LEGITIMASI AKAD DALAM TRANSAKSI EKONOMI ISLAM
Get PDFPeran akad dalam sebuah transaksi untuk melegalkan hubungan antara pembuat akad. Akad menentukan arah transaksi yang akan dilakukan, sah atau tidaknya sebuah transaksi begitupula sebuah transaksi yang mengandung hal yang diharamkan oleh syara` juga dapat dideteksi melalui akadnya. sehingga legitimasi yang dikandung dalam akad sangat urgen untuk dijelaskan. Tulisan ini menggunakan metode penelitian kualitatif yang dikumpulkan dari sumber-sumber yang valid. Data primernya dikumpulkan dari sumber-sumber yang otentik yang dijadikan sebagai rujukan dalam fiqih Islam, sedangkan data sekundernya dikumpulkan dari penelitian-penelitian yang telah diterbitkan oleh jurnal. Tujuan dari tulisan ini adalah untuk memberikan gambaran mengenai road map transaksi yang seharusnya ditempuh, dan membuat Pelaku akad tunduk pada karakteristik akad, sebagai legitimasi yang direkomendasikan oleh akad. Banyak kejadian dalam tataran fakta akad yang dilakukan berbeda dengan karakteristik akad, seperti: sewa menyewa rumah, kadang-kadang pemilik rumah mengusir penyewa tanpa persetujuan penyewa. Hasil dari peneltian ini, bahwa akad yang terjadi baik akad langsung (offline), tidak langsung (online) atau semi online, memiliki jenis dan skop tersendiri. Karakteristi yang ada dalam akad seharusnya menjadi acuan dalam menyelesaikan akad, sehingga legitimasi yang diberikan oleh akad dan syara` dapat dijalankan

No full textThe novel Inna Ma\u27al Ausri Yusra is one of the novels that will be discussed more deeply related to the value of faith. The values of faith that will be studied are related to divine values, prophecy, ruhiyat, and samiyat. The method of this research is library research using descriptive analysis method. Based on the results of the analysis of the divine aspect, the author describes Fatimah\u27s faith and piety who has experienced trials and tests. From the aspect of prophecy, the author describes it implicitly and explicitly in the story, about Fatima\u27s determination to achieve high faith even though trials and suffering always befall her, she is guided by the story of the Prophet Muhammad. From the rihiyyat aspect, there is a belief in this value. Azwar is wrong. He believes in spirits. He uses his knowledge to manipulate his patients to comply with their wishes. From the sam\u27iyat aspect, it is illustrated in the story through the Koran, there are five letters consisting of five hadiths that support the arguments of the Koran so that the story has a strong legal basis

No full textThis research was conducted based on Decision Number 134/Pdt.G/2023/PN Mdn, in which it was found that there was a denial of claim payment by the insurer to the policyholder. Therefore, the author analyzes the legal events with the following problem formulation: how the rights and obligations of the parties in the policy, how are the legal provisions governing defaults in claim payments on insurance policy agreements in Indonesia, , and how is the analysis of the judge's consideration in Decision Number 134/Pdt.G/2023/PN Mdn on defaults in claim payments on insurance policy agreements. The type of research used in this research is normative juridical legal research using secondary data. The writing of this research is descriptive by using a statue approach and case approach by using the rules that were in effect at the time the legal event occurred and the rules that apply at this time. The research conducted by the author produces conclusions, namely first, the rights and obligations of the parties in the insurance policy have an important role in maintaining balance and justice in the contractual relationship. Second, default in the payment of claims on insurance policy agreements in Indonesia is regulated by the Civil Code and also Law Number 40 of 2014 concerning Insurance. Third, the insurer is proven to have made a default to the policyholder and must pay the insurance claim as agreed in the insurance policy.114 pagesSkripsi Sarjan
