Influence of the European Convention for the Protection of the Human Fundamental Rights and Liberties over the Internal Law of the European Council Member States

The Right to Information - Main Element of Freedom of Expression. European and Romanian Standards
The author analyses the right to information in the light of the European Convention for defence of the human rights and the main liberties, of the jurisprudence of the European Court of Human Rights and Romanian right. After stating that this right is one of the two main elements of the right to expression freedom, next to the right of opinion freedom, the author shows, on one side, that the freedom to information supposes responsibility and, on the other side, this should be respected by public authorities, as well as by any natural or juridical person.the right to information, expression freedom, opinion freedom, European Court of Human Rights.
Defalcation of European Union Budget in the Romanian Criminal Law
One of the goals for Romania, after the 1st January 2007, was to protect the financial interests of the European Union to fight against fraud, corruption and other illegal activities. In order to achieve this target, the legal framework has been completed by the Law no. 161/2003 which introduced the article no. 182 in the text of the Law no. 78/2000 regarding prevention, discovery and punishing the corruption acts. The author analyses this new article and he develops the two constitutive elements (actus reus, mens rea), the objective and subjective aspects of the analyzed crime, the ways, the legal punishments applicable to this crime.fraud, financial interests, spending, incomes, actus reus, mens rea, legal punishments.
Niemożliwe „stawanie-się-mężczyzną” Ovidiu Anemţoaicei O propunere de corpo-etică feministă Masculinităţi și filosofia diferenţei sexuale
In this contribution, the author attempts to critically discuss main issues referred to by Ovidiu Anemţoaicei in his book Male Bodies and Sexual Difference.A Proposal for a Feminist Corporeo-Ethics (published in Romanian, 2017). Anemţoaicei’s is a new take on relations between male bodies, men, and masculinity that endeavours to implement, in the field of men’s studies, the notion of sexual difference as understood in Luce Irigaray’s thought. This study proposes a biobibliographical approach on Traian Brăileanu, one of the most interesting theoreticians of the elites, one of the most important European sociologists of the nations who had a systemic vision about society, the first Romanian author of a work dealing with the science of politics and one of the most prolific translators of Aristotle and Kant. In fact, his entire work was influenced by the Kantian doctrine. His work is very complex and resisted in spite of the interdictions of the communist regime. This is why we will try to reconsider and re-evaluate it in order to give Traian Brăileanu the place he deserves
Local and global minimizers for a variational energy involving a fractional norm
We study existence, uniqueness, and other geometric properties of the minimizers of the energy functional

We also deal with the solutions of the related fractional elliptic Allen-Cahn equation on the entire space Rn . The results collected here will also be useful for forthcoming papers, where the second and the third author will study the Γ-convergence and the density estimates for level sets of minimizers
Un impossible "devenir-un-homme" : "O propunere de corpo-etică feministă Masculinităţi și filosofia diferenţei sexuale" par Ovidiu Anemţoaicei
W niniejszym szkicu podejmuję się krytycznego omówienia głównych zagadnień poruszonych przez Ovidiu Anemțoaicei w książce O propunere de corpo-etică feministă. Masculinități și filosofia diferenței sexuale (2017). Anemțoaicei proponuje nowe ujęcie związków pomiędzy męskimi ciałami, mężczyznami i męskościami, aktualizując na polu men’s studies pojęcie różnicy płciowej w rozumieniu Luce Irigaray. Interpretacje prac belgijsko-francuskiej filozofki prowadzą rumuńskiego badacza do post-deleuzjańskiego odczytania konceptu „stawania-się-mężczyzną”, co pozwala mu tym samym zarysować teoretyczne ramy dla nowej męskiej, niehegemonicznej postawy etycznej względem kobiecych i męskich cielesności.In this contribution, the author attempts to critically discuss main issues referred to by Ovidiu Anemţoaicei in his book Male Bodies and Sexual Difference. Masculinităţi și filosofia diferenţei sexuale [Une proposition d’éthique corporelle féministe. Les masculinités et la philosophie de la différence sexuelle] (2017). Anemţoaicei y propose une nouvellemise en perspective des liens entre corps masculins, hommes et masculinités, tout en actualisant la notion de différence sexuelle selon Luce Irigaray et en l’appliquant au champ des Men’s studies. Les interprétations d’ouvrages de la philosophe francobelge mènent le chercheur roumain à une lecture post-deleuzienne du concept de « devenir-homme », ce qui lui permet ainsi de délimiter un cadre théorique pour une nouvelle attitude éthique masculine, non hégémonique envers les corporalités féminines et masculines
