Pirmojo Lietuvos Statuto (toliau – PLS)15 – pagrindu. Jame „atrasti“ kūnai ar jų dalys, be to, bus interpretuojami ir plastesniame XVI a. The category of the body is the main object of this study. The paper hopes to further examine the “corporal” theme in the research of the history of the Grand Duchy of Lithuania while simultaneously aiming to outline the countours of the concept. Being a legal codex, The First Statute of Lithuania (1529) was chosen as a foundational text for this study since it pertains to various aspects of both public and private life. Albeit not exhausting all possible interpretations, three bodies were examined more closely: that of a nobleman, of the grand duke, and of the state (the Grand Duchy) – each more abstract than the former. First of these can be associated with terms of status and honour, the second functions as if by extensions of ducal officers and medias, while the third is characterized by the matters of indivisibility, inalienation and membership. Moreover, three different properties (or faculties) were attributed to the body: epistemological (via senses and body marking), agential (as a mean to excercise one’s will and freedoms), and individualizing (as in the problem of belonging). Keywords: body, the First Statute of Lithuania, monarch, nobility, political theology, law, Grand Duchy of Lithuania

XVI a. modernėjant Lietuvos Didžiajai Kunigaikštystei (toliau – LDK) valstybės kanceliarija tapo viena svarbiausių institucijų. The article examines what influence the number of signed documents had on the careers of GDL scribes. In order to do this, a statistical method is used in this article. The statistical data (see appendices no. 2 and 3) lead to the conclusion that persons who were active in their daily work were more successful in climbing the career ladder. These are Leonas Sapiega, Gabrielius Vaina, Eustachijus Valavičius (the future bishop of Vilnius) and Aleksandras Gosievskis. These individuals have one thing in common – they all started working in the office at a relatively young age. The conducted research allows to see a connection between a person’s education, his professional activity and a more successful career. However, it is important not to forget the informavo influence as well. For example, M. Vaina was one of the most active scribes of the LDK office, but he did not have an impressive career. The importance and influence of education on the career of a scribe is also illustrated by the case of Valavičius brothers. E. Valavičius surpassed his older brother Jeronimas with having a better education, being more active in the chancellery which allowed him to reach the post of chancellor sooner. This case shows that it didn’t matter how long a person had worked in the office before moving up the career ladder. Consequently, education, activity and the ability to maintain good relations with the social environment were more important for the career of a scribe than the work experience. 1. 2. M. J. Gorskio naudotą heraldiką galima suskirstyti į du etapus. Pirmame etape (iki 1753 m.), vedęs Teresę Nagurskytę, jis pagrindinį dėmesį skyrė tėvų heraldikos manifestacijai (pirmojo tipo antspaudas). Antrajame etape (1753–1776 m.), prasidėjusiame vedybomis su Marijona Regina Vainaite ir užsibaigusiame paties kašteliono mirtimi, antspaudų (antrojo–penktojo tipo), koklių, fundacinių ženklų centre dvilaukiame skyde įsitvirtino santuokinis herbas, kurio heraldinėje dešinėje buvo M. J. Gorskio Galvaraiščio, o kairėje – M. R. Vainaitės Trijų ragų herbų figūros. 3. Antrajame laikotarpyje Žemaitijos kašteliono heraldika pamažu sudėtingėjo, šalia pasikartojančių puošimo detalių (šalmo karūnėlė, kunigaikštiška mantija ir kiti) joje atsirado naujų aspektų: a) antrojo tipo antspaude kairiajame skydo kampe panaudota erelio galva (Kėdainių grafystės valdymas) – atspindėjo M. J. Gorskio ekonominio potencialo augimą; b) trečiojo tipo antspaude virš skydo esantis vyro herbo papuošalas – panaudotas tipinis santuokinio herbo elementas; c) ketvirtojo, penktojo tipo antspauduose atvaizduoti jo augantį statusą perteikiantys ženklai: Rusijos Šv. Onos (1764) ir Šv. Stanislovo (1772) ordinų kaspinai ir kryžiai, pareigybių trumpiniai. 4. Tad neatsitiktinai M. R. Vainaitės dėka XVIII a. antroje pusėje Gorskių giminė pagal ekonominį pajėgumą pateko į stambiausių Lietuvos žemvaldžių dvyliktuką. Raktiniai žodžiai: antspaudas, fama, Gorskiai, herbai, Salantai, vedybos, Vainos, Vilnius, ŽemaitijaThis article presents an analysis of the heraldry of the Samogitian castellan Michał Jan Gorski (1717–1776), based on the 36 seals he used, three types of armorial stove tiles and two marks of patronage (at the Dominican Church of the Holy Spirit in Vilnius and the Telšiai Cathedral). These sources highlighted the development of his heraldry, while the application of semiotics and the social history approach helped reveal the motives for why the castellan used his much-admired marital coat of arms for so long. The heraldry used by Gorski may be divided into two stages. In the first (up to 1753), upon marrying Teresa Nagórska, he concentrated mostly on the manifestation of his parents’ heraldry (the type I seal). In the second stage (1753–1776), which began with his marriage to Marianna Regina Wojna and ended with the castellan’s own passing, his seals (types II to V), stove tiles and marks of patronage all featured his marital coat of arms in the centre of the two-field shield, with Gorski’s Nałęcz on the heraldic right, and the three horns of Wojna’s Trąby on the heraldic left. In addition, during the second stage the Samogitian castellan’s heraldry gradually grew more complex, where alongside the repeating decorative details (the crown on the helmet, the ducal mantle, etc.), new aspects emerged: a) an eagle’s head was used in the left corner of the shield on the type II seal, which signified rule over the county of Kėdainiai and reflected the growth of Gorski’s economic potential; b) the male heraldic ornament above the shield on the type III seal – a typical marital coat of arms element was used; c) symbols conveying the castellan’s rising status were used on the type IV and V seals: the ribbons and crosses from the Russian Order of Saint Anna (1764) and the Polish-Lithuanian Commonwealth’s Order of Saint Stanislaus (1772), and abbreviations of the offices he held. The functionality of the Samogitian castellan’s marital coat of arms (with the Wojna family’s Three Horns) even after the death of his second wife and his entering into a new marriage demonstrates its importance to Gorski, which depended on several factors. First, M. R. Wojna came from a family that his its own fama – its members in the Grand Duchy of Lithuania held high secular and religious offices in the 16th–17th centuries. Second, this family had a well known memoria (burial) place in the capital of the Grand Duchy of Lithuania – the Wojna Chapel in the Vilnius Cathedral. Third, certain factors (nine children, his request to be buried next to this wife, a longer period of mourning, perhaps, after her passing, three surviving portraits of this woman, etc.) testify that this couple shared a warm, close relationship. Fourth, Gorski’s second wife was the last representative of the Wojna family in the Grand Duchy of Lithuania. Thus, by marrying her, the Samogitian castellan not only took over the entire landholdings of this family, which significantly increased his economic potential, but also part of this family’s respectability, or fama, which he earnestly reminded other castellans of by specifically using his marital coat of arms. The latter instance shows how successful marital policy could be cleverly conveyed in the heraldry of the nobility. The Wojna family’s coat of arms in the marital heraldry of the Samogitian castellan was his social capital, becoming a part of his identity and paving the way for Gorski’s growth in status. We can see this not only from his ascent through various offices in the Duchy of Samogitia, but also from unofficial titulature, where Gorski was initially identified as the “lord of Kražiai and Salantai” before eventually being titled as count (from 1767). Thus, it is no accident that thanks to M. J. Wojna, the Gorski family featured among the top-twelve largest Lithuanian landowners according to their economic capability in the second half of the 18th century. The Implementation of consensual tenet in modern civil procedure: comparative analysis of court-connected settlement procedures applied in Austria, Lithuania, and Ukraine

    No full text
Background: In this article, the co-authors continue exploring the observable changes in the orientation of civil procedure, moving from competitive and adversarial models towards more cooperative and consensual approaches. Specifically, this work aims to disclose the peculiarities of practically implementing the principles of mutual cooperation and consensuality in civil procedure. The research delves into court-connected settlement procedures in three European countries: Austria, Lithuania, and Ukraine. Through a comparative analysis of the legal regulations and practices in the selected countries, the article evaluates the impact of the application of settlementoriented procedures on fostering a more amicable resolution of civil disputes. Methods: Research commenced with a review of the existing scientific literature, a brief historical analysis, and a document analysis concerning the legal framework of settlementoriented procedures applied in the civil process in selected countries. This work is the continuation of the previous research of the co-authors, aiming to explore how the identified global trend of the drift towards a consensual tenet in the civil procedure was reflected in the selected countries’ legal legislation and practice. The Austrian, Lithuanian, and Ukrainian legal frameworks of court-connected settlement-oriented procedures were compared to acknowledge the existing variety and specifics of national approaches towards consensuality in the civil procedure in different jurisdictions. Results and Conclusions: The ideas of a more socially oriented and consensual civil procedure are implemented in the civil procedure of Austria, Lithuania, and Ukraine through the introduction of settlement-oriented methods of dispute resolution, such as court conciliation and court mediation. Despite the wide common understanding of these amicable procedures, essential differences in the theoretical understanding of the concept and its implementation in the analysed jurisdiction were identified. This research assists dispute resolution practitioners and researchers interested in better understanding the implementation of court-connected settlement-oriented procedures in different jurisdictions

Enhancing active learning through a holistic approach: a case study of primary education in Lithuania

    No full text
The renewed Lithuanian General Framework for Primary Education emphasises an integrated and holistic approach, advocating for active, experiential learning methods without compartmentalisation (2022). This study aims to determine which active, holistic educational methods are prevalent in the Lithuanian primary education system. In holistic education theory, active learning methodologies are divided into transactional and transformational strands. To accomplish the research goal, we carried out a two-phase quantitative study. This study involved 365 Lithuanian primary school teachers and seven public primary schools. The researcher observed 30 lessons conducted by different teachers. The collected data underwent quantitative analysis and qualitative interpretation. The results indicate that transaction-oriented active learning methods, such as group work, discussion, and play-based learning, are standard in Lithuanian primary education settings. The study identifies a lack of transformative educational approaches at the primary level. Keywords: holistic education; active learningmethods; primary education; survey; classroomobservation

When the post-truth devil hides in the details: a digital ethnography of virtual anti-vaccination groups in Lithuania

    No full text
The main aim of this article is to understand how anti-vaccination communities on social media platforms can shape and rationalise their perception of truth, by using a theoretical lens of post-truth studies, and what contextual features frame the formulation of vaccine-related truth statements in post-Soviet contexts. This article explores two of the largest anti-vaccination Facebook groups in Lithuania. An attempt is made to get closer to the participants’ worldview by gathering data using a digital ethnography inspired approach, and then analysing the data with text-based methods. Content analysis was used to find the main themes and to merge them with wider analytical categories, which allows the ongoing process in the wider theoretical context to be investigated. Afterwards, discourse analysis was performed because the overall course of the research called for re-evaluation of the topic and methods from multiple angles. During the research, four analytical categories were outlined: crisis of trust, competing with science, populism, and an anti-public discourse. The Lithuanian case reveals that the proliferation of these narratives often originates in and is affected by contextual realities. It is argued that they must be considered when analysing occurrences of communities founded on alternative epistemologies. Keywords: post-truth, ant-vaccination, vaccine hesitancy, alternative epistemologies, post-Soviet

The article presents a concise overview of the interaction between two art institutions during the interwar period – the Kaunas School of Art and the M. K. Čiurlionis Gallery. In 2022, the Kaunas School of Art celebrated its 100th anniversary. Founded in 1920 by the artist Justinas Vienožinskis as the Higher Drawing Courses, on his initiative, the institution underwent reorganisation into the Kaunas School of Art in 1922. The roots of the M. K. Čiurlionis Gallery can be traced back to December 14, 1921, when the President of the Lithuanian Constituent Assembly and the Republic, Aleksandras Stulginskis, promulgated the “Law on the M.K. Čiurlionis Gallery.” Initially conceived as a temporary gallery, it opened its doors in 1924, situated in proximity to the Art School. Although both institutions operated in different capacities during the periods of German occupation and Soviet rule, and continue their original activities into the present day, the scope of this study focuses primarily on the interwar period due to the abundance of iconographic material available from that era. The buildings of the Kaunas School of Art and the M. K. Čiurlionis Gallery were designed by architect Vladimiras Dubeneckis. He was also the author of the new Vytautas the Great Museum building, where M. K. Čiurlionis’ artistic legacy, the collections of ancient artworks and folk-art treasures were transferred in 1936. In the ensuing century, the Museum has undergone significant growth, now encompassing five branches and thirteen departments. Among these, the Photography, Documentation, and Publications Department stands out, housing a vast array of documentary and iconographic materials (photographs, prints, manuscripts, maps and land plans, drawings, archives of artists and organisations, publications), which illustrate the relationship between the Kaunas School of Art and the Čiurlionis Gallery, the history of the two institutions, and the connections with various personalities who contributed to the work of both establishments. The photographs cover a wide range of subjects: the architecture of the School of Art and the Gallery, their interiors, the collaborative spirit among students and teachers, the cooperation with the Gallery’s staff, and the school’s everyday life – the learning process, the reviews of students’ work, and the leisure time and social activities of the school’s community. Complementing the article are valuable exhibits from other departments of the Museum: The Adelė and Paulius Galaunė House-Museum, the Juozas Zikaras House-Museum, and the Antanas Žmuidzinavičius Museum of Works and Collections. Iconographic material on the presented theme can also be encountered at the Liudas Truikys and Marijona Rakauskaitė House-Museum, as well as the Folk Art Department. Keywords: Kaunas School of Art, M. K. Čiurlionis Gallery, M. K. Čiurlionis National Museum of Art, archive, iconographic material, photographs

Classification of information collected on the ethnography of life. Part 2: the contribution of Antanas Mažiulis

Straipsnis yra tęsinys I dalies [50], kurioje nagrinėta, kaip metodinių priemonių, instrukcijų, klausimynų istoriografija padeda atskleisti etnologijos mokslo Lietuvoje formavimąsi. Iškeltas klausimas, kodėl Vacio Miliaus bibliografijoje tėra keturi Antano Mažiulio straipsniai iš šešiolikos skelbtų, skirtų renkamos medžiagos metodikai, jos populiarinimui. Straipsnio II dalyje nagrinėjama A. Mažiulio renkamos medžiagos metodinių priemonių, informacijos klasifikacija, metrikų bei kitų nurodymų pobūdis. Lyginant ankstesnes metodines priemones su A. Mažiulio skelbta metodine informacija buvo nustatyta, kad A. Mažiulio metodiniai nurodymai pasižymėjo renkamos informacijos sisteminimu pagal tautosakos, muziejinių rinkinių rūšis. Be to, jis išplėtojo vedybų klausimyno struktūrą ir detaliai išdėstė rinkėjo etiketo bei komunikacijos su pateikėjais niuansus. Raktažodžiai: renkamos medžiagos metodinės priemonės; renkamos informacijos klasifikavimas; rinkėjo ir pateikėjo komunikavimas; tautosaka; kraštotyrinė programa; Antanas Mažiulis. This is the second of the two articles that address the problem of how the historiography of methodological tools, instructions, and questionnaires helps to reveal the formation of the discipline of ethnology in Lithuania (for Part 1, see Lituanistica, 69 (3), 225–240). The question is raised why only four out of Mažiulis’s sixteen published articles on the methodology of material collection and its popularisation appeared in Vacys Milius’s bibliography. By examining Antanas Mažiulis’s articles on the issues of collecting folklore and local history materials and comparing them with earlier methodological tools written between 1934 and 1940, we found that the methodological instructions of Antanas Mažiulis were often characterised by a simpler and improved systematisation of the information collected. In one of his first articles, he identified three types of folklore: (a) songs; (b) fairy tales, stories; (c) small folklore. He also distinguished the fourth type, that of ‘Customs’, which lists the main church festivals and groups other festivals by the seasons of the year. Most importantly, Mažiulis developed the structure of the marriage questionnaire in his methodological tools. The classification of museum collections was improved, although, unlike in the methodological programme of the Aušra Museum, he classified ‘Folk Art’ in a separate section from ‘Ethnography’. Looking at how the regulations on metrics and etiquette were formulated for recording material in the nineteenth–the first half of the twentieth century, it is clear that the instructions on metrics changed insignificantly and that the regulations on etiquette changed little in the 1930s. Then the data on the nationality and religion of the respondents were included. The idea of discovering one’s own land, which became popular from the nineteenth century onwards, shaped the view that one should start collecting material in one’s own locality, where the collector is known to the people. This was also supported by Mažiulis. In the communication with the respondent, a change in the attitude towards the relationship with the respondent is observed. From the advocacy of direct communication with respondents (without emphasising that material is being collected), there was a shift towards mutual communication by sharing information with each other. Later, Mažiulis urged and advised the collector of information to maintain a student-teacher relationship when interviewing the respondent. Since the beginning of the twentieth century, the question of the authenticity of the recorded material has remained a topical issue, which has dynamically manifested itself in methodological tools as a dilemma between the reliability of the respondents and the honesty of the recorders. Mažiulis stressed the duty of the note-takers to do their job honestly. Another important area of communication with the respondent to which Mažiulis made a significant contribution is how to gain the respondent’s trust. He recommended certain etiquette in showing respect, friendliness, consideration, etc. to the respondent. This was how the researcher’s etiquette was formed. He was also instrumental in organising the collection of the material and drafting the directives. His methodological tool, the article ‘Tautos papročių rinkimas’ (Collecting folk customs), is considered the first directive for the preparation of the ‘Ancient Days’ in Lithuania. Antanas Mažiulis was a creator of methodological instructions in the field of material collection, a thinker, agitator, and practitioner (material collector, one of the founders of the museum in Dusetos (a town in Zarasai district, Lithuania), a member of the board of the Dusetos branch of ‘Pavasaris’ (Spring), an organisation of Lithuanian Catholic youth, etc.). His contribution to the historiography of methodological tools in Lithuanian ethnology is notable for the systematic nature of the methodological instructions for collecting the material, a new approach to communication with the respondents, and practical application of the collected material. Keywords: methodological tools for collecting material, classification of collected information, communication between collector and respondent, folklore, local history programme, Antanas Mažiulis

Ptolemaic Sudovians along the Danube and the Vistula: in search of similarities

Senųjų baltų, konkrečiau – vakarų baltų, arba aisčių, – tyrimais besidomintys skaitytojai, be abejo, žino, kad Ptolemajas (apytikriai 100–170 m.) mini bent dvi jų gentis – galindus (Γαλίνδαι) ir sūdinus (Σουδινοί) šiauriniame Vyslos krante (Geogr. III, 5, 21), kurių buvimą fiksuoja ir XIII–XIV a. (Cezaris, Strabonas, Velijus, Arianas, Plinijus, Tacitas), mėginama juos surikiuoti į bendrą I–II a. to krašto istoriją. Pagaliau, pasiremiant geografijos, kalbotyros ir archeologijos duomenimis ir bendresniais to meto Barbaricum erdvėje gyvenusių tautų judėjimo dėsningumais, mėginama pagrįsti hipotezę, kad Padunojo sūdinai galėjo būti Ptolemajo Pavyslyje įkurdintų ir Sūduvos sūduviais laikytinų sūdinų (autorius drįsta juos tapatinti su Bogačevo kultūra) dalis. Raktažodžiai: Ptolemajas, sūdinai, Sudetų kalnai, gintaro kelias, markomanai.Scholars interested in the study of the ancient Balts are undoubtedly informed that Ptolemy (c.100–170) mentions at least two tribes, the Galindians (Γαλίνδαι) and the Sudovians (Σουδινοί), on the northern bank of the Vistula River (Geogr. III, 5, 21), the presence of which is also recorded in the documents of the Teutonic Order from the thirteenth and the fourteenth centuries. What is much less well known is that he mentions the Sudovians (Σουδινοί/Σουδιανοί) on the northern bank of the Danube (Geogr. II, 11, 25), and that linguists also associate the Sudeten Mountains with this tribe of Sudovians (Geogr. II, 11, 7; II, 11, 23: Σούδητα ὄρη), the localisation of which is also problematic. Drawing on the knowledge of the south-eastern edge of Ptolemy’s Germania – the rivers, mountains, and the peoples he mentions – the paper attempts to locate more precisely these Sudovians along the Danube. By collecting and summarising all contemporary knowledge of their neighbours, the Marcomanni, the Varisci, etc. (Caesar, Strabo, Arrian, Pliny, Tacitus, etc.), an attempt is made to place them in the context of a more general history of the region of the first and second centuries. Finally, the hypothesis that the Sudovians along the Danube could have been part of the Sudovians of the Vistula, who were involved in the migration of peoples of the time, is supported by geographical, linguistic, and archaeological arguments and by the more general patterns of movement of peoples in the Barbaricum area. The author identifies the Sudovians along the Vistula with the Bogaczew culture. Keywords: Ptolemy, Sudovians, Sudeten Mountains, amber route, Marcomanni
