Good Governance in the Implementation of Presidential Regulation No. 55/2023 on RANHAM: Implications for Social Resilience
This study aims to evaluate the application of sound governance principles in the implementation of Presidential Regulation Number 55 of 2023 concerning the National Action Plan for Human Rights (RANHAM) and examine its implications for community social resilience. The principles of good governance—including participation, transparency, accountability, effectiveness, and the rule of law—are considered essential indicators in realizing inclusive and impactful human rights policy governance. This study uses an empirical juridical method, with a normative approach to regulation and an empirical approach to its implementation practices in the field. The results of the study indicate that the implementation of good governance in RANHAM has shown progress, particularly in increasing access to information, civil society involvement, and public oversight mechanisms. However, obstacles remain, such as the limited capacity of regional implementers, low human rights literacy among grassroots communities, and a suboptimal data-based monitoring and evaluation system. In general, the implementation of RANHAM based on good governance has had a positive impact on strengthening community social resilience, particularly through increasing awareness of citizens’ rights and obligations, strengthening the role of local institutions, and growing public trust in the government. However, institutional strengthening and more inclusive implementation strategies are still urgently needed to ensure the sustainability and effectiveness of policies
Constitutionalism of Presidential and Vice-Presidential Terms in a Presidential System
The existence of a three-year presidential discourse through the 5th Amendment Bill to the 1945 Constitution does have advantages and losses, considering the considerable implications of a president who serves three terms. This study has two objectives, namely first to find out how the presidential system reacts to proposed changes, and second, how the debate around the 5th Constitution of 1945 affects changes in presidential mandates in 3 terms. Perbandingan Sistem Pemerintahan Presidensial Antara Indonesia dan Filipina
In Indonesia, the system of government adopted is presidential, where all policies and supreme command are in the hands of the President. The President in Indonesia holds executive power as well as state power, which means that the President acts not only as head of government but also as head of state. The Presidential System of Government applied in many countries, including Indonesia, does not recognize a republic that holds the highest supremacy. In the context of comparing government republics, Indonesia is often compared with other countries as a benchmark, especially when examining presidential government republics. One country that is often used as a comparison is the Philippines, which is also a member of ASEAN and a republic from colonialism in 1898. The Philippines and Indonesia have similarities in adopting a presidential republic and a unitary state in the form of a republic. The research method in this journal uses a comparative study approach. In this study, there are two problem formulations, namely, How is the Presidential System of Government in Indonesia and the Philippines and How is the Comparison of the Presidential System of Government between the two countries. In Indonesia, the President and Vice President are elected directly by the people for a certain term of office as determined by the Constitution. TANTANGAN HUKUM DAN KEABSAHAN PERKAWINAN DI ERA DIGITAL MENURUT HUKUM POSITIF INDONESIA
Perkawinan di era digital menghadirkan berbagai permasalahan hukum, khususnya terkait dengan keabsahan serta pengaturan perkawinan yang dilaksanakan melalui platform digital atau aplikasi. Seiring dengan pesatnya perkembangan teknologi, perkawinan yang dilakukan secara daring atau melalui aplikasi semakin banyak dijumpai, yang menimbulkan pertanyaan terkait keabsahan hukumnya dalam kerangka hukum positif Indonesia. Penelitian ini bertujuan untuk menganalisis tantangan hukum yang muncul terkait dengan keabsahan perkawinan digital serta pentingnya pembaruan regulasi guna mendukung perkawinan yang dilaksanakan melalui media digital. Selain itu, penelitian ini juga mengidentifikasi potensi masalah yang dapat muncul, seperti isu identitas, bukti keabsahan perkawinan, dan perlindungan hak-hak pasangan yang terlibat. Metode yang digunakan dalam penelitian ini adalah pendekatan normatif dengan analisis yuridis, yaitu dengan mempelajari peraturan perundang-undangan yang berlaku, dokumen hukum, serta literatur yang relevan guna memberikan solusi terhadap tantangan hukum yang dihadapi oleh perkawinan digital. Hasil penelitian menunjukkan bahwa meskipun teknologi memberikan kemudahan dalam proses perkawinan, keabsahan perkawinan secara digital masih memerlukan penyesuaian dalam tatanan hukum agar dapat memenuhi tuntutan perkembangan zaman dan memastikan perlindungan terhadap hak-hak individu.
Analysis of Cyber Bullying Prevention in the Perspective of Positive Law and Islamic Law
Abstract:.This study formulates the problem of How are the methods or efforts to prevent Cyberbullying in the perspective of positive law and How are the methods or efforts to prevent Cyberbullying in the perspective of Islamic law for adolescents, especially students in Indonesia. The research method used in this study is library research, which is a type of research that focuses on data sourced from books, articles, magazines, and other written works that are relevant to the topic discussed. Data sources in this study include works that discuss bullying on social media from the perspective of Islamic Law and Law of the Republic of Indonesia Number 19 of 2016 concerning ITE. This study uses a normative theological, normative juridical, sociological, and comparative approach. In Indonesia, cyberbullying is regulated by law based on Law Number 11 of 2008 concerning Information and Electronic Transactions (UU ITE). Preventive steps are also needed, such as digital education, social media supervision, and psychological support for victims of cyberbullying. Bullying not only violates social norms, but also religious norms. QS. Al-Hujurat verse 11 teaches Muslims to stay away from behavior that belittles others in any form. Bullying, as an increasingly widespread social problem, can be minimized by building children's character from an early age through the following steps: Instilling Islamic Educational Values, Collaboration Between Parents, Teachers, and the Community, and Parents' Efforts to Prevent Bullying
Going Beyond Counting First Authors in Author Co-citation Analysis
The present study examines one of the fundamental aspects of author co-citation analysis (ACA) - the way co-citation
counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings
are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that
only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into
account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed. Reasons for these effects are discussed
Variations on the Author
“Variations on the Author” discusses two of Eduardo Coutinho’s recent films (Um Dia na Vida, from 2010, and Últimas Conversas, posthumously released in 2015) and their contribution to the general question of documentary authorship. The director’s filmography is characterized by a consistent yet self-effacing form of authorial self-inscription: Coutinho often features as an interviewer that rather than express opinions propels discourses; an interviewer that is good at listening. This mode of self-inscription characterizes him as an author who is not expressive but who is nonetheless markedly present on the screen. In Um Dia na Vida, however, Coutinho is completely absent form the image, while Últimas Conversas, on the contrary, includes a confessional prologue that moves the director from the margins to the center of his films. This article examines the ways in which these works stand out in the filmography of a director who offers new insights into the notion of cinematic authorship
Appropriate Similarity Measures for Author Cocitation Analysis
We provide a number of new insights into the methodological discussion about author cocitation analysis. We first argue that the use of the Pearson correlation for measuring the similarity between authors’ cocitation profiles is not very satisfactory. We then discuss what kind of similarity measures may be used as an alternative to the Pearson correlation. We consider three similarity measures in particular. One is the well-known cosine. The other two similarity measures have not been used before in the bibliometric literature.
