    L'article s'inscrit dans le dossier thématique "Politiques du père" de la revue Lien social et politique - RIAC. L'auteur présente un aperçu de la manière dont se pose, en Belgique, la question « Qui doit nourrir l'enfant dont le père est absent ? », à la fois sur le plan socio-démographique et sur le plan politique et juridique. Après avoir tenté d'évaluer l'ampleur du phénomène des familles monoparentales matricentrées dans la Belgique contemporaine, il traite de la problématique au regard du droit civil puis du droit social. Il présente le dispositif public de lutte contre la pauvreté qui se met en œuvre, notamment, vis-à-vis des ménages à père absent confrontés à une situation de précarité sociale, et essaie de cerner le rôle joué par le départ du père dans la précarisation sociale des familles monoparentales matricentrées.Who is Responsible for Supporting the Child When the Father is Absent? The situation in Belgium The author of this paper outlines socio-demographic, political and legal issues in Belgium linked to the question of "who is responsible for supporting the child when the father is absent ?" After trying to assess the scope of the phenomenon of mother-headed single-parent families in Belgium today, he looks at the issues from the perspective of civil and social law. He examines current government measures to combat poverty, especially those targeted to households with an absent father that are faced with a precarious social and financial situation, and he attempts to determine the role the departure of the father has played in the increasingly precarious situation of mother-headed single-parent families

    Līdz ar grozījumiem Komerclikumā likumdevējs Latvijas tiesību sistēmā ir ietvēris komersanta aizturējuma tiesību, vienlaikus aktualizējot arī aizturējuma tiesības piemērošanu. Diemžēl aizturējuma tiesības institūta izpratne Latvijas tiesību zinātnē skaidrota ir ļoti maz, līdz ar to rodas problēmas ar tās piemērošanu praksē. Ņemot to vērā, darba autors izvirza mērķi izskaidrot aizturējuma tiesības izpratni atbilstoši mūsdienu privāttiesību tendencēm un rast risinājumu ar komersanta aizturējuma tiesības piemērošanu saistītajai tiesību problemātikai. Darbā autors analizē aizturējuma tiesības institūtu veidojošos elementus un izdara secinājumus par to pareizu piemērojamību, skatoties arī caur ārvalstu tiesību zinātnes prizmu. Vienlaikus autors sniedz priekšlikumus arī komersanta aizturējuma tiesības piemērošanas efektivitātes uzlabošanai.With the amendments in the Commercial Law, the legislators have included the merchant’s lien, simultaneously actualizing the lien enforcement. Unfortunately, the purpose of lien in the Latvian law science has been explained poorly, thus creating problems in its application in practice. Taking this into account, the author aims to clarify the purpose of lien according with the modern trends of Private Law and to find solutions to the problems related to the application of merchant’s lien. The author analyzes the elements of the lien and draws conclusions about their proper application, looking through the prism of the foreign law science. Meanwhile, the author provides suggestions to increase the efficiency of the merchant’s lien

    The Maryland General Assembly recently enacted a new mechanics\u27 lien statute in response to a Maryland Court of Appeals decision which held that portions of the former mechanics\u27 lien were incompatible with the due process clauses of the Maryland Declaration of Rights and the fourteenth amendment to the Constitution.     Im Zuge vielfältiger lokaler Aktivitäten durch die erhöhte Zuwanderung geflüchteter Menschen im Jahr 2015 stellen sich Fragen der Aufgabenverteilung im Umgang mit Mig- ration. In vielen Kommunen fand eine Verantwortungsteilung unterschiedlicher Akteurs- gruppen statt. Hintergrund sind staatliche Wandlungsprozesse, die auf eine Mitwirkung zivilgesellschaftlicher und wirtschaftlicher Akteur*innen abzielen, um Aufgaben in in- tegrationsrelevanten Bereichen zu verteilen. Dies verstärkt sich noch mit Blick auf unter- schiedliche Raumtypen. Gerade in ländlichen Räumen ist die Bedeutung zivilgesell- schaftlicher Aktivitäten hervorzuheben und die Kommunen versuchen diese durch lokale Governancestrukturen zu steuern um Aufgaben zu verteilen. Die Ausgestaltungen kommunaler Verantwortungsteilung im Umgang mit Migration in ländlichen Räumen zeichnen dabei ein heterogenes Bild. Trotz Aufgabenzuweisung und Rahmensetzung im politischen Mehrebenensystem, nehmen die Kommunen eigene Ge- staltungsspielräume wahr. Hinzu kommt, dass Deutschland sich erst Ende der 1990er Jahre zu einem Einwanderungsland bekannte und somit viele Kommunen in der Vergan- genheit ihre je eigenen Entwicklungspfade eingeschlagen haben. Aktuelle Forschungsar- beiten verweisen daran anknüpfend auf den Bedarf, Erfahrungen im Umgang mit Migra- tion als Einflussfaktor auf die gegenwärtige Ausgestaltung zu betrachten. Aufbauend auf dieser Forschungslücke erarbeitet die vorliegende Dissertation einen theoretisch-konzep- tionellen Zugang, wie Erfahrungen zum Aufbau von Institutional Capacity und damit zum Aufbau gemeinsamer Handlungsfähigkeiten durch lokale Governance führen können. Ziel der Arbeit ist es neben der Erarbeitung des theoretisch-konzeptionellen Rahmens Implikationen für die Praxis zu erarbeiten, wie an vergangenen Erfahrungen angeknüpft werden kann und welche Bedeutung Erfahrungen für die lokale Verantwortungsteilung im Umgang mit Migration haben können. Dazu wurde eine qualitative Einzelfallstudie anhand einer migrationserfahrenen Gemeinde im ländlichen Raum Niedersachsens durchgeführt. Durch die Kombination einer Dokumentenanalyse im zeitlichen Längs- schnitt ab dem Jahr 1945 bis in die Gegenwart wurden Aktivitäten und Strukturen im Umgang mit unterschiedlichen Migrationsformen untersucht. Die ergänzenden Ex- pert*inneninterviews eröffneten eine zusätzliche Perspektive auf gegenwärtige Gover- nanceprozesse und damit auf Rollen- und Aufgabenverteilungen. Als zentrale Erkenntnis konnte herausgearbeitet werden, dass im Jahr 2015 an vergangene Erfahrungen angeknüpft werden konnte. So konnte auf gemeinsames Wissen, Strukturen und Mobilisierungsfähigkeit zurückgegriffen werden. Im zeitlichen Verlauf zeigte sich, dass eine Zunahme der Machtressourcen der Kommune und Hinzukommen weiterer öf- fentlicher Akteure dazu führte, dass die Zusammenarbeit mit zivilgesellschaftlichen Akt- euren und damit die lokale Governance nicht mehr fortgeführt wurde. Erfahrungen stellen nunmehr ein Potenzial für Institutional Capacity im Umgang mit Migration dar. Schluss- endlich bietet die vorliegende Arbeit einen Zugang dahingehend, wie Verantwortungstei- lung durch lokale Governance im Umgang mit Migration an vergangenen Erfahrungen im Sinne des Aufbaus von Institutional Capacity anknüpfen kann. Aus den Erkenntnissen werden Implikationen für die Praxis abgeleitet. Die Arbeit schließt mit einem Ausblick auf weiteren Forschungsbedarf ab.In the course of diverse local activities due to increased immigration of refugees in 2015, questions about the distribution of responsibilities in dealing with migration arise. In many municipalities, a division of responsibility between different groups of actors has taken place. The background to this is the process of change in the state, which aims to involve civil society and economic actors in distributing tasks in areas relevant to inte- gration. This becomes even more important when looking at different types of regions. Especially in rural areas, the importance of civic activities is to be emphasized and the municipalities try to steer them through local governance structures in order to distribute tasks. The arrangements of municipal responsibility in dealing with migration in rural areas paint a heterogeneous picture. Despite the allocation of tasks and the setting of frame- works in the political multi-level system, municipalities exercise their own scope for ac- tion. In addition, Germany only became a country of immigration at the end of the 1990s, so many municipalities have taken their own development paths in the past. Current re- search points out the need to consider experiences in dealing with migration as a factor influencing the current design. Building on this research gap, this dissertation develops a theoretical-conceptual approach to how experiences can lead to the development of insti- tutional capacity and thus to the development of shared capacities for action through local governance. In addition to that, the aim of the thesis is to elaborate practical implications, on how past experiences can be built upon and what meaning experiences can have for the local division of responsibility in dealing with migration. To this end, a qualitative single-case study was conducted on the basis of a community in rural Lower Saxony with experience in international migration. By combining a document analysis in a longitudi- nal temporal section from the year 1945 to the present, activities and structures in dealing with different forms of migration were investigated. The supplementary interviews with experts opened up an additional perspective on current governance processes and thus on the distribution of roles and tasks. The key finding was that it was possible to build on past experiences in 2015. This meant that it was possible to draw on shared knowledge resources, relational resources and ca- pacity for mobilisation. In the course of time, it became apparent that an increase in power resources of the municipality and the addition of further public actors led to the fact that the cooperation with civil society actors and thus local governance led to an end in coop- eration between civil society and local governance. Experiences now represent a potential for institutional capacity in dealing with migration. Finally, this paper offers an approach to how the division of responsibility through local governance in dealing with migration can build on past experiences in the sense of building institutional capacity. Implications for practice are derived from the findings. The paper concludes with an outlook on the need for further research

    Carrier's statutory lien and new Civil Code of the Republic of Serbia

    Na početku rada, izlažu se pojam i opšti i posebni pravni režim prevoziočevog založnog prava po osnovu neplaćene prevoznine. Nakon toga, razmatra se pravna priroda ovog prava u smislu da li je ono po svojsvtima bliže klasičnom zakonskom založnom pravu ili, pak, pravu zadržavanja. Autor u radu predlaže drugačiji pravni režim prevoziočevog založnog prava u odnosu na postojeći. Naime, predlaže se da u Građanskom zakoniku bude regulisan samo ugovor koji zaključuje privatni, a ne i javni prevozilac. S obzirom da privatni prevozilac nije dužan (poput javnog) da zaključuje ugovor o prevozu sa svakim trećim licem, on je u mogućnosti da proceni solventnost i dobronamernost naručioca prevoza. Suprotno, zbog učestalosti, brzine i načina zaključenja ugovora (po pristupu), to nije u stanju javni prevozilac, pa mu se zbog toga i daje zakonsko založno pravo kako bi ga zaštitilo u slučaju kada mu nije plaćena prevoznina.In this article, the author makes difference between common and contract carrier. Common carrier is the subject in law which has obligation to conclude the contract (of carriage) with, practically, everybody, provided that he has material capacity, ability to do carriage in particularly moment of conclusion of contract. Having this difference in mind, the author proposed new legal regime regarding carrier's lien in New Civil Code of Serbia. It is suggested that common carrier has a lien, but contrary to him, that contract carrier shouldn't have. Justification for this proposition is based on (legal) fact that common carrier doesn't have a freedom to choose his (opposite contractor) and because of that, he has to be protected with statutory lien. In the second part of article, the author analyzes the legal nature of carrier's lien. On the one hand, it is the right of retention, but on the other, it is a classical statutory lien. In accord with non-possessory nature of statutory lien, the author concludes that carrier's lien in current Serbian legal regime is, in fact, right of retention, especially because in Serbian legal system this right is supplied with right to sale (reserved thing). The author is of opinion that carrier's statutory lien should (stay) be non possessory, despite of uncertainty which carrier (or other merchant) has statutory lien regarding in particularly thing. This uncertainty would be removed with optional registration at commercial registry

    The Purchase Money Security Interest and Federal Tax Lien: A Proposal for Legislative Change

    When Congress enacted the Federal Tax Lien Act of 1966, it sought to conform federal tax lien provisions to the security interest provisions in the Uniform Commercial Code. Notably, the Act did not contain a provision granting a superpriority to purchase money security interests. This Article examines the historical and analytical justifications for the enactment of such a purchase money superpriority. The author then proposes a legislative amendment that would establish the superpriority, and discusses the expected salutory effect of such a change on the interpretation and application of the Federal Tax Lien Act

    California Civil Code Section 3264 and the Ghost of the Equitable Lien

    Construction lenders in California have long been haunted by the judicially created equitable lien, by which contractors and materialmen have been permitted to gain security for unpaid work while evading established statutory procedures. Civil Code section 3264 is the most recent statute enacted by the California Legislature in its effort to quash the equitable lien; nonetheless, claimants persist in attempting to resurrect this nonstatutory remedy, and the trial courts have proven reluctant to move forcefully against it. The author contends that the mandate of Civil Code section 3264 is sufficiently unambiguous to require that the California courts bury the spectre of the equitable lien once and for all
