    Intellectual property laws and Islam in Malaysia.

    PhDThis study is undertaken on the premise that Islam and Islamic law is to be taken into serious consideration in any future legislative reform of laws in Malaysia. Islam being the religion of the country and the strong religious sentiment of the Muslims (who form the majority in Malaysia) cannot be overlooked or dismissed lightly by the legislators in Malaysia. Reformation of intellectual property laws is timely, as we are now approaching to the dateline set by GATF-Trips agreement which aim is to improve our standard of intellectual property protection. This study seeks to analyze and evaluate the current legislation pertaining to intellectual property in Malaysia in terms of the philosophy and rules governing the existence, ownership and exercise of these rights and their consistency and inconsistency with Islam and Islamic law. The main objective of this study is to prove that a coherent and logical conceptual framework of ownership of intellectual property can be derived from an Islamic perspective which not only offers the basis of rights but also defines the scope of these rights. From the point of ownership of rights, support can be obtained from the normative framework of property rights within the traditional classification of 'mal' (property) and 'haqq al-milkiyyah' (ownership rights) under Islamic law. From the point of exercise of rights, the exact scope can be defined from the analysis of fundamental concepts which have been developed by Muslim jurists. It has been established that Islam and Islamic law offers a sound and systematic paradigm, which in deeper analysis, can satisfy both our current obligations under international treatises, as well as our responsibility to practise our religion to the fullest

    Dakwah has another meaning namely, religious broadcasting, calls to embrace, study and practice religious teachings. While the meaning of preaching is to invite or call for learning and practicing religious teachings. The main purpose of da'wah is to make people always follow His way so that happiness in this world and in the hereafter is blessed by Allah SWT. The da'wah values that we want to examine are from previous Islamic figures, one of whom is Sultan Muhammad Al-Fatih in a book by DR. Ali Muhammad Ash-Shallabi is known for his preaching methods which are synonymous with war, but if studied more deeply Al-Fatih also carried out various kinds of humanist preaching methods, full of wisdom (al-hikmah) which proved to be efficient in his time. In this study using the approach of Content Analysis, namely research that is in-depth discussion of the contents of a written or printed information in the mass media. This type of research is using qualitative research, namely to describe various situations in the form of phenomena, conditions, and situations that exist in the community which are the object of research. The data source here uses primary data obtained directly from the original source and secondary data obtained indirectly through intermediary media. The data collection technique used by the author in this study is the documentation technique. The data analysis used is Content Analysis, namely by analyzing a document in the form of written works, books, films, pictures, biographies, letters, newspapers, magazines, bulletins and others. From the results of this study, it is known that Sultan Muhammad Al-Fatih carried out da'wah activities namely, with worship activities towards schools and institutes, worship activities towards translation activities, worship activities towards government management and worship activities towards the army and navy. Then from the da'wah of social behavior, namely, social behavior towards scholars, social behavior towards poets and writers, social behavior towards prosperity, development and hospitals, social behavior towards trade and industry and social behavior towards justice

    Family's Messengers Stories of Ulul Azmi in The Quran (A Thematic Interpretation)

    This thematic study has based on the verses about the stories (Qaṣaṣ), the kind is the story of the Ulul Azmi messengers. Ulul Azmi messengers are the five prophets who were special by Allah as in Q.46:35, Q.33:7, and Q.42:13. They are messengers who have the high determination and patience in fighting for the Allah’s religion. A messenger was a usual people who certainly lives in a family, they have parents, wives, and children. Whether the special degree that they get was also supported by family support or even their own family which be test for themselves, because defiance or denial of the Allah law. So, how does the Quran explained their family stories and their position as part of a family? This question will be tried to be answered in this thesis research. The research method is the thematic method (Mauḍū‘ī Method) which is presented based on the description and analysis of the Quran’s verses about family’s messengers stories of ulul azmi as primary data, would be taking from the interpretations of several commentaries book collected and then analyzed carefully by author, after that complement data from histories books and stories of the prophets books and other related readings. Family’s messengers stories of Ulul Azmi becomes interesting because their family members were not fully obedient people. The Prophet Nuh was preached for 950 years but only a few of people were believers, and among those who did not believe were his wife and child. The Prophet Ibrahim has a father who a carver of idol and he had to awaken his father to follow a straight path, but his father was still stubbornly opposed. Then, Ibrahim married Sarah, then remarried a slave named Hajar. From Hajar he obtained a child named Ismail and from Sarah even they were old, God gave Ishaq to them. And all of the prophets after Ibrahim came from the generations of Ismail and Ishaq. The Prophet Musa, a baby born in the age of a boy must be killed, but Allah gave inspiration to his mother to make a chest and wash it in the Nile, until the chest beyond the king’s unjust palace, he was even cared and becomes king’s foster son. He fled to Madyan, and then he married a shepherd girl. The Prophet Isa was born from the holy girl was a servant of Baitul Maqdis, since his birth his mother had been bombarded with various heinous accusations because puerperal a baby without marriage, so Isa who was still in the cradle spoke and explained to his peoples to defend his mother. The Prophet Muhammad tested when his wives demanded more shopping, and he could only leave them for one month until the verse came down to this problem. There are some verses of the Quran concerned his wives, they are Khadijah, Aishah, Hafṣah, and Zainab. Based on the results of analysis was getting family’s messengers stories of Ulul Azmi that not all of them was obedient people, some were pious and some were disbelieved to died. Each family’s messengers stories tucked many valuable lessons, about the piety of the parents who descend to their children, family relations in hereafter, family functions, responsibilities as parents, the good children, to obedience and betrayal of a wife.     High-pressure Solubility of Carbon Dioxide in Aqueous Sodium L- Prolinate Solution

    AbstractAn experimental evaluation of CO2 solubility in aqueous sodium L-prolinate (SP) solution was carried out using high-pressure solubility equipment at three different temperatures, 303.15, 313.15, and 333.15K. The study was conducted over the pressure range from 2 to 60bar for 30wt. % SP solution. It was found that, the CO2 loading (mole of CO2 / mole of SP) decreases with increasing temperature, while it increases with increasing the pressure of gas. ANOVA analysis was carried out to determine the statistical significance of the solubility data with respect to temperature and pressure. The CO2 loading of aqueous SP solution was also compared with MEA and aqueous sodium glycinate (SG) solution. It was observed that the aqueous SP solution has higher CO2 loading capacity as compared to 30wt. % MEA, and comparable with aqueous 30wt. % SG solution

    Astrology in literature: how the prohibited became permissible in the Arabic poetry of the mediaeval period

    This thesis is concerned to position the art of astrology within the context of classical Arabic poetry, primarily by investigating and elucidating attitudes to the notion of qadar (fate) and the ideology in which it was embedded. These attitudes were revelatory of the broader world view of the Arabs of those periods, and their shifts from those held in the pre-Islamic and early Islamic eras tell us a good deal about the importance given to the nature and role of fate and about the various understandings of its influence. The pre-Islamic Arab's notion of qadar was in some ways similar to that of the early Muslims: both emphasised predetermination and the irresistible power of fate. But while the jahilf (Pre-Islamic) Arabs identified fate with the malign power of dahr (Time), the Muslims believed the power of fate lies in the hands of God the Omnipotent, who alone is responsible for the fate of the whole universe. Thus the astrology of the pre-Islamic era was one aspect of divination (kihana) and claimed to be able to reveal in advance an individual's destiny, which could be avoided by taking certain precautions. These precautions, however, were considered effective only in relatively trivial cases; they were useless in the areas of major impact: a person's happiness or misery (shaqiiwa aw sa ada), sustenance (rizq) and one's term (ajal), the three inevitable and irresistible manifestations of fate. In the Islamic period not only these major aspects of life are governed and controlled by the Omnipotent; the destiny of the universe, in even its most minute details, is determined and controlled by God alone. Astrology was considered to be of no value whatsoever, and its practitioners were subject to the death penalty. These two irreconcilable views are evident in early Islamic poetry, which reflected clearly the response of poets, and society, to astrology from the perspective of qadar. When the orthodox caliphate was replaced by dynastic rule the status of astrology was changed dramatically. The idea that the stars, as indicators, play a role in the life of human beings found popowerful supporters in some governors of the Islamic world, who allowed astrology to fulfil a public function regardless of the hostility of the official religion of that society. This social phenomenon generated rich material of a controversial character in the realm of literature. Investigating the factors, motivations and impact of mediaeval political, theological and philosophical attitudes to astrology, in relation to the notions of free will and predestination, is the concern of this study

    Penggunaan bahan bantu mengajar (BBM) dalam pengajaran dan pembelajaran memberikan kesan yang positif sepanjang pengajaran guru. BBM juga mampu untuk menarik minat serta menggalakkan pelajar memberi penumpuan sepenuhnya terhadap topik pengajaran guru ketika berlakunya proses P&P. Bagi guru-guru Pendidikan Islam khususnya, pendidikan Rasulullah s.a.w. mestilah dijadikan contoh kerana baginda adalah sebaik-baik role model dalam segala aspek kehidupan. Tujuan dijadikan baginda s.a.w. sebagai model dalam pengajaran adalah untuk melahirkan roh islamiyyah terhadap guru-guru Pendidikan Islam dalam mendidik pelajar khususnya pelajar muslim. Gambaran pendidikan Rasulullah s.a.w. ini dilihat menerusi hadis-hadis sabdaan baginda yang dinukilkan oleh dua perawi hadis yang masyhur iaitu Imam Bukhari dan Imam Muslim. Maka kertas kerja ini ingin melihat BBM yang diaplikasikan oleh Rasulullah s.a.w. berdasarkan perspektif pengarang kitab al-Lu'Lu' wa al-Marjan, iaitu Muhammad Fuad Abdul Baqi dan dibataskan oleh pengkaji hanya kepada hadis-hadis yang berkaitan dengan ibadah khususiah. (English Translation: Use of teaching aids in teaching and learning have a positive impact throughout the lesson. Teaching aids are also able to attract and encourage students to concentrate fully on the topic of the teacher during a learning process. For teachers of Islamic Education in particular, Prophet p.b.u.h education be used as an example because he is the best role model in all aspects of life. Purpose made him p.b.u.h as a model of teaching is to inculcate the spirit Islamic Education teachers in educating students, especially Muslim students. Overview Prophet p.b.u.h education is seen through his hadiths that asserted by two famous narrators of Imam Bukhari and Imam Muslim.     The second peak of Muslim glory occurred during the reign of three great empires: the Ottoman, Safavid and Mughal Sultanates in India (Muhammad, 2015). During the reign of Murad I (3rd Ottoman Sultan) 761 AH/359 AD-789 AH/1389 AD, in 2018 he further expanded his territory to the European continent and strengthened internal security. At that time the Ottoman Turks were a nation that dynamic and has extensive knowledge supported by the Sultanate which has a strong army to expand its territory. The greatest success was that the Ottoman Turks managed to occupy the most strategic area, namely Constantinople, which was a strategic area for trade at that time which was located on land between the continents of Asia and Europe. This article aims to examine the cycle of collapse of the Ottoman Empire according to Malik Bennabi's philosophical theory of history. The method used by the author in this article is the historical research method. The historical method used in this article consists of four stages, namely heuristics, verification, interpretation and writing. The results of this research can be concluded that the factors causing the collapse of the Ottoman Turks are in line with Malik Bennabi's theory of civilization which states that the Islamic Ummah experienced modeling because it did not always renew its civilization. At that time, Ottoman Türkiye was satisfied with its glory and was seen as an Empire that was feared by the nation. The reforms that the Sultan wanted to carry out in the military sector at that time were rejected by the imperial army. Thoughts that were not developed and tended to be primitive and satisfied with the achievements that had been achieved were what brought weakness to various aspects of the Ottoman Empire
