Evolving the Concept of Default in Relation to Losses Arising from Standard Agreements for Bank Account Openings
This research examines the legal responsibility of banks as commercial service providers, which is primarily based on contractual obligations with consumers. While the foundation for customer claims against banks typically arises from breaches of these agreements, the Consumer Protection Law does not explicitly outline various forms of responsibility, resulting in numerous decisions by the Consumer Dispute Settlement Body being overturned by the Supreme Court. One significant issue is the law’s lack of provision for legal claims beyond tort. Using a normative methodology based on Law Number 8 of 1999 on Consumer Protection, this study underscores the need for a legal framework that emphasizes risk-based bank responsibility for losses stemming from standard agreements in opening bank accounts. This development is essential for strengthening consumer protection and achieving a balance between consumer interests and the rights of business actors, thereby promoting a healthier economic environment
Legal Reformulation of Banking Consumer Protection: Building A Justice-Oriented Regulatory System
The contractual relationship between banks and customers in credit agreements often places customers in a weak position, as agreements are typically drafted unilaterally by banks and emphasize obligations over rights, creating potential harm. This article aims to reformulate banking customer protection regulations to improve legal certainty and effectiveness. Using a normative legal method with an empirical approach, the research examines the suitability, gaps, and inconsistencies in existing regulations in achieving fair protection. The findings show that consumer protection aligns with Article 28D(1) of the 1945 Constitution, which guarantees the right to legal protection and security. However, current banking regulations lack specific provisions and enforcement mechanisms, resulting in weak protection. Disputes are often resolved through administrative or criminal sanctions that do not ensure fair outcomes. POLIGAMI TIDAK TERCATAT DI INDONESIA: KAJIAN YURIDIS BERDASARKAN KOMPILASI HUKUM ISLAM
This study examines the juridical implications of unregistered polygamous marriages in Indonesia based on the provisions of the Compilation of Islamic Law (KHI). Although such marriages may be religiously valid, the absence of official registration results in the marriage not being legally recognized by the state, creating significant legal vulnerabilities for both wives and children. This research employs a normative legal approach by analyzing statutory regulations, the KHI, and relevant court decisions. The findings indicate that KHI regulates polygamy through strict requirements, including court authorization, the husband’s ability to act fairly, and consent from the first wife. Failure to meet these requirements renders unregistered polygamy a violation of administrative order and without legal force. As a result, wives lose access to legal protection, while children face obstacles in establishing lineage and civil rights. This study emphasizes the importance of marriage registration as a foundation for legal protection
Aspek Hukum dalam Penyelesaian Sengketa Penguasaan dan Pembangunan Rumah di Atas Tanah Milik Orang Lain
Sengketa penguasaan dan pembangunan rumah di atas tanah milik orang lain merupakan permasalahan hukum yang kompleks dan memerlukan penyelesaian yang adil. Penelitian ini bertujuan untuk mengkaji dasar hukum perlindungan terhadap pemilik tanah serta mekanisme penyelesaian sengketa yang tersedia di Indonesia. Dengan menggunakan metode yuridis normatif, penelitian ini menganalisis peraturan perundang-undangan seperti UUPA, KUHPerdata, dan KUHP, serta studi kasus untuk memahami implementasi hukum dalam praktik. Hasil penelitian menunjukkan bahwa pemilik tanah memiliki perlindungan hukum yang kuat melalui jalur litigasi maupun non-litigasi, termasuk mediasi dan arbitrase. Namun, kendala seperti lemahnya penegakan hukum, birokrasi yang lambat, dan kurangnya kesadaran masyarakat masih menjadi hambatan utama. Oleh karena itu, diperlukan reformasi sistem administrasi pertanahan, peningkatan kesadaran hukum masyarakat, serta penguatan penegakan hukum untuk menciptakan keadilan dan kepastian hukum dalam penyelesaian sengketa tanah.

Law Enforcement Against Environmental Pollution by the Way Kanan District Environmental Service
Environmental management and protection is currently a fundamental problem in Indonesia. The form of environmental protection regulation is Law Number 32 of 2009 concerning Environmental Protection and Management. One form of environmental pollution found in Way Kanan Regency is environmental pollution caused by the manufacture of liquid rubber waste. The research method used is a normative-empirical research method, using a statute approach and an in-depth interview approach related to environmental law enforcement against environmental pollution. The problems that will be discussed in this study are How is Law Enforcement by the Environmental Service against environmental pollution in Way Kanan Regency and what are the inhibiting factors for the Environmental Service in implementing environmental pollution law enforcement in Way Kanan Regency
Hak Perempuan dan Hukum Perceraian Islam: Antara Otonomi Agama dan Perlindungan Minoritas
The application of Islamic divorce law in societies that adhere to legal pluralism presents unique challenges, particularly in the context of protecting women\u27s rights when the Muslim community is a minority. In a number of countries, Islamic family law is still used as an internal guideline for Muslim communities in resolving divorce and property division issues. However, this practice often conflicts with human rights principles, particularly those related to gender equality. This study aims to analyze how pluralistic countries balance respect for religious freedom with the state\u27s obligation to protect individual rights. The research methodology used is a qualitative approach with normative and comparative juridical methods, through analysis of legislation, court decisions, and legal literature in the United Kingdom, India, and Indonesia. The study results indicate that the protection of women\u27s rights should not be compromised in the name of cultural tolerance or religious autonomy. The state has a crucial role to ensure that the application of religious law is fair, voluntary, and transparent, and in line with the principles of justice and equality for all citizens.Penerapan undang-undang perceraian Islam dan perlindungan hak-hak perempuan dalam masyarakat yang beragam, terutama ketika komunitas Muslim adalah minoritas. Di banyak negara yang mengakui pluralisme hukum, hukum keluarga Islam sering memandu komunitas Muslim dalam menangani masalah seperti perceraian dan pembagian properti. Namun, penerapan undang-undang ini sering menghadapi tantangan ketika bertentangan dengan prinsip-prinsip hak asasi manusia, khususnya mengenai kesetaraan gender. Artikel ini mengeksplorasi bagaimana negara-negara pluralistik menyeimbangkan menghormati otonomi beragama dengan melindungi hak-hak individu, terutama bagi perempuan yang rentan terhadap diskriminasi. Melalui analisis komparatif kasus-kasus di Inggris, India, dan Indonesia, makalah ini menyoroti perlunya sistem hukum yang menghormati keyakinan agama dan memberikan keadilan nyata bagi semua warga negara. Artikel tersebut berpendapat bahwa hak-hak perempuan tidak boleh dikorbankan atas nama toleransi budaya atau kebebasan beragama.
