ANALISIS KESESUAIAN DASAR PERTIMBANGAN HUKUM HAKIM MENGENAI PEMBATALAN PERTUNANGAN SEPIHAK SEBAGAI PERBUATAN MELAWAN HUKUM DITINJAU DARI HUKUM PERDATA (STUDI PUTUSAN PENGADILAN NEGERI BANYUMAS NO. 5/PDT.G/2019/PN BMS)
No full textPertunangan dalam pelaksanaannya tidak menimbulkan akibat hukum, sehingga para pihak dapat membatalkan perbuatan tersebut. Permasalahan ini sejalan dengan kasus yang terjadi di Kemranjen, Banyumas antara saudari SSL dan saudara AS. Pembatalan pertunangan dan akibat hukumnya hanya diatur dalam Pasal 58 KUHPerdata dan Pasal 13 KHI. Dengan demikian memunculkan persoalan mengenai dasar pertimbangan hukum hakim dalam memutuskan perkara tersebut, dimana dalam hal ini amar putusannya berbeda-beda, ada yang berbunyi perbuatan melawan hukum dan adapula yang wanprestasi. Sehingga penulis tertarik untuk melakukan penelitian ini dan menganggap penting untuk diteliti, agar mengetahui apakah benar dasar pertimbangan yang ditetapkan oleh hakim Pengadilan Negeri Banyumas mengenai pembatalan pertunangan sepihak sebagai perbuatan melawan hukum sudah sesuai dengan pandangan hukum perdata yang ada.
Penelitian ini termasuk penelitian hukum normatif, yang menggunakan metode pendekatan yuridis. Sumber data primer dalam penelitian ini yaitu Putusan Pengadilan Negeri Banyumas No.5.pdt.G/2019/PN BMS. Sedangkan sumber data sekundernya yaitu buku, dokumen, dan jurnal. Metode pengumpulan data menggunakan dokumentasi. Metode analisis data yaitu metode analisis data kualitatif.
Dari hasil penelitian menunjukkan bahwa, dalam putusan perkara No.5.pdt.G/2019/PN BMS, hakim mempertimbangkan bahwa: pembatalan pertunangan sepihak dikategorikan sebagai perbuatan melawan hukum adalah benar, sesuai dengan Pasal 1365 KUHPerdata, serta menolak petitum ke 1,4,5, dan 6. Mengabulkan petitum ke-2 mengenai perbuatan melawan hukum dan mengabulkan sebagian petitum ke-3 mengenai ganti rugi. Pendapat majelis hakim ini didasarkan oleh Yurisprudensi MA RI No. 3191 K/pdt/1984 tanggal 12 Desember 1985. Dan norma masyarakat Banyumas “Sepadang-Sepenginang”.

IMPLEMENTATION OF THE E-PROCUREMENT SYSTEM IN THE PROCUREMENT PROCESS OF GOODS AND SERVICES AT PT PERTAMINA INTERNATIONAL SHIPPING (JAKARTA)

Both digital and non-digital technologies play an important role in managing an increasingly connected and competitive business. In the logistics sector, especially in procurement, technology plays an important role in improving efficiency and transparency. The provision of resources through procurement is a key aspect of logistics management, which requires appropriate regulations and policies to ensure effective fulfillment of needs. This procurement process often involves bidding, both with local and international companies, to select qualified and suitable providers. However, the procurement process certainly has some problems such as the non-processing of a document. One of the state-owned companies that has implemented e-procurement is PT Pertamina International Shipping (PIS). This study aims to identify the application of the e-procurement system and inhibiting factors in the application of the e-procurement system in the process of procuring goods and services at PT Pertamina International Shipping (PIS). The research method used by the author is descriptive qualitative. The data used by the author is obtained through interviews with supporting data related to the problems that occur. The results of this study indicate that the implementation of the e-procurement system at PT Pertamina International Shipping (PIS) has not run optimally because there are still inhibiting factors, namely human resources who have not mastered e-procurement, unstable internet and system errors.

That way there will be evidence that Qur'an will always be true throughout the ages. The method used in this paper is a qualitative method (library research).
