A Qur’anic Management Framework for Sustainable Work Ethics in the Digital Era: Operationalizing Amānah and Integrity for Organizational Resilience

Purpose –This study addresses the ethical erosion and dehumanizing tendencies of digitally mediated work (e.g., algorithmic control, gig arrangements, and transactional performance pressures) by formulating a Qur’anic management framework for sustainable work ethics grounded in amānah and integrity. It responds to the gap between prevailing digital work norms and Qur’anic moral ideals, with a focus on long-term organizational sustainability. Methods –  Using a tafsīr maudhū‘ī (thematic) approach within qualitative library research, the study conducts a structured thematic synthesis: (i) selection of Qur’anic passages relevant to work, trust, justice, and responsibility; (ii) contextual reading through classical and contemporary tafsīr; and (iii) hermeneutic translation of ethical themes into management constructs and sustainability-oriented outcomes (governance, social well-being, and responsible conduct). Findings–The study constructs an integrative model comprising three pillars—al-‘adl (justice), al-amānah (trustworthy integrity), and mas’ūliyyah ijtimā‘iyyah (social responsibility)—operationalized as sustainability enablers in digital workplaces. Al-‘adl supports fair treatment and worker well-being in data-driven performance systems; al-amānah strengthens ethical governance and accountability under automation; and mas’ūliyyah ijtimā‘iyyah matches organizational behavior with collective benefit and CSR-like commitments. Practical Implications–The framework offers a sustainability-oriented paradigm for human resource management, ethical leadership, and organizational governance, enabling firms to mitigate digital-era risks by embedding justice, integrity, and collective responsibility into codes of ethics, evaluation systems, and digital-work policies. Originality/value–This study advances Islamic management scholarship by moving beyond normative exposition to propose an operational Qur’anic management framework that links Qur’anic ethics to sustainability outcomes in contemporary digital organization

Evidentiary Strength of Electronic Evidence in Civil Disputes within the Framework of Bayyinah: A Case Study of Decision No. 22/PDT.G/2021/PN DGL

Background: The advancement of information technology in the digital era has introduced new dimensions to legal proceedings, particularly through the emergence of electronic evidence. This includes screenshots of digital conversations, electronically produced documents, and other forms of digital records. These new evidentiary types have begun to play a significant role in civil litigation, including inheritance disputes. In the Indonesian legal system, the increasing reliance on electronic documents presents both opportunities and challenges. Questions arise concerning the admissibility, authenticity, and legal force of such evidence, especially in sensitive cases like inheritance, where traditional documentation is often favored. This paper specifically addresses the complexity surrounding the evaluation and use of electronic evidence in Indonesian civil courts, emphasizing its growing importance in delivering justice in the modern legal landscape.   Purpose: This study examines the judicial assessment of electronic evidence in inheritance disputes through a case study of Decision No. 22/PDT.G/2021/PN DGL at the Donggala District Court. The research aims to analyze how electronic communications, particularly WhatsApp chats, are evaluated as valid proof under Indonesian civil procedural law and their relevance to the Islamic legal concept of bayyinah.   Methods: Using a normative juridical approach with statute and case analysis, the study reviews primary legal sources, including the Civil Code, the Herziene Indonesisch Reglement (HIR), and the Electronic Information and Transactions (EIT) Law, complemented by secondary literature   Results: The findings reveal that the court recognized electronic evidence as valid proof when it met formal requirements (printing, stamping, and verification) and material requirements (relevance and uncontested authenticity). The Defendants’ electronic submissions were deemed legally sufficient to prove the transfer of property during the decedent’s lifetime, whereas the Plaintiff’s evidence was rejected for lack of probative value.   Implication: The study highlights the need for clearer judicial guidelines, enhanced digital forensic literacy among judges, and legal reforms such as digital notarization and certified e-filing systems to strengthen evidentiary reliability in line with Sharia principles.   Originality: The novelty of this research lies in its integration of electronic evidence within the framework of Islamic procedural law, interpreting digital communications as a modern manifestation of bayyinah

Negotiating Haqq al-Ibtikar and State Patent Law: A Socio-Legal Study of Maslahah and Intellectual Property among Indonesian Muslim SMEs

    No full text
Background:  Indonesia’s 64 million SMEs drive 61% of national GDP yet face critical barriers in patent protection due to costly procedures, legal complexity, and low IP literacy. Purpose:   This study analyzes systemic gaps in Indonesia’s patent law (Law No. 13/2016) hindering SME innovation and proposes inclusive legal reforms. Methods:  A normative juridical approach examines statutory frameworks, case studies, and secondary data from academic literature (2017–2025) Results:   Key findings reveal: (1) High patent registration costs (up to IDR 20.9 million) exclude 87% of SMEs; (2) First-to-file systems disadvantage grassroots innovators; (3) Enforcement remains inaccessible due to lengthy litigation (avg. 30 months) and minimal ADR mechanisms. Implication:  Structural reforms are urged: specialized IP courts, tiered fee subsidies, and SME-tailored simple patents. Indonesia’s model could inform Global South patent policies. Originality:  This research introduces the inclusive patent framework—integrating open licensing, communal IP rights, and university-SME collaboration—as a novel juridical paradigm for equitable innovation
