dasar hukum pembentukan MKMK permanen berdasarkan pasal 27A Undang-Undang Nomor 7 Tahun 2020 dan PMK Nomor 1 Tahun 2023. 2) Akibat hukum yang timbul dari dibentuknya MKMK permanen sebagai instrument pengawasan hakim konstitusi. 3). Tinjauan Siyasah Dusturiyah terhadap pembentukan MKMK permanen sebagai instrument pengawas hakim konstitusi. Jenis penelitian yang digunakan dalam penelitian ini yaitu jenis penelitian kualitatif dengan menggunakan metode penelitian deskriptif analitis yang berusaha mendeskripsikan suatu objek melalui data yang telah terkumpul sebagaimana adanya. Pendekatan dalam penelitian ini menggunakan pendekatan yuridis normatif yang berusaha menelaah sumber data hukum sekunder berdasarkan bahan-bahan kepustakaan berupa peraturan perundang-undangan, putusan pengadilan, teori hukum dan pendapat ahli, buku-buku serta berbagai sumber literatur kepustakaan yang menunjang Penelitian. Kerangka teori yang digunakan dalam Penelitian ini adalah teori hukum responsif, teori good court governance, dan teori siyasah dusturiyah. Landasan normatif yang digunakan adalah PMK Nomor 1 Tahun 2023 tentang MKMK dan Pasal 27A UU Nomor 7 Tahun 2020 tentang Perubahan Ketiga atas UU Nomor 24 Tahun 2003 tentang Mahkamah Konstitusi Hasil dari penelitian ini menunjukan : 1). Analisis dasar hukum pembentukan MKMK permanen berdasarkan PMK Nomor 1 Tahun 2023 tentang MKMK dan Pasal 27A UU Nomor 7 Tahun 2020 sesungguhnya merupakan responsifitas hukum berdasarkan tuntutan dari para masyarakat melihat kelembagaan MK berjalan tanpa adanya pengawasan oleh karena sikap Abuse of Power Ketua MK melantik keanggotaan MKMK Ad Hoc dan pengabaian rekomendasi MKMK Ad Hoc 2023 untuk membentuk MKMK permanen sehingga perlu ditetapkan sebagai lembaga permanen. 2) Akibat hukum yang timbul dari dibentuknya MKMK permanen adalah berakibat pada percepatan proses pengawasan hakim, hilangnya intensi abuse of power Ketua MK, peningkatan integritas perilaku hakim konstitusi, dan berakibat pada pembentukan budaya hukum masyarakat dalam berpartisipasi untuk menciptakan pengawasan yang kredibel terhadap hakim konstitusi. 3) Tinjauan siyasah dusturiyah terhadap pembentukan MKMK permanen memperlihatkan bahwa dalam paradigma kekuasaan hakim dalam Islam berpegang pada prinsip Al-Muraqabah dan dari segi akibat hukumnya siyasah dusturiyah menekankan bahwa lembaga kekuasaan manapun yang diperkuat pengawasannya akan berdampak pada peningkatan ketaatan dan sikap amanah

    Vulnerability and Survival Strategy by Food Street Vendors: Case Study in Triangle Gold of DKI Jakarta

    Street vendor (Pedagang Kaki Lima - PKL) is the most incarnation of the informal economy with the biggest role even at the state level. Unfortunately, PKL is blamed as the source of problems and surrounded by the threat of eviction which still happened in DKI Jakarta as the symbol and magnet of development in Indonesia. The qualitative method is used with study cases empowered by life history for revealing the vulnerability and survival strategy of the PKL household. The result shows the unforeseeable fact that PKL in Triangle Gold of DKI Jakarta potentially can reach income as same as regional minimum wage in DKI Jakarta. At the same time, the eviction and number of customers are the PKL’s vulnerability factors. Social capital is essential to start a new job or business as PKL, while strengthened by push and pulling factors to migrate from rural to city. Bridging and bonding with stakeholders through adaptation with the changing rule are the PKL’s main strategies to survive; besides preserving the identity and norms of PKL boost the adhesion of the PKL community to encounter a hard time. Beyond that, resignation value to God and effort for growing are determinant aspects that differ between PKL who have more or less revenue.</jats:p

    Covid-19 and Forest Communities: Alignment and Challenges on Case Studies in Forest Community, Pemalang, Indonesia

    A pandemic, last seen a century ago, has reappeared in 2019 under the name of Covid-19. Poor forest communities are also especially affected by this pandemic. The qualitative method through literature and case study is used to explain the connection between the emergence of COVID-19, forest destruction, and its impact on the lives of people in forests in Indonesia. Two cases are going to be models of forest communities in Pemalang, namely LMDH Rawa Sakti and KTH GGL. The program was established by the Ministry of Environment and Forest (MoEF) to create a supportive atmosphere for forest communities’ survival to overcome the Covid-19 crisis. We use the new institutionalism concept introduced by Victor Nee (2003) to understand how the coupling within the affirmation concept was developed at micro-level in Indonesia. The result shows that there are unique and complex situations, especially between the social groups, the members (as the individual), and other actors that are not examined by new institutionalism, which are important to reach collective action or influence the situation. In the KTH GGL context, Juragan (as the other actor) determines the commodity although many members want to plant ginger that aligns with the Ministry of Environment and Forest’s suggestion. On the other hand, trust issues become a more important aspect for members of LMDH RS to do the group’s activity

    Praktik Otoritarianisme dalam Demokrasi Indonesia Pasca Reformasi: Analisis Konstitusional dan Politik

    Democracy does not operate without flaws. Although it represents the best concept of governance among the worst, democracy always contains the potential to lead toward authoritarian regimes. The problem of authoritarianism is a social psychology issue concerning a regime type that suppresses popular sovereignty. In various countries that have experienced it, authoritarianism does not emerge on its own; there are preconditions that can be analyzed based on the ongoing socio-political context, including in post-reform Indonesia. To demonstrate how authoritarian practices operate in Indonesia, this research employs a literature study approach, as its focus relies on sources derived from literature. The research findings indicate that symptoms of authoritarianism such as abusive constitutionalism practices, electoral cartelized systems, juristocracy, and autocratic legalism have occurred in Indonesia, reinforced by various factors such as the formation of legislation that disregards constitutional principles, electoral autocracy, and the partiality of judicial power to the political will of those in power. There are several recommendations for rebuilding Indonesian democracy to make it better, including legal reforms on limiting Presidential powers before elections, tightening ethical oversight of judges, strengthening the authority of state institutions that have been weakened, and encouraging parliament to undertake transformative legislature in order to implement democracy more substantively

    Hermeneutika Al-Qur’an Kontekstual: Metode Menafsirkan Al-Qur’an Abdullah Saeed

    Quranic exegesis has a special place in the development of Islamic intellectual tradition and civilization at large. As the main source of Islamic teaching, for centuries Muslims have attempted to understand the various meanings of the Qur’an in order to be in line with the current needs of the society through the process of contextualization. In this article, the author presents and explains the way in which Abdullah Saeed, a professor in Islamic studies from the the University of Melbourne, Australia, contextualize the meaning of the Quran. In particular, this article analyzes some methodological aspects proposed by Saeed in the qontextualization of the Qur’an: 1) identifying the world of the text; 2) analyzing text critically; 3) connecting the text to the early Islamic community as the first receivers; and 4) relating the text to the current needs of society.
