CONTEMPORARY SHARI'AH STRUCTURING FOR THE DEVELOPMENT AND MANAGEMENT OF WAQF ASSETS IN SINGAPORE
No full textThe institution of waqf proves to bring about social, economic and religious benefit to mankind. It is a vehicle for financing society as a whole (Hodgson, 1974). However, of late there has been a pervasive underdevelopment of waqf assets in the world (Kahf, 1998; Kuran, 2004). One of the reasons cited by Kuran for this underdevelopment is the issue of perpetuity and the inalienability inherent in the features of waqf ( 2004). The other reason, as cited by Kahf and Cizakca (2000; 1998) is the issue of mismanagement and the nationalisation of waqf . However a plethora of reasons can be advanced for the underdevelopment of waqf which includes the entire administration, management, financing and development of waqf.
This research therefore aims at indentifying factors needed for the contemporary shari’ah compliant structuring of waqf assets in Singapore and how this can be achieved. The factors and gaps that have been identified include legal, financing, management structure, perception of stakeholders and the shari’ah issues in managing the waqf assets which form the largest group of assets managed by the Islamic Religious Council of Singapore (Muis).
The research utilised the semi-structured interview of the various stakeholders and expert opinion relating to waqf. In addition, secondary sources from the case study analysis of Majlis Ugama Islam Singapura (Muis) provide an important and useful insight in understanding the management of waqf in Singapore. The study revealed some interesting findings such as the attitudes towards and the perception of non-shari’ah compliant activities carried out in waqf management, the possibilities of the various instruments that can be used to develop waqf assets and the polar shari’ah interpretation of investment and financing of the waqf assets. All issues are presented with real case study in this thesis. The research will then conclude by offering the possible new structuring of waqf assets using the instruments of Real Estate Investment Trust (REITs) and the various policy changes required to move waqf to the next level of its management in order to realise its full potential

No full textPendidikan akidah dan akhlak termasuk bagian atau ranah dalam
pendidikan Islam pada pelaksanaannya memerlukan dukungan semua aspek
terkait, baik di rumah, di sekolah maupun di masyarakat oleh orang tua, guru,
tokoh, ulama atau pendidik yang ada di masyarakat. Akidah yang lurus mampu
memberikan pembebasan dari segala taklid dan ketundukan kepada selain Allah.
Akal sebagai karunia Allah yang paling berharga harus diberdayakan untuk
memikirkan masalah kedunian dan keagamaan. Namun walaupun demikian
sebagai makhluk, akalpun bisa bersifat relatif, oleh karenanya akal memerlukan
bimbingan wahyu. Di situlah peran dan fungsi agama bagi manusia. Karena
agama tidak hanya terbatas mengajarkan tentang norma-norma baik atau buruk
(etika). Namun agama lebih jauh mengajarkan tentang berprilaku, baik terhadap
Tuhannya, sesamanya, maupun terhadap lingkungannya atau yang disebut dengan
akhlak.
Fokus utama penelitian ini adalah konsep pendidikan akidah dan akhlak
menurut Gusti Haji Abdul Muis. Fokus utama tersebut dijabarkan dalam sub.
fokus penelitian yang lebih khusus, yaitu: 1. apa dasar dan tujuan pendidikan
akidah dan akhlak menurut Gusti Haji Abdul Muis ?, 2. bagaimana materi
pendidikan akidah dan akhlak menurut Gusti Haji Abdul Muis ?,3. bagaimana
metode pembelajaran pendidikan akidah dan akhlak menurut Gusti Haji Abdul
Muis?
Penelitian ini menggunakan model kepustakaan murni (library research)
artinya data penelitian berasal dari sumber-sumber kepustakaan, baik berupa
buku-buku, naskah, jurnal, majalah, kaset atau cd. Penelitian ini juga adalah
penelitian kualitatif, karena jenis data yang dikumpulkan berbentuk narasi atau
pengisahan (deskripsi) suatu cerita atau kejadian. Data dalam penelitian ini terdiri
dari data primer dan data sekunder. Data primer adalah data yang diperoleh
langsung ditempat kejadian berupa tulisan langsung dan atau rekaman ceramah
Gusti Haji Abdul Muis. Sedangkan data sekunder adalah laporan hasil observasi,
hasil penelitian, buku yang diterbitkan, atau wawancara orang lain tentang Haji
Gusti Abdul Muis. Termasuk juga dalam data sekunder adalah tulisan–tulisan
yang memaparkan pemikiran-pemikiran pendidikan Islam tokoh lain.
Hasil penelitian ini menemukan bahwa: Berkenaan pendidikan akidah,
yaitu : Menurut Gusti Haji Abdul Muis, akidah adalah kepercayaan, tetapi
kepercayaan tidak sama dengan akidah, akidah adalah ajaran Islam yang memberi
petunjuk kepada manusia untuk mengenali Allah Tuhannya, melahirkan Iman atau

keyakinan yang kuat berupa tauhid dalam segala aspeknya. Terkait masalah akal,
Muis menyatakan akal adalah untuk memikirkan tentang dunia dan masalah
keagamaan, tetapi akal terbatas untuk memikir tentang zat Allah. Pemikiran
semacam ini lebih cenderung kepada paham tradisionalis dalam Islam. Jadi wahyu
berfungsi sebagai informasi tentang hal-hal yang akal tidak dapat memikirkannya.
Gusti Haji Abdul Muis menyatakan bahwa manusia bebas untuk
menentukan perbuatan baik dan buruk, serta bukan ditentukan oleh Allah SWT.
Pemikiran semacam ini sesuai dengan kalam rasionalis dalam Islam, yaitu bahwa
manusia bebas berbuat dan berkehendak. Gusti Haji Abdul Muis menyatakan
bahwa Ahlussunnah wal Jama’ah adalah orang Islam yang selalu berpegang teguh
kepada al Qur’an dan Hadits yang shahih. Pemikiran seperti ini sesuai dengan
pendapat aliran salafiyah, yaitu memurnikan ajaran Islam sesuai dengan al Qur’an
dan al Hadits.
Tujuan pendidikan aqidah yang Muis laksanakan adalah membentuk
aqidah tauhid yang kuat, yakni mengesakan Allah dan menjauhkan diri dari
kemusyrikan. Materi pendidikan akidah menurut Gusti Haji Abdul Muis berkisar
tentang ketauhidan. Metode pendidikan Akidah Gusti Haji Abdul Muis adalah :
metode ceramah, metode diskusi, metode keteladanan , metode kisah
Konsep pendidikan akhlak Gusti Haji Abdul Muis adalah pembersihan
jiwa atau tazkiyyatun nafs, Gusti Haji Abdul Muis lebih menekankan pada usaha
pembersihan jiwa (tazkiyyatus nafs). Tujuan pendidikan akhlak yang ingin dicapai
oleh Muis adalah untuk mewujudkan atau menjadikan akhlak yang mahmudah
melekat dan menjadi sifat dan sikap dalam hidup dan kehidupan kaum muslimin.
Materi pendidikan akhlak yang paling ditekankan dan paling sering diajarkan atau
didakwahkan oleh Muis tentang cara mewujudkan akhlak yang mulia
(mahmudah) melalui pendidikan hati atau riyaadhah dengan tahapan takhalli,
tahalli, dan tajalli. Metode pendidikan akhlak yang Muis terapkan, yaitu :

It was first established in 1972 as the Office of Local Engineers, before evolving into the Department of Development and Maintenance in 1982. By 1994, it became the Office of Development and Maintenance. On September 15, 1995, recognizing the expanding responsibilities of both the Development and Maintenance Offices, they were reorganized and placed under the Chancellor's Office as separate entities to better manage their growing roles. The declaration of UITM as MARA Technology University in August 1999 further expanded the Maintenance Office's scope, aligning it more closely with the university's broader development efforts. In alignment with the vision of MARA University of Technology to achieve world-class recognition as a public institution, the Maintenance Office underwent a major restructuring and rebranding on January 4, 2006, becoming the Office of Facility Management. At the Permatang Pauh Campus, the Facility Management Office is divided into several specialized units, including the Administrative, Council, Project, Public, Electrical, and Mechanical units
Annotation of conceptual co-reference and text Mining the Qur'an
No full textThis research contributes to the area of corpus annotation and text mining by developing novel domain specific language resources. Most practical text mining applications restrict their domain. This research restricts the domain to the Qur'anic Text.
In this thesis, a number of pre-processing steps were undertaken and annotation information were added to the Qur'an. The raw Arabic Qur'an was pre-processed into morphological units using the Qur'anic Arabic Corpus (QAC). Qur'anic terms were indexed and converted into a vector space model using techniques in Information Retrieval (IR). In parallel, nearly 24,000 Qur'anic personal pronouns were annotated with information on their referents. These referents are consolidated and organized into a total of over 1,000 ontological concepts. Moreover, a dataset of nearly 8,000 pairs of related Qur'anic verses are compiled from books of scholarly commentary on the Qur'an. This vector space model, the pronoun tagging, the verse relatedness dataset, and the part-of-speech tags available in QAC all together served for a number of Qur'anic text mining applications which were rendered online for public use. Among these applications: lemma concordance, collocation, POS search of the Qur'an, verse similarity measures, concept clouds of a given verse, pronominal anaphora and Qur'anic chapter similarity.
Furthermore, machine learning experiments were conducted on automatic detection of verse similarity/relatedness as well as categorization of Qur'anic chapters based on their chronology of revelation. Domain specific linguistic features were investigated to induct learning algorithms. Results show that deep linguistic and world knowledge is needed to reach the human upper bound in certain computational tasks such as detecting text relatedness, question answering and textual entailment. However, many useful queries can be addressed using text mining techniques and layers of annotations made available through this research. The works presented here can be extended to include other similar texts like Hadith (i.e., saying of Prophet Muhammad), or other scriptures like the Gospels

serious consideration in any future legislative reform of laws in Malaysia. Islam being
the religion of the country and the strong religious sentiment of the Muslims (who
form the majority in Malaysia) cannot be overlooked or dismissed lightly by the
legislators in Malaysia. Reformation of intellectual property laws is timely, as we are
now approaching to the dateline set by GATF-Trips agreement which aim is to
improve our standard of intellectual property protection. This study seeks to analyze
and evaluate the current legislation pertaining to intellectual property in Malaysia in
terms of the philosophy and rules governing the existence, ownership and exercise of
these rights and their consistency and inconsistency with Islam and Islamic law. The
main objective of this study is to prove that a coherent and logical conceptual
framework of ownership of intellectual property can be derived from an Islamic
perspective which not only offers the basis of rights but also defines the scope of
these rights. From the point of ownership of rights, support can be obtained from the
normative framework of property rights within the traditional classification of 'mal'
(property) and 'haqq al-milkiyyah' (ownership rights) under Islamic law. From the
point of exercise of rights, the exact scope can be defined from the analysis of
fundamental concepts which have been developed by Muslim jurists. It has been
established that Islam and Islamic law offers a sound and systematic paradigm, which
in deeper analysis, can satisfy both our current obligations under international
treatises, as well as our responsibility to practise our religion to the fullest

Maulana Shaykh TGKH. Muhammad Zainuddin Abdul Madjid has many santri and santriwati in West Nusa Tenggara, even the archipelago under the Nahdlatul Wathan organization who faithfully practice his teachings and even his advice. Problems arise when his students are constrained by distance and time who want to read the books of his teacher. Therefore the author provides a solution with the Digitization of TGKH Works. Muhammad Zainuddin Abdul Madjid is based on mobile as an interactive learning medium for the preservation of the legacy of the founder of Nahdlatul Wathan. That will help his students who in fact do not have the book and are hindered by distance and time. barang yang dijual kepada pembeli tetapi tidak disertai dengan penyerahan hak milik
dengan suatu perjanjian, Setelah kredit dibayar penuh oleh pembeli saat itulah ia
memperoleh haknya secara penuh, baik untuk memiliki maupun untuk memindahkan
barang tersebut kepada pihak ketiga.
Apabila salah satu pibak tidak memenuhi atau melaksanakan isi dari
perjanjian tersebut maka inilah yang disebut wanprestasi. Adapun yang menyebabkan
timbulnya wanprestasi adalah karena kelalaian atau kesengajaan debitur maupun
karena keadaan memaksa atau tidak beralasan. Khusus dalam hal keadaan memaksa,
selain keadaan itu diluar kekuasaan debitur, dapat juga suatu keadaan yang tidak
dapat diketahuinya pada saat waktu dibuatnya perjanjian itu setidak-tidaknya
resikonya tidak dipikul oleh debitur misalnya bencana alam.

debitur setelah kreditur memberikan batas waktu tertentu (batas jatuh tempo kredit).
Sebelum akhirnya kreditur menarik Yamaha yang di jadikan sebagai jaminan dalam
perjanjian tersebut. Hal ini sesuai dengan isi perjanjian jual beli yang telah disepakati
kedua belah pihak dan disinilah kreditur dapat menjualnya kembali kepada pihak
ketiga untuk mengambil keuntungan dari kerugian yang ia derita
