No full textWeil die AfD in der Zeit von Juli bis September 2017 Spenden in Höhe von insgesamt 132.005,52 €, unter Verstoß gegen § 25 Abs. 2 Nr. 6 PartG angenommen hatte, machte der Präsident des Deutschen Bundestages einen Zahlungsanspruch nach § 31c PartG in Höhe des Dreifachen des rechtswidrig erlangten Betrages durch Bescheid geltend. Das OVG bestätigte diesen: Eine Spende „an die Partei“ und keine Direktspende an einen Kandidaten ist gegeben, wenn der Spendenbetrag auf das Parteikonto überwiesen und zudem zu Parteizwecken wie der Finanzierung einer Wahlkampfwerbekampagne verwendet worden ist. Die Offenlegungspflichten und Spendenannahmeregelungen des Parteiengesetzen dienen der Offenlegung einer Verflechtung von politischen und wirtschaftlichen Interessen, damit die Wähler sich unter anderem über die Kräfte unterrichten können, die die Politik der Parteien bestimmen, und die Möglichkeit haben, die Übereinstimmung zwischen den politischen Programmen und dem Verhalten derer zu prüfen, die mit Hilfe finanzieller Mittel auf die Parteien Einfluss zu nehmen suchen. Zugleich soll die innere Ordnung der Parteien durch die Pflicht zur öffentlichen Rechenschaftslegung gegen undemokratische Einflüsse gesichert werden

No full textThis study deals with the analysis of the mesoconstruction [V{bodily_reaction} de DET N{emotion/somatic_reaction_physiological_need}], whose constructional meaning can be paraphrased as ‘experience N{emotion/somatic_reaction_physiological_need} in its highest degree’. This intensifying semi-schematic construction conforms a continuum with the [V de NG] causative construction, with which it is related through a vertical relation of metaphorical extension (Goldberg 1995). To carry out this corpus-based study (esTenTen18, Sketch Engine) the slots fillers emoción ‘emotion’, risa ‘laugh’ and susto ‘scare’ where chosen, which correspond to N{emotion/somatic_reaction_physiological_need}. With this study, a twofold goal is pursued. First, to demonstrate that each of the three constructional idioms licensed by the [V{bodily_reaction} de DET N{emotion/somatic_reaction_physiological_need}] meso-construction tends to license very few types with high token frequency and a high degree of idiomaticity. The rest of the types, however, with lower token frequency, are intrinsically related to the meaning of the prototypical meaning, forming a “cognitive core”, which is revealed as specific to each bodily sensation/reaction analyzed (emoción, risa, susto). Second, to show that in the continuum between the causative construction and the intensifying construction, the instances licensed by the latter tend to exhibit both projectors and triggers of the intensifying meaning. These are contextual elements that can be found in the most immediate syntagmatic profile of the construction and its pragmatic function is in harmony with the intensifying meaning of the instances in which these appear. In addition to these formal elements, there are also logic-semantic traits that point to the intensifying meaning. In this way, those verbal slot fillers alluding to very unlikely or impossible human actions or reactions, such as se despezona de la risa ‘break off with laughter’, are clear indicators of a non-literal (causative) meaning but intensifying. A gradient notion of constructionhood
No full textThis paper contrasts two views of constructions that have emerged over the last decades of constructionist research. On the one hand, constructions are often treated in categorical terms, assuming that linguistic units either display the characteristics of a construction or not. Alternatively, constructions can be viewed in gradient terms, positing that linguistic patterns vary in their degree of constructionhood, i.e., the extent to which they display constructional characteristics. It is argued that the gradient view provides a more plausible account of speakers’ linguistic knowledge. Moreover, several implications of the gradient view for current and future constructionist research are outlined
Differentiating valence patterns: A quantitative analysis based on formal and semantic attributes
No full textA verb licenses multiple constructions. For instance, the verb replace licences (at least) three constructions: (i) Alice replaced Bill with Charlotte, (ii) Alice replaced Bill, (iii) Bill replaced Charlotte. Each construction realises different arrays of semantic roles (i.e., Alice as the responsible entity for the transition of Bill and/or Charlotte, Bill as the ``new\u27\u27 entity, and Charlotte as the ``old\u27\u27 entity). Since each construction represent different meanings, a hearer (or reader) must identify the appropriate construction to understand a given utterance. Despite its theoretical importance, the cues used in identifying each construction have yet to be explored. This paper aims to reveal the features used in identifying each construction by annotating data with semantic features (i.e., Animacy of subjects and objects) and a formal feature (i.e., the presence of with-phrase). The analysis based on the conditional inference tree showed that active sentences with the verb replace can be classified by nearly 80% accuracy, which was fairly ``good\u27\u27 (baseline: 35.4%). Moreover, the analysis of misclassifications revealed that a finer-grained characterisation of semantic types is needed for a more accurate specification of a construction, which suggests the necessity of event ontologies in semantic role labelling

Gender und Parteien im Kommunalwahlkampf
No full textDer Beitrag untersucht entlang von aus dem internationalen Forschungsstand hergeleiteten Hypothesen, zu welchen Wahlkampfstrategien Frauen im Zuge ihrer Bürgermeister_innenkandidaturen in einer eher männlich geprägten Handlungssituation in verschiedenen Settings (Männerrunden vs. nicht-Männerrunden) greifen. Hierzu werden insgesamt 551 Wahlslogans aller nordrhein-westfälischen Bürgermeisterkandidat_innen aus unserer Erhebung mittels Inhaltsanalyse untersucht, um herauszufinden, wie sich die weiter vorherrschende Unterrepräsentanz von Frauen auf den Bürgermeister_innenwahlkampf auswirkt und wie sich Wahlkampfstrategien und Themen unterscheiden.Im Ergebnis kann gezeigt werden, dass– möglichweise in Erwartung an das Bürgermeister_innenamt an bzw. die zentralen Themen und Fragestellungen – Männer etwas stärker auf Kompetenz und/oder Kontinuität setzen, Frauen hingegen stärker emotionalisieren oder sich als Kontrastkandidatur positionieren. Gerade Frauen aus dem linken Parteienspektrum bevorzugen weichere Themen (Sozialpolitik etc.) und nehmen die Veränderung der Wahlkampfinstrumente stärker wahr. Gender und Parteien interagieren somit im Bürgermeisterwahlkampf. In reinen Männerrunden dominieren hingegen eher harte Politikfelder (Finanzen etc.)

No full textThose who are not part of the antitrust family in the DACH region will certainly associate the Tyrolean capital Innsbruck primarily with the Alps and winter sports and perhaps also think of the fantastic adventures of the spaceship Orion, whose protagonist, Major Cliff Allister McLane, was impersonated by actor Dietmar Schönherr, one of the prominent sons of the city of Innsbruck. Friends of antitrust law and competition economics, on the other hand, immediately think of the annual symposium of the Forschungsinstitut für Wirtschaftsverfassung und Wettbewerb (a research institute, FIW for short), which took place for the 56th time from 22 to 24 February 2023 and traditionally starts three days after the famous Rhineland carnival culminates in the big processions called “Rosenmontagszug”. That is good timing with regard to the not entirely insignificant antitrust community from the Rhineland – they are back to their senses. Prof. Dr. Justus Haucap was there and reports here

No full textDie Rechte der Mitglieder eines Vereins bewegen sich in dem Rahmen, den ein Verein setzt, denn das Grundrecht der Vereinigungsfreiheit in Art. 9 Abs. 1 GG gewährt einem Verein grundsätzlich das Recht, über die Aufnahme und den Ausschluss von Mitgliedern selbst zu bestimmen. Die Verfassung garantiert das Prinzip freier sozialer Gruppenbildung aus privater Initiative unabhängig vom Staat und schützt damit auch die Entscheidung über die Zwecksetzung dieses Zusammenschlusses. Zielt ein privater Amateur-Breitensportverein mit seiner Satzung ausdrücklich auf eine Orientierung an der freiheitlich-demokratischen Grundordnung und tritt extremistischen, rassistischen und fremdenfeindlichen Bestrebungen entgegen, ist das mit Blick auf die in Art. 9 Abs. 2 GG wie auch in Art. 1 Abs. 1, 3 Abs. 3 und 21 Abs. 2 GG zum Ausdruck kommende Wertung nicht zu beanstanden
