    Dilema Hak Atas Pekerjaan dalam Kebijakan Pasar Tenaga Kerja Fleksibel

    The right to work demands the role of the State in its fulfillment but the development of a flexible labor market poses a dilemma for the state in fulfilling the right to work. This study was conducted by using a normative type of research that examines the right to work in a flexible labor market using a statutory approach. In Indonesia, the flexible labor market is embodied in the Job Creation Act, which describes the state’s dilemmatic position in carrying out its duties for the right to work. Against this dilemmatic position, the state prioritizes job creation over the feasibility of the jobs created. Based on this research, the author outlines the importance of a holistic approach in viewing human rights in the legislation process. So that the availability of work and the feasibility of work are not placed separately. This is because indecent work places the degree of human beings, who are trying to be protected by human rights, in a vulnerable position.Hak atas pekerjaan menuntut peran Negara dalam pemenuhannya, namun kehadiran pasar tenaga kerja fleksibel telah menimbulkan dilema bagi negara dalam pemenuhan hak atas pekerjaan yang menjadi tanggung jawabnya. Penelitian ini merupakan penelitian normatif yang menelaah hak atas pekerjaan di dalam pasar tenaga kerja fleksibel dengan menggunakan pendekatan peraturan perundang-undangan. Di Indonesia, pasar tenaga kerja fleksibel mewujud dalam Undang-Undang Cipta Kerja yang menggambarkan posisi dilematis negara dalam menjalankan tanggungjawabnya terhadap hak atas pekerjaan. Terhadap posisi dilematis ini, negara mendahulukan terciptanya lapangan kerja dibandingkan dengan kelayakan pekerjaan yang diciptakan. Berdasarkan penelitian ini, terkuak pentingnya pendekatan holistik dalam memandang hak asasi manusia. Sehingga antara ketersediaan pekerjaan dan kelayakan pekerjaan tidak diletakkan secara terpisah. Hal ini dikarenakan pekerjaan yang tidak layak, menempatkan derajat manusia yang dilindungi oleh hak asasi manusia dalam posisi yang rentan

    Paradigm of Application of The No Work No Pay Principle in Determining Process Wages

    The principle of no work no pay is a legal principle in labor law whose content shows the relationship between wages and work in an employment relationship. That means workers will not get paid if they do not work. The legal principle is frequently applied by courts in determining wages for workers whose employment relationship have been terminated so that workers lose their rights to process wages. With a non-doctrinal study that uses court decisions, this research examines the legal considerations of the panel of judges in applying the principle of no work no pay when determining whether to give wages to workers whose employment relationship has been terminated. The study showed that the paradigm of applying the no work no pay principle is still focused on the positivist mindset, which is deeply rooted in court as well as in the process of legal reasoning by the panel of judges. So that workers who do not work are considered as a single legal fact without other legal facts that accompany it

    An effort to protect workers throughout an economic transition to a sustainable economy gave rise to the concept of a just transition. This is because the transition will have an effect on the employment in which workers are engaged. Based on this concept, this study examines Indonesia’s worker response to a just transition. Non-doctrinal research was used to conduct the study. This study shows that the question of a just transition is not now at the forefront of the workers movement in Indonesia. Neoliberalization of Indonesian labour law, nollen vollens, encourages the workers movement to continue concentrating on economic concerns, particularly those involving the fundamental rights of workers. Under these circumstances, Indonesia runs the risk of failing to accomplish a just transition, which would put workers in a ‘dark world’ while the economy moves towards a green economy

    Worship in the Shadow of Capital: Neoliberalism and the Fate of Religious Freedom in Indonesia

    This article examines how neoliberal logic influences the articulation and implementation of the right to freedom of religion in Indonesia. Through a non-doctrinal approach and critical analysis of legal frameworks and institutional practices, it demonstrates that neoliberalism not only permeates the economic sphere but also redefines human rights, including religious freedom. Under the neoliberal regime, religious freedom is reduced to an individual preference subject to market logic and commodified within the frameworks of consumption and political stability. The state tends to adopt a passive or selective stance in protecting religious groups, privileging those aligned with dominant economic-political interests while restricting those perceived as disruptive to stability or oppositional to the status quo. Religious freedom is thus politicized, used as a tool for regime legitimacy, and controlled through administrative, symbolic, and economic mechanisms. This article highlights that genuine religious freedom cannot be realized without inclusive democracy, social justice, and the protection of pluralism. Therefore, structural efforts are necessary to liberate religious freedom from neoliberal constraints so that this right can be substantively and equitably exercised within Indonesia’s pluralistic society

    Covid-19 menyebabkan perubahan sosial terhadap hampir seluruh aspek kehidupan, termasuk dunia kerja. Perubahan yang terjadi di dunia kerja menuntut hukum perburuhan untuk turut melakukan perubahan. Perubahaan dilakukan guna menjamin perlindungan hukum bagi buruh sebagai akibat dari adanya perubahan dunia kerja sebagai imbas dari pandemi Covid-19, hukum perburuahan Indonesia dituntut untuk melakukan penyesuaian diri dengan perubahan yang terjadi di masa pandemi Covid-19. Perubahan tercermin melalui politik hukum perburuhan Indonesia di masa pandemi Covid-19. Dirumuskan permasalahan dalam penelitian ini terkait, bagaimanakah transformasi politik hukum perburuhan di masa Covid-19 dalam hal memberikan perlindungan bagi pemenuhan hak-hak buruh. Berdasarkan rumusan masalah tersebut, penelitian ini bertujuan untuk melakukan telaah terhadap politik hukum perburuhan Indonesia di masa Covid-19. Terhadap tujuan ini, penelitian dilakukan dengan menggunakan tipe penelitian normatif dengan menggunakan pendekatan peraturan perundang-undangan. Pendekatan ini digunakan untuk melakukan pembacaan terhadap politik hukum perburuhan di masa Covid-19. Pendekatan ini ditopang dengan bahan hukum primer berupa aturan hukum yang diselenggarakan di bidang perburuhan di masa Covid-19. Data yang diperoleh kemudian dianalisis secara kualitatif lalu dijabarkan secara deskriptif. Penelitian ini menunjukkan bahwa di masa Covid-19, politik hukum perburuhan memberlakukan hukum yang baru meliputi hukum di bidang hubungan kerja, pengupahan, kesehatan dan keselamatan kerja, jaminan sosial, dan perlindungan pekerja migran. Perubahan hukum perburuhan berupaya untuk melindungi buruh dari dampak yang ditimbulkan oleh Covid-19. Penguatan hubungan kerja di masa pandemi, subsidi upah yang dilakukan pemerintah, serta kelonggaran terhadap jaminan sosial merupakan wujud nyata. Namun, pembentukan hukum yang baru masih setengah hati, utamanya di bidang hukum pegupahan. Serta politik hukum perburuhan yang masih melanggengkan informalitas. Sehingga politik hukum perburuhan di masa Covid-19 tidak bersifat inklusif. Â

    PARADIGMA POLITIK HUKUM PENGUPAHAN INDONESIA: STUDI HAK ATAS UPAH LAYAK BAGI BURUH INFORMAL

    In developing countries, including Indonesia, majority of workers are informal with low wages. This situation occurs mainly because of the problems with their status as informal workers and how  Indonesian labor law regulates on that matter. On this basis, this research was conducted by investigating labor law policies in the field of wages that do not protect informal workers, i.e., wage policy. There are two issues that are the focus of the study in this research. The first is: what is the paradigm of Indonesian wage policy? Second, what paradigm must be incorporated into wage policy in order to provide informal workers with decent wages? The research was conducted using a non-doctrinal research type supported by statutory and conceptual approaches. The conceptual approach is particularly based on Roscoe Pound’s conceptualization of sociological jurisprudence. The research resulted in the finding that Indonesian wage policy is based on the contractualism paradigm, which is rooted in the idea of neoliberalism and causes informal workers to receive low wages. The study also reveals that there is a need to incorporate a human rights paradigm into Indonesian wage policy so that Indonesian wage policy is able to provide a decent life for informal workers

    This paper originates from an observation of the water crisis affecting Cikeusal. Recognizing water as an integral part of human rights, we pose the question: why does a water crisis occur in Cikeusal, despite water being recognized as a human right? In addressing this issue, we position water as a resource closely intertwined with political dynamics. Therefore, we employ a socio-legal approach, using autoethnography as the primary method for data collection. Our study reveals that the water crisis in Cikeusal stems from capitalist expansion in the form of extractive industries, specifically karst mining. This capitalist expansion has led to the maldistribution of water resources for Cikeusal residents, ultimately resulting in the water crisis they face today

    ABSTRAKArtikel ini merupakan telaah atas hukum perundang-undangan yang mendiskriminasi eks tahanan politik Partai Komunis Indonesia (PKI) selama rezim otoritarian Orde Baru berkuasa. Isu yang dikaji berkenaan dengan bentuk-bentuk umum diskriminasi yang dijustifikasi oleh hukum perundang-undangan Orde Baru, serta kepentingan politik rezim status-quo di balik pemberlakuan hukum diskriminatif tersebut. Telaah ini menggunakan metode penelitian normatif (doktrinal) dengan pendekatan penelitian konseptual, perundang-undangan, dan historis, yang di sebelah itu turut mengandalkan teori hukum relevan yang terkait dengan hukum dan politik, serta sejarah hukum Indonesia. Pada garis konklusif yang ditarik, ditegaskan ulang bahwa eks tahanan politik PKI telah menjadi korban atas pelbagai diskriminasi formal, baik di bidang sipil dan politik, maupun ekonomi, sosial dan budaya. Contoh bentuk umumnya ialah pembatasan hak untuk berpartisipasi dalam urusan pemerintah, sampai dengan pembatasan jenis pekerjaan yang dapat dikerjakannya. Hukum perundang-undangan diskriminatif tersebut diberlakukan sebagai salah satu modus rezim Orde Baru untuk mempertahankan legitimasi dan kekuasaannya.Kata kunci: diskriminasi; eks tahanan politik PKI; orde baru. ABSTRACTThis article is a review of the laws that discriminated against ex-political detainees of the Indonesian Communist Party (PKI) during the authoritarian New Order regime era. The issues studied relate to the general forms of discrimination justified by the New Order statutory laws, and the political interests of the status-quo regime behind the enactment of such discriminatory laws. This study uses a normative (doctrinal) research method with a conceptual, statutory, and historical approach, which also uses relevant legal theories related to law and politics, as well as the history of Indonesian laws. In the conclusive line drawn, it is reaffirmed that ex-PKI political detainees have been victims of various formal discriminations, both in the civil and political, as well as in the economic, social, and cultural fields. Such examples of its general form are the restriction of the right to take part in the conduct of public affairs, to the limitation of the type of work those ex-political detainees could occupy. Those discriminatory laws were enacted as one of the New Order regime’s modus operandi to maintain its legitimacy and power.Keywords: discrimination; ex-PKI political detainees; new order
