Analyzing Children's Marriage (Sociological and Reproductive Legal Perspective)
Article 7 paragraph (1) Law No. I of 1974 concerning Marriage, states that marriage is only permitted for those who have reached the age of 19 years (male) and 16 years (female) and if it has not reached that age the parties may request dispensation to the court. Child marriage is not a simple problem because it does not only violate the law that stated in the article 6 paragraph (2) of Law Number 1 of 1974 concerning Marriage, but it also can damage the social order. Hence, in this study, the authors try to analyze the relevance of marital age according to the Law No. 1 of 1974 concerning Marriage in term of sociological and reproductive juridical aspects. In addition, the author also wants to know what solutions should be taken to reduce the adverse effects of marriage at an early age. This is a normative legal research with legal and conceptual approach. The legal material analysis technique used is legal reasoning using deduction method. The result of the study shows that early marriage causes many disadvantages and risks, especially in terms of reproduction. There is a necessity to reform Islamic family law, especially in the legal juridical aspect for example renewing the article relating to the marriage age limit of the bride and groom

Perlindungan Hukum Pemegang Polis Asuransi Syariah Berdasarkan Undang-Undang Nomor 40 Tahun 2014 Tentang Perasuransian
This research was conducted to find out the legal protection that Sharia insurance policyholders can have based on law number 40 of 2014 concerning insurance, in the event of a dispute between Sharia insurance policyholders and an insurance company through an insurance agreement.This study uses a juridical method that is guided by the norms of the rule of law contained in statutory regulations. Sources of data used include secondary data, primary data, and tertiary data. Primary legal materials are legal and statutory provisions that will be examined, including 1) Law Number 40 of 2014 concerning Insurance Business; 2) Fatwa of the national sharia council No. 21/DSNMUI/X/2001 concerning general guidelines for Sharia insurance; and 3) Supreme Court Regulation No. 2 of 2008 concerning Sharia Economic Compilation Law. Secondary legal material is in the form of written source literature on the main questions of this study in the form of legal treatises, books, and legal journals. While tertiary legal materials for this research include legal dictionaries, legal research books, journals, and internet research.The results of this study are protection for policyholders or insureds based on dispute resolution and Sharia insurance legal entities according to law number 40 of 2014. The insurer as a party bound by an insurance contract with an insurance company is protected by Article 53 which regulates insurance guarantee schemes, and Article 54 which regulates the settlement of insurance disputes through mediation. PENYELESAIAN SENGKETA EKONOMI SYARIAH DALAM HUKUM ISLAM SERTA PANDANGAN HUKUM POSITIF PADA PELAKSANAANNYA
AbstratcThis study aims to determine the Alternative Dispute Resolution (APS) model which includes mediation, negotiation, conciliation, and arbitration in Positive Law and Islamic law which are taken from the Al-Qur'an and Al-Hadith. The essence of the problem to be uncovered in this study is to find Dispute Resolution models at the time of Rasulullah SAW and the mechanism according to Positive Law in resolving sharia economic disputes. The research method used in this study is a literature study research model by relying on books, articles, journals, and turots as sources of research data. The results of this study found that at the time of the Prophet Muhammad SAW had encountered the practice of resolving disputes through Alternative Dispute Resolution (APS). This is proven by, first, the finding of the arguments for negotiation, mediation, conciliation and arbitration from the Qur'an and Hadith, secondly, the prophet Muhammad SAW negotiated with Suhail Bin 'Amr as a negotiator for the polytheists in the form of a hudaibiyah agreement, the three prophets Muhammad SAW became a mediator in reconciling two people from the ansor circles who were in dispute over material rights, fourth it was found that the prophet Muhammad SAW justified the arbitration carried out by Abu Shuraykh and Sa'ad Bin Muadz.Keywords: Dispute Resolution, Sharia Economy, Positive Law, Islamic Law.AbstrakPenelitian ini bertujuan mengetahui model Alternatif Penyelesaian Sengketa (APS) yang meliputi mediasi, negosiasi, konsiliasi, dan arbitrase dalam Hukum Positif dan hukum Islam yang dipetik dari Al-Qur’an dan Al-Hadits. Inti permasalahan yang ingin diungkap dalam penelitian ini adalah menemukan model-model Penyelesaian Sengketa pada zaman Rasulullah SAW dan mekanismenya menurut pandangan Hukum Positif dalam menyelesaikan sengketa ekonomi syariah. Adapun metode penelitian yang digunakan dalam penelitian ini adalah model penelitian studi kepustakaan dengan mengandalkan buku, artikel, jurnal, dan turots sebagai sumber data penelitian. Hasil dari penelitian ini menemukan bahwa pada masa Rasululloh SAW telah dijumpai praktek pendamaian sengketa melalui Alternatif Penyelesaian Sengketa (APS). Hal ini di buktikan dengan, pertama, ditemukannya dalil negosiasi, mediasi, konsiliasi dan arbitrase dari Al-Qur’an dan Hadits, kedua, nabi Muhammad SAW melakukan negosiasi dengan Suhail Bin ‘Amr sebagai negosiator kaum musyrik dalam wujud perjanjian hudaibiyah, ketiga nabi Muhammad SAW menjadi mediator dalam mendamaikan dua orang dari kalangan ansor yang berselisih dalam hak kebendaan, keempat ditemukan bahwa nabi Muhamad SAW membenarkan arbitrase yang dilakukan oleh Abu Syuraikh dan Sa’ad Bin Muadz.Kata-kata kunci : Penyelesaian Sengketa, Ekonomi Syariah, Hukum Positif, Hukum Islam

Hasil penelitian menunjukkan bahwa potensi pariwisata
di Lokawisata Baturraden Banyumas dapat dikembangkan
menjadi pariwisata syariah. Hal ini dapat diketahui melalui
indikasi sebagai berikut, 1) Masyarakat memahami pengertian
pariwisata syariah, pariwisata dilaksanakan dengan tujuan
rekreasi, tadabbur alam, wisata keluarga yang sesuai dengan
fatwa DSN - MUI; 2) Kegiatan pariwisata dan lokasi obyek
wisata cukup terhindar dari kegiatan kemaksiatan, sesuai dengan akidah Islam dan tidak melanggar tata susila. Hanya sedikit yang perlu dibenahi yakni penerapan aturan tidak boleh pacaran dan pelaksanaan jam malam yang lebih ketat; 3) Persoalan laten Gang Sadar (prostitusi lokal) yang belum dapat diatasi; 4) Di lokasi wisata menyediakan fasilitas umum seperti toilet, kamar mandi, tempat ibadah dan berwudhu, rumah makan, toko souvenir, ketersediaan akses Wi-Fi, belum tersedianya hotel yang berlabel halal, restoran atau rumah makan yang berlabel halal, dan tempat hiburan yang tidak melanggar peraturan pemerintah daerah
Legal Reasoning Hakim dalam Memutuskan Jumlah Kerugian Materil Sengketa Murabahah di Pengadilan Agama Purwokerto
Dispute cases in the field of sharia economics are new cases for the Panel of Judges of the Religious Courts since the promulgation of Law Number 3 of 2006, so that with the limitations of formal law and material law relating to cases of sharia economic disputes. So the judges are required to create laws that are progressive as an effort to decide on a case at hand. In this study, the author seeks to explain how a judge applies law to sharia economic cases, especially in case number 6379/Pdt.G/2019/PA.Clp in the Case of Default in the Murabahah Contract at the Cilacap Religious Court.The author in conducting research certainly uses research methods that are in accordance with scientific principles. The type of research used is a type of library research where the data used is primary data, namely the Islamic banking dispute decision Number. Number 6379/Pdt.G/2019/PA.Clp In the Case of Default in the Murabahah Contract at the Cilacap Religious Court with a normative juridical approach. Data collection techniques were carried out by collecting primary and secondary materials, including through interviews with the main source of the Panel of Judges examining the case in order to explore the method of application and discovery of law. Data analysis used descriptive analysis method with deductive qualitative analysis techniques.The results of the study show that the decision of the panel of judges in case number 6379/Pdt.G/2019/PA.Clp produces 2 results, namely the first explains the reasons for the validity of the murabahah agreement in the case and the legal reasoning of the judge in deciding the dispute so as to get a decision that is felt have justice between the two parties and of course have legal certainty
Construction of Professional Zakat in the Perspective of Islamic Law: Orientation and Formulation
Professional zakat, as a crucial instrument in Islamic economics, has experienced significant development alongside the increasingly complex dynamics of modern society. This study aims to analyze the legal construction of professional zakat through the maqashid shariah approach and to examine the formulation of policies and calculation mechanisms of professional zakat within the Indonesian legal system. The findings indicate that professional zakat has a strong normative foundation based on the method of analogy (qiyas syabah) to zakat on gold and agricultural produce, which is subsequently implemented in national regulations such as Law No. 23 of 2011 and the Indonesian Ulama Council’s fatwa. However, the implementation of professional zakat faces various challenges, particularly related to public awareness and structural obstacles in zakat management. This study emphasizes the importance of strengthening professional zakat literacy and integrating technology into zakat collection systems to enhance the effectiveness of professional zakat as a tool for empowering the Muslim community’s economy
Social mobility of Orang Asli: a conceptual paper / Farah Adilla Ab Rahman …[et al.]
Social mobility exists because of the causes and effects of collective or individual movements arising from changes in the social system (Aldridge, 2001). In 2020, the World Economic Forum produced Global Social Mobility Report that placed Malaysia at Number 43 indicating that there are decreased opportunities for people in health care, education, access to technology, working conditions and social protection (The Global Social, Mobility Report, 2020). Furthermore, social mobility does affect the indigenous people in terms of their employment, education and risk of exclusion (United Nations, 2016). The 2030 Agenda for Sustainable Development has the potential to be transformative for indigenous people if its implementation respects these principles of equality and participation (United Nations, 2017). To achieve the SDGs in Malaysia, the government is committed to increase the socio-economic well-being of the indigenous people. Moreover, the Malaysian government has planned several development programmed such as the New Economic Policy, Structured Placement Program and a few more, to improve the social mobility of the indigenous people (Wee, Maryati, & Mohd Nur Syufaat, 2013. As a result, the focus of this conceptual paper will be on a discussion of the lack of literature related to the social mobility of Orang Asli in Malaysia, factors influencing social mobility, and possible future studies in social mobility concerning indigenous people in Malaysia
