Zastępstwo Prezydenta Republiki Włoskiej w sprawowaniu urzędu w świetle regulacji konstytucyjnej i praktyki ustrojowej
Autorzy analizują problem zastępstwa Prezydenta Republiki Włoskiej. Kwestia ta została bardzo lakonicznie uregulowana w przepisach Konstytucji Włoch, co spowodowało powstanie istotnych wątpliwości interpretacyjnych. Wiele problemów stworzyło przede wszystkim doprecyzowanie pojęcia „trwałej przeszkody”, o której mowa w konstytucyjnych przepisach, a także określenie procedury zadeklarowania jej zaistnienia. Niejasna jest również pozycja ustrojowa oraz zakres uprawnień Przewodniczącego Senatu sprawującego funkcję zastępcy głowy państwa. Autorzy stoją jednak na stanowisku, że doktryna włoskiego prawa konstytucyjnego i praktyka ustrojowa całkiem dobrze i wyczerpująco z tymi problemami sobie poradziły
The (Post-)Communist Orient: History, Self-Orientalization and Subversion by Michał Witkowski and Vladimir Sorokin
This article analyses two literary texts: Barbara Radziwiłłówna z Jaworzna-Szczakowej by the Polish author Michał Witkowski (2007) and Sakharnyi
Kreml’ by the Russian author Vladimir Sorokin (2008) in the context of postcolonial studies. I treat the terms coined by post-colonial critique, such as orientalism,
orientalization, subversion or mimicry as not only ideological categories, but also
as aesthetic and narrative ones. These tools turn out to be useful in the interpretation of both these texts which, despite the differences between them, may be read
as examples of post-dependence narration, which articulate issues in connection
with identity-related problems of modern Polish and Russian cultures. Both
Witkowski and Sorokin subversively employ auto- and heterostereotypes and
avail themselves of the strategy of self-orientalization, which enables the play on
foreign notions regarding, respectively, Polish and Russian culture and collective
identity. The novel by Michał Witkowski ironically, perversely addresses national
complexes associated with the systemic transformation of 1989 and takes the
floor in the discussion on post-communism. In turn, Sakharnyi Kreml’ by Vladimir
Sorokin is an example of a futuristic dystopia, in which criticism of Putin’s Russia
commingles with reflections on the non-autonomous and non-independent status
of own culture which, in the year 2028, continues to reproduce foreign discourses
and finds it difficult to articulate its own position

Summary
This article analyses two literary texts: Barbara Radziwiłłówna z Jaworzna-Szczakowej by the Polish author Michał Witkowski (2007) and Sakharnyi Kreml’ by the Russian author Vladimir Sorokin (2008) in the context of postcolonial studies. I treat the terms coined by post-colonial critique, such as orientalism, orientalization, subversion or mimicry as not only ideological categories, but also as aesthetic and narrative ones. I rapporti tra Parlamento e Corte costituzionale nella garanzia dei diritti sociali
Il contributo affronta il tema dei rapporti tra Parlamento e Corte costituzionale dallo specifico punto di vista della garanzia dei diritti sociali. La riflessione si propone perciò di osservare dinamicamente come il controllo di legittimità costituzionale interagisca con l’esercizio della discrezionalità legislativa nella concreta attuazione della forma di Stato sociale.
L’indagine si sofferma sull’evoluzione che ha caratterizzato la giurisprudenza degli ultimi anni in materia di diritti sociali. Anzitutto, si evidenzia come oramai il criterio dominante utilizzato dal Giudice di costituzionalità nel sindacare le leggi attuative dei diritti sociali sia quello, dai contorni non esattamente definiti, del “ragionevole bilanciamento” che deve sussistere tra la previsione di (costose) prestazioni pubbliche e la necessità di salvaguardare l’equilibrio finanziario del sistema. Viene altresì posto in luce come, per la Corte, il bilanciamento legislativo non possa essere ritenuto ragionevole quando comprometta il “nucleo essenziale” di un diritto sociale. Inoltre, si constata come siano diminuite in modo drastico le c.d. “sentenze di spesa”; quelle, cioè, attraverso cui la Corte, trovando illegittime le restrizioni contenute nelle scelte legislative, aggiunge o estende prestazioni pubbliche a beneficio dei cittadini. Infine, si fornisce un quadro di sintesi dei rapporti che, in questi anni di crisi economica, si sono creati tra Giudice delle leggi e Parlamento in materia di diritti sociali, rilevando una sostanziale consonanza – pur con qualche eccezione – in vista del contenimento della spesa pubblica.The speech deals with the relationship existing between Parliament and Constitutional Court in the protection of social rights. It aims, therefore, at analyzing how the constitutional review of the legislation interacts with the legislative discretion in the welfare state’s actual implementation.
The analysis focuses on the evolution of last years’ jurisprudence about social rights. First, it stresses that the balancing test has became the prevalent criterion adopted by the Constitutional Court in the review of statutes dealing with the implementation of social rights: through this test, the Court is able to balance the cost of public services with the financial balance of the government. The author sheds light on the perspective of the Court: in the review of the legislation, the Court refuses to consider as “reasonable” a norm which infringes the core of a social right.
Furthermore, the speech explains the decrease of a specific kind of judgments, called “Spending Judgments”, i.e., judgments through which the Court, due to the unconstitutionality of a norm, expands public services.
As a conclusion, the speech outlines a framework of the relationships between Parliament and the Courts that have been produced during the economic crisis, pointing out a substantial consistency – even though with few derogations – in pursuing the goal of a reduction in public spending
Jak uprawiać humanistykę? W stronę polityki wrażliwości
The paper reports from the author’s perspective the debate on the book by M.P. Markowski Polityka wrażliwości. Wprowadzenie do humanistyki (Kraków: Universitas, 2013). This debate was organized within the Framework of the Conrad Festival in Cracow in 2013, and the participants were the following professors: Michał Paweł Markowski as the author of the book himself, Ryszard Nycz as the moderator of discussion, Agata Bielik-Robson, Krzysztof Kłosiński and Lech Witkowski, together with Grzegorz Jankowicz represen ing the journal „Tygodnik Powszechny”. The key question for the debate was linked with the issue whether and in what a way one can defend the value of humanities in their contrast with the scientific rigour on one side, and the neoliberal afirmation of equivalence of banality on the other.
Artykuł przedstawia z perspektywy autora debatę poświęconą książce M.P. Markowskiego Polityka wrażliwości. Wprowadzenie do humanistyki (Kraków: Universitas, 2013). Debata została zorganizowana w ramach Festiwalu Conrada w Krakowie w 2013 roku, a jej uczestnikami byli następujący profesorowie: Michał Paweł Markowski jako autor książki, Ryszard Nycz jako moderator dyskusji, Agata Bielik-Robson, Krzysztof Kłosiński i Lech Witkowski, a także Grzegorz Jankowicz reprezentujący tygodnik „Tygodnik Powszechny”. Hail to the Supermen: Ideology and Pop Culture (Chwała supermanom. Ideologia a popkultura) by Przemysław Witkowski has been considered by Przemysław Czapliński as ‘the monograph’ of pop culture created in the last thirty years. In his essay, Witkowski has made several attempts to reveal how the neoliberal and nationalistic ideologies are related to the popular or mass movies, TV series and shows, music, books, and other pop cultural phenomena. This article is a review of Hail to the Supermen… The author reconstructs the main assumptions and points out some of the most noticeable simplifications and general problems with the book.Hail to the Supermen: Ideology and Pop Culture (Chwała supermanom. Późne spotkanie: Znaniecki, Witkowski i nauki o zarządzaniu. Organizatorska refleksja na temat pewnego fragmentu Uroszczeń i transaktualności w humanistyce Lecha Witkowskiego
Abstract: The author of the article discusses the importance of the reinterpretation of Florian Znaniecki\u27s thought, which is carried out by Lech Witkowski in his monograph Uroszczenia i transaktualność w humanistyce, for management studies. The article focuses on the thesis – extracted from Znaniecki\u27s writings by Witkowski- about “the rationalization demands”. It describes the situation when rationalization transferred from one area to another, causes chaos and suppresses creativity. According to the author of the article, this thesis by Witkowski-Znaniecki can significantly help in the development of humanistic management (this stream of management, created in the early 2000s as a reaction to the hegemony of business corporations that do not care about employees and the environment while weakening the role of the state, is briefly presented in the text). On the one hand, the Witkowski – Znaniecki’ thesis raises awareness of the phenomena of “mathiness” and “lost in mathematics” in management. On the other, it shows the need and possibilities for scholars of humanistic management to undertake legitimate reflection on the epistemological contexts of combining management with the humanities.W artykule omówiono znaczenie reinterpretacji myśli Floriana Znanieckiego, której dokonuje Lech Witkowski na kartach swojej monografii Uroszczenia i transaktualności w humanistyce, dla studiów nad zarządzaniem. Skoncentrowano się na tezie – zaczerpniętej przez Witkowskiego z pism Znanieckiego– o „roszczeniach racjonalizacji”. Teza ta opisuje stan, w którym racjonalizacja przeniesiona z jednego obszaru poznania do drugiego wywołuje chaos i tłumi kreatywność. Zdaniem autora artykułu wspomniana teza może znacząco pomóc w rozwoju zarządzania humanistycznego (ten nurt zarządzania – powstały w pierwszych latach XXI wieku jako reakcja na hegemonię korporacji biznesowych, które nie dbają o pracowników i środowisko, jednocześnie osłabiając rolę państwa – jest krótko przedstawiony w tekście). Z jednej strony teza Witkowskiego/Znanieckiego uwrażliwia na zjawiska mathiness i „zagubienia w matematyce” odniesione do zarządzania, z drugiej zaś wskazuje na potrzebę i możliwości podjęcia przez przedstawicieli zarządzania humanistycznego pogłębionej refleksji nad kontekstami epistemologicznymi łączenia zarządzania z humanistyką

The Białowieża Forest controversy in the light of the world dispute in conservation biology
The controversy between naturalists and foresters on the management of the Białowieża Forest is one of numerous disputes in conservation biology. Cause of the dispute is a difference in stand-point on the purpose of nature conservation. Biocentrists (Soulé 1985) argue that the only goal should be to preserve natural processes as well as endangered ecosystems and species. Anthropocentrists on the other hand (Kareiva, Marvier 2012) support conservation as a need of mankind, that is, the sustainable support of ecosystem services with the protection of species and ecosystems simply being a side effect. Another important factor in the dispute is the management of bark beetle mass outbreaks. Foresters try to control this by removing the infested trees, but naturalists protest against this practice. However, in 2013, the European Commission clearly presented its statement in this regard (EU Guidelines on Wilderness in Natura 2000); and thus, the dispute has only shown that none of the debating parties are familiar with the EU guidelines
