    Prinsip Kehati-Hatian Bagi Bank Umum Dalam Penyerahan Perkerjaan Kepada Perusahaan Lain

    In contracting work, there are three groups of people who are interested, namely the company that provides chartering work (the company that provides the charter), the company that accepts the work of chartering (the company that accepts the charter), and workers. The Contracting Company may submit part of the work implementation to the Contracting Recipient Company. This is carried out through a written Contract of Work Agreement. It must contain provisions that guarantee the fulfillment of the rights of workers/laborers in the emerging employment relationship. Since December 9, 2011 Bank Indonesia issued Bank Indonesia Regulation No.13/25/PBI/2011 concerning Prudential Principles for Commercial Banks in Delegating Work to Other Companies, requiring banking companies in Indonesia to follow these rules in drafting Job Contracting Agreements with Another company. This is inseparable from the decision of the Constitutional Court no. 27/PUU-IX/2011 decision dated January 17, 2012. Based on the description above, the author feels interested in researching this problem and intends to put the results of the research into a scientific paper entitled The Effect of Bank Indonesia Regulation No. 13/25/PBI/2011 concerning Prudential Principles for Commercial Banks in Delegating Work to Other Companies with the Decision of the Constitutional Court No. 27/PUU-IX/2011 Related to the Implementation of Part of the Work between Banking Companies and Non-Banking Companies

    Spread of Covid-19, One of them is to carry out mass vaccinations that are given to the public free of charge. But not a few who refuse to be vaccinated for one reason or another, because of the incitement of others and theories stating that vaccines are dangerous and so on. So everyone who has been designated as the target recipient of the Covid-19 Vaccine but refuses it can be subject to administrative sanctions in accordance with Article 13A of Presidential Regulation Number 14/2021. In addition, vaccine refusals can be subject to criminal sanctions because they are considered to have hindered the handling of Covid-19. The research method used is juridical-normative with a statutory approach, namely Presidential Regulation no. 14 of 2021 concerning Amendments to Presidential Regulation No. 99 of 2020 concerning the Procurement of Vaccines and the Implementation of Vaccinations in the Context of Combating the Covid-19 Pandemic. Another approach used is a conceptual approach by studying the principles, principles, and doctrines of legal science that are used as guidelines to answer and provide legal arguments on related legal issues

    Local governments (Pemda) are given the authority to regulate and manage their own households according to the principles of autonomy and assistance tasks. laws and regulations governing local governments through the principles of decentralization, deconcentration and co-administration can be used as indicators of the size of the regional authority in regulating and managing their household affairs. The greater the application of the principle of decentralization to the regions, according to Article 11 paragraph 1 of Law Number 32 of 2004, among others, based on externality, accountability and efficiency by taking into account the harmony of relations between government structures. (2) Law Number 32 of 2004 concerning Regional Government states that government affairs under the authority of regional governments consist of mandatory and other matters. Article 13 paragraph 1 point n of Law Number 32 of 2004 states that mandatory affairs under the authority of the provincial government are affairs on a provincial scale which include investment administration services, including across districts/cities. In Article 14 paragraph 1 point n of Law Number 32 of 2004 it is stated that the obligatory affairs to become the authority of the regional government for regencies/municipalities are district/city-scale affairs covering administrative services and investment

    Perlindungan Hukum Terhadap Siswa dan UU ITE: Sistematik Literatur Review

    Penelitian ini bertujuan untuk mengetahui bagaimana perlindungan hukum terhadap siswa dalam delik pencemaran nama baik dari perspektif UU ITE. Metode penelitian yang diterapkan yaitu penelitian hukum normative, sedangkan pendekatan yang digunakan yaitu conceptual approach. Selain itu penelitian ini juga menggunakan metode Systematic Literature Review (SLR) dengan menggunakan aplikasi Vosviewer. Artikel yang direview sejumlah 500 artikel yang bersumber dari database Dimentions. Hasil literature review dengan applikasi Vosviewer memperlihatkan bahwa penlitian dengan tema perlindungan hukum terhadap siswa dan UU ITE masih sangat sedikit dan Negara-negara yang mengangkat isu ini hanya ada di cluster Negara Indonesia, Cluster United Statet, Cluster Malaysia dan Australia. Data dari database dimentions juga menujukkan bahwa topik penelitian dengan tema ini terclusterisasi berdasarkan banyaknya kata yang child, law, teacher, efeect dan lain-lain.     Abstrak:  Artikel ini dimaksudkan untuk mengkaji eksistensi akal dalam pembentukan ijtihad sebagai dalil hukum. Pengunaan akal sudah menjadi alternatif pilihan bagi para ulama didalam menemukan jawaban atas persoalan-persolan kontemporer yang berkembang saat ini Meskipun sampai saat ini penggunaan akal dalam berijtihad masih ada perbedaan pendapat. Guna memahami penggunaan akal dalam berijtihad untuk melahirkan dalil hukum dilakukanlah penelitian normatife dengan menggunakan bahan hukum sekunder yang bersumber dari kepustakaan. Bahan yang dikumpulkan dianalisis secara kualitatif dan kemudian dideskriptifkan. Berdasarkan analisis yang dilakukan diperoleh bahwa akal sebagai alat dan atau sumber untuk berfikir dalam ijtihad guna menemukan dalil dalil hukum baik yang didasarkan pada Al Qur’an dan hadist maupun yang tidak ada di jelaskan.     The Problems of Proving Electronic Evidence

    The purpose of writing this article is to present the results of research on the problems in the existence of electronic evidence in proving civil cases, criminal cases, and state administrative cases, as well as finding solutions to these problems. This article was written using a normative legal research method with a statutory approach and a conceptual approach. The results of this study determine that there is a need for synchronization of rules regarding electronic evidence as regulated in Law Number 11 of 2008 concerning Electronic Information and Transactions as amended by Law Number 19 of 2016, and rules of procedural law, both legal criminal procedure, civil procedural law and state administrative procedural law.     Tujuan penelitian: Penelitian ini bertujuan untuk membuat analisis perpskriptif terhadap tatanilai yang menjadi kultur hukum dengan menggunakan pendekatan transcendental.Metodologi: Penelitian ini merupupakan jenis penelitian hukum normative. Pendekatan yang digunakan adalah pendekatan filosofis, dimana hukum dimanakan sebagai kumpulan nilai, asas-asas dan moral yang memiliki misi suci kebenaran, dan keadilan.Temuan Utama: Agar hukum benar-benar menjadi mutiara, dan tempat persemaian kebenaran yang mengemban misi suci, maka ada beberapa tatanilai yang dibutuhkan dalam membangun kultur hukum (kesadaran hukum), yakni hukum harus menjadi alat integrasi social, sarana yang meningkatkan kualitas idividu, berhukum harus dipandu oleh standar moral, keadilan menjadi mahkota hukum, dan hukum harus mampu mendorong pembebasan.     Opportunities to Implement Mutual Legal Assistance in Criminal Law Enforcement in Indonesia

    Studies on Mutual Legal Assistance (MLA) in various countries around the world have been carried out. However, for Indonesia, this is a new thing. So this article aims to examine Mutual Legal Assistance from the perspective of law and social contracts. This study explores methods for obtaining witness statements of foreign nationals. The writing of this article uses a normative legal research method, with a conceptual and statutory approach. The technique of analyzing legal materials used in writing this article is literature study. The results of this study are that it can be seen that foreign nationals have the right to refuse to give their statements before an Indonesian court, and there are no legal consequences whatsoever. Based on this phenomenon, it causes a lack of evidence that is very important in the examination of criminal cases, namely witness statements

    Indonesia sebagai negara hukum wajib menjunjung tingga HAM setiap warga negaranya. HAM mutlak menjadi kedaulatan tiap-tiap individu, termasuk penyandang disabilitas. Konstitusi menjamin hak bagi penyandang disabilitas, diantaranya hak keadilan dan perlindungan hukum, hak aksesibilitas, serta hak pelayanan publik. Penelitian ini bertujuan untuk meneliti tentang peyalanan proses penerbitan SIM bagi penyandang disabilitas yang menjadi hak setiap warga negara yang memenuhi syarat. Dalam hal ini, substansi yang dibahas adalah  Pasal 35 Ayat 1 Huruf C Peraturan Kapolri Nomor 9 Tahun 2012 Tentang SIM Berkaitan Dengan Syarat Karakteristik Pembuatan SIM D Bagi Disabilitas. Dalam hal ini studi kasus diambil di Kantor Satlantas Polres Metro Jakarta Barat. Metode yang digunakan dalam penelitian ini adalah metode hukum normatif dengan pendekatan yuridis empiris. Pengumpulan Data dilakukan menggunakan teknik wawancara dengan informan dan dianalisis secara kualitatif. Berdasarkan hasil penelitian didapatkan kesimpulan bahwa implementasi penerbitan SIM bagi penyandang disabilitas berdasarkan Peraturan Kapolri di Wilayah Hukum Polres Metro Jakarta Barat sudah cukup baik, meskipun secara komprehensif belum efektif secara maksimal karena pelaksanaan teknis di lapangan yang belum dapat disesuaikan dengan keadaan penyandang disabilitas. Adapun terkait kriteria fisik bagi penyandang disabilitas yang hendak mengurus kepemilikan SIM adalah tidak tulis, tidak buta total dan buta warna, sanggup mengendarai kendaraan bermotor

    The main issue discussed in this study is the extent to which the Supreme Court's power is autonomous in recruiting judges with the status of public officials for judicial organizations under its jurisdiction. Since legislation is the main source of information, this study takes a normative legal approach. The results of the study indicate that the current legal framework is not yet fully capable of regulating, implementing and ensuring the judicial system accurately, as well as the nature and status of judges as public officials. The current system and structure of the recruitment of judges continues to show a lack of transparency and uncertainty regarding the legal rules governing the recruitment of judges with the status of public officials. Existing norms maintain weak legitimacy, as they are not regulated by the Constitution, which establishes an independent judiciary responsible for upholding law and justice. Therefore, in the future it is necessary to adopt new rules and regulations governing the system and procedure for recruiting judges in accordance with the specificity of the position of judges as public officials to ensure the performance and accountability of judicial duties
