PERLINDUNGAN HUKUM BAGI PARA PIHAK DALAM PERJANJIAN JUAL BELI MELALUI MEDIA INTERNET
ABSTRAK
Pemanfaatan media e-commerce dalam dunia perdagangan sangat
membawa dampak pada masyarakat internasional pada umumnya dan
masyarakat Indonesia pada khususnya. Bagi masyarakat Indonesia hal ini terkait
masalah hukum yang sangat penting. Pentingnya permasalahan hukum di
bidang e-commerce adalah terutama dalam memberikan perlindungan terhadap
para pihak yang melakukan transaksi melalui internet.
Permasalahan dalam penulisan ini adalah tentang bagaimana proses
pelaksanaan, hambatan-hambatan serta cara mengatasi hambatan-hambatan
dalam jual beli melalui media internet dan bagaimana perlindungan hukum bagi
para pihak dalam perjanjian jual beli melalui media internet. Tujuan dari
penelitian ini adalah untuk mengetahui proses pelaksanaan, hambatanhambatan
serta cara mengatasi hambatan-hambatan dalam jual beli melalui
media internet dan untuk mengetahui perlindungan hukum bagi para pihak dalam
perjanjian jual beli melalui media internet.
Penelitian dilakukan dengan menggunakan metode pendekatan yuridis
empiris dan spesifikasinya dilakukan secara deskriptif analisis. Sumber dan jenis
data yang digunakan adalah data primer dan data sekunder. Teknik
pengumpulan data menggunakan studi kepustakaan dan studi lapangan, dan
data yang didapat akan dianalisis secara kualitatif.
Hasil penelitian yang telah dilakukan bahwa pelaksanaan jual beli melalui
media internet terdiri dari empat proses, yaitu penawaran, penerimaan,
pembayaran, dan pengiriman, hambatan-hambatan dalam transaksi di internet,
khususnya mengenai cacat produk, informasi dan webvertising yang tidak jujur
atau keterlambatan pengiriman barang, dan umumnya mengenai pola pikir,
minat, dan kultur atau budaya masyarakat Indonesia. Perlindungan hukum bagi
para pihak dalam perjanjian jual beli melalui media internet meliputi perlindungan
hukum dalam perjanjian dan perlindungan hukum di luar perjanjian. UUITE
menambahkan suatu bentuk system pembuktian elektronik yaitu adanya tanda
tangan elektronik (digital signature) yang merupakan suatu sistem pengamanan
yang bertujuan untuk memastikan otentisitas dari suatu dokumen elektronik.

ABSTRACT
Utilization of the e-commerce in the world trade has impact on the
international community in general and Indonesia in particular communities. For
Indonesia this community related issues is very important law. Importance of
legal issues in the field of e-commerce is primarily in providing protection for the
parties to a transaction over the Internet.
The problems in this paper are about how the process of implementation,
barriers and ways to overcome the obstacles in the sale and purchase via
internet and how legal protection for the parties to the sale and purchase
agreement via internet. The purpose of this research is to determine the
implementation process, the obstacles and how to overcome the obstacles in the
sale and purchase via internet and to determine the legal protection for the
parties to the sale and purchase agreement via internet.
Research carried out by using the method of approach juridical empirical
and specifications done in descriptive analysis. Sources and types of data used
are primary data and secondary data. Data collection techniques using library
research and field studies, and data obtained will be analyzed qualitatively.
The research has been done that the implementation of a media buying
and selling via the Internet consists of four processes, namely supply, receipt,
payment, and delivery, the constraints in transactions on the Internet, especially
regarding product defects, information and webvertising dishonest or delay in
delivery of goods , and generally about the mindset, interests, and culture or the
culture of Indonesian society. Legal protection for the parties to the sale and
purchase agreement over the internet media covering the legal protection and
legal protection agreements outside the treaty. UUITE add some form of
electronic verification system that is the electronic signature (digital signature)
which is a security system which aims to ensure the authenticity of an electronic
document.

The Protection of Consumer's Rights and the Application of Criminal Law in the Unlawful Operation of Services and Content Service Application
Media reports on cases of the theft of pre-paid pulses taking place nowadays have created a misunderstanding in terms of the appropriate application of criminal law. In the context of existing legal provisions concerning consumer protection as set forth both under the Consumer Protection Law as well as in part under the Telecommunications Law, law enforcement agencies are leaning towards applying general criminal provisions (theft) which, after a careful observation of the Indonesian Criminal Code, in fact do not extend to corporate criminal acts. This paper purports to explain that the currently occurring cases of the theft of pre-paid pulses should be adequately dealt with by imposing administrative sanctions by the governing and supervisory agencies, both under the Telecommunications Law as well as the Consumer Protection Law. It is proposed that it would be more effective to apply the Consumer Protection Law in such cases, as it contains provisions concerning the threat of alternative criminal punishment in the form of confinement or fines, along with additional sanctions in the form of an order to pay compensation for damages to consumers accompanied by the seizure and the halting of the application system in use by the Operator and/or CP concerned. It is proposed that in administering a proper telecommunications system to the public, the application of the Consumer Protection Law is likely to be less counterproductive as opposed to the application of general criminal provisions, considering that the latter are contradictory to the principles of legal certainty and partnership mandated under the Telecommunications Law itself
