    The main purpose of marriage is having progeny besides for having happy and restful life. It is common saying that every people that get married are having kids besides other purposes in their lives. Unlike the purpose of common marriage, the main purpose of nikah misya&gt;ris not for having kids. Yet, nikah misya&gt;r is the marriage that aims only to have life together legally and to get sexual pleasure. This kind of marriage is done like common marriage in Islamic law that still fulfils the requirements and the principles of marriage. Some of Ulamas see that nikah misya&gt;r is allowed to do. They argue that the purpose of marriage is not only for having descendant, but also for enjoyment and happiness. Ignoring to have kids in marriage aim actually is not a digression of Islamic rules. Otherwise, some of Ulama strongly forbid this kind of marriage because it does not actualize the interest of marriage that is to have posterity. However, in maqa&gt;ṣid al-aṣliyyah (primary purpose of syari’ah) and maqa&gt;ṣid al-tab’iyyah (secondary purpose of syari’ah) view, nikah misya&gt;r should be banned because it clearly infringes the will of The Lawmaker, al-Syâri’ (Allah).</jats:p

    Ḥisāb and ru’yat always be warm conversations when there is an early determination of Ramadhan and Shawwal. At that time, there are always two camps of scholars in reacting, the scholars who hold on to ḥisāb (calculating the calendar) on one side, and on the other hand hold to ru’yat al-hilāl (seeing the moon directly). This in turn often leads to time differences in setting the beginning of the month among Muslims. With the aim to unite the people in starting their worship, some scholars try to understand the texts of these traditions about ru’yat al-hilāl by trying to find the 'illat (reason) of the laws of hadiths about ru’yat al-hilāl. Their study of the 'illat law resulted in the conclusion that the ru’yat al-hilāl is only a suitable means for the people that time and may not suitable for Muslims in this modern era. Therefore Muslims must use other wasīlah (means) which further guarantee the realization of the purpose of law, namely modern astro­nomy. The conclusion of the law from the side of the discovery of ‘illat seems to be less suited to the purpose of ta'līl al-aḥkām, is to establish textual texts in addition to discovering the forms of development of the texts

    Utilizing the Assets Acquired from Illegal Conducts A Study of Fiqh Maqâshid of Yûsuf al-Qaradlâwî

    Harta merupakan kebutuhan setiap orang yang di dalam Islam mesti didapatkan sesuai dengan aturan-aturan yang benar. Menurut  Yûsuf al-Qaradlâwî apabila seseorang sudah terlanjur mendapatkan harta dengan cara maksiat, maka yang bersangkutan tidak boleh memanfaatkan harta itu untuk dirinya, sebaliknya harta itu boleh dipergunakan untuk kepentingan umum. Pemikiran hukum ini beranjak dari adanya pertentangan antara konsep larangan memanfaatkan harta haram secara dharûriyah dan konsep larangan menyia-nyiakan harta yang juga berada dalam tingkat dharûriyah. Dengan pendekatan fiqh maqâshid al-Qaradlâwî menyimpulkan bahwa pertentangan antara dua dharûriyah yang berhubungan dengan pemanfaatan harta harus diprioritaskan kepada mafsadah yang lebih kecil dan maslaẖah yang lebih besar. Sehingga dengan demikian harta hasil maksiat tidak boleh dimanfaatkan oleh si pelaku maksiat karena menimbulkan mafsadah yang lebih besar pada dirinya dan tidak ada celah maslaẖah yang didapatkannya. Sebaliknya harta itu boleh dimanfaatkan untuk kepentingan umum, karena terhindar dari mafsadah dan menghasilkan maslaẖah. (An asset is the basic need of every human being, but in Islam, it should be acquired through proper ways according to the rules. Yûsuf al-Qaradlâwî argued that if someone has already acquired an asset through immoral acts, then he is forbidden to utilize the asset for himself. On the contrary, the assets could still be utilized for the public benefit. This legal concept is based on the contradiction between the concept of prohibiting the use of illegal assets in dlarûriyah state and the concept of prohibiting the misuse of assets which is also in the dlarûriyah state. With the approach of fiqh maqâshid, al-Qaradlâwî concluded that the conflict between the two dlarûriyah states regarding the utilization of the asset should prioritize less on the mafsadah and more on the maslaẖah. Thus, the illegal assets are forbidden to be exploited by immoral act offenders because it generates more mafsadah for him and there are only a few maslaẖah he could get. On the contrary, the assets are allowed to be utilized for public benefit since the assets will be protected from mafsadah and will result in maslaẖah).</p

    Menurut kesepakatan mayoritas ulama, maqâshid al-syarî’ah bukan sebuah ilmu yang berdiri sendiri di luar ushul fiqh, tetapi ia harus mengilhami setiap ketetapan hukum yang dilahirkan oleh mujtahid. Dengan kata lain, dengan melakukan istinbath hukum melalui metode-metode di atas, yang menjadi tujuan mujtahid adalah agar hukum yang ditetapkannya dapat merealisir kemaslahatan bagi manusia, baik di dunia maupun di akhirat. Oleh karena itu, suatu hal yang perlu diperdebatkan ketika ada yang berpendapat bahwa maqâshid al-syarî’ah, dalam hal ini maslahah, dapat menjadi dalil hukum yang mandiri. Apabila pendapat terakhir ini dibenarkan, maka akan muncul maslahah-maslahah menurut ukuran akal manusia yang dimungkinkan bertentangan dengan nash dan ijma’, dan tentunya suatu hal yang tidak bisa diterima ketika akal yang hanya menghasilkan kesimpulan yang zhanni lebih diutamakan dari nash atau ijma’ yang disepakati keqath’iannya oleh ulama. Oleh karena itu, teori maqâshid al-syarî’ah lebih tepat dikatakan sebagai pemandu bagi mujtahid dalam menetapkan hukum, agar hukum yang ditetapkan tidak melenceng dan sesuai dengan yang dikehendaki oleh al-Syâri’. Dalil-dalil hukum manapun yang akan digunakan oleh seorang mujtahid, apabila mereka sungguh-sungguh memperhatikan maqâshid al-syarî’ah, diduga kuat (al-mazhinnah) dapat mewujudkan tujuan hukum Islam itu, yaitu jalb al-mashâlih wa daf’u al-mafâsid.     The objectives of this research are (1) to know the Indonesian transtool translation of English phrases and (2) to know the Indonesian transtool translation of English clauses.This research uses a descriptive-qualitative method, that deccribes the translation of English phrases and clauses into Indonesian. The research data are noun phrases that consist of two and three words, verb phrases that consist of two and three words, adjective phrases that consist of two words, and clauses. The data collection technique used are hearing and taking-note technique.The results of the research show that structurally English and Indonesian noun phrases are different. The structure of English noun phrases consists of modifier and head. Meanwhilw, in Indonesian the head is on the left side. The structures of English and Indonesian verbal phrases that consist of two and three words are the same. The structures of English and Indonesian adjective phrases are the same.Generally, the translation of noun, verb, and adjective phrases using transtool has been good. But, there are still errors. The errors of the transtool translation are on the translation of words, not structure

    Imam Abu Hanifa is the founder of the Hanafi school of law which is famous for rational thought. In his periode discussion the regarding by gender haven`t known as the contemporary era, but in his ijtihads that related with women, indirectly he has given a strong position for a woman as a subject of law. This is different from the ulama mayority who often place women as objects of law. Consequences of legal thinking, among others, making women as human beings that will determine the issue of marriage, other social relations and also in matters of worship. In relation to the position of women in politics and government, Imâm Abû Hanîfah already gives the right to women to be judges in civil matters. As for the head of state, it looks like the traditions about the ban on women becoming head of state, understood the same as the scholarly opinions. Understanding it seems not prohibit absolutely, but the circumstances of women who exist in his time that causes such ijtihad. When linked with the present condition of women, presumably Imâm Abû Hanîfah will interpret the tradition in accordance with contemporary gender studies
