POLIGAMI DALAM PEMIKIRAN KH HUSEIN MUHAMMAD PERSPEKTIF SOSIOLOGI HUKUM

Polygamy has been interestingly discussed and giving rise to pros and cons with its all related arguments until now. This paper aims to analyze polygamy based on the thinking of KH Husein Muhammad and is strengthened by the theory of legal sociology. This research is qualitative, particularly the type of library research, and uses a conceptual approach. According to KH Husein Muhammad's thought, polygamy is not a practice born out of Islamic tradition. Islam did not initiate polygamy. Long before Islam came, the polygamy tradition had become a form of patriarchal civilization practice. According to KH Husein Muhammad, there must be an effort to reconstruct the Marriage Law related to polygamy. The phenomenon that is often encountered is a bad situation due to polygamy which can gradually harm the future of the nation's generation. This situation is immediately resolved by all parties, both the public and the state, through the improvement of laws or regulations. Referring to the process of gradual improvement as exemplified by the al-Qur'an for many cases, including cases of slavery, it is time for the process towards monogamous marriage to be carried out. Although the Qur'an mentions the issue of polygamy in Surah an-Nisa'(4): 3, however, there is a Hadis of the Prophet Muhammad that opposed Ali bin Abi Talib's plan to polygamy on Fatimah ra. KH Husein Muhammad criticized several manhajs of polygamy by arguing that monogamy rejects more harm than polygamy does. Therefore, monogamy must take precedence to be implemented because polygamy which causes arbitrary actions and endangers his wife and children must be avoided, in accordance with a sociological view of law, namely looking at law or norms from a social aspect

Land Conflicts in Wadas: Perspectives from Islamic Law

The Wadas case refers to a dispute over land that has arisen between a local community and the government in Wadas Village, Bener District, Purworejo, Central Java, as a direct outcome of a large-scale construction project. Since 2018, when an environmental permit was given by the governor stating that Wadas was included in the location of the impact of the construction of the Bener dam, the conflict has been ongoing. The governor's permit said that Wadas will be impacted by the construction of the dam. The construction of dam infrastructure brought up the conflict because locals were afraid that it would harm natural ecosystems and sources of livelihood in the area. After the apparatus launched oppressive activities, the disagreement escalated and became a national issue. This prompted NU and Muhammadiyah, the two largest community organizations in Indonesia, to take a stance on the matter. This investigation's objective is to ascertain the Islamic worldview with regard to the preservation of natural habitats and land in the context of wadas. The research method that was employed was looking through books in libraries, and the major data that was used was LBH Yogyakarta's findings from their investigation. The findings of the study lead one to the conclusion that the dispute over property in Wadas is not in line with the Islamic perspective on the importance of preserving the environment.

Going Beyond Counting First Authors in Author Co-citation Analysis

The present study examines one of the fundamental aspects of author co-citation analysis (ACA) - the way co-citation counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed. Reasons for these effects are discussed

    Variations on the Author

“Variations on the Author” discusses two of Eduardo Coutinho’s recent films (Um Dia na Vida, from 2010, and Últimas Conversas, posthumously released in 2015) and their contribution to the general question of documentary authorship. The director’s filmography is characterized by a consistent yet self-effacing form of authorial self-inscription: Coutinho often features as an interviewer that rather than express opinions propels discourses; an interviewer that is good at listening. This mode of self-inscription characterizes him as an author who is not expressive but who is nonetheless markedly present on the screen. In Um Dia na Vida, however, Coutinho is completely absent form the image, while Últimas Conversas, on the contrary, includes a confessional prologue that moves the director from the margins to the center of his films. This article examines the ways in which these works stand out in the filmography of a director who offers new insights into the notion of cinematic authorship
