EKSISTENSI PERADILAN ADAT DI ACEH
This paper deals with the existence of customary courts in Aceh in the national judicial system. From formal-juridical perspective, the existence of customary courts is not clearly stated; however, the practices of community have indicated that most of civil disputes and criminal offenses were resolved by the customary courts in Aceh. The question relates to such issues as administration of  Aceh  customary courts, duties of functionaries in this customary courts, and its existence within the national judicial system. This paper shows that, although the local government of Aceh does not legally include customary court as one of the state official justices, this kind of court has been sociologically recognized in resolving disputes that occur in the society. Furthermore, the local government of Aceh has codified it in the form of qÄnÅ«n (legal code).This paper deals with the existence of customary courts in Aceh in the national judicial system. Abstract: The Institute of Islamic education is foremost on the classic era is the mosque. However, because of the demands of Muslim society to education has increased and the demands of the welfare of the teachers have also increased the education that was originally held in the mosque developing into education held at the madrasah. Therefore, madrasah educational institutions were  the development of the mosque, the mosque khan then increased to madrasah. Learning methods used in the madrasah also experienced growth. In essence, marriage is one of the things desired by everyone, male or female, in their lives. It is also seen as a change of status in a person from living in single life into family one through the media dealing with this. In terms of kinship, the relationship between society and family can occur through marriage and mate selection in order that a new family is established. This is an event in people’s life which is considered important and sacred in their lives. REKONSTRUKSI PEMIKIRAN FIKIH: Suatu Gagasan Awal Mencairkan Kebekuan Fikih di Indonesia
Indonesia is a country whose population is majority Muslim. Thus, the aspects of syari’ah (Islamic law) should color the religiousity of Indonesian Muslims. However, the syari'ah is not static, it is  dinamic as it always gets in contact with social aspects. In this context, the reactualization and reconstruction of Islamic jurisprudence should be continually performed. The reactualization of the Islamic jurisprudence related to pragmatic values covering the patterns  of daily life of the Muslims while the reconstruction the Islamic jurisprudence thought more focuses on conceptual intellectuality values. Based on the relationship of the idea of reactualization and reconstruction of the Islamic jurisprudence, it can be concluded that the latter is an infrastructure, while the renewal is a means to realize the function of syari'ah (Islamic law) as a social control and social engineering
STRUKTUR DAN POLA KEPEMIMPINAN KYAI DALAM PESANTREN DI JAWA
Abstract: The world of pesantren and the Islamic clerics’ charisma  is one of the interesting phenomena to be studied. The style of clerics’ life and religious students is so great that it makes Islamic boarding school posess a multi-dimensional function: The Kyais not only are not only required as priests in religious ceremonies and rituals , but also often required her presence  to resolve the case or the difficulties that  befall the community. In this context, the role of the Islamic clerics is increasingly rooted in the community when their presences are believed to bring fortune. The existence of structures and patterns of authority (leadership) clerics in the Islamic world remain sustainable, because the Islamic clerics have internal social nets (among  the religious schools) and  external social netwoeks (with the world   outside pesantren), includes genealogical network,  ideological network,  intellectual network, theological network, and spiritual network.Kata Kunci: pola kepemimpinan kyai, pesantren, kharismatik dan jaringa
BAIT AL-ḤIKMAH DAN KONTRIBUSINYA DALAM PERKEMBANGAN TRADISI KEILMUAN ISLAM PADA ERA ABBASIYAH
Abstract: The Period of Abbasid rule was also called the golden age of Islam. It was so called since in that period, some Muslim scholars in the field of Islamic law and philosophy emerged. The emergence of Muslim scholars at that time was closely related to the obligation to search knowledge in Islam and the supports of the caliphs. It is because of the obligation that a translation institution called Bait  al-Ḥikmah was established. In this institution, the Greek works were translated into Arabic. The translation works were then completed  with new thoughts of the translators and spread out to Syria, Spain and Cecilia. Abstract: Human beings possess three kinds of intruments to catch the whole reality. The three instruments are the five senses, reason and intellectuality as well as intuiion (revelation and inspiration) whreas the Western intellectluas agree one instrument only, namely the five senses so that they develope one research method only, namely observation method and experiment. The observation method is continually developed into very sopisticated level but it persistently derive from the sense perception. Reason—in the form of reasoning—is employed, but only to choose, to decide and to perform reasoning, not as other instruments to catch the reality.
