Comparison of Rahn Contract from the Perspective of Islamic Law and Indonesian Guarantee Law
This paper analyzed pawn in comparison between the Civil Code and Islamic law. It examined the specific differences between pawn contracts in Islamic law and Indonesian positive law to compare two contract theories. The method used in this paper is a qualitative approach. The type used in writing this article is library research. The author examines, observes and looks for data from reference books that can be accounted for. The result of the research in this paper is that the term pawn in Islamic law is called ar-rahn. The difference between rahn and pawn in positive law, among others, is regarding the maintenance of the collateral. In Islamic law the pawnbroker is not subject to the term interest or additional costs outside the pawn agreement, but there is only an additional maintenance fee for the collateral. Whereas in positive law, in addition to the cost of maintaining goods, there is also an additional cost called 'interest' that must be borne by the lender. In Islamic law collateral goods are not limited to movable goods, but also immovable goods, while in positive law the collateral object is only limited to movable goods
Correlation of The Concept of Property Rights in Islamic Law and KUHPerdata
Abstract: The nature of property rights to an object in Islam is absolute belongs to Allah, human ownership is only majazi. It is different from the concept of property rights in KUHPerdata, that property rights are control over an object and take advantage of the object. However, the concept of property rights according to Islamic law and KUHPerdata has a very significant correlation. As in the causes and mechanisms of obtaining ownership rights in KUHPerdata, which must go through claims that are in line with the concept of Ihrazul Mubahat (creating permissibility) in Islam. Because the ownership of Participation/Attachment is in line with the concept of At-Tawalud min al-mamluk (with increase or birth). The concept of past time/expiration is in harmony with Al-Uqud (Testament). The concept of inheritance is in line with Al-Khalafiyat (Replacement) or the concept of inheritance. While the concept of surrender is in line with the concept of ownership in Islam, namely al-muhabat. Istila 'al-muhabat or the way of ownership through control of property. The correlation of property rights in Islamic law and KUHPerdata can also be proven by the arguments in the Qur'an and Hadith, so that it can strengthen the belief of the Muslim community to comply with the ownership rights laws listed in KUHPerdata.Abstrak: Hakekat hak milik terhadap suatu benda dalam Islam adalah mutlak milik Allah, kepemilikan manusia hanya bersifat majazi. Berbeda dengan konsep hak milik dalam KUHPerdata, bahwa hak milik adalah penguasaan terhadap suatu benda dan mengambil manfaat dari benda tersebut. Akan tetapi konsep hak milik menurut hukum Islam dan KUHPerdata memiliki kolerasi yang sangat signifikan. Sebagaimana dalam sebab dan mekanisme memperoleh hak kepemilikan pada KUHPerdata yang harus melalui pendakuan selaras dengan konsep Ihrazul Mubahat (menimbulkan kebolehan) dalam Islam. Sebab kepemilikan Ikutan/Perlekatan selaras dengan konsep At-Tawallud min al-mamluk (dengan pertambahan atau kelahiran). Konsep lampaunya waktu/daluwarsa selaras dengan Al-Uqud (Perjanjian). Konsep pewarisan selaras dengan Al-Khalafiyat (Penggantian) atau konsep waris. Sedangkan konsep penyerahan selaras dengan konsep kepemilikan dalam Islam, yaitu al-muhabat. Istila’ al-muhabat atau cara kepemilikan melalui penguasaan terhadap harta. Kolerasi hak milik dalam hukum Islam dan KUPerdata tersebut juga dapat dibuktikan dengan dalil-dalil dalam Al-Qur’an dan Hadist, sehingga dapat meperkuat keyakinan masyarakat muslim untuk mematuhi udang-undang hak kepemilikan yang tercantum dalam KUHPerdata.
TINJAUAN TENTANG HARGA DAN UKURAN DALAM JUAL BELI (EKSPOR) BENIH LOBSTER MENURUT HUKUM DAGANG DAN UNDANG-UNDANG PERMEN-KP NO.1 TAHUN 2015
Pelaksanaan praktik jual beli Benih Lobster yang terjadi pada saat ini diduga belum sesuai dengan Hukum positif. Pada praktik jual beli tersebut khususnya dalam ekspor, terdapat beberapa pihak yang merasa dirugikan, seperti halnya Nelayan, dan juga Negara Republik Indonesia sendiri, karena harga yang ditetapkan oleh penjual belum sesuai dengan apa yang telah ditetapkan oleh Undang-Undang. Dalam hukum positif sendiri dalam jual beli benih lobster ada aturan dan ketetapan jenis dan ukuran dalam jual beli lobster laut. Namun sangat disayangkan beberapa nelayan saat melakukan profesi mereka tidak memperhatikan efek kedepannya, yang dimana sebagian nelayan ada yang melakukan transaksi jual beli benih lobster tidak sesuai kebijakan yang telah dibuat. Ditakutkannya pula ini akan berdampak pada tingkat ekonomi khususnya dalam jual beli biota laut, terutama untuk hewan lobster. Dikarenakan, bewan tersebut menjadi incaran para nelayan sebab harganya yang jika dijual lumayan mahal dan rasanya sendiri bila dikonsumsi sungguh nikmat sehingga permintaan pasar akan hewan tersebut terus menerus tiada henti. Going Beyond Counting First Authors in Author Co-citation Analysis
The present study examines one of the fundamental aspects of author co-citation analysis (ACA) - the way co-citation
counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings
are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that
only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into
account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed. Reasons for these effects are discussed
Variations on the Author
“Variations on the Author” discusses two of Eduardo Coutinho’s recent films (Um Dia na Vida, from 2010, and Últimas Conversas, posthumously released in 2015) and their contribution to the general question of documentary authorship. The director’s filmography is characterized by a consistent yet self-effacing form of authorial self-inscription: Coutinho often features as an interviewer that rather than express opinions propels discourses; an interviewer that is good at listening. This mode of self-inscription characterizes him as an author who is not expressive but who is nonetheless markedly present on the screen. In Um Dia na Vida, however, Coutinho is completely absent form the image, while Últimas Conversas, on the contrary, includes a confessional prologue that moves the director from the margins to the center of his films. This article examines the ways in which these works stand out in the filmography of a director who offers new insights into the notion of cinematic authorship
Appropriate Similarity Measures for Author Cocitation Analysis
We provide a number of new insights into the methodological discussion about author cocitation analysis. We first argue that the use of the Pearson correlation for measuring the similarity between authors’ cocitation profiles is not very satisfactory. We then discuss what kind of similarity measures may be used as an alternative to the Pearson correlation. We consider three similarity measures in particular. One is the well-known cosine. The other two similarity measures have not been used before in the bibliometric literature. TINDAK PIDANA RAHASIA DAGANG DITINJAU DARI UU NO. 30 TAHUN 2000 TENTANG RAHASIA DAGANG
Legal protection applies to the rights of every citizen, both to rights obtained due to transfer or rights arising from the results of their own copyrighted work. For rights in the form of copyrighted works, in the legal world they are included in the category of Intellectual Property Rights (IPR). Trade secrets as part of the Intellectual Property Rights system are not given much attention by the wider community, therefore they should be given protection like other Intellectual Property Rights objects. The purpose of this research is to find out criminal acts against violators of trade secrets and analyze using Law No. 30 of 2000. This research method uses normative research with a qualitative approach. The legal materials used in this study are primary legal materials and secondary legal materials. The primary legal material is the legislation in the field of intellectual property rights in Indonesia, namely Law no. 30 of 2000. Secondary legal materials used in this research are legal publications such as books, research results and so on. The results of this study indicate that anyone who intentionally and without rights uses or discloses a Trade Secret, or reneges on an agreement to maintain a Trade Secret or obtains or controls a Trade Secret in a way that is contrary to the applicable laws and regulations: shall be sentenced to a maximum imprisonment of 2 (two) years and/or a maximum fine of Rp.300,000,000.00 (three hundred million rupiah)
Effectiveness of Complete Systematic Land Registration (PTSL) Against Waqf Land Certification at Magelang Regency
The government's policy on Complete Systematic Land Registration (PTSL) is a policy initiated by the Ministry of Agrarian Affairs of the Republic of Indonesia in 2017, then further refined in 2018 as it still has problems in its implementation. The policy is expected to expedite the existing land certification process in Indonesia, including waqf land certification. However, this policy should be tested to measure the level of effectiveness against the facilities and acceleration of the certification process, especially the waqf land certification at Magelang Regency. The purpose of this study is to analyze the effectiveness of government policies on PTSL towards accelerating the certification of waqf land at Magelang Regency. Research methods are field research and qualitative approach by checking interview results, PTSL related regulations, regulations related to registration of waqf land certification, scientific journals related to soil certification, etc. The results of this study show that the implementation of government policies on PTSL towards accelerating the certification of waqf land is not optimally implemented in Magelang Regency. This can be seen from the percentage of waqf land certification levels at Magelang Regency still low, despite experiencing a decline after the birth of government policy on PTSL
Penyuluhan Status Harta Waris Islam Terhadap Anak Angkat kepada Seluruh Civitas Universitas Sains Islam Malaysia
This Community Service (PKM) focuses on providing counseling about the legal status of adopted children's inheritance rights from their adoptive parents. An adopted child is a child whose rights have been transferred from the family environment and authority of the biological parents, legal guardians, or other persons responsible for caring for, educating and raising the child. The legal status of adopted children in the perspective of laws in Indonesia and Malaysia is legal, however it then becomes an issue when faced with their rights within the inheritance assets of their adoptive parents. In Islamic inheritance law, adopted children do not have legal power over inheritance rights from their adoptive parents, except through obligatory wills (wasiat wajibah). Meanwhile, in positive law, adopted children obtain equal status as biological children, so that adopted children can become heirs. This PKM program is carried out for all USIM civitas (lecturers, staff, employees, workers) in collaboration with the USIM Faroid Study Center. This PKM program aims to provide an understanding of the inheritance rights status of adopted children. This PKM program uses socialization, counseling, and mentoring methods
