    This paper distributed by many religious conflictsthat has happened in Indonesia. So,to prevent and resolve the issue, the Government has established regulations and legislation about  religious believiers protection even since the beginning of the founding the nation. However, the reality show us that religous conflict is still not over. Thus, author aim to describe and analyze NU criticism to  religious believiers protection laws in Indonesia as well as how the solution offered especially on Bahtsul Masail Muktamar NU 33th at 2015. On NU persfective, there are some things abaut religious believiers protection laws: (1) regulations and legislation about  religious believiers protection are scattering on many legistlation or regulation on under the act, so it does not focus talking about religious believiers protection only. (2) many legislation and regulation is not enough to be a foundation of nation to execute every religious conflict. (3) LITBANG reseach has proven there are seven factor that cause religious conflict. (4) some of regulations under the legislation judged is not have a strong position, because it is not included in hierarchy of legislation. Therefore, all these problems, on NU perspective proves that more existence of operacional and aplicable legislation are absolutely needed

    Hadis is one of reference to solve problems that arise in contemporary societyissues. Likewise conducted by Nahdhatul Ulama (NU) on Bahtsul MasailMuktamar NU 33th 2015. Th interesting thing is how does NU positioninghadis as a proof (hujjah) to deciding religion contamporary issues in theBahtsul Masail. So, this paper aims to how determination Hadith as one ofproofin Bahtsul Masail on Muktamar NU 33th 2015 and what methodsis used by NU to determine that hadith as a proof. Ths reseach usingarchaeological approach to analyse the problems what carried by Foucalton power and knowledge relation theory.     Melacak Akar Pemikiran Nu Dalam Menetapkan Hadis Sebagai Hujjah Perpektif Michel Foucault

    NU always cite a Hadith of the Prophet to issue a statute of law. Reviewing the Hadith in NU traditions and understanding is exciting and unique. This uniqueness can also be seen on NU tradition of Hadith when they set it as proof when deciding religion contemporary issues. If the attempt is seen by Foucault’s theory, hadith what be NU choice as evidence is a form of power relations and knowledge. If the efforts seen with Foucault’s theory, the hadith which has been selected as a proof (hujjah) is a form of power and knowledge relation. This pa pe r e xa m i ne s how   t he   root s t hought of   NU i n t he   de t e rm i na t i on of the Hadith as proof by analysis genealogu approach and archeological method on Foucault theory carried “power and knowledge relations”. Base on this theory, to know a root thought of NU in determination of the hadits as proof (hujjah), the impor- tant thing to do is: (1) conducting a genealogical approach to trace the roots of the thought of NU, (2) using the method of assignment as the basis for the NU archeological on Hadith, (3) with the approach of the genealogy and the archeol- ogy method, then a discourse can be presented. With the advent of the discourse, it wi l l  be a nswe re d how t he  root s t hought of  NU i n t he  de t e rm i na t i on of the Hadith as proof.[NU senantiasa mencantumkan hadis nabi untuk mengeluarkan suatu ketetapan hukum. Mengkaji hadis dalam tradisi dan pemahaman NU merupakan hal yang menarik dan unik. Keunikan ini juga dapat dilihat pada usaha NU memposisikan hadis sebagai hujjah saat memutuskan persoalan-persoalan agama kontemporer. Jika usaha tersebut dilihat dengan teori Foucault, maka pilihan NU tentang hadis yang dipilih sebagai hujjah merupakan bentuk relasi kuasa (power) dan pengetahuan (knowledge). Tulisan ini mengkaji bagaimana akar pemikiran NU dalam penetapan hadis sebagai hujjah dengan analisis pendekatan genealogi dan metode arkeologi yang diusung Foucault dalam teorinya ‘relasi kuasa dan pengetahuan’. Berdasarkan teori tersebut, untuk mengetahui sebuah akar pemikiran NU dalam penetapan hadis sebagai hujjah, hal yang penting dilakukan adalah: (1) melakukan pendekatan genealogi untuk melacak akar pemikiran NU, (2) menggunakan metode arkeologis NU sebagai dasar penetapan hadis, (3) dengan adanya pendekatan genealogi dan metode arkelogi, maka sebuah wacana dapat dimunculkan. Dengan munculnya wacana tersebut, maka akan terjawab bagaimana akar pemikiran NU dalam penetapan hadis sebagai hujjah tersebut.

    Pendidikan Islam sangatlah penting, karena merupakan hal dasar untuk diberikan kepada semua peserta didik tanpa terkecuali sebagai bekal untuk memahami dan menjalani kehidupan. Pentingnya mempelajari ilmu agama ini bermakna luas, tidak memandang kondisi seseorang baik dia normal ataukah memiliki keterbatasan, baik fisik, mental maupun kelainan dalam berperilaku, dalam hal ini disebut dengan anak berkebutuhan khusus (ABK). Jadi anak-anak dengan kebutuhan khusus seperti tunanetra, tunarungu, tunagrahita, tunadaksa, dan anak-anak berkesulitan belajar juga memiliki kesempatan yang sama untuk mendapatkan pendidikan. Penelitian ini adalah penelitian kepustakaan (library reserch) atau studi dokumentasi. Penelitian kepustakaan dilakukan untuk mendapatkan konsepsi kebijakan teori atau doktrin, dan pemikiran konseptual. Riset pustaka yang membatasi kegiatan hanya kepada bahan-bahan koleksi perpustakaan saja, sedangkan data-data wawancara dipergunakan untuk mengkonfirmasi dan memperjelas (klarifikasi) data-data yang diperoleh dari pustaka tersebut. Hasilnya adalah pelaksanaan Pendidikan Islam terhadap anak berkebutuhan khusus tidak dapat hanya dilihat sebelah mata saja, tetapi harus adanya keseriusan berbagai pihak yang menangani pendidikan. Metode yang dapat dilakukan pada anak berkebutuhan khusus yaitu metode pembiasaan, nasihat, dan keteladanan dengan pendekatan perilaku (behaviorial approach), dimana para pendidik berperan dalam melakukan perbaikan perilaku anak-anak tersebut, lebih dominan kepada menanamkan aspek akhlak atau perilaku yang sesuai dengan Pendidikan Islam

    Going Beyond Counting First Authors in Author Co-citation Analysis

    The present study examines one of the fundamental aspects of author co-citation analysis (ACA) - the way co-citation counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed. Reasons for these effects are discussed

    Tulisan ini bertujuan untuk menjawab dilema masyarakat atas kepastian hukum terkait pasal 55 ayat (2) Undang-Undang Nomor 21 Tahun 2008 tentang Perbankan syariah setelah adanya Undang-Undang nomor 3 Tahun 2006, Undang-Undang Nomor 48 Tahun 2009, dan Putusan MK Nomor 93/PUU-X/2012. Pokok permasalahannya adalah, pertama untuk menjelaskan keberadaan pasal 49 huruf  i Undang-Undang Nomor 3 Tahun 2006 berkaitan dengan Undang-Undang Nomor 30 Tahun 1999 dengan alasan kepastian hukum. Kedua, untuk menjelaskan kedudukan Undang-Undang Nomor 30 Tahun 1999 terhadap sengketa ekonomi syariah. Ketiga, untuk menjelaskan bagaimana peraturan yang lebih baru, yaitu Undang-Undang Nomor 48 Tahun 2009 Pasal 58 dan Putusan MK No. 93/PUU-X/2012 yang mengakomodasi pokok permasalahan dalam tulisan ini. Penelitian ini merupakan penelitian normatif, yaitu penelitian terhadap data sekunder yang diperoleh melalui studi pustaka. Hasilnya adalah berdasarkan  pada  pasal  58-61  Undang-Undang  Nomor  48  Tahun 2009 tentang Kekuasaan Kehakiman, maka  secara  tidak  langsung  Undang-Undang Nomor 30 Tahun 1999 tentang  Arbitrase dan Alternatif Penyelesaian Sengketa berlaku bagi penyelesaian sengketa ekonomi syariah. Oleh karena itu, dalam menyelesaikan perkara ekonomi syariah masyarakat diarahkan pada jalur non-litigasi.     LOCAL WISDOM IN PRACTICE TRADITIONAL WEDDING IN INDONESIA

    The writing of this journal aims to present a form of local wisdom in the practice of traditional marriage that occurs in Indonesia. In almost all indigenous communities the problem of marriage is family and community affairs, although it appears to be an individual affair, but concerns the interests of many people, so marriage is often a topic that never goes away. Writing this scientific work uses a method with a qualitative approach that investigates a social phenomenon and human problems. The result of this research is that there are various forms of wedding traditions customary in Indonesia, such as: a) tradition elopement which were the work of Indonesian culture eastern highly based on local wisdom, b) tradition obligation for male candidates meet pisuka to potential women who want to marry as a form of local wisdom, c) the tradition of donations in celebration when time walimah (wedding entertainment) occurs. This is what must always be maintained as a form of Indonesian nation's local wisdom towards its culture. Do not let Indonesian local culture continue to erode so that it is replaced by an external culture that is very unsuitable and inappropriate for the people of Indonesia

    ANALISIS PASAL 39 AYAT 3 KHI TENTANG LARANGAN KAWIN KARENA SESUSUAN: PERSPEKTIF FILSAFAT HUKUM ISLAM

    The Compilation of Islamic Law (KHI) cannot be separated from the rules of law written in the Qur'an and Hadith. Article 39 paragraph 3 of The Compilation of Islamic Law (KHI) states that there is a prohibition on marriage due to the same breastfeeding mother. Philosophically, Allah's purpose in prescribing the law is to preserve the benefits of human beings, as well as to avoid ‘mafsadat’, both in the world and in the hereafter. In article 39 paragraph 3 KHI, the determination of the law is in order to realize the benefits of human beings. There are five main elements that are protected against the law of prohibition on marriage due to the same breastfeeding mother as mentioned in article 39 paragraph 3 KHI. The five main elements are religion (ḥifẓ ad-dīn), soul (ḥifẓ an-nafs), reason (ḥifẓ al-‘aql), descendants (ḥifẓ an-nasl), and property (ḥifẓ al-māl). [Kompilasi Hukum Islam (KHI) tidak lepas dari kaidah-kaidah hukum yang tertulis dalam al-Qur’an dan Hadis. Pasal 39 ayat 3 Kompilasi Hukum Islam (KHI) menyatakan adanya larangan melangsungkan perkawinan karena sesusuan. Secara filosofis, tujuan Allah mensyariatkan hukumnya adalah untuk memelihara kemaslahatan manusia, sekaligus untuk menghindari mafsadat, baik di dunia maupun di akhirat. Dalam pasal 39 ayat 3 KHI, penetapan hukum tersebut dalam rangka mewujudkan kemaslahatan manusia. Ada lima unsur pokok yang dilindungi terhadap penetapan hukum keharaman menikah karena sesusuan yang tercantum dalam pasal 39 ayat 3 KHI. Kelima unsur pokok tersebut adalah agama (ḥifẓ ad-dīn), jiwa (ḥifẓ an-nafs), akal (ḥifẓ al-‘aql), keturunan (ḥifẓ an-nasl), dan harta (ḥifẓ al-māl).

    Tradition Balimau Kasai in Kampar:Integration of Islamic and Local Culture

    This study aims to explain that there is an integration between Islamic values and the local culture of Kampar in the balimau kasai tradition. The balimau kasai tradition is a tradition of welcoming the holy month of Ramadan by bathing with traditional herbs and gathering on the banks of the river. In this study it was found that, there are 4 (four) categories that can be integrated between Islamic values and the local culture of Kampar, namely: (1) as a form of gratitude to be met with the month of Ramadan, (2) as a form of joy and happiness with the coming of the month of Ramadan, (3) as a means of cleansing and purifying the body and spirit, (4) as a place to establish friendship, and (5) as a moment to forgive each other. Of the four categories found, it is evident that balimau kasai is a local cultural tradition, as well as a form of planting Islamic values
