No full textIl saggio analizza la pronuncia del Mediatore europeo del 25 gennaio 2013, in cui è stato accertato un caso cattiva amministrazione a carico della Commissione europea, che ha sbagliato nell'interpretare l'art. 17 del Trattato sul Funzionamento dell'Unione europea.
Partendo da questa pronuncia, l'Autore svolge alcune considerazioni sul significato e la portata dell'art. 17 TFUE e ricostruisce una lettura di tale disposizione diversa da quella spesso accolta dalle istituzioni europee e da parte della dottrina.The essay analyzes the decision of the European Ombudsman of 25 January 2013, in a case where it was found maladministration by the European Commission, which has made a mistake in interpreting Article 17 of the Treaty on the Functioning of the European Union.
Based on this ruling, the author performs some thoughts on the meaning and scope of Article 17 TFEU and reconstructs a reading of this provision that is quite different from that which the European institutions often seem to accept

No full textIn questo saggio l'autore prende in esame la recente sentenza con cui la IV Sezione della Suprema Corte di Cassazione italiana ha chiesto il deferimento di una causa riguardante l'esposizione del crocifisso in un'aula di una scuola pubblica. A differenza di quanto avvenuto in altre controversie già decise in passato, in questo caso l'appello viene da un insegnante e si basa sulla violazione della sua libertà religiosa "negativa"; alla luce di questa peculiarità, l'autore esamina la decisione concentrandosi prima di tutto sul diritto affermato dal ricorrente, poi sul divieto di discriminazione e, infine, sul principio di laicitàIn this essay the author examines the recent decision by which the IV Section of the Italian Supreme Court of cassation requested the referral of a case concerning the display of the crucifix in a public school classroom.
