    U radu se istražuje odnos između slobodnog tumačenja prava (slobode kao metode rada sudije) i contra legem odlučivanja. U tom kontekstu razmatraju se pre svega stavovi H. Kantoroviča koji su izazvali velike nedoumice i polemike na ovu temu. Osim teorijskih kontroverzi vezanih za Kantorovičeve, ali i stavove ostalih predstavnika slobodnopravnog pokreta, u radu se izlaže dilema o potrebi i domašaju contra legem judiciranja. Najzad, daju se primeri iz prakse Vrhovnog kasacionog suda Srbije koji ukazuju na to da je zbog inherentne nesavršenosti pravnog poretka, contra legem odlučivanje realnost sa kojom se moramo suočiti i u odnosu na koju se moramo odrediti. Tada, kontralegalno judiciranje predstavlja metod rešavanja vrednosnih protivrečnosti do kojih dolazi kada se relativno slični društveni odnosi drugačije regulišu u različitim pravnim propisima. .The author examines the relation between the reality of contra legem decision making and the necessity for a methodical articulation of this form of judicial work. Contra legem decision making is analyzed as a method of the least painful and the most rational dealing with the value based discrepancies, which derive from the instances of relatively similar social relations being regulated differently. The author offers examples of the contra legem decision making of the Supreme Cassation Court of Serbia.

    The Image of Muhammad in Riccoldo da Monte di Croce’s "Contra legem Sarracenorum"

    Contra legem Sarracenorum written by the Dominican Riccoldo da Monte di Croce was considered one of the most influential medieval Christian anti-Islamic polemics. The treatise was devoted to criticism of the Quran, which was also reflected in the way Muhammad was presented there. It offers an image of the prophet that is rather blurry considering that the author’s focus is on the contents and the form of the book. Despite that, at least three distinct categories regarding the image of Muhammad can be distinguished in Contra legem Sarracenorum. He was portrayed, first and foremost, as a heresiarch, as a false prophet (most of the information about the prophet included in this work is used to support that view), and simply as an evil man. The image of Muhammad outlined by Riccoldo is largely dependent on the contents of the Mozarabic polemic treatise Liber denudationis, which the author used profusely. Muhammad is present in Contra legem Sarracenorum mainly in an indirect way as the creator of the teachings contained in the Quran. Generally speaking, in this specific aspect, one cannot speak of constructing an image of the prophet because in these fragments, the polemic conducted by Riccodlo focuses not so much on the person of Muhammad as on the contents of the book ascribed to him, in isolation from the creator

    En el espacio medieval la redacción de textos exegéticos constituye una práctica común a las tres religiones del Libro, con diversas facetas y modalidades que dependerán de la perspectiva del autor. El caso que se presenta en este contrapunto, el análisis del prólogo del Contra legem Sarracenorum del dominico Riccoldo da Monte di Croce (ca 1300), ofrece una doble particularidad, por un lado el valor apologético del texto, que se observa mediante el uso del salmo CXVIII, por otro, el uso de ese salmo que empuja al autor a su discurso polémico contra el islam. Así, aunque el autor, en el decurso de su tratado use de sus conocimientos de los textos islámicos, obviando textos cristianos, previamente busca fortalecerse a través de la lectio para emprender su disputatio, que va más allá del mero comentario exegético.Au Moyen Âge, la rédaction de textes exégétiques renvoie à une pratique commune aux trois religions du Livre, pratique dont les modalités et les formes dépendent des objectifs de l’auteur. Dans ce contrepoint est analysé le prologue du Contra legem Sarracenorum du dominicain Riccoldo da Monte di Croce (ca 1300). Y examiner l’usage du Psaume CXVIII offre un double intérêt. Non seulement l’auteur confère de la sorte une valeur apologétique remarquable à son texte, mais il y trouve encore un levier pour son discours polémique contre l’islam. En effet, bien que Riccoldo développe son traité au moyen de sa connaissance des textes islamiques, cachant les textes chrétiens auxquels il recourt, dans un premier temps, il cherche à consolider les fondations de sa disputatio dans une lectio qui aille au‑delà du simple commentaire.In medieval times, the writing of exegetical texts constitutes a common practice to the three religions of the Book, with different facets and modalities that will depend on the perspective of the author. The case presented in this counterpoint, the analysis of the prologue of the Contra legem Sarracenorum of the Dominican Riccoldo da Monte di Croce (ca. 1300), offers a double peculiarity: on the one hand the apologetic textual value, which is observed through the use of the psalm CXVIII; on the other, the use of this psalm which pushes the author to his controversial discourse against Islam. Thus, although the author uses his knowledge of Islamic texts in the course of his treaty, omitting Christian texts, in the first instance he seeks to strengthen his disputatio through lectio, which goes beyond mere exegetical comment

    This article examines the nuanced application of the contra legem principle by judicial panels in the adjudication of community property cases, particularly in the context of marital property. It highlights the evolving legal landscape and the importance of equitable distribution in contemporary law, underscoring the need to understand judicial reasoning in an era increasingly focused on fairness and gender equality. The study closely examines cases from religious courts, highlighting a trend in which judges have awarded a disproportionate share of community property to wives. This observation raises important questions about the balance between legal norms and the pursuit of equity in family law, and provides a critical lens through which to explore the dynamics of asset distribution and its broader implications in current legal frameworks. The research aims not only to outline judges\u27 distribution formulas, but also to offer insights into why such decisions are increasingly relevant in today\u27s legal discourse, marking a significant shift toward recognizing the complexities of marital property division. This study uses qualitative research methods with a legal descriptive analysis approach. A thorough legal source is case number 413/Pdt.G/2021/PA.Tng and a number of other legal materials related to the author\u27s research topic. The results of the study show that the panel of judges applied the contra legem principle in deciding this matter based on sociological considerations and distributive justice
