JUSTICE PERSPECTIVES ON BP TANGGUH'S CLAIM TO CORPORATE SOCIAL RESPONSIBILITY IN BINTUNI BAY
Objective: This study is to determine and analyze the accountability of BP Tangguh and the Government concerning the rights of indigenous peoples in areas affected by BP Tangguh's operations. The focus is on evaluating these accountabilities through the lens of John Rawls' Theory of Justice. The study aims to identify any disparities between the proclaimed Corporate Social Responsibility (CSR) initiatives by BP Tangguh in Bintuni Bay and the justice values advocated by Rawls.
Theoretical Framework: John Rawls' renowned framework, characterized by its emphasis on principles of justice, fairness, and equity, serves as a powerful tool for evaluating the actions and responsibilities of BP Tangguh and the Government with regard to indigenous communities. This framework offers a comprehensive lens through which one can critically examine the social, economic, and environmental impacts of corporate activities on these communities.
Methodology: This research adopts a socio-legal research approach with a qualitative methodology. The data collection process incorporates observation, interviews, and literature study methods. Through these methods, the study aims to gather comprehensive insights into the social conditions of the communities around BP Tangguh's operational area and assess the effectiveness of CSR initiatives in promoting justice values.
Results and Conclusion: The results of the study reveal significant disparities between the social conditions of the affected communities and the CSR claims made by BP Tangguh. This suggests a misalignment with the justice values advocated by Rawls. The study concludes that, in practice, the proclaimed Corporate Social Responsibility initiatives by BP Tangguh in Bintuni Bay fall short of reflecting the principles of justice put forward by John Rawls.
Originality/Value: The originality and value of this study lie in its application of John Rawls' Theory of Justice to assess the accountability of BP Tangguh and the Government in relation to the rights of indigenous peoples. By employing a socio-legal research approach, the study contributes to the ongoing discourse on corporate accountability and social justice, shedding light on the practical implications of CSR initiatives in affected areas. The findings of this study may inform policy recommendations and contribute to the development of more equitable practices in the interactions between corporations, governments, and indigenous communities

sistematisasi interpretasi, analisis, penilaian terhadap norma hukum positif,
Pendektan yang digunakan adalah politik hukum dan sejarah hukum . Data yang
digunakan berupa data sekunder yang terdiri dari bahan hukum primer dan bahan
hukum tersier yang diperoleh dari perpustakaan ,media cetak, elektronik. Untuk
menarik kesimpulan dilakukan melalui penalaran hukum secara eksklusi, dan
penalaran derogasi yaitu menolak suatu aturan yang bertentangan dengan aturan
yang lebih tinggi.

Breach of Contract in the View of Islamic law: A Case Study on the Partnership Agreements of Mini BRI-link
As a banking industry, BRI has several financial services and products whose role is to satisfy the community's needs. Services and products provided by BRI include EDC Merchant machines, ATMs, E-Bangking, sales of third party products, such as Telkom products, PLN, credit cards and EDC mini BRI ATMs or BRILink Mobile. It is undeniable that sometimes there are some problems in the field such as defaults. Default is a form of negligence committed by one party that results in losses to the other party. This will be reviewed from Islamic Law using qualitative research methods with the research location located in Manokwari Regency, namely at the Manokwari Branch of the BRI Bank office (BRILink Section). In Indonesia itself, DSN-MUI Fatwa No. 17/DSN-MUI/IX/2000 states that fines for consumers who are competent but unwilling to pay their debts are contained in the category of ta'zir that is allowed. Analysis of Compliance Reporting of State Officials' Assets in the Regional Government of Manokwari Regency
Transparent and accountable management of state finances is a necessity in facing global uncertainty. In this context, compliance with the reporting of state administrators' assets is an important aspect in effective state financial management. This research aims to analyze compliance with reporting of state administrators' assets within the Manokwari Regency regional government through the implementation of e-filing of State Administrators' Asset Reports (LHKPN). This research uses a normative legal approach with library research methods. Data was collected through analysis of official documents related to wealth reporting and related literature. The research results show that compliance with reporting the assets of state administrators in Manokwari Regency is still limited. This compliance is influenced by several factors, including a lack of awareness and technical capability in using LHKPN e-filing, as well as a lack of transparency in state financial management. This research shows that compliance with reporting of state administrators' assets in Manokwari Regency still needs to be improved. To achieve this goal, local governments need to increase awareness and technical capabilities of state civil servants in using LHKPN e-filing, as well as increase transparency in state financial management
Upaya Bank Indonesia Menanggulangi Money Laundering Dalam Perbankan Online
Money laundering is a crime that can result in significant losses for the state since it can impair the national economy or state finances through a variety of criminal behaviours, and it is also very harmful to community actions. This study intends to describe the government\u27s efforts to combat money laundering in internet banking, specifically in the case of Bank Indonesia. This study uses normative legal research as an approach. The establishment of a Special Work Unit based on Bank Indonesia External Circular No. 11/31/DPNP of November 30, 2009, is the outcome of the implementation of the Money Laundering Law on the prevention of money laundering in the online banking system, according to the findings of the research. In addition, banks must also implement CDD and EDD policies. Customer Due Diligence (CDD) is a process by which the bank must identify, verify, and monitor transactions to ensure that they are in line with the customer\u27s profile. Because there is a substantial danger of money laundering and terrorism funding in the bank\u27s interaction with its customers, the bank must conduct an intensive CDD method called Enhanced Due Diligence (EDD). In the position as the executor of anti-tipping off, which means that in bank activities, especially in reporting suspicious financial transactions, the bank is obliged to keep the reporting information confidential to the customer concerned. An information management system that supports an effort to prevent money laundering crimes must be owned by banks to facilitate monitoring in order to analyze suspicious finances.Pencucian uang menjadi salah satu kejahatan yang dapat menimbulkan kerugian besar bagi negara karena dapat mengancam serta merugikan negara dengan meningkatnya berbagai tindakan ilegal, dan juga sangat merugikan masyarakat. Studi ini bertujuan untuk mendeskripsikan upaya pemerintah dalam hal ini adalah Bank Indonesia menanggulangi money laundering dalam perbankan online. Studi hukum normatif digunakan sebagai metode dalam studi ini. Berdasarkan studi yang telah dilakukan diperoleh hasil bahwa upaya Bank Indonesia terhadap penanggulangan tindak pidana money laundering dalam sistem perbankan online adalah dengan pembentukan suatu Unit Kerja Khusus berdasarkan Surat Edaran Ekstern Bank Indonesia No.11/31/DPNP tanggal 30 Nopember 2009. Selain itu bank juga harus menerapkan kebijakan CDD dan EDD. Customer Due Diligence (CDD) adalah proses dimana bank harus mengidentifikasi, memverifikasi, dan memantau transaksi untuk memastikan kesesuaiannya dengan profil nasabah. Karena adanya bahaya pencucian uang dan pendanaan terorisme yang cukup besar dalam interaksi bank dengan nasabahnya, bank harus melakukan metode CDD intensif yang disebut Enhanced Due Diligence (EDD). Dalam kedudukannya sebagai pelaksana anti tipping off, yang artinya dalam kegiatan bank khususnya dalam pelaporan transaksi keuangan mencurigakan, bank wajib merahasiakan keterangan pelaporan terhadap nasabah yang bersangkutan. Sistem manajemen informasi yang turut mendukung sebagai upaya penanggulangan tindak pidana pencucian uang harus dimiliki oleh perbankan sebagai sarana kemudahan dalam memantau dan menganalisis keuangan yang mancurigakan.
Implementation of Manokwari Regency DPRD Duties Regarding Supervision of Regional Government Performance Based on Law Number 23 of 2014 concerning Regional Government
Law no. 23 of 2014 concerning Regional Government provides a legal basis for the Regional People's Representative Council (DPRD) in supervising the performance of regional government. The Manokwari DPRD, as one of the legislative institutions at the regional level, has an important role in carrying out this supervisory task. This research aims to examine the implementation of the Manokwari DPRD's duties in monitoring regional government performance based on Law no. 23 of 2014. The research method used is descriptive analysis with a qualitative approach. Data was obtained through interviews with members of the Manokwari DPRD, document analysis, and direct observation of the Manokwari DPRD's work processes related to monitoring regional government performance. The research results show that the Manokwari DPRD has carried out its supervisory duties in accordance with the provisions of Law no. 23 of 2014. They supervise regional government performance through a number of mechanisms, such as commission meetings, plenary meetings, and examination of regional heads' accountability reports. They also play an active role in monitoring the use of regional budgets and evaluating regional government programs. However, there are several challenges in carrying out the supervisory duties of the Manokwari DPRD. One of them is limited resources, both in terms of manpower and budget. Apart from that, sometimes there are political obstacles that affect the independence of the DPRD in carrying out its supervisory function. Some DPRD members also face obstacles in accessing information needed for supervision. In the context of monitoring regional government performance, the Manokwari DPRD has great potential to increase accountability and transparency of regional government. To overcome the challenges faced, efforts are needed to strengthen the capacity of DPRD members, increase budget allocations, and ensure DPRD independence in carrying out supervisory duties. Apart from that, good cooperation between the DPRD and regional governments in providing access to the necessary information is also important. In conclusion, the implementation of the Manokwari DPRD's duties in monitoring regional government performance is based on Law no. 23 of 2014 has been running well, although there are still several challenges that need to be overcome. With the right efforts, the Manokwari DPRD can play a more effective role in increasing accountability and transparency of local government and improving the quality of public services for the people of Manokwari
Peran Dewan Perwakilan Rakyat Daerah Dalam Pengawasan Pemerintah Daerah Kabupaten Manokwari Berdasarkan Undang – Undang Nomor 23 Tahun 2014 Tentang Pemerintahan Daerah
This research discusses the role of the Regional People\u27s Representative Council (DPRD) in supervising Regional Government which has legislative, budget and supervisory functions. The tasks of the Regional People\u27s Representative Council are normatively a reflection of democratic life in regional government. Law Number 23 of 2014 concerning Regional Government gives the Regional People\u27s Representative Council (DPRD) a central role in supervising regional government. Through various provisions, this law mandates the DPRD to carry out various supervisory functions over regional government. The DPRD has a role in supervising general policy, budget implementation, government performance, drafting regional regulations, as well as being involved in the policy formation process. Apart from that, the DPRD also has special rights such as interpellation and inquiry rights to ensure transparency, accountability and public participation in supervision of regional government. This abstract summarizes the essence of the DPRD\u27s role in supervising regional government in accordance with the Regional Government Law, which aims to maintain integrity, efficiency and community interests in the implementation of regional government
Tinjauan Hukum Administrasi Negara Terhadap Pemenuhan Hak Penduduk Asli Papua dalam Konteks Otonomi Khusus
This research investigates the effectiveness of the Special Autonomy Law (UU Otsus) in protecting and empowering the rights of indigenous West Papuans. Through a descriptive approach, this research aims to provide a comprehensive picture of the situation and present data systematically to strengthen the arguments and conclusions. Research data was collected from reliable sources such as government reports, academic journals, and NGO publications. Descriptive research methods were used to analyze the data and elaborate on the findings. The results show that the Special Autonomy Law has provided some progress in the recognition of customary rights, improved infrastructure, improved living standards, and political participation of the people of West Papua. However, there are still challenges in implementation, such as unclear mechanisms, limited resources, corruption, prolonged conflicts, and the lack of understanding of indigenous peoples about their rights. Therefore, increased transparency, public participation, close monitoring, peaceful conflict resolution, and improved understanding of indigenous peoples are needed to improve the effectiveness of legal protection of indigenous rights in West Papua.Penelitian ini menginvestigasi efektivitas penerapan Undang-Undang Otonomi Khusus (UU Otsus) dalam melindungi dan memberdayakan hak-hak penduduk asli Papua Barat. Melalui Pendekatan deskriptif: Tujuan dari penelitian ini adalah untuk memberikan pemahaman yang menyeluruh tentang situasi yang ada serta menyajikan data secara sistematis untuk memperkuat argumen dan kesimpulan yang dihasilkan. Pengambilan data penelitian diperoleh dari sumber-sumber terpercaya seperti laporan pemerintah, jurnal akademis, dan publikasi LSM. Metode penelitian deskriptif digunakan untuk menganalisis data dan menguraikan hasil temuan. Hasil penelitian menunjukkan bahwa UU Otsus telah memberikan beberapa kemajuan dalam pengakuan hak ulayat, peningkatan infrastruktur, peningkatan taraf hidup, dan partisipasi politik masyarakat Papua Barat. Namun, masih terdapat tantangan dalam implementasi, seperti ketidakjelasan mekanisme, keterbatasan sumber daya, korupsi, konflik berkepanjangan, dan kurangnya pemahaman masyarakat adat tentang hak-hak mereka. Oleh karena itu, peningkatan transparansi, partisipasi masyarakat, pengawasan yang ketat, penyelesaian konflik secara damai, dan peningkatan pemahaman masyarakat adat diperlukan untuk meningkatkan efektivitas perlindungan hukum terhadap hak penduduk asli di Papua Barat.
