    Tinjauan Maqasid Syariah terhadap Fatwa MUI dan Al-Lajnah Al-Daimah tentang Pernikahan Dini

    The objectives of this research were to find out and analyze early marriage in fatwas issued by the Indonesian Ulama (MUI) and al-Lajnah al-Daimah in Saudi Arabia. This research was a literature study research with a qualitative approach. The data collection technique was carried out by documentation study. The research process was conducted by collecting fatwa documents from the Indonesian Council of Ulama and al-Lajnah al-Daimah in Saudi Arabia. The findings of this reserach were that 1) The status of early marriage is considered legal if the prerequisite and pillar in contract have been fulfilled according to the view of (MUI) and al-Lajnah al-Daimah 2) There are differences in the fatwas studied in the substance and recommendations, al-Lajnah al-Daimah encourages young people to marry even though they have not reached the age of majority, while MUI require brides and grooms to meet the age stipulated in the Law and 3) Viewed through the maqasid sharia perspective shows that the fatwa of Indonesian Ulama Council is more suitable with the value of maqasid sharia than the fatwa of al-Lajnah al-Daimah, these found through a study of four aspects in these fatwas, namely: theoretical basis, influence on family resilience, consideration of the maslahat and mafsadat in early marriage, and Fatwa recommendations. Abstrak Penelitian ini bertujuan untuk mengetahui dan menganalisis pernikahan dini dalam fatwa yang dikeluarkan oleh Majelis Ulama Indonesia dan al-Lajnah al-Daimah Arab Saudi. Penelitian ini merupakan penelitian studi pustaka dengan pendekatan kualitatif. Pengumpulan data dilakukan dengan studi dokumentasi. Proses penelitian dilakukan dengan mengumpulkan dokumen-dokumen fatwa dari Majelis Ulama Indonesia dan al-Lajnah al-Daimah Arab Saudi.Temuan dalam penelitian ini adalah 1) Status pernikahan dini yang dihukumi sah apabila dalam akadnya telah terpenuhi syarat dan rukunnya dalam pandangan MUI dan al-Lajnah al-Daimah 2) Terdapat perbedaan dalam fatwa-fatwa yang dikaji dalam substansi dan rekomendasinya, al-Lajnah al-Daimah mendorong anak muda untuk menikah walaupun belum mencapai usia dewasa, sedangkan MUI mengharuskan pengantin untuk memenuhi usia yang ditetapkan dalam Undang-Undang dan 3) Ditinjau melalui perspektif maqasid syariah dalam pernikahan menunjukkan bahwa fatwa MUI lebih sesuai dengan nilai maqasid syariah, hasil ini ditemukan melalui kajian terhadap empat aspek dalam fatwa-fatwa tersebut, yaitu: landasan teori, pengaruh terhadap ketahanan keluarga, pertimbangan maslahat dan mafsadat pernikahan dini, dan rekomendasi fatwa.

    Di wilayah kutub ketika memasuki musim panas, umat muslim di sana berpuasa dengan waktu yang sangat lama yaitu mencapai 20 jam, sebaliknya pada musim dingin mereka berpuasa hanya dalam waktu beberapa jam saja. Persoalan tersebut dapat menjadi masalah karena tidak ada penjelasan di dalam al-Qur‟an dan hadits tentang tata cara puasa di wilayah kutub atau di tempat yang mengalami waktu ekstrim. Penelitian ini bertujuan untuk mengetahui pendapat Dar Al-Ifta Al-Misriyyah dan Lajnah Daimah tentang hukum berbuka puasa di wilayah kutub, argumentasi dalil, serta persamaan dan perbedaannya. Penelitian ini menggunakan metode penelitian hukum normatif yaitu penelitian hukum yang menggunakan sumber data yang diperoleh melalui bahan�bahan kepustakaan. Adapun jenis penelitian ini adalah library research atau penelitian kepustakaan. Dengan menggunakan pendekatan deskriptif-komparatif, yaitu penelitian untuk mengumpulkan data dan mencari persamaan dan perbedaan antara fatwa Dar Al-Ifta Al-Misriyyah dan Fatwa Lajnah Daimah. Hasil dari penelitian ini ada dua pendapat yang berbeda. Dar Al-Ifta Al�Misriyyah menyarankan agar umat muslim di wilayah kutub berpuasa dengan mengikuti waktu di Mekkah. Adapun Lajnah Daimah mempunyai dua pendapat. Pendapat pertama mengatakan agar muslim di wilayah kutub tetap berpuasa sebagaimana mestinya dengan mengikuti waktu setempat dan jika tidak mampu maka boleh mengqadha puasa di lain hari. Pendapat kedua, Lajnah Daimah menyarankan agar berpuasa dengan mengikuti waktu Negara terdekat. Persamaan antara keduanya ialah dalam hal perujukan dalil hadits Nabi yang diriwayatkan oleh Nawas bin Sam‟an ra., kesamaan dalam hal istinbat hukum untuk memperkirakan waktu shalat dan puasa, dan kesamaan penemuan „illat hukum tentang kewajiban puasa Ramadhan yang sama seperti kewajiban mendirikan shalat. Adapun perbedaan nya, Dar Al-Ifta Al-Misriyyah lebih banyak mencantumkan pendapat Ulama, sedangkan Lajnah Daimah lebih banyak mencantumkan dalil dari nash al-Qur‟a

    The ruling on wishing non-Muslims a happy holiday has been debated by scholars. The concept of religious moderation and the values of tolerance in a plural society are the dominant discourses today that require a reading of the law of congratulating non-Muslims. Fatwas related to the law have emerged from various regions and countries. Among them are Al-Lajnah Ad-Daimah and Dar Al-Ifta'. If the first fatwa institution comes from a country with a textualist application of Islamic law (Saudi Arabia), then it is different from the second fatwa institution. Dar Al-Ifta' is an Egyptian fatwa institution, one of the moderate countries in applying Islamic law. The fundamental question of this research is how the law of wishing happy holidays to non-Muslims is studied by the two fatwa institutions. This type of research is qualitative with data sourced from library research. The data of this research are obtained from the fatwas of Al-Lajnah Ad-Daimah and Dar Al-Ifta' as primary data and supporting data from various literatures relevant to this topic. Furthermore, the fatwas of both are analyzed using the framework of negotiative hermeneutics theory. This theory was initiated by Khaled Abou El Fadl who emphasized the negotiation between three entities, including the author, text, and reader. There are three key variables in studying the fatwa of Al-Lajnah Ad-Daimah and Dar Al-Ifta'. Starting from text and authority, the construction of authoritarianism, to the anatomy of authoritarian discourse. Based on this, this research uses a socio-legal approach. First, the conclusion obtained is that these two fatwa institutions have a considerable gap in fatwa differences. Second, there are three key variables used when analyzed using negotiative hermeneutics theory. In text and authority, it can be seen how these two fatwa institutions have authority in discussing this topic. At the same time, the differences in the social reality of their audiences also affect the differences in methods and rulings. In the construction of authoritarianism, it can be seen that the determination of the law is not authoritarian from the fulfillment of the five prerequisites proposed by negotiative hermeneutics. Both have differences in fulfilling these five prerequisites. Then, in the anatomy of authoritarian discourse, three things are studied: consistency, selective attitude in sorting out arguments, and balancing various interests and rationales. Both fatwa organizations consistently use their own methods in studying this topic. Al-Lajnah Ad-Daimah is selective in sorting out arguments, in contrast to Dar Al-Ifta' which explores more arguments. Finally, in balancing various interests, Al-Lajnah Ad-Daimah is only concerned with preserving religion.     Going Beyond Counting First Authors in Author Co-citation Analysis

    The present study examines one of the fundamental aspects of author co-citation analysis (ACA) - the way co-citation counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed.     “Variations on the Author” discusses two of Eduardo Coutinho’s recent films (Um Dia na Vida, from 2010, and Últimas Conversas, posthumously released in 2015) and their contribution to the general question of documentary authorship. The director’s filmography is characterized by a consistent yet self-effacing form of authorial self-inscription: Coutinho often features as an interviewer that rather than express opinions propels discourses; an interviewer that is good at listening. This mode of self-inscription characterizes him as an author who is not expressive but who is nonetheless markedly present on the screen. In Um Dia na Vida, however, Coutinho is completely absent form the image, while Últimas Conversas, on the contrary, includes a confessional prologue that moves the director from the margins to the center of his films. This article examines the ways in which these works stand out in the filmography of a director who offers new insights into the notion of cinematic authorship

    Appropriate Similarity Measures for Author Cocitation Analysis

    We provide a number of new insights into the methodological discussion about author cocitation analysis. We first argue that the use of the Pearson correlation for measuring the similarity between authors’ cocitation profiles is not very satisfactory. We then discuss what kind of similarity measures may be used as an alternative to the Pearson correlation. We consider three similarity measures in particular. One is the well-known cosine. The other two similarity measures have not been used before in the bibliometric literature.     Dispelling the Myths Behind First-author Citation Counts

    We conducted a full-scale evaluative citation analysis study of scholars in the XML research field to explore just how different from each other author rankings resulting from different citation counting methods actually are, and to demonstrate the capability of emerging data and tools on the Web in supporting more realistic citation counting methods. Our results contest some common arguments for the continued use of first-author citation counts in the evaluation of scholars, such as high correlations between author rankings by first-author citation counts and other citation counting methods, and high costs of using more realistic citation counting methods that are not well-supported by the ISI databases. It is argued that increasingly available digital full text research papers make it possible for citation analysis studies to go beyond what the ISI databases have directly supported and to employ more sophisticated methods
