    Although the dissemination of religious moderation in Indonesia has not always been responded positively by the public, its universal mission for the civilisation of religious life is always important to study.This qualitative study aims to identify the values of inclusive Islamic education in the indicators of religious moderation in Indonesia. The data collection technique of this study uses documentation. Data analysis included reduction, presentation and verification stages. The results of this study found the content of inclusive Islamic education values on indicators of religious moderation in Indonesia. First, the value of tasammuh and ta’awuneducation in the emphasis of indicators of the formation of tolerant and humane diversity. Then, the value of tawassuteducation in emphasising indicators of the formation of diversity that maintains state integration. Furthermore, the value of taarufeducation in emphasising indicators of the formation of diversity that appreciates synergistic religious practices with local culture as long as it does not conflict with religious teachings. This study confirms the synergy of inclusive Islamic education values with the promotion of religious moderation in Indonesia. The limitation of this study is that it has not examined the socialisationprogramme of inclusive Islamic education values in the indicators of religious moderation in Indonesia

    Ritualitas ibadah puasa ramadhan bukanlah sekedar ibadah yang berdimensi legal formalistik semata, seperti syarat, rukun, dan sah, batal atau tidaknya ibadah puasa tersebut. Namun demikian penting disadari bahwa pensyariatan ibadah puasa memiliki nilai-nilai falsafah hukum Islam yang termuat di dalamnya. Penelitian ini bermaksud untuk mengeksplorasi nilai-nilai maqasid shariah yang termuat dalam perintah kewajiban ritualitas ibadah puasa ramadhan. Jenis penelitian ini merupakan penelitian kualitatif berupa kajian pustaka (library research) dengan pendekatan normatif filosofis. Sumber  data  yang digunakan, yakni pelbagai literarur ilmiah, baik berupa buku (kitab) dan artikel jurnal ilmiah terkait pembahasan nilai-nilai falsafah ibadah puasa ramdhan. Sementara itu, teori analisis yang digunakan, yakni teori maqasid shariah yang dikembangkan oleh Jasser Auda. Hasil penelitian menyimpulkan terdapat tiga nilai maqasid shariah yang termuat dalam ibadah puasa ramadhan, antara lain (1) Peningkatan keimanan sebagai orientasi hifz din (2) Pendidikan karakter sebagai orientasi hifz nafs (3) Kepeduliaan sosial sebagai orientasi hifz mal

    Penelitian ini bermaksud untuk mengeksplorasi sejarah perkembangan tugas maupun wewenang penghulu di Indonesia dalam tiga masa, yakni masa kerajaan Islam di Nusantara, pemerintahan kolonial Belanda, dan pasca kemerdekaan. Peneltian ini merupakan penelitian kualitatif yang berupa kajian pustaka. Jenis penelitian hukum dalam penelitian ini masuk dalam kategori penelitian hukum normatif empiris dengan pendekatan sejarah. Hasil penelitian menunjukan bahwa tugas dan wewenang penghulu di Indonesia dari masa ke masa semakin mengalami penyempitan. Hal tersebut disebabkan oleh faktor dinamika sosial politik pemerintahan yang ada. Pada masa kerajaan Islam Nusantara, tugas dan wewenang penghulu sangat kompleks dan multi fungsi, yakni persoalaan agama secara umum, penasehat spritual pengusa, bahkan politik. Kemudian, pada masa pemerintahan kolonial Belanda, peran dan tugas penghulu dibatasi pada persoalan perdata Islam. Selanjutnya, pada masa pasca kemerdekaan, tugas dan wewenang penghulu semakin mengalami penyempitan, yakni dibatasi pada persoalan pernikahan dan perceraian

    The phenomenon of da'wah content on various social media platforms that usher in social conflicts has become a crucial problem in Indonesia. This encourages the government and all elements of society to be able to minimize it. This study intends to identify and explore the dimensions of Pancasila values in the fatwa of the Indonesian Ulema Council of East Java Province Number. 06 of 2022 concerning Da'wah Ethics in the Digital Era. This qualitative study in the form of literature study uses a normative-philosophical approach. The philosophical values contained in Pancasila become a theory of analysis of the subject of study. The data collection of this study uses documentation techniques, and data analysis techniques use the stages of data reduction, presentation, and verification. This study concludes that there is a dimension of Pancasila values in the fatwa of the Indonesian Ulema Council of East Java Province concerning Da'wah Ethics in the Digital Era. First, the value of divinity (religion) and humanity in the prohibition of the delivery of provocative da'wah content. Second, the value of unity in advocating the delivery of pluralist and nationalist da'wah content. Third, the value of democracy and social justice in the recommendation of delivering da'wah content that maintains public conduciveness and stability. The theoretical implications of this study show that the universal values contained in Pancasila can be transformed into Islamic socio-religious fatwas, as well as fatwas related to da'wah ethics in the digital space. The limitations of this study have not identified the effectiveness of the fatwa of the Indonesian Ulema Council of East Java Province on Da'wah Ethics in the Digital Era

    THE PROBLEM OF LIBERALIZING ISLAMIC MARRIAGE LAW IN INDONESIA : The Perspective of Science Philosophy

    The phenomenon of liberalism on Islamic marriage law in Indonesia often creates social problems. Therefore, it is important to understand understanding and wise attitudes towards the phenomenon within the framework of the scientific paradigm. This research aims to understand various forms of liberalism on Islamic marriage law in Indonesia in the perspective of the philosophy of Science. This research is a qualitative research in the form of literature review. The type of legal research in this study is philosophical normative legal research. The research data used is various research on liberalism on the law of Islamic marriage in the Compilation of Islamic Law (KHI). Meanwhile, the theory used as a knife of analysis is the theory of the scientific revolution of Thomas Samuel Kuhn. This study concludes that liberalism on Islamic marriage law in Indonesia is a form of paradigm shift over the construction of legal thinking in various KHI articles that are considered to have experienced anomalies, which are not relevant to social development and do not answer the challenges of modernity, such as issues of gender equality, democracy, human rights Humans, and pluralism. Such conditions have encouraged contemporary Islamic law reviewers in Indonesia to voice a paradigm shift and even a scientific revolution by giving birth to the construction of new Islamic marriage law

    FATWA ABOUT SOCIAL INTERACTION ON SOCIAL MEDIA IN THE PARADIGM OF ISLAMIC LEGAL PHILOSOPHY

    This study aims to find the paradigm of Islamic legal philosophy contained in the Fatwa of the Indonesian Ulema Council (MUI) regarding guidelines for social interaction through social media. This type of research is qualitative research (library research). Data sources of this study is the Fatwa of MUI, No.24 of 2017 Concerning Law and Guidelines for Bermuamalah through Social Media and various relevant literature. The theory used in this research is the Maqasid Shariah theory. This study concludes that the Fatwa of MUI legal provisions that limit freedom of social interaction through social media are legal provisions in realizing the benefit of individuals (al-maslahat al-khassah) and the public (al-maslahat al-ammah) in the context of social life. To realize these two benefits, the five objectives of Islamic law (maqasid shari'ah al-khomsah), such as hifz al-nafs, hifz al-aql, hifz al-mal, hifz al-nasl can be manifested in various legal provisions of the fatwa of MUI which limits freedom of social interaction on social media. Penelitian ini bertujuan untuk menemukan paradigma filsafat hukum Islam yang terkandung dalam Fatwa Majelis Ulama Indonesia (MUI) tentang pedoman interaksi sosial melalui media sosial. Jenis penelitian ini adalah penelitian kualitatif (penelitian kepustakaan). Sumber data penelitian ini adalah Fatwa MUI, No.24 tahun 2017 Tentang Hukum dan Pedoman Bermuamalah melalui Media Sosial dan berbagai literatur terkait. Teori yang digunakan dalam penelitian ini adalah teori Maqasid Syariah. Penelitian ini menyimpulkan bahwa Fatwa ketentuan hukum MUI yang membatasi kebebasan interaksi sosial melalui media sosial adalah ketentuan hukum dalam mewujudkan manfaat individu (al-maslahat al-khassah) dan masyarakat (al-maslahat al-ammah) dalam konteks kehidupan sosial. Untuk mewujudkan dua manfaat ini, lima tujuan hukum Islam (maqasid syari'ah al-khomsah), seperti hifz al-nafs, hifz al-aql, hifz al-mal, hifz al-nasl dapat dimanifestasikan dalam berbagai ketentuan hukum fatwa MUI yang membatasi kebebasan interaksi sosial di media sosia

    This study aims to find the correlation of motivation, behavior and spiritual peak experience in the view of Islamic psychology. This type of research, namely qualitative research in the form of literature study. The primary data source of this research, namely the theory of hierarchy of human basic needs from Abraham Maslow. Meanwhile, secondary research data sources, namely various other relevant western motivational theories. The theory is used as a knife of analysis, namely the theory of motivation of the human soul from al-Ghazali which includes dimensions of heart, reason and lust. This study concludes that in the perspective of Islamic psychology there is a strong relationship between motivation and the behavior of every human being in the process of achieving spiritual peak experiences. The relationship of motivation and human behavior in the perspective of Islamic psychology that is more likely to emphasize religious motives (spiritual), both in psychological and physiological conditions of humans. motivation and behavior in Islam are very closely related to various stages in the process towards the ultimate spiritual human experience

    This study aims to explore and identify the philosophical basis and features of Abdurrahman Wahid's approach to Islamic law regarding the implementation model of Islamic law in Indonesia. This research is a qualitative research in the form of literature review. This research is included in the category of philosophical normative Islamic law research.     The mainstreaming of religious moderation in  Indonesian is not welcomed positively by all elements of society. This is because there are some views that consider the mainstreaming of religious moderation as a form of liberalization or secularization of religion in state life. Through a normative-philosophical approach, this qualitative study aims to identify and explore the content of Sufism values on the four indicators of religious moderation formulated by the Ministry of Religious Affairs of the Republic of Indonesia. Data collection of this study through documentation. Data analysis includes the stages of reduction, presentation, and verification. The results of this study show the dimensions of Sufism values in indicators of religious moderation in Indonesia, including the value of mahabbah in indicators of tolerance and anti-radicalism, namely in the formation of Islamic religion full of compassion, love, and peace. Then, the value of itsar on the indicator of national commitment, namely in the formation of Islamic religion that maintains mutual benefit for the integration of social life. Furthermore, the value of futuwwah on indicators accommodating to local culture, namely in the formation of Islamic religion that is fair and non-discriminatory against cultural plurality. The theoretical implications of this study emphasize that there is a meeting point related to the manifestation of the value of Sufism teachings with indicators of religious moderation in Indonesia.     This research aims to understand the existence of the Compilation of Islamic Law (KHI) and its status in the political perspective of the formation of law. In addition, it is also to understand the existence of KHI in the midst of the liberalism movement of Islamic legal thinking in Indonesia. This research is a qualitative research in the form of literature review. While the type of legal research in this study, namely historical normative legal research. There are two big conclusions from the results of this study. The First, the formation of KHI accommodates orthodox and responsive legal strategies. The second, the existence of KHI remains consistent even though there have been many thoughtful efforts and studies that have criticized it. This is due to the criticism only as the impact of the opening of the democratic climate for the liberal movement of Islamic thought in the public sphere
