Analisis Hukum Mengenai Peran Indonesia dalam Kerangka Kerjasama Regional untuk Menangkal Praktik Dumping di Era Perdagangan Global: Studi Kasus Terigu Impor Turki (Oleh: Ariawan Gunadi)
International trade has experienced great growth in both developed and developing countries alike. Many conventions have been created for the purpose of regulating such international trade, most prominently under the organization known as The World Trade Organization (WTO). The WTO has set out some standards to create balance between its members such as countervailing duties for export-import activities and for the Indonesian government. This article attempts to view the ongoing case of countervailing duties on flour import from Turkey to Indonesia during 2008-2012 based on article IV section (2) GATT to analyze the legal basis of Indonesia’s act to remedy the dumping act done by Turkey and Article 12 (1) and Article 19 Acts Number 10 Year 1995 on Customs and Article 23A dan 23B Act Number 17 Year 2006 on Acts Number 17 Year 2006 on Amendment of Acts Number 10 Year 1995 on Customs as the national legal basis to determine the admission charge of antidumping act done by the Indonesian government. As a conclusion, the article sums up the development of antidumping regulation in WTO, the national law and role of Indonesian AntiDumping Committee in order to consider future import products that may be indicated as dumping products that affect the national market in Indonesia
Theoretical Review on Indonesian Academic Legal Education in Conjunction with ASEAN Economic Community Era
Indonesia will be welcoming the ASEAN Economic Community in 2015 as a multilateral agreement to create integrated regions such as: (a) a single market and production base, (b) a highly competitive economic region, (c) a region of equitable economic development, and (d) a region fully integrated into the global economy. These characteristics are interrelated and mutually reinforcing in a sense that overall development would not be complete without total completion of the previous sector. This article discusses the participation of Indonesia as part of ASEAN as a single market and production base, through free flow of services which targets higher education in law. The author researched that Indonesian higher education system still faces issues, especially in legal education. Compared to other states that manages higher education in a relatively guided term, Indonesian legal education is still regulated generally by the government, operated by state and private educational entity, and further trained by profession organization. Indonesian legal education standard has not been supported by proper accreditation bureaucracy from BAN-PT or fair treatment from the government between state and private university. As a result, the quality of Indonesian law graduate still varies. Indonesian legal education is special in nature since it is considered profession and regulated by code of ethic. According to the author, legal education should be integrated with profession organization so that upon graduation, law graduates can directly conduct internship according to their desired profession and compete against ASEAN law graduates
Juridical Analysis on the Copyright of Modification and Customization of Android Software
Abstract— Android is a mobile operating
system developed by Google. It is usually used by
several smartphones and tablets. The Android
System (OS) is an open source, meaning developers
can modify and customize the OS for each phone.
Despite the fact that the creator of the Android system
must have held the copyright on the appearance of
the software which he created. This issue raises the
problem: whether or not modifying and customizing
the appearance of the Android System will infringe
the copyright which is possessed by the holder. By
researching, the author would seek on the status of
the modified/customized Android Software and the
legal consequences of the modified and customized
Android System. The result of this legal research
lies in the agreement that is proposed to modifier
when they are about to download or install the
software itself (by clicking yes/accept). This legal
research is conducted by using normative legal
research methods, using library research as a data
collection technique and qualitative normative
techniques as a data analysis technique, by
juxtaposing legal theories as analytical knives.

Tanggungjawab Pejabat Pembuat Akta Tanah atas Pembatalan Akta Hibah
The land deed registrar has the authority to make authentic acts concerning certain legal acts or rights to land as regulated in Government Regulations Number 24 of 2016 on the regulations of the land deed department. The one where there is a fact on the ground that many incidents of cancellation of grants are assessed to not give a sense of justice for the parties, because of the lack of responsibility of the land deed registrar both in terms of form and material as the official authority to make grants rights on the land. The purpose of this research is to know and analyze the responsibility of the land registry officer for the cancellation of the grant act and to know the legal force of the subsidy act made by the land registry officer. This study uses a type of normative legal research. The results of the research showed that the grant acts made by the authorized land registrar officials are expected to qualify for the grant, and in terms of form and material, when there are errors committed by the land registrar officer, then the land registrar officer can be charged with administrative, civil, and criminal liability
PERDAGANGAN BEBAS DALAM PERDAGANGAN INTERNASIONAL: PELUANG DAN TANTANGAN INDONESIA DALAM ASEAN-CHINA FREE TRADE A GREEMENT
This article explains the theory of international trade law as framework for trade agreements between nations. What began as a multilateral agreement for member states of World Trade Organization was then narrowed down into regional and bilateral agreements due to geographical, social and economical concerns. In such case, the Association of South East Asian Nation, including Indonesia has established a bilateral agreement with China under the Asean-China Free Trade Agreement (ACFTA) which opens numerous opportunities but also cumbersome trade negotiation scheme. The author intends to argue that free trade agreements had shifted overtime from a wider scope with less stringent rights and responsibilities to a more complex agreement with options of tariff and non tariff barrier removal. As such, government should scrutinize free trade agreements according to the national economic necessity as opposed to the international demand in order to avoid social and economic risks.

Abstrak: Artikel ini menjelaskan teori hukum perdagangan internasional sebagai kerangka untuk peijanjian perdagangan antar negara. Apa yang dimulai sebagai perjanjian multilateral bagi negara-negara anggota Organisasi Perdagangan Dunia kemudian dipersempit perjanjian regional dan bilateral karena masalah geografis, sosial dan ekonomi. Dalam hal demikian, Asosiasi Asia Tenggara Nation, termasuk Indonesia telah membentuk perjanjian bilateral dengan Cina di bawah ASEAN-China Free Trade Agreement (ACFTA) yang membuka banyak kesempatan tetapi juga skema negosiasi perdagangan rum it. Penulis bermaksud untuk menyatakan bahwa perjanjian perdagangan bebas telah bergeser lembur dari lingkup yang lebih luas dengan hak dan tanggung jawab yang kurang ketat untuk kesepakatan yang lebih kompleks dengan pilihan tarif dan penghapusan hambatan non tarif. Deegan demikian. pernerintah harus memeriksa perjanjian perdagangan bebas sesuai dengan kebutuhan ekonomi nasional yang bertentangan dengan permintaan internasional untuk menghindari risiko sosial dan ekonomi

Promoting Regional Integration Through Higher Education: Legal Analysis on the Empowerment of Foundation in Private Universities
Higher education holds an important role in developing nation to build the manpower capacity of young generation and generate intellectual property. The same case applies in Indonesia as the most populous country in South East Asia with unmanaged higher education. Originally set out as a social entity which is engaged in nonprofit activities, some foundations have engaged in higher education. However conflict arises when the purpose of foundation is skewed for personal use that ended up disparaging other good foundations and the society in general. These issues prompted the government to promulgate Law No. 16 of 2001 regarding the Foundation and Law No. 28 of 2004 regarding the Amendment of Law No. 16 of 2001 regarding the Foundation. With this legislation, the foundation is expected to carry out specific standard and policies in managing their activities especially in order to prevent internal and external interference This article discusses on four parts: i) thetheoretical legal background of foundation in Indonesia compared to other legal entities; ii) the exposition of organs on the foundation in such as the Board of Trustees, Board of Executive and Board of Supervisory; iii) The analysis of role between foundation and universities, including examples of internal and external conflict as study case; and iv) the role of foundation to enhance Indonesia's regional position in the International community
Analisis Yuridis Praktik Diskriminasi Penjualan Tiket Umroh oleh Perusahaan Penerbangan Ditinjau dari Perspektif Hukum Perlindungan Konsumen
The issue of consumer protection has in fact become a hot topic that needs attention from various parties, especially considering that every business activity involves consumers and there are consumer rights that must be fulfilled by entrepreneurs based on Law Number 8 of 1999 concerning Consumer Protection. Cases that have been widespread include discriminatory practices carried out by PT Garuda Indonesia (Persero) Tbk in selling Umrah tickets, closing access to ticket reservations by Garuda Indonesia to 301 PPIUs (Umrah Travel Organizers), so that consumers cannot reserve tickets directly. This problem then invites the author to discuss further regarding consumer protection in this case and the implementation of legal protection that should be for consumers in discriminatory practices in business activities. This research uses a normative juridical research method using literature study and a legal approach. The research results show that in constructing consumer protection, you must actually look at legal principles, both in terms of legal certainty, legal protection and justice, as well as referring to the principles of Islamic law. In implementing legal protection referring to the Consumer Protection Law, it is necessary to take several steps, including collaboration in supervising entrepreneurs by utilizing technology, clear and integrated regulations and the imposition of strict and proportional sanctions, as well as education for entrepreneurs to can always uphold consumer protection values including transparency, fairness, openness, equality
Pembentukan Lembaga Pengawas Perlindungan Data Pribadi Di Era Ekonomi Digital : Kajian Perbandingan Dengan KPPU
In recent years, the advancement of information and communication technology has made the circulation of personal data in Indonesia difficult to control, and cases of personal data breaches that harm consumers have often occurred. As a country that has specific regulations protecting personal data, there is a need for an overseeing institution to monitor the circulation of such personal data. However, up to this day, the government has not established this institution, causing uncertainty regarding the implementation of Law 27/2022. In conducting this research, the Author adopted a normative juridical research method, involving various approaches such as statute approach, conceptual approach, and comparative approach, with the aim of gaining a deeper and more comprehensive understanding of the analyzed issue. Based on the conducted analysis, the Author finds that the establishment of a Personal Data Protection Supervisory Institution would bring about numerous positive benefits, therefore this institution needs to be established promptly for Indonesia to achieve adequacy status. However, the form of this institution is still under debate as attaching it to the Ministry of Communication and Informatics may lead to a conflict of interest. In essence, Indonesia already has several independent state institutions, one of which is the Indonesia Competition Commission. Indonesia Competition Commissionis an independent state institution with a quasi-judicial model that cannot be intervened by any party in its handling, decision-making, or investigation of competition cases. Hence, drawing lessons from Indonesia Competition Commission, the Author's view is that the Personal Data Protection Supervisory Institution should ideally be established as an independent state institution due to the similarities it shares with Indonesia Competition Commission.

Sebagai negara yang telah mempunyai regulasi khusus yang melindungi data pribadi tentunya membutuhkan suatu lembaga yang berperan mengawasi peredaran data pribadi tersebut. Namun, hingga hari ini lembaga tersebut belum dibentuk oleh Pemerintah sehingga menimbulkan ketidakpastian terhadap implementasi UU No. 27 Tahun 2022. Dalam proses penyelenggaraan penelitian ini, Penulis mengadopsi jenis penelitian yuridis normatif, yang melibatkan pendekatan beragam seperti statute approach, conceptual approach, dan comparative approach, dengan tujuan untuk mendapatkan pemahaman yang lebih mendalam dan komprehensif mengenai isu yang sedang dianalisis. Berdasarkan analisis yang telah dilakukan, Penulis menemukan bahwa kehadiran Lembaga Pengawas PDP memiliki banyak manfaat positif sehingga lembaga ini harus segara dibentuk agar Indonesia mencapai status adequacy. Meski demikian, bentuk dari lembaga ini masih diperdebatkan karena apabila dilekatkan dengan Kominfo maka dapat menimbulkan conflict of interest. Sejatinya, Indonesia sendiri telah memiliki sejumlah lembaga negara independen yang mana salah satunya adalah KPPU. KPPU sendiri merupakan lembaga negara independen dengan model quasi-judicial yang tidak bisa diintervensi oleh pihak mana pun dalam melakukan penanganan, pengambilan keputusan, atau penyelidikan terhadap perkara persaingan usaha. Oleh karena itu, berkaca dari KPPU maka Penulis berpandangan bahwa Lembaga Pengawas PDP haruslah dibuat dalam bentuk lembaga negara independen sebagai bentuk paling ideal karena memiliki sejumlah kemiripan antara KPPU dan Lembaga Pengawas PDP.
