    Penerapan Pidana Mati Terhadap Pelaku Tindak Pidana Korupsi: Pertimbangan dan Hambatan

    Dikenal sebagai kejahatan luar biasa, korupsi juga harus ditangani dengan tindakan luar biasa termasuk hukuman. Undang-undang Pemberantasan Korupsi Indonesia menyebutkan dengan jelas tentang hukuman mati, sayangnya sanksi pidana yang dijatuhkan biasanya hanya tentang pidana penjara dan/atau denda. Tulisan ini bermaksud memperkenalkan pertimbangan hukum penerapan pidana mati/hukuman mati dan menegaskan tantangan penerapan pidana mati. Penelitian ini merupakan penelitian hukum normatif. Data dikumpulkan dari buku, jurnal, peraturan perundang-undangan terkait. Hasil penelitian menunjukkan bahwa dalam mengoptimalkan pidana mati terhadap pelaku tindak pidana korupsi, harus dipenuhi syarat-syarat tertentu sebagaimana diatur dalam undang-undang. Sayangnya, tantangan untuk menjatuhkan hukuman mati karena ada klausul yang ambigu dalam undang-undang. Menyikapi hal tersebut, pemerintah sebaiknya merevisi undang-undang yang ada untuk memberikan kepastian hukum kepada masyarakat. Indonesia Corruption Eradication Act mentioned clearly on the death penalty, unfortunately, the criminal sanctions usually imposed only about imprisonment and/or fines. This paper intends to introduce the legal considerations for the application of capital punishment/death penalty and asserting the challenges in the application of death penalty. This research is a normative legal research. Data collected from books, journals, relevant laws and regulations. The results of the study indicate that in optimizing the death penalty against perpetrators of corruption, certain conditions must be met as stated in the law. Unfortunately, the challenges to imposed the death penalty is because there is an ambiguous clause in the law.     Going Beyond Counting First Authors in Author Co-citation Analysis

    The present study examines one of the fundamental aspects of author co-citation analysis (ACA) - the way co-citation counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed.     Variations on the Author

    “Variations on the Author” discusses two of Eduardo Coutinho’s recent films (Um Dia na Vida, from 2010, and Últimas Conversas, posthumously released in 2015) and their contribution to the general question of documentary authorship. The director’s filmography is characterized by a consistent yet self-effacing form of authorial self-inscription: Coutinho often features as an interviewer that rather than express opinions propels discourses; an interviewer that is good at listening. This mode of self-inscription characterizes him as an author who is not expressive but who is nonetheless markedly present on the screen. In Um Dia na Vida, however, Coutinho is completely absent form the image, while Últimas Conversas, on the contrary, includes a confessional prologue that moves the director from the margins to the center of his films. This article examines the ways in which these works stand out in the filmography of a director who offers new insights into the notion of cinematic authorship

    ABSTRAKRegulasi pendidikan inklusi di Indonesia bertujuan untuk memberikan akses setara bagi semua anak dalam memperoleh pendidikan. meskipun manfaat pendidikan inklusif diakui efektif, namun implementasinya masih menghadapi tantangan, terutama terkait kesiapan dan kompetensi guru. Dalam konteks ini, self-compassion dan self-efficacy dapat menjadi faktor penting dalam penguatan dan pemberdayaan guru di kelas inklusi, untuk itu penelitian ini bertujuan untuk mengetahui hubungan antara self-compassion dengan self-efficacy guru kelas inklusi pada beberapa Sekolah Dasar yang tersebar di kota Makassar. Penelitian ini melibatkan 59 guru yang mengajar siswa berkebutuhan khusus, terdiri dari 18 guru laki-laki (30,51%) dan 41 guru perempuan (69,49%) dengan lama pengalaman partisipan mengajar di kelas inklusi berkisar antara 2 hingga 18 tahun. Penelitian ini meggunakan uji korelasi dengan teknik analisis Pearson Product Moment. Hasil penelitian menunjukkan nilai korelasi sebesar 0,467 (p<0.05), yang mengindikasikan adanya hubungan positif antara self-compassion dan self-efficacy dimana semakin tinggi self-compassion maka semakin tinggi pula self-efficacy guru. Penelitian memperlihatkan ketangguhan guru dalam menghadapi tantangan di lingkungan pendidikan, terutama dalam dukungannya terhadap siswa berkebutuhan khusus

    The development of the Sharia business in Indonesia has become the most potential business not only in Islamic banking but also the non-Islamic bank financial industries, such as Islamic insurance, Islamic pension funds, Islamic finance companies, Islamic bonds (sukuk), Islamic mutual funds, and even Islamic lodging. This phenomenon makes the Sharia "label" as a trend. This research aims to analyze the urgency of Sharia certification in the Sharia lodging business in Indonesia. The method used is a type of normative legal research with statutory approaches, case approaches, and conceptual approaches. The results of this study indicate that the urgency of Sharia certification in the Sharia lodging business is to maintain the image of Islamic teachings and to provide certainty to consumers. This is because the application of Sharia in business institutions bearing the Sharia label still shows that the concept of Sharia understood by these business institutions still seems partial/not kaffah (total). Besides that, the Sharia "label" in the lodging business is used mostly as a brand or company brand. Therefore, it is high time for Sharia lodging certification to be carried out, like the halal label certificate on food product

    Appropriate Similarity Measures for Author Cocitation Analysis

    We provide a number of new insights into the methodological discussion about author cocitation analysis. We first argue that the use of the Pearson correlation for measuring the similarity between authors’ cocitation profiles is not very satisfactory. We then discuss what kind of similarity measures may be used as an alternative to the Pearson correlation. We consider three similarity measures in particular. One is the well-known cosine. The other two similarity measures have not been used before in the bibliometric literature.     Dispelling the Myths Behind First-author Citation Counts

    We conducted a full-scale evaluative citation analysis study of scholars in the XML research field to explore just how different from each other author rankings resulting from different citation counting methods actually are, and to demonstrate the capability of emerging data and tools on the Web in supporting more realistic citation counting methods. Our results contest some common arguments for the continued use of first-author citation counts in the evaluation of scholars, such as high correlations between author rankings by first-author citation counts and other citation counting methods, and high costs of using more realistic citation counting methods that are not well-supported by the ISI databases. It is argued that increasingly available digital full text research papers make it possible for citation analysis studies to go beyond what the ISI databases have directly supported and to employ more sophisticated methods
