Zarte Pflänzchen oder gefährliches Unkraut? Sinn und Unsinn von Zulassungsverfahren und Nichtzulassungsbeschwerde für Kleinstparteien
No full textDas Instrument der Nichtanerkennungsbeschwerde existiert seit einiger Zeit als Ergänzung zum Wahlprüfungsverfahren. Es soll möglich machen, dass Kleinstparteien zur Bundestagswahl zugelassen werden können, auch wenn der Bundeswahlausschuss ihnen den Status als Partei zunächst verweigert hat. Trotz inzwischen einiger Dutzend Verfahren vor dem Bundesverfassungsgericht und vereinzelter erfolgreicher Entscheidungen führt das Verfahren nicht dazu, demokratische Legitimation von Bundestagswahlen zu stärken. Der Beitrag vertritt die These, dass das Zulassungsverfahren samt Nichtanerkennungsbeschwerde den Aufwand nicht wert ist, von Kleinstparteien keine Gefahr für die Demokratie ausgeht und es aufgrund des schlechten Eindrucks, den es auch nach außen hin macht, nicht nur reformiert, sondern abgeschafft gehört

We discuss sentences (a) in which a verb which is normally used intransitively, i.e. without an object, is used transitively, i.e. with an object, and (b) in which a transitive verb appears with a new type of object
What? Me, lie? : The Form and Reading of the Incredulity Response Construction
No full textIn the present study, we focus on the formal properties of the Incredulity Response Construction (IRC) and attempt to point out that they provide clues to help establish the interpretation of this closed-class form. While many previous studies stressed the construction’s idiosyncratic properties which have been held up as arguments in favor of its special construction status, we wish to argue that although the IRC is a construction with a clear meaning, its form and function are not as idiosyncratic, irregular, or unpredictable as they are portrayed in the literature. Indeed, the formal and functional properties of the IRC fit well within traditional characterizations of items located on the syntactic side of the lexicon-syntax continuum. We will attempt to demonstrate that the form of the construction is an iconic representation of its reading. Additionally, we question the reading itself, arguing that the incredulity that gave rise to the construction’s very name is not its semantic contribution. Instead, we propose a more general meaning of incongruousness or “cognitive dissonance”
Grundlagen zum Parteienrecht
No full textDer Spiegel der Rechtsprechung zu den Grundlagen des Parteienrechts ist auch im Berichtsjahr 2016 von Entscheidungen zum Problem des staatlichen Neutralitätsgebots gegenüber Teilnehmern am politischen Wettbewerb geprägt. So hatte sich der Thüringer VerfGH mit einer Aussage des Justizministers bezüglich der AfD und des Ministerpräsidenten bezüglich der NPD zu beschäftigen. Aber auch das OVG NRW hatte sich mit diesem Themenkomplex zu beschäftigen. In diesem Fall hatte der Düsseldorfer Bürgermeister anlässlich einer DÜGIDA-Demo die Rathausbeleuchtung ausschalten lassen. Im Zentrum des Berichtjahres 2016 steht wohl das NPD-Verbotsverfahren vor dem BverfG, welches auch einige verfahrensrechtliche Hürden aufwies. Aber auch die Waffenrechtliche Zuverlässigkeit spielt in diesem Jahr – wie z.B. vor dem VG-Dresden – eine Rolle.

No full textAls „Sternstunden des Parlaments“ gelten gemeinhin Plenardebatten und Abstimmungen, bei denen Abgeordnete ohne Auflagen ihrer Fraktion handeln und entscheiden. In diesem Beitrag wird zunächst begründet, warum typische Merkmale einer solchen Gewissensentscheidung bei der namentlichen Abstimmung über die Einführung einer allgemeinen Corona-Impfpflicht im Bundestag trotz anderslautender Ankündigung fehlten. Auf dieser Grundlage diskutiert der Autor notwendige Voraussetzungen, die gegeben sein müssen, damit Fraktionen bereit sind, den parteipolitischen Wettbewerb für den Moment auszusetzen und ein freies Spiel der Kräfte im Parlament zuzulassen

No full textDie Digitalisierung stößt in Deutschland auf manche Hindernisse. Das gilt auch für das Recht der politischen Parteien. Das ändert aber nichts daran, dass die Verfassung richtig verstanden Vorstandswahlen und Satzungsänderungen auf digitalen Parteitagen nicht entgegensteht. Die Annahme eines rechtlichen Zwangs zur Briefwahl nach einem elektronischen Parteitag scheint jedenfalls überprüfungsbedürftig. Die Digitalisierung macht auch vor dem Parteienrecht nicht halt
Digital Campaigning on the Rise? A Long-term Perspective on German Federal Elections
No full textIn the last decade, digital tools have become central elements of electoral campaigns. This trend might have been amplified in 2021, as the possibilities for personal interactions were limited due to the severe restrictions of the COVID-19 pandemic. However, little is known about whether the use of digital tools pays off on election day. Thus, this research note asks to what extent Bundestag candidates used digital tools in the past federal elections and whether the activities are associated with better election results in 2021. Analyses of the candidate surveys of the German Longitudinal Election Study (GLES) indicate that constituency candidates increasingly use digital campaigning. This trend was not boosted by the 2021 election. Instead, a ‘natural’ increase is observable. Moreover, using a personal website or blog is associated with slightly better election results.
In den letzten zehn Jahren sind digitale Werkzeuge zu zentralen Elementen von Wahlkampagnen geworden. Dieser Trend könnte sich im Jahr 2021 noch verstärkt haben, da die Möglichkeiten für persönliche Interaktionen aufgrund der starken Einschränkungen durch die COVID-19-Pandemie begrenzt waren. Es ist jedoch wenig darüber bekannt, ob sich der Einsatz digitaler Instrumente am Wahltag auszahlt. Der Beitrag geht daher der Frage nach, inwieweit die Bundestagskandidaten bei den vergangenen Bundestagswahlen digitale Instrumente genutzt haben und ob diese Aktivitäten mit besseren Wahlergebnissen im Jahr 2021 verbunden sind. Analysen der Kandidatenbefragungen der German Longitudinal Election Study (GLES) deuten darauf hin, dass Wahlkreiskandidaten zunehmend digitale Kampagnen nutzen. Dieser Trend hat sich durch die Wahl 2021 nicht verstärkt. Vielmehr ist ein „natürlicher“ Anstieg zu beobachten. Zudem ist die Nutzung einer eigenen Website oder eines Blogs mit leicht besseren Wahlergebnissen verbunden
Storage as a way to grammaticalization
No full textThis paper explores the possible contribution of various types of storage to grammaticalization processes, and the description of such processes by means of Construction Grammar(s) (CxG). The grammaticalization processes of French pas and certain complex adpositions in German and Finnish serve to illustrate that storage can background the literal meaning of elements like pas, thus enabling the constructions containing them togrammaticalize. A further form of storage, the emergence of a productive template on the basis of high type frequency, may in turn stand behind their grammaticalization. Two further assumptions about language use are also exploited in the explanation of grammaticalization: the possibility of processing complex units holistically and a human urge to interpret recurring forms as signs. Since CxG is based on stored units, it can serve to explicate the role of storage in grammaticalization, while a grammaticalization perspective can help in uncovering the origin of different types of constructions assumed within CxG. The CxG analysis of the grammaticalization processes examined suggests that in terms of CxG, grammaticalization amounts to the emergence of partially schematic, complex constructions, while further grammaticalization deletes semantic constraints on their schematic parts
The construal of constructions: Causal and temporal interpretations in change constructions
No full textIn this paper I first discuss some non-causal change constructions which have largely gone unnoticed in the literature, such as The butler bowed the guests in (which is said to code mild causation) and The supporters booed Newcastle off at the interval (which only codes temporal coextension between its two constitutive subevents). Since the same structure (i.e. the transitive object-oriented change construction) can be used to code a wide spectrum of causal and temporal relations, the question arises of what cognitive mechanisms may be involved in such meaning shifts. I argue that variation can be motivated on the basis of the figure/ground segregation which the conceptualiser can impose upon the integrated scene coded by the change construction. The integrated scene depicts a force-dynamic scenario but also evokes a unique temporal setting (i.e. temporal overlap or coextension between the constitutive subevents). Such a “bias” towards temporal overlap can be used by the conceptualiser to background causation and highlighttemporal overlap interpretations. It is also shown that figure/ground segregation can be appealed to to account for the causal interpretation of intransitive change constructions, e.g. The kettle boiled dry. If the conceptual distance between the verbal event and the non-verbal event is (relatively) great, causality can be highlighted even in intransitive pattern
Particle placement and the case for "allostructions"
No full textAs a reaction against derivational frameworks, Construction Grammar accords no place to regular alternations between two surface patterns. This paper argues for a more tolerant position towards alternations. With respect to the well-known placement variability of verbal particles (pick up the book / pick the book up), the author grants that there is little reason for analysing one ordering as underlying the other but goes on to show that it is equally problematic to claim that the two orderings code two different meanings (or serve two different functions) and therefore cannot be linked in the grammar as variants of a single category. The alternative offered here is to consider the two orderings as two “allostructions” of a more general transitive verb-particle construction underspecified for word order
