No full textIn questo saggio Manuel Atienza intende proporre un modello generale per analizzare e valutare criticamente le argomentazioni giudiziali. Prendendo le mosse dalla cornice teorica elaborata in uno dei suoi lavori più celebri, Diritto come argomentazione, Atienza distingue il momento dell’analisi – volto a identificare, per “capire” e “comprendere”, gli argomenti utilizzati in un ragionamento giudiziale – e quello della valutazione – destinato, invece, a vagliare criticamente tali argomenti. Per rendere più fruibile lo strumento dell’analisi, l’autore ne propone l’applicazione schematica ad un caso fittizio. In merito alla valutazione, invece, egli chiarisce i concetti di oggettivismo morale, universalità, coerenza, consequenzialismo, morale sociale, morale giustificata e ragionevolezza, proponendoli come criteri basilari per valutare le argomentazioni giudiziali. Nella parte finale del saggio, Giovanni Blando propone un’analisi e valutazione critica della sentenza Sez. un. civ., 09/09/2021, n. 24414, sulla scorta del modello elaborato da Manuel Atienza. Dopo aver distinto gli argomenti utilizzati dalla Corte, l’Autore sviluppa alcune riflessioni critiche sulle scelte dei giudici in materia di esposizione del crocifisso nelle aule scolastiche.In this essay, Manuel Atienza intends to propose a general model to analyze and critically evaluate judicial reasoning. Moving from the theoretical framework elaborated in one of his most famous works, Diritto come argomentazione, Atienza distinguishes the moment of the analysis – aimed to identify, and then to “understand” and “comprehend” the arguments used in a legal reasoning – and that of evaluation – meant to critically evaluate those arguments. To make the instrument of analysis more accessible, the Author proposes to apply it to a fictional case. Instead, regarding evaluation, he clarifies the concepts of moral objectivism, universalism, coherence, consequentialism, social morality, justified morality and reasonableness, upholding them as basic criteria for evaluating judicial arguments. In the final part of the essay, Giovanni Blando proposes an analysis and a critical evaluation of the judgment Sez. Un. civ., 09/09/2021, n. 24414, based on the model developed by Manuel Atienza. Desarrollo y miniaturización de un sensor electroquímico para la determinación de hidrocortisona

Doctorado en Ciencias e Ingeniería de Materiales.La hidrocortisona, HC, es la hormona responsable de la modulación de los sistemas nervioso, inmune y metabólico, su producción depende del adecuado funcionamiento de diversas glándulas y su exceso o deficiencia promueve diversos padecimientos como hipertensión, obesidad, osteoporosis, depresión, entre muchos otros, por lo que es necesario crear métodos que permitan efectuar su determinación de manera rápida y confiable en tratamientos o diagnósticos. Es por ello, que en este trabajo se plantea efectuar su cuantificación mediante espectrofotometría UV-Vis y electroquímica, empleando para ésta última una celda electroquímica miniaturizada, diseñada, construida y funcional para tal fin. El primer capítulo de esta tesis detalla la problemática de la hidrocortisona, repercusiones de su exceso o deficiencia en la salud, así como formas actuales para efectuar un análisis cualitativo, mientras que, los antecedentes de la cuantificación de la HC que abarcan diversas metodologías, el trabajo de respaldo con el que cuenta el grupo de trabajo, así como los objetivos para hacer este proyecto de investigación se presentan en el Capítulo 2. El tercer título está enfocado en el estudio espectrofotométrico de la HC, su estabilidad química, constantes de acidez y su mecanismo de desprotonación, mientras que, siguiendo esta línea, el cuarto presenta un estudio espectrofotométrico orientado hacia la evaluación de la interacción de la HC con la β-ciclodextrina y el Dodecil Sulfato de Sodio, así como la estimación teórica de la factibilidad de la formación del complejo con el oligosacárido. El Capítulo 5, se adentra en la caracterización electroquímica de la señal de reducción de la HC en Electrodos de Pasta de Carbono, EPC, la determinación de sus parámetros electroquímicos y el mecanismo que gobierna este proceso; seguido en el sexto por la evaluación de modificaciones superficiales del EPC con óxido de grafeno, y poli-β-ciclodextrina. El Capítulo 7, introduce métodos espectrofotométricos y electroquímicos para la determinación del corticoide, resaltando los parámetros analíticos alcanzados. El octavo capítulo, se interna en el diseño, modelado y fabricación de la celda electroquímica miniaturizada, así como su desempeño, mientras que, finalmente, el noveno título se centra en la cuantificación de HC en muestras farmacéuticas.Hydrocortisone (HC) is a hormone responsible for modulating the nervous, immune, and metabolic systems. Its production depends on the proper functioning of various glands, and its excess or deficiency promotes various ailments such as hypertension, obesity, osteoporosis, depression, among many others. Therefore, it is necessary to create methods that allow for its rapid and reliable determination in treatments or diagnoses. For this reason, this work proposes its quantification using UV-Vis spectrophotometry and electrochemistry, employing for the latter a miniaturized electrochemical cell, designed, constructed, and functional for this purpose. The first chapter of this thesis details the problems associated with hydrocortisone, the repercussions of its excess or deficiency on health, as well as current methods for qualitative analysis, while the background of HC quantification, which encompasses various methodologies, the supporting work of the research group, and the objectives of this research project are presented in Chapter 2. The third chapter focuses on the spectrophotometric study of HC, its chemical stability, acidity constants, and its deprotonation mechanism, while, following this line, the fourth presents a spectrophotometric study oriented towards the evaluation of the interaction of HC with β-cyclodextrin and Sodium Dodecyl Sulfate, as well as the theoretical estimation of the feasibility of complex formation with the oligosaccharide. Chapter 5 delves into the electrochemical characterization of the HC reduction signal on Carbon Paste Electrodes (CPE), the determination of its electrochemical parameters, and the mechanism that governs this process; followed in the sixth by the evaluation of surface modifications of the CPE with graphene oxide and poly-β-cyclodextrin. Chapter 7 introduces spectrophotometric and electrochemical methods for the determination of the corticosteroid, highlighting the analytical parameters achieved. The eighth chapter delves into the design, modeling, and fabrication of the miniaturized electrochemical cell, as well as its performance, while, finally, the ninth chapter focuses on the quantification of HC in pharmaceutical samples.Esta investigación recibió el apoyo del Sistema Nacional de Posgrados (SNP) del Consejo Nacional de Humanidades, Ciencias y Tecnologías (México). Em um primeiro momento contextualiza-se o surgimento do futurismo com o intuito de proceder uma leitura de caráter geral do Marinetti pré-futurista e futurista, passando pela gestação do movimento na revista Poesia. Em um segundo momento busca-se, com o apoio da teoria dos gêneros literários, definir quais são os procedimentos dominantes que caracterizam um manifesto do futurismo italiano. Por fim, são apresentados e analisados alguns dos manifestos do futurismo italiano, tais como o Fondazione e manifesto del futurismo e o Manifesto tecnico della letteratura futurista em base, principalmente, às reflexões de Giovanni Lista e de Claudia Salaris, bem como são abordados seus desdobramentos.This thesis has as its objective to analyze "l'artedifarmanifesti" by F.T. Marinetti. Firstly, the outbreak of futurism is contextualized with the aim to conduct a reading of general characteristics of the pre-futuristic and futuristic Marinetti, passing through the gestation of the movement in the magazine Poesia. Secondly, with the support of the theory of literary genres, there is a tentative move to define the prevailing procedures which characterize a manifesto of Italian futurism. At last, some manifestos of the Italian futurism are presented and analyzed, such as the Fondazione e manifesto del futurismo and the Manifesto tecnicodellaletteratura futurista in basis, mainly with regard to the reflections of Giovanni Lista and of Claudia Salaris, added to the approach of the unfolding of the manifestos

Get PDFIn this paper we will study the Archive of the great 17th century writer, D. Francisco Manuel de Melo (Lisbon 1608 - 1666) according to the principles of Historical Archivistic.
The idea of starting this study came from the intersection of our admiration for the work and Francisco Manuel de Melo with the reading of a remarkable essay by Eric Ketelaar on Rembrandt's Archives - Prologue: Rembrandt's Archives, included in his Archiving people. A social history of Dutch Archives, La Haye, Stichting Archiefpublicaties, 2020, p. 9- 14.
Unlike the case of the famous Dutch painter, of whom no documents remain, from the Francisco Manuel's Archive there is/was a small nucleus of documentation preserved over generations by the descendants of a collateral branch, which was transcribed, published and studied by Edgar Prestage between 1909 and 1914 and which is now in unknown whereabouts.
Our goal is to make a first approximation to what may have been the writer's archive at the time of his death in 1666, the reasons why and the manner in which the documentation was produced, its custodial history, the uses made of the documentation by the his heirs, and the historical, literary, sociological, and knowledgeable importance of the Ancient Regime society in the Hispanic world and in Portugal during the Restoration.
The paper is structured in six chapters:
1 - METHODOLOGY - Our method will consist in the analysis of the published bibliography of Francisco Manuel de Melo from an archival point of view, i.e. studying the author as a producing entity of an Archive according to the guidelines of the Archival Method, as explained by Elio Lodolini, Luciana Duranti and Giovanni Michetti. The main work on Francisco Manuel is the biography - D. Francisco Manuel de Mello: Esboço biographico, Coimbra University Press, 1914, by Edgar Prestage, who was a noted historian, but with the characteristics of his time, i.e. using archives as a reservoir of historical information, as sources. This paper will be the beginning of an approach to this work taking the archive as the object of study, making the social history of the archive, putting into practice the principles of Historical Archivistics as they are defined by Maria de Lurdes Rosa, among many others, in her 2017 articles, 2018 with the collaboration of Rita Nóvoa, and in the doctoral theses she has supervised within the VINCULUM Project, which includes the Invent.Arq Project - Inventories of Family archives, XV-XIX centuries.
2 - BIOGRAPHICAL SUMMARY - We have established a summary of the biography of D. Francisco Manuel, based on Prestage's fundamental work, complemented with some of the contributions, which have uncovered new information and confirmed or updated known information. This summary introduces the reader to the personality who produced the documentation studied, with factual and chronological accuracy.
3 - D. FRANCISCO MANUEL, DOCUMENTATION PRODUCING ENTITY - Analysis of the main characteristics of the man integrated in his time and social environment, with recourse to a fundamental work on Francisco Manuel, authored by Camões Gouveia, which identifies very accurately, using techniques proper to history, several aspects of his personality that shaped the production and conservation of the documentation, namely the fact that he was a nobleman among noblemen.
4 - THE PHYSICAL AND HUMAN CONTEXT - The fourth chapter is dedicated to a survey of the places where he was born, where he lived, where he was imprisoned and exiled, as well as a possible inventory of the servants who served him during his life and influenced his documentary production.
5 - DESCRIPTION OF THE DOCUMENTATION - The fifth chapter presents a description, and characterization of the writer's documentary production, using tables in the text and in the appendix. In addition to the aforementioned work by Prestage, we will take into account documents located and described by Teófilo Braga, and Joan Estruch Tobella.
6 - CUSTODIAL HISTORY - In this chapter, based on many of the facts established in the previous chapters, we present the research on the history of the Archive of D. Francisco Manuel, using methods proper of History, to extend and develop the so-called Custodial History, which is already carried out by archivists and is foreseen in ISAD (G). We have also used genealogy to establish and identify the successive generations who owned parts of Francisco Manuel's archive, and we summarize the results of our investigations in three family trees.
In it we follow the fate of the documentation from the date of the sudden death of D. Francisco Manuel's in August 1666, up to the present day. It was only possible to follow its path and the purposes for which it was successively used, by its various holders, until the beginning of the 20th century. From that date on, all hypotheses are possible, including the most terrible ones, which was the fate of many other archives in Portugal.
CONCLUSIONS - In this brief but fascinating investigation, we have applied the principles of Historical Archivistics, to study the documentation produced by D. Francisco Manuel de Melo, in the context of his status as a nobleman and in the era of the Ancien Régime. Based on this work, we can present several lines of investigation to achieve a greater knowledge of the Archive of D. Francisco Manuel.
This research shows the great importance of the study of family archives for the understanding of each of the individuals that make them up, giving much greater depth to their actions and making it possible to understand the limitations and qualities of each person inserted in his class and in his time.
The deeper knowledge of what would have been the archives of D. Francisco Manuel de Melo will allow us to increase our knowledge of his literary work and the context in which it was written.
A final negative conclusion, of a general nature, about the Portuguese culture of the last 250 years imposes itself at the conclusion of this work. It is the continued disinterest, laxity and lack of awareness of cultural values, as structuring elements of a free and developed society that characterizes Portugal. From one of the greatest Portuguese writers, who had an adventurous and fascinating life, nothing remains! Everything has disappeared: the houses where he lived, whose exact location is unknown, the graves of his sister, his mother, his grave, his Archive, the originals of most of his literary works! All lost! All destroyed! Quare?Neste trabalho vamos estudar o Arquivo do grande escritor do século XVII, D. Francisco Manuel de Melo segundo os princípios da Arquivística Histórica como são definidos por Maria de Lurdes Rosa.
A ideia deste tema veio do cruzamento da nossa admiração por D. Francisco Manuel de Melo, com a leitura de um notável ensaio de Eric Ketelaar sobre o arquivo de Rembrant.
Do Arquivo de D. Francisco Manuel existe (ou existiu) um pequeno núcleo de documentação conservada ao longo de gerações pelos descendentes de um ramo colateral e que foi transcrita, publicada e estudada por Edgar Prestage entre 1909 e 1914.
O nosso objectivo será, com base nesse núcleo de documentação, fazer uma primeira aproximação ao que terá sido o Arquivo do escritor à data do seu falecimento em 1666, os motivos e a maneira porque foi produzida a documentação, a sua história custodial, os usos da documentação feitos pelo produtor, pelos seus herdeiros e a importância histórica literária, sociológica e para o conhecimento de múltiplos aspectos da sociedade do Antigo Regime no mundo hispânico e no Portugal da Restauração

of Brazil

its literature is
constructed
in the Anglo-American world. To this
end, a survey of
Brazilian literary
works
in English translation was
carried out.
Having
gathered this data, it became
possible to establish
correlations
between the historical
moments when such translations
were made, when their number
increased,
and the events occurring at
those times in the international
panorama, as well as to look into the
role of sponsors, publishers and translators in the
selection and
production of such translations.
The data
also allowed a profile of
Brazilian literary
works
in
English translation to be drawn. It became
possible to suggest that
such works
fall into four
main categories:
`authorial
works',
'topical
works',
`ambassadorial
works'
and `consumer-oriented
works'.
In
order
to look
more closely
into how the translation process
has helped to
shape
the
virtual
image
of Brazilian literary
works
in
the Anglo-American world, an analysis of a sample of
translations
of
such works was made. Included in this
sample were
the translations
of works
by Machado de Asis, by Indianist
and
Regionalist
wirters,
culminating
in
an examination of translations of
GuimarAes Rosa's
works.
Having looked
at these aspects of
the translation
process, what
remained
to be done
was to investigate
to what extent
Brazilian
literary
works
in English translation
are read
by the English-
speaking public.
To this
end, a survey of availability and
library
readership was undertaken. Finally,
a reading experiment was carried
out
in
which native speakers of
English
were asked to read the short
story
'A terceira
margem
do
rio',
by GuimarAes Rosa.
The
conclusion attempts to pull all these threads together and
to indicate directions for further
research

Tal conjunto de histórias desempenhou um papel relevante na formação de Borges como leitor, no desenvolvimento de seu pensamento sobre tradução e na incorporação do oriente islâmico à sua expressão literária madura. Por outro lado, foi também através da tradução e criação de alguns episódios mileumanoitescos que o autor ensaiou pela primeira vez o tratamento de temas e imagens que o consagraram mundialmente, como o labirinto, o Aleph e o duplo. Assim, a longa relação do escritor com as Noites é analisada aqui enquanto leitura e recepção de suas muitas versões, fundamento na articulação de suas ideias tradutórias e, por fim, inspiração e espaço para inovações em sua poética narrativa
