    SEMANTIC APPROACH (BAYANI) IN ISLAMIC STUDIES

    The Semantic Approach (Bayani) is an approach in the study of Islamic studies to comprehend Islam comprehensively. This research refers to some literature related to the semantic approach. Semantics as an epistemological system includes three pairs of basic concepts, namely pronunciation-meaning, asl-far, and substance-accidents. The first and second concepts include methodological aspects, while the third concept includes aspects of the world view. The urgency of this method is that this approach is used to extract the meaning of zahir from lafadz and 'ibarah who is zahir and take the istinbath of the laws of al nushush' an diniyyah and the Qur'an in particular. So this approach is classified as a textual method

    THE CONCEPT OF HERMENEUTICS AS A METHODOLOGY OF INTERPRETATION OF THE QUR'AN TEXT

    Akhir-akhir ini konsep metologi penafsiran teks-teks al-Qur’an bukan hanya berkutat dari riwayat para sahabat dan tabi’in melainkan dalam memahami fiman Allah Swt perlu berdialektika dengan interpretasi teks dengan Istilah hermeneutika. Beberapa tafsir kontemporer melakukan kajian baru  terhadap al-Qur’an dengan menggunakan pendekatan hermeneutika. Secara spesispik tulisan ini berusaha untuk berkontribusi memberikan konsep terkait hermeneutika sebagai metodologi penafsiran teks. Ada beberapa hal yang sangat urgen untuk perlu dikaji dalam pembahasan ini, diantaranya, Pertama, hermeneutika sebagai  dialektika interpretasi teks. Kedua, metodologi pendekatan hermeneutika dalam memahami teks. Ketiga, Konsep hermeneutika sebagai interpretasi teks. Dengan demikian, bahwa konsep hermeneutika dalam wacara interpretasi teks adalah untuk menemukan Nilai-nilai  Al-Qur’an secara kontekstual dibalik makna teks ayat tersebut.Lately the concept of the methodology of interpreting the texts of the Qur’an is not only struggling from the history of the Companions and the Tabi'in but in understanding the Word of God it is necessary to have dialectics with the interpretation of the text with the term hermeneutics. Some contemporary interpretations make a new study of the Qur’ran using the hermeneutic approach. Specifically this paper seeks to contribute to providing concepts related to hermeneutics as a textual interpretation methodology. There are some things that are very urgent to be studied in this discussion, including, First, hermeneutics as a dialectic of text interpretation. Second, the methodology of the hermeneutic approach in understanding texts. Third, the application of hermeneutics as a text interpretation. Thus, the concept of hermeneutics in the texts is to find the Qur'anic values ​​contextually behind the meaning of the text of the verse

    Dampak Pandemi Terhadap Tingginya Angka Cerai Gugat di Pengadilan Agama Kabupaten Lima Puluh Kota

    Recently divorce cases have become increasingly popular and have become popular in the community. Tens of people a day can change their status to become widows/widowers. The Lima Puluh Kota is one of the largest contributors to divorce cases in Indonesia. In addition to the year of pandemic, 2020 is also marked with the year of divorce, because not yet in December the divorce rate in Lima Puluh Kota has reached 951 divorce case that has entered the religious courts. Of the 951 cases submitted 75% of these cases were claimants. This study aims to describe the driving factors for the increase in the divorce rate (divorce is the wife’s initiative) in the religious courts of Lima Puluh Kota with a descriptive qualitative approach with a phenomenological type. Based on this research, it can be concluded that the highest driving factors for divorce are constant arguments and domestic violence. Other factors that influence it are economic problems, being entangled in legal cases/imprisonment, the relatively young age of marriage.Belakangan ini perkara cerai semakin marak dan menjadi popular di tengah masyarakat. puluhan orang dalam sehari bisa berubah status menjadi janda/duda. Kabupaten lima puluh kota menjadi salah satu penyumbang terbanyak perkara perceraian di Indonesia. Selain tahun pandemi, 2020 juga diwarnai dengan tahun cerai, karena belum masuk desember angka perceraian di kabupaten Lima Puluh Kota sudah mencapai 951 perkara perceraian yang masuk ke Pengadilan Agama. Dari 951 perkara yang masuk 75% dari perkara tersebut adalah cerai gugat. Penelitian ini bertujuan menggambarkan faktor pendorong naiknya angka cerai gugat (perceraian yang merupakan inisiatif isteri) di pengadilan agama kabupaten Lima Puluh Kota dengan pendekatan kualitatif deskriptif dengan jenis fenomenologis. Berdasarkan penelitian ini, dapat disimpulkan bahwa faktor pendorong tingginya perceraian adalah pertengkaran yang terjadi secara terus-menerus, dan kekerasan rumah tangga. Faktor lain yang mempengaruhinya adalah persoalan ekonomi, terjerat kasus hukum/ dipenjara, usia pernikahan yang masih tergolong muda

    Covid-19 has not only damaged people's lives in the health and economic sectors, but religious activities in various areas have temporarily stopped carrying out religious activities in mosques and surrounding areas such as compulsory prayers, Friday prayers, yasinan, recitation, etc. Dusun Gemutri from the very beginning of the existence of Covid had confusion in deciding daily activities. This research uses a qualitative approach. The subjects of this research are the head of the hamlet, Pak RW, Pak RT, community leaders and part of the community. The object of this research is the Internalization of Religious Values in Facing the Covid-19 Pandemic in the Community in Dusun Gemutri Sukoharjo Ngaglik Sleman Yogyakarta. This study used purposive sampling technique in determining the subject of this study. Data collection techniques with observation, interviews and documentation. The data analysis technique was carried out by means of data reduction, data presentation, and drawing conclusions Based on the results of the analysis and discussion of the internalization process of religious values in the Gemutri Sukoharjo Ngaglik hamlet, it is very different from before the covid pandemic and after the pandemic, because at the beginning of the Covid pandemic yesterday the community was very scared and religious activities such as Mujahadah, Yasinan, etc. Everything has been stopped temporarily but the very interesting thing in the Gemutri Sukoharjo Ngaglik Sleman community is when there is Covid in the cultivation of Yauti religious values which usually do not have tasbih prayer activities, when Friday prayers in Friday prayers use prayers Qunud and Carry out Istighosah activities.Abstrac   Religiosity (religious adjective) is not synonymous with religion.     BULAK SUMUR FRAMEWORK: IMPLEMENTATION SOCIAL CAPITAL VALUES TO OPTIMISE ZISWAF POTENTION

    Zakat, Infak, Sedekah dan Wakaf (ZISWAF) merupakan instrument potensial dalam meningkatkan kesejahteraan masyarakat disektor perekonomian. Namun, hal tersebut tidak sesuai dengan yang diharapkan, karena terdapat banyak permasalahan mulai dari penghimpunan hingga pendistribusian seperti rendahnya kesadaran masyarakat, management dan SDM lembaga yang kurang kompeten, hingga regulasi yang kurang mendukung. Permasalahan ini coba diselesaikan peneliti dengan menggunakan Bulak Sumur Framework melalui penerapan nilai social capital berupa kepercayaan, norma dan jaringan. Penelitian ini menggunakan pendekatan kualitatif dengan metode studi kepustakaan. Adapun hasil penelitian yang diperoleh dalam mengoptimalkan potensi ZISWAF yaitu dari sisi kepercayaan dengan melakukan sosialisasi, memperbaiki manajemen SDM, dll. Kemudian dari sisi norma dengan membuat regulasi, kebijakan serta aturan terkait kemudahan ZISWAF bagi masyarakat, kerjasama antar lembaga serta terkait sanksi bagi muslim yang tidak membayar zakat. Dan terakhir dari sisi jaringan yaitu meliputi kerjasama dengan lembaga Teknologi dalam membuat program, kerjasama antar lembaga penghimpun dan pendistribusi sampai ke ranah masjid dan ormas serta kerjasama dengan para influencer dan youtuber yang memiliki penghasilan dan daya tarik bagi masyarakatZakat, Infaq, Alms and Waqf (ZISWAF) are potential instruments in improving the welfare of the community in the economic sector. However, this is not as expected, because there are many problems ranging from collection to distribution of funds, such as low public awareness, management and HR institutions that are less competent, to regulations that are less supportive. This problem is tried to be solved by researchers using the Bulak Sumur Framework through the application of social capital values ​​in the form of trust, norms and networks. This research uses a qualitative approach with the method of literature study. The research results obtained in optimizing the potential of ZISWAF are in terms of trust by conducting socialization, improving HR management, etc. Then in terms of norms by making regulations, policies and rules related to the ease of ZISWAF for the community, cooperation between institutions and related sanctions for Muslims who do not pay zakat. And finally from the network side which includes cooperation with technology institutions in making programs, collaboration between institutions in collecting and distributing starting from the realm of mosques and mass organizations as well as cooperation with influencers and YouTubers who have income and appeal to the communit

    LEGITIMACY OF HADITH AMAR MAKRUF NAHI MUNKAR AS EVIDENCE OF VIOLENCE BY FPI

    This paper explains the concept that was initiated by the Islamic Defenders Front (FPI) mass organization in applying amar makruf nahi munkar. The concept is based on the Prophet's hadith. which was narrated from Abu Said al-Khudri about the steps taken when looking at the munkar that occurred in the community. The facts on the ground show that, the steps taken by FPI when eradicating the impression are only following the first editorial on the hadith, namely preventing it with a 'hand' which is often interpreted as an act of violence. So it is not uncommon when conducting executions in the field often causes conflicts that trigger hostilities to the point of conflict with criminal law. This is the result of textual understanding and partial impression in understanding the hadith amar makruf nahi munkar. The offer to understand the verses contextually and review aspects of their maqasyid is a necessity when they want to apply them to the social spaces of Indonesia that are diverse in the various religions and cultures of their people and are bound by kuhap (legal and criminal laws). Thus, ignoring the context of the universality of the traditions will only lead to greater harm, on the contrary by prioritizing moral ideals in the traditions, it will be easily actualized in the contemporary context without colliding with law and culture

    INTERNALIZATION OF MULTICULTURAL VALUES IN ARABIC LEARNING

    Internalisasi nialai-nilai multikultural telah menjadi perhatian banyak peneliti saat ini, tetapi bagaimana proses internalisasi dalam pembelajaran terutama pembejalaran bahasa masih sedikit dilakukan. Untuk itu penelitian ini berfokus pada pendekatan internalisasi  nilai-nilai multikultural dalam pembelajaran bahasa Arab di salah satu sekolah Madrasah Aliyah Negeri yang ada di kota  Palu. Penelitian ini menggunakan pendekatan kualitatif studi kasus. Pengumpulan data dilakukan dengan teknik observasi, wawancara mendalam, dan dari bahan-bahan dokumen tertulis. Hasil penelitian menunjukkan bahwa  nilai-nilai multikultural di internalisasikan melalui kurikulum, silabus, dan rencana pembelajaran (RPP). Proses pengintegrasian nilai – nilai multikultural yang mencakup nilai-nilai spiritual dan sikap sosial dilakukan melalui proses semi kontributif, semi aditif, dan indirect teaching. Nilai-nilai yang diintegrasikan mencakup sikap spiritual dan sikap sosial yang mendorong tumbuhnya nilai multikulturalisme. Internalization of multicultural values ​​has become the concern of many researchers today, but how the process of internalization in learning, especially language learning, is still a little done. For this reason, this study focuses on the approach of internalizing multicultural values ​​in learning Arabic at one of the State Madrasah Aliyah schools in the city of Palu. This research uses a qualitative case study approach. The data were collected by means of observation, in-depth interviews, and from written documents. The results showed that multicultural values ​​were internalized through the curriculum, syllabus, and lesson plans (RPP). The process of integrating multicultural values ​​which includes spiritual values ​​and social attitudes is carried out through semi-contributive, semi-additive, and indirect teaching processes.     This paper discusses the increasingly visible failure of cosmopolitanism in France. Laïcité rules are considered as a form of cosmopolitanism that determines between religion and the State, but currently, laïcité are considered as a "tool" to regulate individuals to regulate themselves with certain political, social, and cultural values adjusted by the State. Islam is the second-largest religion after Christians in France, and this makes Islam a debated subject in France. For several ages, the Government issued a policy to restrain Muslim freedom especially women for use hijab, and recently Government ban the use of the niqab in public spaces. In 2020, President Emmanuel Macron issued a plan to stop for the existence of imams and teachers from 9 Islamic countries to prevent separatism and avoid those who disagree with French values.     This study aims to examine related problems: 1) What are the characteristics of the professionalism of Marawola Islamic religious education teachers in developing cultural religiosity at Muhammadiyah Vocational Schools? 2) How is the religiosity of Muslim students at Muhammadiyah Vocational School? The objectives of this study are: 1) To determine the characteristics of the professionalism of the Marawola Islamic religious education teachers in developing cultural religiosity at Muhammadiyah Vocational Schools. 2) To find out how the religiosity of Muslim students at Muhammadiyah Vocational High School. The results of this study indicate that Islamic religious education teachers are professional in carrying out their duties and responsibilities. Most of the students who attend SMK Muhammadiyah Marawola, seem to have quite good religiosity.     ADULTERY IN THE PERSPECTIVE OF ISLAMIC RELIGIOUS LAW AND POSITIVE LAW IN THE INDONESIAN COMMUNITY

    This study aims to examine and find out about the arrangements for adultery in Islamic law and criminal law in Indonesia and to find out the zina sanctions that exist in Islamic religious law and criminal law. The type of data used in this study is secondary data consisting of the Criminal Code, Al-quran, as well as other sources in the form of books and other materials such as journals related to the issues discussed in this. This data collection uses literature study techniques. Data analysis using analysis techniques between content theory. Based on the research that has been done, it can be found that the regulation of adultery in criminal law is contained in Article 284 which states that adultery is a sexual relationship between two perpetrators who are married or one of them is bound by a marriage. In Islamic law, it provides regulations regarding adultery, that every husband and wife relationship outside of a legal marriage we can call adultery, and distinguishes the perpetrator of adultery here into two, namely Ghairu Muhshan: the perpetrator who is not bound by marriage and secondly, Muhsan is the perpetrator who bound by marriage. In this criminal law, it provides sanctions for criminal acts of adultery in the form of a prison sentence of 9 months which must fulfill several existing requirements. Islamic law provides sanctions for criminal acts of adultery in the form of punishments such as 100 lashes and exile for one year for the perpetrator of Ghairu Muhsan, 100 lashes and stoning to death for the perpetrator of Muhsan.Penelitian ini bertujuan guna untuk mengkaji dan mengetahui mengenai pengaturan zina dalam hukum Islam dan hukum pidana di Indonesia dan untuk mengetahui sanksi zina yang ada di dalam hukum agama Islam dan hukum pidana. Jenis data yang dipakai dalam penelitian ini adalah data sekunder yang terdiri dari KUHP, Al-qur’an, serta sumber lain yang berupa buku-buku dan bahan lainya seperti jurnal-jurnal yang berkaitan dengan masalah yang dibahas ini. Pengumpulan data ini menggunakan teknik studi pustaka. Analisis data menggunakan teknik analisis antar teori isi. Berdasarkan penelitian yang sudah dilakukan dapat diperoleh hasil bahwa pengaturan zina dalam hukum pidana terdapat dalam Pasal 284 yang menyebutkan bahwa zina adalah hubungan persetubuhan antara kedua orang pelaku yang telah kawin atau salah satunya terikat suatu perkawinan. Pada hukum Islam memberikan pengaturan tentang perzinaan, bahwa setiap hubungan suami istri diluar pernikahan yang sah itu bisa kita sebut zina, dan membedakan pelaku zina disini itu menjadi dua yaitu pertama Ghairu Muhshan: pelaku yang tidak terikat didalam perkawinan dan yang kedua, Muhsan adalah pelaku yang terikat oleh perkawinan. Di dalam hukum pidana ini memberikan sanksi terhadap tindak pidana perzinaan berupa hukuman penjara selama 9 bulan itupun harus memenuhi beberapa persyaratan yang ada. Hukum Islam memberikan sanksi terhadap tindak pidana perzinaan berupa hukuman seperti 100 kali cambuk dan diasingkan selama satu tahun untuk pelaku Ghairu Muhsan, hukuman cambuk 100 kali dan rajam sampai mati untuk pelaku Muhsan
