    Democracy is recognized as the meaning of government is from the people, by the people, for the people and together with the people. This is manifested among others by the existence of general election. How if there are some countries claimed that their countries applied democratic system without having general election. Did this case justified in a democratic system, such as Indonesian where the majority of people state that this country is part of the countries with democratic systems, but on the other hand, Yogyakarta as one of provinces of Indonesia did not organize the democratic election of governor and deputy governor which automatically removes political rights of citizens in Yogyakarta.     Legalitas Hukum Komisi Pemilihan Umum Daerah dalam Menyelenggarakan Pilkada

    Penelitian ini membahas legalitas hukum Komisi Pemilihan Umum Daerah (KPUD) dalam menyelenggarakan pemilihan kepala daerah pasca putusan Mahkamah Konstitusi Nomor 97/PUU-XI/2013. Penelitian ini bertujuan untuk menganalisis dan memahami legalisasi pengaturan kedudukan hukum KPUD dalam penyelenggaraan Pilkada pasca putusan MK Nomor 97/PUU-XI/2013. Jenis penelitian yang digunakan adalah yuridis-normatif, dengan teori lembaga negara, hierarki, kewenangan, keabsahan hukum, dan tujuan hukum. Hasil penelitian yang diperoleh adalah bahwa legalitas kedudukan hukum KPUD dalam penyelenggaraan Pilkada pasca putusan MK Nomor 97/PUU-XI/2013 yaitu bahwa KPUD tidak dapat menyelenggarakan Pilkada karena KPUD bagian dari KPU yang bersifat hierarki, sedangkan KPU berwenang secara konstitusional menyelenggarakan Pemilu, sedangkan Pilkada bukan bagian dari Pemilu pasca putusan MK Nomor 97/PUU-XI/2013 dan KPUD bukan lembaga daerah yang diberikan tugas khusus oleh undang-undang untuk menyelenggarakan pilkada, tugas menyelenggarakan Pilkada tersebut diberikan oleh undang-undang kepada KPU dan dilaksanakan oleh KPUD.The study addressed the legality of Regional Election Commission (KPUD) to hold local elections after the decision of the Constitutional Court No. 97/PUU-XI /2013. It aims to give analysis and to better understand the law that provides legal status of KPUD for organizing the elections after the court decision. The type of research is a juridical-normative research by employing the theory of state organs, hierarchy, powers, legal validity, and legal objectives. The obtained results showed that based on its legal status in organizing regional head elections, after the judgment of the Court decision No. 97/PUU-XI/2013, KPUD cannot hold regional head elections due to its position as subordinate of KPU as a hierarchical organization. KPU has the constitutional power to hold elections while regional head elections are not parts of the Election after the decision of the Constitutional Court No. 97/PUU-XI/2013. KPUD is not a regional organ given a special duty by the law to hold a local election. The task of organizing the local election is given by law to KPU and implemented by KPUD

    The overall impact of the acts of corruption according to criminology science, certainly can happen due to two things, namely the first due to the intent or in the science of law is referred to as the evil inner attitude (Mens Rea), and the second because of an opportunity to do evil deeds (Actus Reus). Actus Reus and Mens Rea are an essential element of a crime. The eradication of corruption and the efforts of promoting and fulfilling human rights are not simply left to the elite rulers, because frequently they are more corrupt and oppressive. Corruption eradication efforts can be maximized, while a simultaneous awareness of the Government and people of the importance of protecting, fulfill, maintain, and promote human rights, then it is not impossible that Indonesia becomes a prosperous country, given the authorized capital of development in this country has been in existence since ancient times which is a priceless grace of God Almighty. How To Cite: Ansori, A.     Criminal Justice System of Children in The Law Number 11 of 2012 (Restorative Justice)

    The future of the children will determine the future of the nation. The increasing problem of juvenile delinquency in this globalization and information technology era, requires the state to give more attention to the child's future. Application of the criminal justice system for children in Indonesia is as stipulated in Law Number 3 of 1997 potentially detrimental to the child's interests. In practice, the judicial system had many problems, among them is a violation of the rights of children, such as: physical and psychological violence, as well as deprivation of the right to education and welfare. It happened because the juvenile justice system is against to national and international regulations on the protection of children’s rights. Besides that, theory of punishment for the juvenile delinquency still refers to the concept of retribution for the crimes. This concept is not very useful for the development of the child, so the concept need to be repaired with the concept of restorative justice. With this concept, the criminal justice system for the juvenile delinquency, leads to the restoration of the state and the settlement pattern, involving the perpetrator, the victim, their families and engage with the community. This is done with consideration for the protection of children against the law.     THE HERMENEUTICS OF KHALED M. ABOU EL-FADL AND ITS RELEVANCE WITH RELIGIOUS MODERATION IN INDONESIA

    Hermeneutics is an interpretation method that develops in the study of texts. Its usage in the horizon of Islamic text study (Qur’an and Hadith) is not an exception. One figure who discusses different areas of Islamic law is Khaled M. Abou El-Fadl. Khaled has analyzed various texts in Islamic law and their relation to people's lives. This study attempts to explore the thoughts of Khaled M. Abou El-Fadl, especially regarding hermeneutics in analyzing texts and its relation with religious moderation in Indonesia. This study implements the literature review method, where the researcher reviews several works of Khaled M. Abou El-Fadl and other relevant articles. The results of this study reveal that the core problems of authoritarianism in interpretation are the methodological procedural errors of the three elements, namely: the author, text, and reader. The meaning of a text should occur from a complex, interactive, dynamic, and dialectical process between the three elements. Interpreters cannot avoid his subjectivity, therefore an interpreter should fulfill five conditions namely honesty, sincerity, thoroughness, rationality, and self-control. Khaled Abou el-Fadl's hermeneutics is very relevant as a concept of understanding religious teachings to foster and maintain religious moderation, namely mutual understanding between religions and between denominations within a religion

In this writing the author uses a normative juridical method with research specifications in the form of descriptive analysis. In this era of globalization, drug trafficking is no longer only carried out by individuals, but involves many people, even gathered as one syndicate which is organized with a wide network and works in a neat, systematic and very secretive manner at both the national and international levels. POLRI as an institution that handles drug problems, collaborates with drug crime organizations by implementing laws and regulations firmly and consistently. Apart from that, POLRI also carries out cooperation between domestic agencies and also mutually beneficial international cooperation. The POLRI Narcotics Investigation Unit has the task of carrying out the development of investigative functions, investigating, supervising investigations into criminal acts of illicit drug trafficking. In general, the Narcotics Investigation Unit has the function of investigating and investigating criminal acts of drug abuse and illicit trafficking

    Mohammad Hasyim Asyári dalam format pembaharuannya berpendapat bahwa dalam mempelajari agama Islam tidaklah mungkin kalau tidak mau membaca dan meneliti karya Ulama dahulu dan sangat tidak mungkin langsung mengambil dari sumbernya yang asli Mohammad Hasyim tidaklah menolak anggapan kaum Wahabi bahwa praktek keagamaan kaum muslimimn pada waktu itu bercampur dengan praktek yang datangnya bukan dari Islam dan Bahkan syirik oleh karena belum ternetralisir secara tuntas dari tauhid yang murni. Rumusan masalah penelitian ini adalah; 1. Bagaimankah perkembangan pemikiran KH Mohammad Hasyim Asyári dalam merumuskan faham Ahlussunah Waljamaáh terutama dalam pendekatan al Manhaji. 2. Bagaimana pula format atau rumusan tentang Ahlussunah Waljamaáh yang dirumuskan KH. Hasyim Asyári.3. bagaimana pula dari dampak rumusan tersebut bagi kalangan kaum Nahdziyin dan dunia pesantren salaf pada khususnya. Metode pembahasan penelitian ini menggunakan metode induksi, metode deduksi dan metode historis. Kesimpulan daripenelitian ini adalah; 1. Yang mempengaruhi orientasi pemikiran KH.Mohammad Hasyim Asyári dalam merumuskan faham Ahlussunnah Waljamaáh adalah Syeh Nawawi Banten dan Syeh Mahfud Atturmuzy. 2. KH.Mohammad Hasyim Asyári dalam merumuskan Ahlussunnah Waljamaáh menggunakan pendekatan al Manhaji (mettodologi berfikir) mendahulukan Nash baru akal dalam menentukan dan menjawab setiap problematika yang terjadi. 3. Adapun format Ahlussunnah Waljamaáh pendekatan al Manhaji ini adalah mengikuti system bermadzab terutama madzahibul arbaáh (ABU hanifah, Imam Maliki, Moh. Idris Assyafií dan Ibnu Hambal)

    Quantitatively, there is a gap between the number of limited religious texts and the enormous reality of dynamic context. Indeed, in the main principle of Islamic law, every activity carried out by a Muslim must comply with sharia rules. The syara’ regulations are religious texts concerning words, actions, or other activities carried out by someone capable of law (mukallaf). To overcome the possible gap between the text and the context, the scholars (ulama) formulate various methods with the result that Islamic law can be a medium of connecting and an effective means of compromising religious texts with one’s activities. With the production of these various methods, the production of texts that have ended since the death of the Prophet Muhammad ± 1500 years ago will still have control and be able to guide humankind. This article discussed how fatwa, as scholars’ thoughts, has a dialectic with society’s reality. In addition, it also explored fatwas’ practical level. In fact, fatwa is one of the efforts to find syar’i answers to various problems arising in human life, especially in modern time

    IntroductionWhistleblowers serve as pivotal actors in exposing corruption within governmental and institutional systems. While Indonesia has formal legal instruments aimed at protecting whistleblowers, practical challenges persist, and public perception continues to discourage reporting. Despite Islamic ethical teachings that support moral intervention, cultural and institutional obstacles remain unaddressed. This study investigates whistleblower protection in Indonesia from both legal and Islamic economic perspectives.ObjectivesThe study aims to evaluate the effectiveness of whistleblower protection regulations in Indonesia, identify legal and institutional gaps, and explore how Islamic ethical principles can support and enhance existing mechanisms to promote ethical reporting and institutional accountability.MethodUsing a qualitative research approach, this study applies a structured literature review of statutory laws, academic publications, institutional documents, and comparative international frameworks. It integrates positive legal analysis with normative Islamic economic thought to assess the institutional and cultural readiness of Indonesia to protect and empower whistleblowers in corruption-related cases.ResultsThe study reveals that while legal frameworks such as Law No. 31 of 2014 offer formal protection, enforcement is weak, jurisdictional overlaps exist, and regional implementation is inconsistent. Institutions like the LPSK and KPK lack adequate coordination and resources, particularly outside Jakarta. Public stigma against whistleblowers remains high. Comparative analysis shows that countries with clear reporting procedures and strong enforcement offer better protection. Islamic ethical principles such as justice (adl), accountability (mas’uliyyah), and public welfare (maslahah) can serve as normative frameworks to strengthen public trust and ethical motivation for whistleblowing.ImplicationsThe findings suggest that whistleblower protection in Indonesia requires a multidimensional reform strategy involving legal precision, institutional capacity building, and cultural transformation. Incorporating Islamic values into education, legal discourse, and institutional governance may promote greater societal acceptance and operational effectiveness of whistleblower mechanisms.Originality/NoveltyThis study offers a unique contribution by synthesizing legal analysis with Islamic ethical principles to propose a hybrid framework for whistleblower protection. It highlights the necessity of culturally grounded legal reform in Muslim-majority contexts and provides actionable recommendations for legal, institutional, and educational policy development

    Tujuan penelitian ini adalah: 1) Untuk mengetahui kepemimpinan instruksional kepala madrasah, supervisi akademik pengawas dan profesionalitas guru di MAN Rembang dan MAN Lasem, 2) Untuk menguji secara empiris pengaruh kepemimpinan instruksional kepala madrasah terhadap profesionalitas guru di MAN Rembang dan MAN Lasem, 3) Untuk menguji secara empiris pengaruh supervisi akademik pengawas terhadap profesionalitas guru di MAN Rembang dan MAN Lasem, 4) Untuk menguji secara empiris pengaruh kepemimpinan instruksional kepala madrasah dan supervisi akademik pengawas terhadap profesionalitas guru di MAN Rembang dan MAN Lasem. Penelitian ini menggunakan pendekatan field research dengan metode angket yang disebarkan langsung pada guru MAN Rembang dan MAN Lasem sebanyak 85 responden. Teknik pengambilan sampel menggunakan simple random sampling. Teknik analisis data menggunakan analisis path. Adapun hasil temuan penelitian ini adalah: 1) Kepemimpinan instruksional kepala MAN Rembang dan MAN Lasem tergolong baik dengan mean sebesar 112,60, supervisi akademik pengawas tergolong cukup dengan mean sebesar 107,66 dan profesionalitas guru tergolong cukup dengan mean sebesar 111,48 2) Kepemimpinan instruksional kepala madrasah memiliki pengaruh positif dan signifikan terhadap profesionalitas guru di MAN Rembang dan MAN Lasem ini dibuktikan dari hasil pengolahan komputer dapat diketahui bahwa nilai thitung > ttabel, yaitu nilai thitung sebesar 0,328 > ttabel sebesar 0,213, 3) Supervisi akademik pengawas memiliki pengaruh positif dan signifikan terhadap terhadap profesionalitas guru di MAN Rembang dan MAN Lasem ini dibuktikan dari hasil pengolahan data dapat diketahui bahwa nilai thitung > ttabel, yaitu nilai thitung sebesar 0,296 > ttabel sebesar 0,82, 4) kepemimpinan instruksional kepala madrasah dan supervisi akademik pengawas memiliki pengaruh terhadap profesionalitas guru di MAN Rembang dan MAN Lasem ini dibuktikan dari hasil pengolahan data dapat diketahui bahwa nilai F sebesar 11,307 dengan taraf signifikasi 0,000 lebih kecil 0,005 (Sig.<0.05
