Sistem Keadilan Pemilu dalam Penanganan Pelanggaran dan Sengketa Proses Pemilu Serentak 2019 di Sumatera Barat
The electoral justice system has been established in Law Number 7 of 2017. It is marked the electoral justice system has been established in Law Number 7 of 2017. It is marked by the regulation of all procedures for implementing the election stages and the mechanism for handling election violations or disputes. The settlement of violations and election disputes is carried out by Election Supervisory Body (Bawaslu). In resolving violations and conflicts, Bawaslu has the authority to issue final decisions. With this authority, the role of Bawaslu is strengthened in the framework of law enforcement for election justice. This study would like to examine how this authority is exercised, especially in West Sumatra. West Sumatra has chosen because this province has become one of the most vulnerable areas in terms of organizing free and fair elections. Furthermore, there has also been an increase in the number of cases handled by Bawaslu in the 2019 elections compared to 2014 in West Sumatera. Therefore, how election law enforcement is carried out by Bawaslu to realize electoral justice, particularly in handling election violations and disputes. This article using normative legal research methods by relying on legal materials in the form of court decisions and decisions of the Bawaslu in province and city. In this study, it was concluded that the electoral justice system had implemented in the process of handling violations and disputes by Bawaslu in West Sumatra. All complaint report indicated it, i.e., administrative offenses, alleged criminal acts, and election disputes have been passed based on procedures determined by statutory regulations. However, there are still some weaknesses that must be evaluated because the election justice can not maximize.
Pertanggungjawaban Pelaksana Operasional Badan Usaha Milik Nagari (BUMnag) Gadut Sejahtera Nagari Gadut Kecamatan Tilatang Kamang
The operational implementation of BUMNag Gastra experienced various problems which made it difficult to develop properly. These problems include, among others, the Human Resources Manager is still low, resulting in one of the accountability BUMNag not being carried out properly. Therefore the author examines the following problem formulation: 1) How is the Operational Implementation of BUMNag Gastra Nagari Gadut 2) What is the accountability of the Operational Executive of BUMNag Gastra Nagari Gadut. The research method that the author uses is Juridical Empirical, namely research that focuses on how the implementation of BUMNag Gastra Nagari Gadut operations in the field. The results of the research are presented in the form of descriptive analysis relying on primary data in the form of field data (interviews) supplemented by secondary data. As for the results of the author\u27s research, it can be concluded, firstly, the operational implementation of BUMNag Gastra Nagari Gadut is still simple and not fully in accordance with management functions. The two accountability reports have not been properly presented, so they are not in accordance with legal objectives, namely certainty and justice. In the future, efforts are expected to promote BUMNag, namely 1) increasing human resources 2) increasing capital 3) instilling a sense of ownership of BUMNag which is still low. 4) improvement of facilities and infrastructur
Kedudukan Hukum Sertipikat Hak Milik Karena Cacat Yuridis Sebagai Bukti Kepemilikan Hak (Studi Putusan Pengadilan Negeri Batusangkar Nomor 67/Pid.B/2021/PN Bsk)
One of the plots of land where land registration is carried out by issuing a certificate is Certificate of Ownership Number 00164/Nagari Padang Magek. The certificate is the object of a dispute which has been decided by the Batusangkar District Court Decision Number 67/Pid.B/2021/PN Bsk, which has obtained permanent legal force (inkracht van gewijsde). Based on the Decision of the Batusangkar District Court Number 67/Pid.B/2021/PN Bsk, the issuance of Certificate of Ownership Number 00164/Nagari Padang Magek, namely a Statement of Physical Control of the Field and a Certificate of Land Ownership Number 074/SK/PMT/2000, is a fake document. So the Certificate of Ownership Number 00164/Nagari Padang Magek has a legal defect. The formulation of the problem examined in this research is: 1) what is the legal position of a certificate of ownership due to juridical defects as proof of ownership of rights?; 2) what are the legal consequences of ownership of land rights following the Batusangkar District Court Decision Number 67/Pid.B/2021/PN Bsk? The research method that the author uses is normative juridical, with a case approach. The type of data used is secondary data, which consists of primary, secondary and tertiary legal materials. The data collection technique used is document study. The results of the author\u27s findings are the position of Ownership Certificate Number 00164/Nagari Padang Magek, which has changed the data on the certificate above to become Ownership Certificate Number 1892/Nagari Padang Magek, Land Plot Identification Number 03.10.03.02.01654, with Measurement Letter Number: 2616/2021 dated 27 April 2021, area 940, in the names of Tisra Juwita and Hasni Wirda, still valid and valid. The next finding is that in the Batusangkar District Court Decision Number 67/Pid.B/2021/PN Bsk, the basis for issuing the certificate used was a fake letter related to the ages of the parties, namely Tisra Juwita and Hasni Wirda, not a fake regarding the subject of their rights. So the plot of land registered in Certificate of Ownership Number 00164 is still legally valid in the names of Tisra Juwita and Hasni Wirda. Certificates issued based on fake documents can be canceled by submitting a written application to the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency through the Head of the Land Office where the object is located, in this case the Head of the Tanah Datar Regency Land Office
Legal Protection Against Bad Debtor Who is Bound by the Fiduciary Liability Insurance Against Auction Conducted by Creditor in Padang City
The execution of the fiduciary liability insurance, based on the fiduciary liability insurance certificate, has the executive power that is the same as the court decision that has obtained permanent legal force. The right to execute arises since a default occurs by a debtor whose creditor has the right to sell the object of the fiduciary liability insurance on his own power through auction. The purpose of this study was to find out how the execution process of the fiduciary liability insurance carried out by the company to the bad debtor and the form of legal protection against the bad debtor who is bound by the fiduciary liability insurance after the collateral object is auctioned by the creditor. After the auction is conducted, the author is interested in conducting a research discussing on the forms of legal protection against debtor who is bound by the fiduciary liability insurance after the collateral object is auctioned by the creditor. This research applies empirical juridical method by using primary and secondary data. The results of the study found that legal protection for bad debtor, who is bound by the fiduciary liability insurance after the collateral object is auctioned, is the elimination of fiduciary duties on objects guaranteed by fiduciary liability insurance and the return of the remaining credit obtained from the auction by the creditor to the debtor
The Authority Of Bank Indonesia In Issuing Legal Products According To The State Auxillary Agencies Theory
As an State Auxillary Agencies. Bank Indonesia is authorized to make it’s own legal products that bind the public. Currently the product of he regulation is in a Bank Indonesia Regulation, as a consequence of one of the characteristics of an State Auxillary Agencies namely a self regulatory body. From this study it may be concluded that Bank Indonesia only has the authority to enforce the delegation’s regulation. Second, Bank Indonesia, in the hierarchy of regulations, should be in line with Presidential Regulations. Third, the Governor of Bank Indonesia may make State Administative Decisions in accordance with his authority. Fourth, the stages of formation of Bank Indonesia Regulations in the Bank Indonesia Regulation concerning the establishment of Regulations at Bank Indonesia, include: a.planning; b.arrangement; c.discussion; d.determination; e.promulgation; and f.dissemination. Fifth, the establishment of a Bank Indonesia Regulation in order to prioritize meaningful public participation in the process of its information, especially to involve academics. For this reason, according to the author, academics need to be empowered by Bank Indonesia in the establishment of Bank Indonesia in the Framework of improving the State Auxillary Agencies
Pembatalan Sertifikat Pelatihan Peningkatan Kualitas Jabatan Notaris Sebagai Syarat Pengangkatan Notaris (Studi Putusan Mahkamah Agung Nomor3P/HUM/2022)
Through Supreme Court Decision Number 3 P/HUM/2022, the request for judicial review of Article 2 paragraph (3) letter of Minister of Law and Human Rights Regulation Number 19 of 2019 was granted, which implied canceling one of the conditions for appointing a Notary, namely a photocopy of the Quality Improvement Training certificate Notary Position. The research method used is normative juridical, with a case approach. The results of the author\u27s findings are that the Supreme Court thinks that legal norms which have been tested and declared to conflict with higher laws and regulations and declared to have no binding legal force, may not be re-published in a regulation. After the Supreme Court Decision Number 3 P/HUM/2022, the process of appointing Notaries in 2022 still uses reference to Article 2 of the Regulation of the Minister of Law and Human Rights Number 19 of 2019 as a whole, including Training to Improve the Quality of Notary Positions as a condition for appointing Notaries. So, prospective Notaries who have completed all the requirements other than Training to Improve the Quality of Notary Positions, cannot apply for appointment

The aim of conducting research on Consumer Legal Protection in the Housing Sector in the City of Bukittinggi is as follows: 1. To find out the basic principles of Consumer Legal Protection in the Housing Sector using the Sharia System in the Event of Default by One of the Parties. 2. To find out the Judge\u27s Decision on Consumer Legal Protection Cases in the Housing Sector with the Sharia System. In the research, the author took an empirical, descriptive, juridical approach. From the results of this research it is known that: 1. Indonesia as a country of law, legislation has provided the basis for legal protection for consumers. where the government guarantees legal certainty to protect citizens. Banyak perusahaan kurang memahami konsep kegiatan Corporate Sosial
Responsibility (CSR) sehingga pelaksanaannya menjadi tidak efektif dan tepat sasaran.
Corporate Sosial Responsibility (CSR) adalah sebuah konsep untuk perusahaan
mengintegrasikan perhatian sosial dan lingkungan dalam operasi bisnisnya dan
interaksinya dengan stakeholder dengan dasar sukarela (Wahyudi, Isa dan Busya Azheri,
2008:29). Program Kerangka Dialog Masyarakat untuk Kawasan Industri di Kecamatan
Bergas, Kabupaten Semarang merupakan upaya pengembangan sebuah mekanisme
komunikasi antara pihak perusahaan, masyarakat, dan pemerintah dalam merencanakan
kegiatan Corporate Sosial Responsibility (CSR). Penelitian terhadap implementasi
program tersebut dilakukan untuk mengetahui proses pelaksanaan dialog melalui proses
komunikasi antar stakeholder dalam perencanaan kegiatan Corporate Sosial
Responsibility (CSR), dan menganalisa kontribusi program dialog dalam menghasilkan
bentuk-bentuk kegiatan Corporate Sosial Responsibility (CSR) yang baik dan berkualitas
bagi komunitas industri. Data primer penilitian diperoleh melalui wawancara dengan staf
ProLH GTZ sekalu fasilitator kegiatan, perwakilan pihak perusahaan, masyarakat, dan
pemerintah yang terlibat aktif di dalam kegiatan dialog. Selain itu, data sekunder
diperoleh melalui observasi dan analisis dokumentasi kegiatan. Penelitian ini merupakan
penelitian studi kasus dengan menggunakan teknik analisis perjodohan pola.
Program Kerangka Dialog Masyarakat merupakan bagian dari program European
Union’s Asia Pro Eco II yang tujuan utamanya adalah meningkatkan kondisi kehidupan
kepada masyarakat yang tinggal di sekitar zona industri. Sedangkan tujuan pelaksanaan
program dialog difokuskan pada pengembangan sistem komunikasi yang saling
menguntungkan antara pihak perusahaan, masyarakat lokal, dan pemerintah setempat.
Mekanisme komunikasi yang dipilih adalah komunikasi konvergensi dengan
menggunakan metode dialog. Sebelum pelaksanaan dialog, ProLH GTZ selaku fasilitator
kegiatan melakukan kegiatan needs assessment dan pemetaan stakeholder untuk
mendapatkan informasi yang kontekstual terkait dengan lokasi kegiatan dan sumber daya
yang diperlukan pada pelaksanaan kegiatan dialog. Selain itu, dilakukan juga kegiatan
seminar Corporate Sosial Responsibility (CSR) untuk memberikan kesamaan
pemahaman tentang konsep kegiatan Corporate Sosial Responsibility (CSR) kepada
perwakilan dari pihak perusahaan, masyarakat, dan pemerintah. Kegiatan dialog
dilakukan sebanyak empat kali dan diikuti oleh perwakilan pihak perusahaan, masyarakat
lokal, dan pemerintah setempat. Dialog-dialog tersebut dilakukan untuk mengidentifikasi
kepentingan bersama, menyusun aksi bersama, melakukan monitoring, dan perbaikan
kerangka dialog antara pihak perusahaan, masyarakat, dan pemerintah. Konsep
komunikasi konvergensi disertai dengan komitmen dan goodwill bersama merupakan inti
dari pelaksanaan dialog untuk menghasilkan dan menyepakati keputusan bersama terkait
dengan perencanaan kegiatan Corporate Social Responsibility (CSR). Dari keseluruhan
pelaksanaan dialog dihasilkan sebuah kerangka perencanaan kegiatan Corporate Social
Responsibility (CSR) yang dilakukan oleh PT. Sidomuncul, PT. Nyonya Meneer, dan
PT. Coca-cola Bottling
Tanggung Jawab Direksi Atas Penyalahgunaan Dana Pemegang Saham Yang Dititipkan Pada Perusahaan( Study Putusan Pengadilan Negeri Nomor 892/Pdt/2021/Pt.Sby )
A limited liability company is a legal entity that is a partnership of capital established based on an agreement, conducts business activities with a basic capital entirely divided into shares, and meets the requirements set forth in this regulations. The existence of the board of directors in the company is mandatory as their presence is crucial for managing the company in accordance with the provisions of the company law. Based on this, the author formulates the issues as follows: first, how the directors' responsibilities relate to the deposit of funds in the company by shareholders, and second, how the judges' considerations in decision number 892/Pdt/2021/Pt.Sby and decision number 39/Pdt.G/2020/Pn Btm regarding the deposit of shareholders' funds in the company. The research method used is normative juridical, which means that the board of directors is obligated to carry out their duties in good faith and with full responsibility. The theories used are first the theory of responsibility, second the ultra vires theory, and third the judge's discretion theory. The results of this research indicate that in the execution of the board of directors' duties, it should be carried out with a review of the theory of responsibility and the ultra vires theory. Conclusion on the personal responsibility of the board of directors for company losses caused by negligence in performing their duties, it is advisable for the parties to ensure the implementation of good corporate governance by strengthening the internal supervision.
