But not so in the consumer contract, the existence of the principle of balance is often ignored.It is caused by several factors including the position the unbalanced parties, the rapid development of the business world, unfair business competition, monopolistic practices, as well as the regulatory civil law (aanvulenrechts), so it is easy to be disregarded by the parties including the consumers.     Ovim radom obuhvaćena je tema inovativnog načina prikupljanja pitke vode iz procesa koji se odvijaju u atmosferi, a stvaraju horizontalne i vertikalne oborine. Objašnjen je projekt koji je nazvan Warka water, inspiracija za njegov nastanak, način na koji se postavlja, sistem po kojem radi, ciljevi samog projekta te ostali sistemi prikupljanja vode. U sklopu rada izrađen je model Warka tornja u mjerilu 1:4 te instaliran pokraj zgrade Građevinskog fakulteta u Rijeci kako bi se ispitala njegova primjena na ovom području.This paper covers topic of a innovative way of gathering drinking water from the processes that take place in atmosphere and create horizontal and vertical rainfall. The project which is called Warka water is explained, inspiration for its creation, the way it is set up, the system under which it works, the goals of the project and other water collection systems. Within the work, Warka tower model is made in 1:4 scale and installed beside the building of Faculty of Civil Engineering in Rijeka to see its application on this area

The efforts of central government and City government in attracting investment have been performed such as the lessen of bureaucracy paths, the given of guarantee to political and security stability, and law certainty besides the giving of incentive forms to the investors, therefore, they will be believe and have faith that capital investment in industrial sector will give much advantages to investors

    The Foundation of the Town of Warka at the Background Political and Institutional Processes of Mazovia in 14th Century

    The political and economic changes that took place from the 13th to the end of 15th century influenced the development of settlement and town foundations in Mazovia. The foundation of the town of Warka must have taken place before 1375, since the municipal authorities are mentioned under this year. Many previous researchers (e.g., Stanisław Pazyra) connected the location of Warka’s town to a document issued by the Mazovian Prince Trojden I (c. 1285–1341) in 1321, in which the Prince approved the donations made to the Dominican monastery in Warka. In this document Warka appears as an „oppidum”. Although the year 1321 was an important one for Warka – today we would rather have to say that it marked the beginning of the development of the town, important for Mazovia, both in the Middle Ages and later centuries. Following the processes of location, the formation of the municipal government, the economic life of the town, the formation of a separate judiciary, religious foundations- these are the issues that are before us and need to be carefully studied.Zmiany polityczne i gospodarcze, które zachodziły od XIII do końca XV w., wpłynęły na rozwój osadnictwa i lokacji miejskich na Mazowszu. Lokacja miasta Warki musiała nastąpić przed 1375 r., skoro pod tym rokiem są wzmiankowane władze miejskie. Wielu wcześniejszych badaczy (np. Stanisław Pazyra) łączyło lokację miejską Warki z dokumentem wydanym przez księcia mazowieckiego Trojdena I (ok. 1285–1341) w 1321 r., w którym książę zatwierdził nadania uczynione na rzecz klasztoru dominikanów w Warce. W tym dokumencie Warka występuje jako „oppidum”. Choć rok 1321 był dla Warki ważnym, dzisiaj raczej trzeba by powiedzieć, że zapoczątkował proces rozwoju miasta, ważnego dla Mazowsza, tak w średniowieczu, jak i w wiekach późniejszych. Procesy lokacji, kształtowanie się samorządu miejskiego i życia ekonomicznego miasta, wytworzenie się odrębnego sądownictwa, fundacji religijnych – to zagadnienia, które stają przed nami i wymagają gruntownego przebadania

    Dyssynchronization of law in investment Held happens in vertical and horizontal relationship. For example, relationship between the Decree of Investment Ministry/ Chief of Capital Investment Coordinator Agency Number 37/SK/1999, it follows decentralization principle. When it is related with the Decree of President of Republic of Indonesia Number 29 Year 2004, it follows centralization principle. According to Law Number 32 Year 2004, in the relationship between Regency/City government with another there is dyssynchronization because each regions only sued for optimal PAD increment, therefore many regional rules (Perda) which are established by Regency/City government tend to obstruct capital investment in the Regency/City area. With dyssynchronization above, there is uncertainty concerning with the effect of law to investor, and finally, the number of unemployment is increasing

    Foreign investment has decisive role, given that developed countries still need capital, let alone a developing countries need it more. District and city governments throughout Indonesia, explore the potential of their respective regions in order to carry out promotions, so that they will be able to attract in investment. Following up on this eagerness, the District/City Government each issues a Regional Regulation (called Perda), in order to increase Local Income (PAD), regardless of the interests of the community and other impacts, Target to increase PAD is the people and investors in general at the authority of the District / City, finally competing to issue regional regulations (Perda) without taking into account other aspects, which could hinder investment in their respective regions. Among others, regional regulations regarding parking fees, street lighting fees and licensing in the industrial trade and investment sectors.     Indonesia merupakan Negara Hukum sesuai dengan dasar Konstitusi Negara Indonesia yaitu pada Pasal 1 ayat (3) Undang-Undang Dasar Negara Republik Indonesia Tahun 1945. Dengan Indonesia menjadi negara hukum tidak menutup kemungkinan Indonesia memiliki lembaga-lembaga baru yang bersifat independen. Dengan muncul adanya lembaga-lembaga baru maka terjadi tumpang tindih kewenangan yang mengakibatkan pada ketidakjelasan lembaga yang mengatur dan berhak untuk mengadili. Berdasarkan pada Putusan Mahkamah Konstitusi Nomor 25/PUU-XII/2014 menyatakan bahwa frasa “dan bebas dari campur tangan pihak lain” yang mengikuti kata “independen” dalam Pasal 1 angka 1 Undang-Undang Nomor 21 Tahun 2011 tentang Otoritas Jasa Keuangan bertentangan dengan Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 dan tidak memiliki kekuatan hukum yang mengikat. Sehingga bunyi Pasal 1 angka 1 Undang-Undang Nomor 21 Tahun 2011 tentang Otoritas Jasa Keuangan jadi “Otoritas Jasa Keuangan, yang selanjutnya disingkat OJK adalah lembaga yang independen, yang mempunyai fungsi, tugas, dan wewenang pengaturan, pengawasan, pemeriksaan dan penyidikan sebagaimana dalam Undang-Undang ini”
