Get PDFDissertação (mestrado) - Universidade Federal de Santa Catarina, Centro de Ciências Jurídicas, Programa de Pós-Graduação em Direito, Florianópolis, 2014.A base desta pesquisa é o diálogo entre os pressupostos do positivismo e do pluralismo jurídico enquanto correntes teóricas que estabelecem uma racionalidade que controla a produção do discurso jurídico através da invocação da utilização dos métodos de interpretação jurídica: a hermenêutica. Influenciada pelo seu pressuposto doutrinário, identificam-se alguns critérios de legitimidade na interpretação do direito que constitui a decisão da autoridade competente e indicam-se limites para a fundamentação considerada jurídica de uma decisão. O problema estudado é a reinterpretação do texto legal vigente inalterado, aquele em lei posta pelo Estado, que estabelece um significado como prevalecente e define um novo precedente a ser seguido. O escopo do trabalho limita seu exame aos votos dos Ministros do Supremo Tribunal Federal ao decidirem a Ação Direta de Inconstitucionalidade n. 4.277 que tratou do reconhecimento jurídico da união homoafetiva. Neste caso de interpretação conforme a constituição, haveria uma lacuna de cunho axiológico a ser colmatada e uma rol de possibilidades que seriam conflitantes com a norma superior.Abstract : This research is developed upon assumptions of legal positivism and legal pluralism as schools of law that sustain a distinct rationality which stablishes a form of control of what is considered a legal speech through interpretation methods. Some criteria of legitimacy on the interpretation of the law in a decision are identified by these assumptions embedded in the interpretation and such serve to indicate limits to legality of arguments in the decision. The problem observed is the reinterpretation of the legal text, the one place by the State, that establishes a certain meaning as proper and sets a new precedent to be followed. The extent of this research is the study of the speech of judges in the Supremo Tribunal Federal in the ruling of Ação Direta de Inconstitucionalidade n. 4.277, about the legal recognition of same sex union. In this case of constitution compliance through interpretation, there is a axiological gap to be filled and a set of interpretation possibilities in conflict with the constitution
INTERPRETAÇÃO CONFORME A CONSTITUIÇÃO NA ADI 4277
Get PDFEste artigo possui o escopo de retratar a aplicação da interpretação conforme a constituição na ADI 4277 referente ao reconhecimento da união homoafetivacomo entidade familiar. Com o estudo que se segue, procurou-se descortinar a implícita finalidade judiciária de usurpar e desrespeitar a obra legislativa ao exercer o famigerado ativismo judicial. O presente artigo se justifica pela relevância presente no tema exposto e pela necessidade de se demonstrar a desproporção existente entre a colocação doutrinária da interpretação conforme e sua aplicação prática. A slow bar in the lenticular barred galaxy NGC 4277
Get PDFAims. We characterised the properties of the bar hosted in lenticular galaxy NGC 4277, which is located behind the Virgo cluster.
Methods. We measured the bar length and strength from the surface photometry obtained from the broad-band imaging of the Sloan Digital Sky Survey and we derived the bar pattern speed from the stellar kinematics obtained from the integral-field spectroscopy performed with the Multi Unit Spectroscopic Explorer at the Very Large Telescope. We also estimated the co-rotation radius from the circular velocity, which we constrained by correcting the stellar streaming motions for asymmetric drift, and we finally derived the bar rotation rate.
Results. We found that NGC 4277 hosts a short (Rbar = 3.2 +0.9 −0.6
kpc), weak (S bar = 0.21 ± 0.02), and slow (R = 1.8 +0.5
−0.3) bar and its pattern speed (Ωbar = 24.7 ± 3.4 km s−1 kpc−1) is amongst the best-constrained ones ever obtained with the Tremaine-Weinberg (TW) method with relative statistical errors of ∼ 0.2.
Conclusions.
NGC 4277 is the first clear-cut case of a galaxy hosting a slow stellar bar (R > 1.4 at more than a 1σ confidence level)
measured with the model-independent TW method. A possible interaction with the neighbour galaxy NGC 4273 could have triggered the formation of such a slow bar and/or the bar could be slowed down due to the dynamical friction with a significant amount of dark matter within the bar region
Going Beyond Counting First Authors in Author Co-citation Analysis
Get PDFThe present study examines one of the fundamental aspects of author co-citation analysis (ACA) - the way co-citation
counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings
are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that
only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into
account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed. Reasons for these effects are discussed
