    Restorative Justice as an Effort to Fulfill the Constitutional Rights of Citizens: Restorative Justice sebagai Upaya Pemenuhan Hak Konstitusional Warga Negara

    This study aims to determine whether the settlement of criminal cases through restorative justice is an effort to fulfill the constitutional rights of citizens. The method used in this research is normative legal research with a statutory approach and a conceptual approach. The results of the study show that the settlement of cases through restorative justice is an effort to fulfill the constitutional rights of citizens because the principle of resolving cases through restorative justice can be said to be more able to guarantee justice and equality before the law (equality before the law) as regulated in Article 27 paragraph (1), Article 28D paragraph (1) and Article 28I paragraph (2) of the 1945 Constitution of the Republic of Indonesia

    Legal Policy of President Joko Widodo and the Independence of Constitutional Court: Politik Legislasi Presiden Joko Widodo dan Independensi Mahkamah Konstitusi

    This article discusses the independence of the Constitutional Court in reviewing legislation created by President Joko Widodo. There are three main questions posted: What is the character of legal policy under President Joko Widodo, how has the role of the Constitutional Court shifted in the last decade and what is the character of the Constitutional Court’s decisions in reviewing legislation enacted by President Joko Widodo. These questions are discussed using normative research on Constitutional Court decisions. Data from the results of this research are deployed quantitatively and qualitatively. Quantitative data is displayed to show legislative trends and Constitutional Court decisions. Analysis was carried out on 78 laws and 277 Constitutional Court Decisions. Meanwhile, qualitative research is to assess the character of legislation and Constitutional Court decisions through case studies of several Constitutional Court decisions related to politics, economics, law enforcement institutions and civil liberties. This article shows that the Constitutional Court has not been effective in exercising judicial review of legislation enacted under President Joko Widodo, amidst an increasingly abusive legislative process

    Constitutionality of the Regional-Owned Enterprises in the Management of New and Renewable Energy

    This research focuses on the constitutionality of the Regional-Owned Enterprises authority in the management of New and Renewable Energy. There are two research objectives to be obtained. First, the classification of EBT in the major production branches and the dominance over people’s lives refers to the dynamics of laws and decisions of the Constitutional Court. Second, the determination of BUMD\u27s authority over the management of EBT refers to the state\u27s control rights according to MK. This research is normative legal research based on secondary data. This research showed two conclusions. First, the classification of EBT includes nuclear, coal methane gas, liquefied and gasified coal, geothermal, and water flows and waterfalls. Second, the position of BUMD is classified into two models; (1) BUMN is prioritized over BUMD; and (2) BUMD is equivalent to BUMN. However, for SDA which are not included in this qualification, the position of these entities are equal.Penelitian ini berfokus menjawab konstitusionalitas kewenangan Badan Usaha Milik Daerah dalam pengelolaan Energi Baru dan Terbarukan. Penelitian ini bertujuan memperoleh dua hal. Pertama, klasifikasi EBT dalam cabang produksi penting dan menguasai hajat hidup orang banyak mengacu dinamika undang-undang dan putusan Mahkamah Konstitusi. Kedua, penentuan kewenangan BUMD terhadap pengelolaan EBT mengacu hak menguasai negara menurut MK. Penelitian ini adalah penelitian hukum normatif berbasis data sekunder. Penelitian ini menghasilkan dua kesimpulan. Pertama, klasifikasi EBT dalam cabang produksi penting dan menguasai hajat hidup orang banyak meliputi nuklir, gas metana batubara, batubara tercairkan dan tergaskan, panas bumi, serta aliran dan terjunan air. Kedua, kedudukan BUMD diklasifikasikan menjadi dua model; (1) BUMN lebih diutamakan daripada BUMD; dan (2) BUMD setara dengan BUMN. Namun, bagi SDA yang tidak termasuk kualifikasi tersebut, kedudukan seluruh badan usaha setara

    Pasca Putusan MK No.93/PUU-X/2012, masih terdapat sengketa perbankan syariah yang kemudian diadili dan diselesaikan melalui Peradilan Umum. Seperti dalam Putusan Pengadilan Negeri Padang No. 27/Pdt.G.S/2022/PN Pdg. Penelitian ini bertujuan untuk mengurai titik singgung wewenang penyelesaian sengketa perbankan syariah pasca Putusan MK No.93/PUU-X/2012. Penelitian ini dilakukan dengan menggunakan jenis penelitian yuridis normatif. Hasil penelitian menunjukkan bahwa Pasca Putusan MK No.93/PUU-X/2012, masih terjadi ketidakpastian hukum dalam penyelesaian sengketa perbankan syariah disebabkan keberadaan Pasal 50 ayat (2) UU Peradilan Agama. Ketentuan tersebut mengakibatkan kekaburan titik singgung wewenang mengadili Peradilan Agama dan Peradilan Umum dalam penyelesaian sengketa hak milik, sengketa perbuatan melawan hukum (PMH), dan sengketa konsumen. Agar nasabah ataupun perbankan syariah mendapatkan kepastian hukum dalam penyelesaian sengketa sesuai amanaat Pasal 28D ayat (1) UUD 1945, diperlukan perubahan terhadap norma dalam Pasal 50 ayat (2) UU Peradilan Agama dan juga UU 8/1999.After the Constitutional Court Decision No.93/PUU-X/2012, there were still sharia banking disputes, which were resolved through the General Courts. As in the Padang District Court Decision No. 27/Pdt.G.S/2022/PN Pdg. This study aims to unravel the intersection of jurisdiction in resolving sharia banking disputes after Constitutional Court Decision. This study uses normative juridical methods. The results of the study show that after the Constitutional Court Decision, there is still legal uncertainty in the settlement of sharia banking disputes due to the existence of Article 50 paragraph (2) of the Law 7/1989 on Religious Courts. These provisions have resulted in a blurring of the points of contact for the authority to adjudicate the Religious Courts and the General Courts in resolving property rights disputes, unlawful acts disputes (PMH), and consumer disputes

    The Impacts of Constitutional Court Decisions on Criminal Policy of Indonesia: Implikasi Putusan Mahkamah Konstitusi Terhadap Politik Kriminal Indonesia

    Artikel ini bertujuan untuk melihat bagaimana dampak Putusan Mahkamah Konstitusi di bidang Pengujian Undang-Undang terhadap perkembangan politik kriminal dan memberikan rekomendasi bagaimana seharusnya MK menguji Undang-Undang pidana di masa yang akan datang. MK sejak berdiri telah menguji berbagai Undang-Undang Pidana di Indonesia, baik dari segi materiil maupun formil. Dalam hukum pidana materiil, MK senyatanya masih konsisten untuk bertindak hanya sebagai negative legislature dan tidak menjadi criminal policy maker. Dalam hukum pidana materiil, MK hanya menjatuhkan putusan untuk dekriminalisasi tindak pidana yang diatur dalam Undang-Undang, seperti dalam pengujian Pasal Penghinaan Presiden dan Perbuatan tidak menyenangkan dalam KUHP. MK juga menolak menghapus unsur “ikatan perkawinan” dalam Pasal 284 KUHP karena berpotensi menjadi kriminalisasi, bukan dekriminalisasi. Namun, pada hukum pidana formil MK bertindak menjadi positive legislature, sebagai contoh dalam putusan penambahan kompetensi praperadilan. Sehingga menunjukan inkonsistensi pada pandangan bahwa MK bukanlah criminal policy maker. MK sejatinya memang tidak memiliki konsistensi dalam menerapkan jucial activism atau judicial restraint dalam menguji suatu Undang-Undang. Dalam konteks hukum pidana yang berkaitan dengan HAM, seharusnya MK hanya bertindak sebagai negative legislature dan dibatasi pada proses dekriminalisasi. Sehingga MK hanya menerapkan judicial restraint ketika menguji Undang-Undang Pidana.In substantive criminal law, the Constitutional Court (MK) has consistently acted as a negative legislature and not as a criminal policy maker. However, in procedural criminal law, the MK has taken on the role of a criminal policy maker. This article aims to examine the impact of the Constitutional Court’s decisions in judicial reviews on the development of criminal policy in Indonesia and to provide recommendations on how the MK should review criminal law in the future. This research is conducted using a doctrinal method strengthened by a statute and case approach. The findings show that, in substantive criminal law, the MK has only issued decisions for the decriminalization of offenses regulated by law, such as in the judicial review of the article on Defamation of the President and Unpleasant Acts in the Criminal Code (KUHP). However, in procedural criminal law, the MK has acted as a positive legislature, for example, by expanding pre-trial competences through its decisions. The MK has not been consistent in applying either judicial activism or judicial restraint in reviewing laws. In criminal policy, the MK should act as a negative legislature and be limited to decriminalization, as a form of judicial restraint

    Hak Menguasai Negara (HMN) memberikan otoritas kepada pemerintah dalam melakukan pemanfaatan terhadap bumi, air, dan kekayaan alam. HMN merupakan refleksi atas Pasal 33 ayat (3) UUD NRI tahun 1945. Kerusakan lingkungan yang semakin masif bahan bakar fosil mensyaratkan pentingnya transisi energi di Indonesia. Penggunaan energi terbarukan dapat menjadi sumber energi sekaligus mendukung pembangunan berkelanjutan. Penggunaan energi terbarukan yang ramah terhadap lingkungan seharusnya tidak menjadikannya sebagai suatu pilihan, melainkan sebagai kewajiban untuk digunakan secara meluas di Indonesia. Pokok permasalahan tersebut melahirkan pertanyaan yakni bagaimana konsepsi HMN dan hubungannya terhadap peran pemerintah dalam menciptakan iklim energi terbarukan di Indonesia. Penelitian hukum normatif digunakan dalam penelitian ini. Pada akhirnya diketahui bahwa konsep HMN telah memberikan kewenangan kepada pemerintah dalam melakukan peruntukan dan pemanfaatan sumber daya alam di Indonesia. Kewenangan pemerintah melalui HMN dapat menjadi sarana dalam membuat regulasi maupun kebijakan atas penggunaan energi terbarukan di Indonesia, serta ditujukan untuk menciptakan sebesar-besar kemakmuran rakyat.The dominance of fossil energy use in the midst of abundant renewable energy potential in Indonesia is the basis for looking at the existence of State’s Rights of Control (SRC) in the energy sector. This research aims to elaborate on the concept of SRC and its correlation to the use of renewable energy in Indonesia. This research was studied with a normative legal approach. The results show that SRC not only gives authority to the government, but also gives responsibility so that the utilization of natural resources is oriented towards the interests and prosperity of the community. The dominance of the use of fossil energy actually puts people and the environment in a threatened condition. Therefore, the selection of renewable energy in the primary energy mix is the responsibility of the government as part of SRC. to encourage the use of renewable energy in Indonesia, strengthening the concept of SRC is needed in every regulation and policy on the utilization of natural resources in the energy sector

    The Role of NGOs in Environmental Governance in Indonesia: Peran Ornop dalam Tata Kelola Lingkungan Hidup di Indonesia

    The role of non-governmental organizations (NGOs) needs to be strengthened to enhance the capacity for environmental governance in Indonesia, as natural resources cannot be effectively protected, and environmental problems cannot be resolved without collaboration between the government and civil society. This research aims to explain the concept and role of NGOs as actors in environmental governance. The research was conducted through a literature review. The results show that NGOs play a significant role in protecting natural resources and assisting in solving environmental issues. In Indonesia, the role of NGOs has been legally strengthened. However, due to the restrictive nature of the environmental legal system, not all NGOs have legal standing to bring lawsuits before the courts. To preserve the environment, the legal standing of NGOs should not be limited, as environmental lawsuits involve the broader public interest and the sustainability of natural resources, both of which must be safeguarded

    Constitutional Court Decision Number 46/PUU-VIII/2010 impacts the position of a child out of wedlock. With the enactment of the decision, a legal relationship arises between the child out of wedlock and his biological father. This article discusses the position of children out of wedlock after the decision is made and how the decision is applied in a notarial deed. The method used in this study is the normative legal method, in which research analyzes norms, laws, regulations, and legal theory related to applying the abovementioned decisions in the context of civil relations of illegitimate children in a notarial deed. Constitutional Court Decision Number 46/PUU-VIII/2010 shows that it cannot be directly applied as a basis for kinship relations between illegitimate children and their fathers. However, this relationship can be recognized through a court decision taking into account science and technology and other relevant evidence

    Standardisation of the Legislation as a Follow-Up to the Constitutional Court’s Decision on Judicial Review of Omnibus Law: Standardisasi Regulasi Tindak Lanjut Putusan Mahkamah Konstitusi pada Perkara Pengujian Undang-Undang Omnibus

    The re-examination of the Job Creation Law in 2023 highlights a serious issue in the national legislative system, specifically the follow-up to the Constitutional Court’s (MK) decisions in judicial review cases (PUU) concerning the Omnibus Law. The urgency of this research stems from the high demand among lawmakers for drafting laws in the omnibus format and the potential for judicial review of such laws. This research contributes to addressing the follow-up to the Constitutional Court’s decisions by focusing on the choice of legislative forms as a response to these rulings. The research employs normative legal methods with conceptual, legislative, and case-based approaches. The findings emphasize the need to standardise the type of regulation to ensure the executability of the Constitutional Court’s decisions. The ideal regulatory form for implementing the Court’s rulings on the Omnibus Law is a law. Therefore, it is necessary to legitimise the use of laws as the standard form of follow-up to the Constitutional Court’s decisions on the Omnibus Law to maximise the executability of these rulings.Pengujian kembali Undang-Undang Cipta Kerja tahun 2023 menandakan sedang adanya permasalahan serius dalam sistem legislasi nasional, utamanya terkait penentuan tindak lanjut atas Putusan Mahkamah Konstitusi pada perkara Pengujian Undang-Undang Omnibus. Rumusan masalah dalam penelitian ini ialah: Pertama, mengapa perlu adanya standarisasi bentuk produk hukum sebagai tindak lanjut Putusan Mahkamah Konstitusi?; Kedua, Bagaimana bentuk produk hukum ideal sebagai tindak lanjut Putusan Mahkamah Konstitusi atas pengujian undang-undang omnibus?. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan konsep, perundang-undangan, dan kasus. Pembahasan dalam penelitian ini ialah bahwa standarisasi bentuk produk hukum dimaksudkan untuk menjamin eksekutabilitas Putusan Mahkamah Konstitusi. Sedangkan bentuk produk hukum ideal sebagai tindak lanjut Putusan Mahkamah Konstitusi ialah undang-undang dengan model fast track legislation. Kesimpulan dalam penelitian ini ialah perlunya legitimasi atas gagasan undang-undang sebagai bentuk tindak lanjut atas Putusan Mahkamah Konstitusi pada perkara pengujian undang-undang omnibu

    Resolving Institutional Dualism of Election Supervisory Institutions in Aceh Province: Penyelesaian Dualisme Kelembagaan Lembaga Pengawas Pemilihan Umum di Provinsi Aceh

    Hingga saat ini, dualisme kelembagaan lembaga pengawas pemilu dan pilkada di Aceh masih terjadi. Kondisi tersebut masih menyisakan masalah dalam pelaksanaan pengawasan pemilu dan pilkada di Aceh. Artikel ini memfokuskan bahasan pada aspek pilihan kebijakan hukum yang dapat diambil untuk menyelesaikan dualisme tersebut. Penelitian ini merupakan penelitian hukum normatif yang sepenuhnya menggunakan data sekunder berupa bahan hukum primer dan sekunder. Kajian ini berkesimpulan bahwa akar persoalan dualisme lembaga pengawas pemilu dan pilkada di Aceh disebabkan tidak sinkronnya pengaturan UU Pemilu dan UU Pilkada dengan UU Pemerintahan Aceh. Hal itu juga diperkuat dengan Putusan MK yang menyatakan Pasal 557 dan Pasal 571 huruf d UU Pemilu bertentangan dengan UUD 1945 karena pembentukannya tidak sesuai dengan ketentuan perubahan UU Pemerintahan Aceh yang dimuat dalam UU Pemerintahan Aceh itu sendiri. Penelitian ini merekomendasikan agar dualisme kelembagaan lembaga pengawas pemilu dan pilkada di Aceh segera diakhiri melakukan perubahan terhadap UU Pemilu, UU Pilkada dan UU Pemerintahan AcehUntil now, the institutional dualism of election monitoring institutions and regional elections in Aceh still exists. This condition still leaves problems in the implementation of election supervision and regional elections in Aceh. This article focuses discussion on aspects of legal policy choices that can be taken to resolve this dualism. This research is normative legal research which fully uses secondary data in the form of primary and secondary legal materials. This study concludes that the root of the problem of dualism in the election and regional election supervisory institutions in Aceh is due to the lack of synchronization in the regulation of the Election Law and the Regional Election Law with the Aceh Government Law. This was also reinforced by the Constitutional Court\u27s decision which stated that Article 557 and Article 571 letter d of the Election Law were contrary to the UUD 1945 because their formation was not in accordance with the provisions of the amendment to the Aceh Government Law contained in the Aceh Government Law itself. This research recommends that the institutional dualism of election and regional election supervisory institutions in Aceh be ended immediately by making changes to the Election Law, Regional Election Law and Aceh Government Law
