In brevi quasi tabella: immagini e strategie retoriche nella storiografia di Floro
[Italiano]: L’opera storiografica di Floro è sempre stata considerata una sintesi della più ampia narrazione di Livio, sebbene riorganizzata in funzione di una maggiore efficacia narrativa all’interno di una visione “biologica” della storia. Il racconto, tuttavia, è costruito attraverso una serie di strategie che l’autore stesso sintetizza nella praefatio, dove dichiara di voler operare come “coloro che dipingono i luoghi della terra”, comunicando così al lettore l’adozione di una precisa scelta di metodo. L’analisi di questo testo dimostra infatti che, anche sacrificando l’esattezza del dato storico, la cura dell’autore è rivolta a rendere la storia di Roma dalle origini ad Augusto un percorso coerente che giustifichi l’impero, “visibile” attraverso un criterio narrativo “evolutivo” tracciato dai passaggi delle diverse aetates, ma anche “geografico”, in linea con la politica espansionistica romana. L’unica interruzione è costituita dal racconto delle guerre civili accorpate per esigenza di chiarezza tutte nel secondo libro, dall’età dei Gracchi in poi, con una nuova strategia, che infrange l’andamento cronologico a tutto vantaggio di una sofferta riflessione etica. Il volume evidenzia anche le specifiche soluzioni formali adottate nel corso del racconto: la metafora, l’intervento diretto dell’autore che commenta fatti e personaggi o inserisce domande ed esclamazioni creano una sintesi originale di storia e retorica, finalizzata ad ottenere il consenso del lettore, sull’onda dei meccanismi declamatori fortemente sedimentati in un testo a cui va restituito il giusto valore letterario
./[English]: Florus’ work has always been regarded as a summary of Livy’s broader narrative, reorganized around a “biological” conception of history to become more effective. The design of his historical account, however, is the result of a series of strategies outlined by the author himself in his praefatio. There Florus reveals his methodology to the reader by declaring that he intends to operate like “those who paint the regions of the earth.” My analysis of this work shows that Florus sacrifices the accuracy of historical information in order to present the Roman history from the origins to the Augustan age as a coherent trajectory that justifies the Empire. On the one hand, this path is made “visible” through the use of an “evolutionary” narrative pattern, characterized by the transition between different aetates; on the other hand, it can be defined as “geographical,” for it mirrors the Roman imperialistic expansion. The only break in this linear narrative is the account of the civil wars from the age of the Gracchi onward, recounted all together in Book 2 for the sake of clarity. In this case Florus employs a new strategy, that shatters the chronological arrangement of the material to privilege the discussion of agonizing ethical considerations. This monograph also examines the stylistic choices adopted by Florus throughout his narrative. The use of the metaphor and the direct intervention of the author, who comments on particular events or characters, inserting questions and interjections, create an original synthesis of history and rhetoric that aims at gaining the reader’s approval. Florus’ resorting to techniques commonly employed in declamations speaks to the artistic value of his work
Landscape Archaeology in the Ager Telesinus: Scientific Results and Land-Use Planning
This paper is focused on the territories of San Lorenzello, Guardia Sanframondi and Cerreto Sannita (district of Benevento, Campania), in the eastern area of the Ager Telesinus, along the route to the Apennines mountains through the Volturno, Titerno and Calore valleys. The research
is related to the Project of the Archaeological Map of the Northern Campania, coordinated by S. Quilici Gigli. This territory has important archaeological
risk, as archaeological records testify, including hill-forts with polygonal walls, the town of Telesia, the necropoleis and the ruins of the villae in the
suburbium. The current expansion of the survey to both the eastern and western sectors offers a larger point of view to analyse wide-ranging topics such
as the pre-Roman settlement and the interregional roads. New data are emerging on the prehistoric and protohistoric ages in the territory of Guardia
Sanframondi, in the wide alluvial area closest to the Calore River. In the territory of San Lorenzello and Cerreto Sannita, new data was been collected
by the author on a settlement of the pre-Roman times in the zones overlooking the Titerno valley. Studies and surveys in this area have had operating
implications. Maps of archaeological risk, based on the archaeological map of the Ager Telesinus, were produced, thanks to collaboration between the
University, Soprintendenza per i Beni Archeologici and the local Government, with the goal of creating a common strategy for land-use planning

The paper illustrates the main allegations that have led the European Commission to start an investigation against Google for abuse of dominance. These are related to the manipulation of Google's algorithm; the imposition of exclusivity clauses in contracts with web- publishers and advertisers; behaviour aimed at preventing advertisers from investing in alternative platforms; and refusal to deal with rivals. The paper discusses the likely outcome of the case, as well as the impact that the Commission's decision might exert on the future of competition on the Internet. The paper casts rather dark shadows on the current application of antitrust in cyberspace, which seems even more problematic today than it was already in 2004, when the Commission adopted its controversial decision in the Microsoft case. At the same time, the author argues that the ongoing quest for neutrality and pluralism on the Internet should be neither subject to extremist pro-regulatory stances, nor left exclusively to the remit of antitrust law

The Amphiteater of ancient Capua becomes pervasive environment because of personal devices like tablets and smart-phones, which are able to detect and explain ruins, artifact and points of cultural interest by their on-board peripherals. By modeling an archaeological site as a pervasive environment we are able to improve its exploitation by the visitors. The author present, by a relevant case study of the Campano Amphitheater, a framework that supports experts in the domain of the Cultural Heritage to augment the archaeological site with a set of multimedia contents, which are delivered by innovative services to the visitors in order to guide their tour and to enhance their perception of the reality
Legal and Economic Approach to Tying and Other Potentially Unfair and Anticompetitive Commercial Practices: Focus on Financial Services
This paper analyses the economic and legal aspects related to practices such as tying, bundling and other potentially unfair commercial practices widely used in the financial services industry. Authors draw special attention to the European financial services market. Their law and economics approach aims at illustrating the rationales for applying both antitrust and consumer protection legislation to the practices subject to analysis in this paper and observed in the retail financial services market. The author explores the main findings of the legal and economic theory as regards the applicability of antitrust rules to the practices at hand, and the possibility to treat new commercial practices under antitrust law. The paper then illustrates the economics of tying, bundling and other unfair commercial practices from a consumer policy perspective, and reports some empirical data on switching costs and patterns of consumer behaviour in retail financial services and in other sectors of the economy. Cognitive biases that may cause irrational behaviours in judgement and decision-making processes of a retail consumer are widely assessed. Finally, the author proposes a new multi-stage test for the joint assessment of selling practices under competition and consumer policy
Lo scambio di embrioni e il dilemma della maternità divisa
La nota esamina criticamente l’ordinanza cautelare del Tribunale di Roma 8 agosto 2014, relativa ad un caso di scambio di embrioni verificatosi nel corso della sottoposizione da parte di due coppie a tecniche di PMA omologa in vitro. Mentre il Tribunale assume che secondo l’ordinamento vigente la maternità spetti alla donna che ha partorito i gemelli, l’autore ritiene che si sia in presenza di una lacuna normativa, da colmare attraverso un principio generale dell’ordinamento. Dopo aver argomentato l’impossibilità di dimostrare la prevalenza tanto del criterio del parto quanto di quello genetico nell’identificazione della maternità, propone conseguentemente di risolvere il caso riconoscendo lo status di madre sia alla donna che ha partorito che a quella alla quale è riferibile il contributo genetico.This note to judgement examines in a critical way the provisory measure issued by the Court of Rome (August 8th, 2014) on a case of mistaken embryos, occurred while two couples were undergoing homologous in vitro fertilization. While the Court assumes that under the laws in force the woman who gave birth to the twins is entitled to be recognized as the mother, the A. holds that in this case the legal system shows a regulatory gap, to be filled through a general principle. Having argued the impossibility of proving that the criterion of childbirth prevails over the genetic one, and vice versa, in order to identify motherhood, the author consequently proposes to solve the case by granting the status of legal mother at the same time to the woman who gave birth to the children and to the one to whom the genetic contribution refers
La media valle del Volturno al tempo di Annibale: la ricostruzione del paesaggio storico attraverso le ricerche per la Carta archeologica della Campania nei territori di Caiatia e Telesia
Il contributo si incentra sui territori amministrati in epoca romana dai centri di Caiatia (attuale
Caiazzo, CE) e Telesia (in territorio di San Salvatore Telesino, BN), per i quali si considerano le testimonianze, letterarie e archeologiche, databili durante gli anni della seconda guerra punica.
In area telesina le differenti versioni di Livio e Polibio circa la presa di Telesia da parte di Annibale
nel 217 a.C. vengono esaminate alla luce dei dati archeologici a disposizione.
Nel territorio caiatino si considera la complessa situazione poleografica di fine II secolo a.C. e le
novità emerse in seguito a recenti ricognizioni di superficie circa l’esistenza di aree sacre nei siti fortificati d’altura e la presenza di votivi anatomici, nell’ambito dell’ampia discussione sul significato, anche
politico, di questo tipo di oggetti.This paper focuses on the territories of Caiatia (Caiazzo, district of Caserta) and Telesia (S. Salvatore
Telesino, district of Benevento) during the Second Punic War. The author analyses the different versions
of Livius and Polibius regarding the conquest of Telesia on the part of Hannibal in 217 BC, and compares
them by employing archaeological data.
Concerning the territory of Caiatia, the settlement in the second half of the 2nd century BC is considered. In particular, new data provided by a recent survey on the presence of sacred places in correspondence
of the hill-forts of Monte S. Croce and Monte Alifano are examined. The article also takes into account the
anatomical votives which are part of a larger discussion on the general and political significance of these
objects in the ancient world
