    Controlling the Spending of EU Funds in Italian and Polish Law Against the Background of EU Regulations

The BETKOSOL project (Grant Agreement (GA) No: 101015421) was co-funded by the European Union HERCULE III programme; research on the protection of EU financial interests in Poland was also carried out as part of the Centre for Democracy, Accountability and Representation (CEDAR) project.Spending from the budget of the European Union (EU) should be done correctly, in line with EU and Member State legislation. However, minor or major irregularities cannot be avoided in the disbursement of EU funds, so procedures must be in place to detect and eliminate them. Control procedures are key in this respect. This article reviews the EU regulations that apply to the control of EU spending and analyses the control concepts adopted in two Member States: Italy and Poland. The authors found that in these two countries, the control of EU spending is carried out by a number of actors. Solutions for improvement were identified.     It follows from the Entrepreneurs’ Law that an entrepreneur may refer to an individual interpretation decision which he has received or to an established interpretation practice. The article analyses an institution of an established interpretation practice – it examines applicable legal regulations, views of doctrine and judicature. The paper also points to analogous solutions adopted in the Tax Ordinance Act, which concern taxes.     This study deals with the legal and financial issues of the National Fund for the Protection of Monuments (NFOZ), which has been operating since 1 January 2018 as a special purpose fund. The Fund has statutorily assigned revenues that come from fines paid by violators of regulations related to the protection of monuments. The study analyses the fund’s receipts and expenditures listed in its annual financial plans and concludes that, due to its relatively small revenues, the NFOZ contributes only minimally to the financing of the monument protection system in Poland.Opracowanie dotyczy prawnofinansowej problematyki Narodowego Funduszu Ochrony Zabytków (NFOZ). Podmiot ten funkcjonuje od 1 stycznia 2018 r. jako fundusz celowy. Posiada on ustawowo przypisane przychody, które pochodzą z kar pieniężnych opłacanych przez podmioty naruszające przepisy związane z ochroną zabytków. Autor przeanalizował wpływy i wydatki funduszu wynikające z corocznych planów finansowych i doszedł do wniosku, że z uwagi na stosunkowo niewielkie przychody Narodowy Fundusz Ochrony Zabytków w minimalnym tylko stopniu przyczynia się do finansowania systemu ochrony zabytków w Polsce

    The article deals with the Accessibility Fund which is a part of a system of ensuring accessibility for people with special needs. One of the basic tasks of the state is to remove barriers and ensure accessibility for all citizens, including people with mobility or perception difficulties. The Accessibility Fund is a state purpose fund. This fund has statutorily defined revenues and expenditures. It is a fund of relatively low financial significance. The study argues that the state’s tasks in the area of an accessibility could be effectively fulfilled without the establishment of this fund, and its role could be taken over by one of the existing special purpose funds.Artykuł dotyczy Funduszu Dostępności, który jest elementem systemu zapewnienia dostępności osobom ze szczególnymi potrzebami. Jednym z podstawowych zadań państwa jest bowiem usuwanie barier i zapewnienie dostępności dla wszystkich obywateli, w tym osób posiadających trudności w mobilności czy percepcji. Fundusz Dostępności jest państwowym funduszem celowym, który ma określone ustawowo przychody i wydatki. Jest funduszem o stosunkowo niewielkim znaczeniu finansowym.     The Act – Entrepreneurs’ Law provides that an entrepreneur may submit an application to a competent authority or a competent state organisational unit for issuance of an explanation regarding the scope and manner of application of regulations from which the entrepreneur’s obligation to pay public levy or social or health insurance contributions arises, in his/her individual case (individual interpretation). The effective filing of an application requires the fulfilment of subjectmatter prerequisites, i.e. the application may be filed only by an entrepreneur and only in relations to the provisions concerning public levy or social and health insurance contributions. The article analyses the restrictions on the sale of medicines (prohibition of the so-called reverse distribution of medicines), in the context of the possibility of qualifying these restrictions as public tributes. The paper indicates what public burdens and benefits and public tributes are in the light of the applicable legislation, doctrinal views and case law. It is clear from the article that the prohibition of the so-called reverse distribution of medicines is an important restriction for the entrepreneur, but it is not a public tribute. Consequently, the conclusion is drawn that an entrepreneur cannot successfully apply for an interpretative decision regarding Article 86a of the Pharmaceutical Law.Ustawa – Prawo przedsiębiorców przewiduje, że przedsiębiorca może złożyć do właściwego organu lub właściwej państwowej jednostki organizacyjnej wniosek o wydanie wyjaśnienia co do zakresu i sposobu stosowania przepisów, z których wynika obowiązek świadczenia przez przedsiębiorcę daniny publicznej lub składek na ubezpieczenia społeczne lub zdrowotne, w jego indywidualnej sprawie (interpretacja indywidualna). Skuteczne złożenie wniosku wymaga spełnienia przesłanek podmiotowo-przedmiotowych, tj. wniosek może złożyć tylko przedsiębiorca i tylko w odniesieniu do przepisów dotyczących daniny publicznej lub składek na ubezpieczenia społeczne i zdrowotne. Artykuł zawiera analizy dotyczące ograniczeń w zakresie sprzedaży leków (zakaz tzw. odwróconej dystrybucji leków), w kontekście możliwości zakwalifikowania tych ograniczeń do danin publicznych. W opracowaniu wskazano czym są ciężary i świadczenia publiczne oraz daniny publiczne w świetle obowiązujących przepisów, poglądów doktryny i orzecznictwa. Z artykułu jednoznacznie wynika, że zakaz tzw. odwróconej dystrybucji leków jest istotnym ograniczeniem dla przedsiębiorcy, ale nie jest daniną publiczną. W konsekwencji sformułowano wniosek, że przedsiębiorca nie może skutecznie złożyć wniosku o wydanie decyzji interpretacyjnej dotyczącej art. 86a ustawy – Prawo farmaceutyczne
