    COLOMBIA’S EXPERIENCES WITH INTERNATIONAL INVESTMENT ARBITRATION: CONTEXT, CASES, TREATIES

    This paper analyses Colombia’s experiences with international arbitration in disputes with foreign investors. Three periods of roughly 30 years were chosen: a) diplomatic protection of great powers’ expatriates in Latin America (Colombia) in the era of Imperialist rivalry: the last decades of the nineteenth century and the early years of the twentieth. This protection (sometimes with naval interventions) was meant to uphold a minimum standard of treatment for foreigners and gave rise to the Calvo doctrine as its counter-current protecting Latin American economic sovereignty; b) interregnum between the 1960s and 1980s: Calvo (prevalent in Latin America) reincarnated in an economic emancipation drive by postcolonial countries at the United Nations. Yet, the doctrine suffered a setback in the World Bank where the Icsid Convention was adopted despite a collective No vote by Latin American members on an earlier draft in Tokyo; c) investor-state arbitration under international investment agreements: expansion and retreat, from 1990 to present. Expansion of such agreements and emergence of a kind of arbitral case-law occurred between the early 1990s (when the Latin American mainstream abandoned Calvo) and the late 2000s. Counter-currents appeared since the early 2000, including treaty clarifications, public policy carve-outs, and withdrawals of Latin American, North American and European states. This periodization allows for comparing Colombia’s international investment arbitration consents, relevant awards, treaties, legislation and constitutional case-law over time.

    This essay discusses globalization and glocalization as crucially important concepts for the Social Sciences and Humanities, thereby distinguishing between globalization/ glocalization as research methodology (hermeneutics) and as historical process unfolding through time. For many SSH scholars the term globalization evokes historical processes that likewise spanned the globe and were (apparently) directed from above, such as imperialism, Westernisation and modernisation. Defining globalization as glocalization, which it is by nature, might help to overcome this (incorrect) association and make it into an important instrument of the (decolonial) SSH toolbox. After discussing the content of the Handbook of Culture and Glocalization, edited by Victor N. Roudometof and Ugo Dessì (2022), to show what glocalization entails and how the concept is fruitfully used over a variety of fields already, I focus on the idea of “arrival” as a next step in our research agenda. Glocalization, I argue, is very much about the impact of globalization, in local contexts, in cognitive terms of experience. Increasing global dynamics demand embedding practices to make globalization work on the ground, in the lives of people, as glocalization. Advance Treatments Directives, medical activity and conscientious objection ABSTRACT: Law n. 219 of 2017 regulated Advance Treatment Arrangements by allowing the patient to express their treatment choices even for the future in the event of a supervening incapacity. The patient, therefore, may express prior consent or dissent with respect to future diagnostic-therapeutic options and/or individual medical treatments, including artificial hydration and/or nutrition practices. The paper examines the issue of the conflict of conscience of the physician called upon to carry out the patients decisions with the suspension or nonactivation of life-saving health treatments in the absence of a specific conscience clause regulated by law.     Public order and religious family rights. Sustainability and limits of an evolving legal relationship The evolution of the public order clause in the nexus between civil and religious legal systems assumes particular significance when contemplated within the context of personal statutes of family law, particularly within Islamic tradition. In addition to its historically function as an instrument for the protection of state sovereignty and a guarantee of respect for the inviolability of fundamental principles, recent developments have enhanced the capacity of public order to mediate between different visions of personal relations within multicultural societies. In this dynamic, the not always univocal solutions expressed by recent jurisprudence of legitimacy denote an ever changing use of the substantial and procedural public order. The reference to the evaluation of the effects of the specific case does not, however, seem to diminish the need to define public order in relation to the protection of the most vulnerable subjects from the effects deriving from the introduction, or blocking, of those legal institutions of family law that involve them.     I ventuno βασιλικοὶ λόγοι scritti e pronunciati da Michele Psello (1018 – 1078), inediti fino alla seconda metà del XIX secolo, hanno visto diverse edizioni principi fino agli anni Ottanta del secolo scorso; furono riuniti in un unico volume teubneriano nel 1994, per cura di George T. Dennis, sotto il titolo di Orationes panegyricae; sebbene questo volume sia tutt’oggi l’edizione di riferimento per gli encomi pselliani, esso consta di numerose problematicità: ordine delle orazioni non corrispondente a quello cronologico, assenza di altre cinque orazioni (tuttavia presenti negli Oratoria minora curati da Littlewood), frequentissime letture errate dai manoscritti e un apparato delle fonti che spesso travisa gli intenti dell’autore. Con l’ausilio dei numerosi studi su Psello pubblicati nel corso degli ultimi vent’anni, l’intento del presente contributo è fornire uno studio preparatorio per una nuova edizione critica, evidenziando e superando tutte le problematicità delle precedenti edizioni teubneriane.The twenty-one βασιλικοὶ λόγοι written and pronounced by Michael Psellos (1018 – 1078), unedited until the second half of 19th century, saw various editiones principes until the 1980s; they were then collected in an unique Teubner volume in 1994, by George T. Dennis, under the title of Orationes panegyricae; although this volume is the Psellian panegyrics’ edition of reference nowadays, it presents several problems: orations’ order out of phase with actual timeline, the absence of other five orations (anyway collected in the Oratoria minora by Littlewood), very frequent wrong readings from manuscripts and often non-relevant apparatus fontium with author’s achievements. With the help of the numerous studies on Psellos published during the last twenty years, the purpose of this paper is to provide a preparatory study to a new critic edition, by highlighting and overcoming all the problems of the previous Teubner editions

    La langue et la littérature : des espaces de médiation interculturelle. La force performative de « Kuessipan » de Naomi Fontaine

    The process of intercultural mediation aims to allow exchanges, connection, dialogue, rapprochement, understanding, prevention and resolution of disputes by postulating, as a fundamental value, the possibility of living together with differences (Cf. Paola Puccini, Michèle Vatz Laaroussi, Claude Gélinas, La Médiation interculturelle, Milan, Hoepli, 2022, pp. 21-22). It is therefore a matter of building a bridge between people, groups, institutions that are ignorant of each other, have prejudices or are in a situation of misunderstanding or conflict where the intercultural dimension is present, or even predominant. We believe that Indigenous literature is particularly significant in its attempt to denounce racism, discrimination, prejudice, exclusion and oppression, but also in its desire to draw up potential spaces for intercultural mediation to be developed. In our work we want to look at Kuessipan by Naomi Fontaine with the desire to show her performativity through which the author manages to create new spaces where she can stage the relationship between the members of a community and the world they live in build, thus generating a transformation. The pragmatics applied to the literary text and the linguistic theory of the enunciation will be used to describe the mechanisms of construction of links that are created beyond the barriers, exclusions, sufferings.Le processus de médiation interculturelle vise à permettre l’échange, la connexion, le dialogue, le rapprochement, la compréhension, la prévention et la résolution des conflits en postulant, comme valeur fondamentale, la possibilité de vivre ensemble avec des différences (Cf. Paola Puccini, Michèle Vatz Laaroussi, Claude Gélinas, La Médiation interculturelle, Milan, Hoepli, 2022, pp. 21-22). Il s’agit donc de construire un pont entre des personnes, des groupes, des institutions qui s’ignorent, ont des préjugés ou se trouvent dans une situation d’incompréhension ou de conflit où la dimension interculturelle est présente, voire prédominante. Nous pensons que la littérature autochtone est particulièrement significative dans sa tentative de dénoncer le racisme, la discrimination, les préjugés, l’exclusion et l’oppression, mais aussi dans sa volonté de dessiner des espaces potentiels pour le développement de la médiation interculturelle. Dans notre travail, nous voulons examiner Kuessipan de Naomi Fontaine avec le désir de montrer sa performativité à travers laquelle l’auteur parvient à créer de nouveaux espaces où elle peut mettre en scène la relation entre les membres d’une communauté et le monde dans lequel ils vivent, générant ainsi une transformation. La pragmatique appliquée au texte littéraire et la théorie linguistique de l’énonciation seront utilisées pour décrire les mécanismes de construction des liens qui se créent au-delà des barrières, des exclusions, des souffrances
