    Berdasarkan ketentuan Pasal 24C ayat (3) UUD 1945 perubahan ketiga telah memberikan kewenangan bagi DPR untuk mengajukan (tiga) dari 9 (sembilan) hakim konstitusi. Dalam melaksanakan proses seleksi hakim konstitusi DPR tentunya harus sesuai dengan prasyarat yang telah ditentukan oleh undang-undang Mahkamah Konstitusi, seperti ketentuan Pasal 15 ayat (1) Undang-Undang Nomor 8 Tahun 2011 tentang perubahan Undang-Undang Nomor 24 Tahun 2003 tentang Mahkamah Konstitusi (MK) yang menyatakan hakim konstitusi harus memiliki integritas, kepribadian tidak tercela, adil, serta negarawan yang menguasai konstitusi dan ketatanegaraan, ketentuan Pasal 19 Undang-Undang Nomor 24 tahun 2003 tentang MK yang mensyaratkan pelaksanaan pencalonan hakim konstitusi harus dilakasanakan secara transparan dan partisipatif, Pasal 20 ayat (2)nya menyatakan pemilihan hakim konstitusi wajib diselenggarakan secara objektif dan akuntabel Kemudian berdasarkan Pasal 20 ayat (1) UU MK, menyerahkan tata cara seleksi, pemilihan dan pengajuan hakim konstitusi kepada Presiden, DPR, dan MA. Meskipun UU MK telah mengatur persyaratan tersebut, namun UU MK tidak mengatur secara rinci kriteria dan standar dalam proses seleksi tersebut. Hal tersebut mengakibatkan tidak adanya aturan yang jelas untuk dipedomani, sehingga setiap lembaga penyeleksi mekanisme seleksi secara berbeda-beda. Rumusan masalah penelitian ini adalah bagaimana pengaturan kewenangan DPR RI dalam proses seleksi hakim konstitusi, bagaimana pelaksanaan proses seleksi hakim konstitusi oleh DPR RI dan bagaimana gagasan ideal dalam pelaksanaan proses seleksi hakim konstitusi oleh DPR RI. Adapun jenis penelitian yang digunakan yaitu penelitian hukum normatif yang bersifat normatif kualitatif Dari uraian pembahasan dapat disimpulkan DPR RI memiliki wewenang dalam pengajuan 3 (tiga) dari 9 (sembilan) hakim konstitusi, tapi UU MK tidak mengatur secara jelas dan rinci terkait mekanisme seleksinya. Dalam pelaksanaan proses seleksinya sudah cukup transparan dan partisipatif, namun adanya ketidak konsistenan dalam melaksanakan mekanisme fit and proper test. dan sebaiknya DPR memberikan jangka waktu yang cukup bagi masyarakat untuk memberikan masukan. Agar proses seleksi lebih independen dan objektif sebaiknya fit and proper test dilakukan oleh tim independen

    The visible fast increase in the growth rate of world population occurred during the second half of the twentieth century due to the faster declines in mortality following the medical and public health advances made around the time of World War II. The global population growth rate after peaking of at around 1.7 to 1.9 percent per annum in the 1970s and 1980s has since started declining and is currently around 1.4 percent per annum. The world population more than doubled, recording 142 percent increase, from 2.51 billion in 1950 to around 6.07 billion in 2000 [Hakim (2000)]. Most of the increase has been in less developed countries, from 1.68 billion in 1950 to 4.88 billion in 2000, recording 190 percent. Compared to this, the more developed countries witnessed only a marginal increase of 43 percent from 0.83 billion in 1950 to 1.19 billion population in 2000.

    Novel Himar Hakim by Taufiq Hakim tells about the friendship that exists between a writer named Beik with a pet donkey, which sometimes Beik equates his habit with the donkey. The novel is very philosophical and full of psychic experiences from the main characters described. The main character of the novel is the Taufiq Hakim, in terms of the background in Egypt, and the professor, a writer who in the novel is portrayed by a film dialog writer. The form of the conversation in the novel Himar Hakim by Taufik Hakim is inseparable from the act of speech or the intent to be conveyed by the author to the reader. In Himar Hakim's novel, there are speeches of Beik figures with various forms and objectives of the act of speech and the type of preoccupation. The problems discussed in this research are: how the act of indirect illustration of Beik in the novel of Judge Himar Hakim by Taufik Hakim, and how the presupposition of Beik speech acts in the novel Himar Hakim by Taufik Hakim. The purpose of this research is to know the act of indirect illusions of Beik in the novel of Himar Hakim by Taufik Hakim, and to know the type of presupposition of Beik's speech acts in the novel Himar Hakim by Taufik Hakim. To achieve these objectives, this research uses descriptive analytic method. Then in the data collection techniques using the method refer, then the data were analyzed by using the method of extralingual padan and grouping Beik's speech by using pragmatic approach of speech acting theory and pre-response. Based on the analysis of the novel Himar Hakim by Taufik Hakim, it can be concluded that in the novel there are speeches that contain representative, directive, expressive, commodative and declarative illustrations, with various purposes, including: affirming, stating, asking , ordering, suggesting, commanding, blaming, denouncing, apologizing, insinuating, complaining, refusing, declaring ability, swearing, offering, promising, expecting, praying, and decisive. Expressive speech acts with the purpose of mocking into the findings that dominate Beik's speech. The types of presuppositions contained in the speech are such as existential prejudice, factual presupposition, lexical presuppositions, non-factual presuppositions, structural presuppositions and counterfactual presuppositions. Factual acceptability became the findings that dominated Beik's speech

    ABSTRAKHakim merupakan salah satu penegak hukum yang menurut Undang-Undang bertugas mengadili perkara di Pengadilan. Dalam Menjalankan Profesinya harus sesuai dengan aturan yang disebut juga dengan Kode Etik Hakim. Adanya ketentuan Kode Etik dan Pedoman Perilaku Hakim diatur dalam Surat Keputusan Bersama (SKB) Nomor 047/KMA/SKB/IV/2009 dan Nomor 02/SKB/P.KY/IV/2009 tentang Kode Etik dan Pedoman Perilaku Hakim yang menerangkan mengenai Kode etik yang harus di patuhi oleh hakim dan harus ada keefektifan dalam menajalankan profesinya. Walaupun terdapat kode etik, tidak menutut kemungkinan bahwa ada hakim yang nantinya lalai  yang kemudian melanggar kode etik profesi hakim itu sendiri. Dalam penerapan sanksinya pun harus sepadan dan sesuai dengan pelanggaran yang dilakukan. Artikel ilmiah ini menggunakan  metode penelitian  ini, penulis menggunakan pendekatan hukum normatif atau penelitian kepustakaan. Sedangkan metode pengumpulan data dalam penulisan artikel ilmiah ini dengan melakukan wawancara terhadap pihak yang terkait.Kode etik tersebut menjadi suatu keefektifan tersendiri bagi hakim khususnya di Pengadilan Agama Bangkalan dalam menjalankan profesinya, dilihat dari hakim yang memang melaksanakan tugas dan wewenang sesuai dengan Kode Etik Profesi Hakim. Namun. apabila melanggar terdapat sanksi yang diberikan walaupun hakim juga termasuk salah satu penegak umum dilingkup Mahkamah Agung, sanksi yang diberikan berbeda-beda yakni sanksi ringan, sanksi sedang dan sanksi berat. Hal ini disesuaikan dengan ringan beratnya pelanggaran yang dilakukan oleh hakim. Tidak ada sanksi pelaporan pelanggaran yang diajukan masyarakat Bangkalan ke Pengadilan Agama Bangkalan, hal ini membuktikan hakim dilingkup Pengadilan Agama Bangkalan mematuhi kode etik yang berlaku. Sehingga dapat disimpulkan bahwa Pengadilan Agama Bangkalan keefektifan dalam mengimplementasikan adanya Kode Etik Profesi sesuai dengan Pedoman memang benar-benar dipatuhi serta tidak ada sanksi pula yang dilanggar oleh Hakim yang ada di Pengadilan Agama Bangkalan.Kata Kunci : Hakim, Kode Etik, Efektivitas, Sanksi.  ABSTRACTThe judge is one of the law enforcers who according to the Law is tasked with hearing cases in the Court. In carrying out his profession must be in accordance with the rules, also called the Judges' Code of Ethics. The provisions of the Code of Ethics and the Code of Conduct for Judges are regulated in the Joint Decree (SKB) Number 047 / KMA / SKB / IV / 2009 and Number 02 / SKB / P.KY / IV / 2009 concerning the Code of Ethics and the Code of Conduct for Judges which explains the Code ethics that must be obeyed by the judge and there must be effectiveness in managing his profession. Even though there is a code of ethics, it does not undermine the possibility that there will be judges who will be negligent who then violate the professional code of justice itself. In applying the sanctions must be commensurate and in accordance with the violations committed. This scientific article uses this research method, the author uses a normative legal approach or library research. While the method of collecting data in writing scientific articles is by conducting interviews with related parties.The code of ethics has become a special effectiveness for judges, especially in the Bangkalan Religious Court in carrying out their profession, seen from judges who indeed carry out their duties and authority in accordance with the Professional Code of Ethics for Judges. However. if there is a sanction violated, even though the judge is also included as one of the general enforcers in the scope of the Supreme Court, the sanctions are different, namely mild sanctions, medium sanctions and severe sanctions. This is adjusted to the severity of the violations committed by the judge. There are no sanctions for reporting violations submitted by Bangkalan people to the Bangkalan Religious Court, this proves that judges in Bangkalan Religious Courts comply with the applicable code of ethics. So it can be concluded that the Bangkalan Religious Court's effectiveness in implementing the existence of the Professional Ethics Code in accordance with the Guidelines was really obeyed and there were no sanctions that were violated by Judges in the Bangkalan Religious Court.Keywords: Judge, Code of Ethics, Effectiveness, Sanctions
