Análise da conduta de Edward Snowden a partir da teoria moral de Immanuel Kant

Direito.Na presente monografia será analisada a conduta de Edward Snowden a partir da teoria moral de Immanuel Kant. O principal objetivo desta pesquisa é responder exatamente a seguinte pergunta: Snowden fez a coisa certa ou não? Para obter a resposta ao problema suscitado será aferida se sua conduta preencheu os requisitos ou não da teoria moral kantiana. Ademais com esta análise, buscar-se-á verificar se existe a possibilidade de uma justificativa plausível para a escolha feita diante do dilema moral enfrentado pelo então delator, qual seja, a escolha entre: a) o dever em obedecer às leis de vigilância de seu país; e b) o dever em denunciar as violações aos direitos de privacidade e liberdade de cidadãos tanto norte-americanos, quanto de outros países. A razão do interesse nesta pesquisa consiste em aprofundar os conhecimentos sobre a filosofia moral, e, em descobrir, se é possível justificar condutas como as de Snowden, através do imperativo categórico kantiano, vale dizer, com base naquilo que Kant denomina de “suprema moralidade”, em que pese Snowden ter “violado” as leis positivas de seu país. A decisão em escolher a teoria base e o caso concreto a ser estudado, surgiu após uma participação no curso Justice, promovido pela Universidade de Harvard, o qual deu origem ao livro Justiça: o que é fazer a coisa certa? De Michael J. Sandel, bem como de ter tomado conhecimento do caso de Edward Snowden e logo associá-lo às questões que estudava durante o referido curso. Neste contexto nada mais oportuno do que compreender estes fenômenos político-filosóficos e aprofundar os conhecimentos sobre as teorias que fundamentam a justiça destas escolhas na contemporaneidade. O trabalho começa com uma pequena reflexão sobre a importância das definições de justiça. Depois são apresentadas as concepções teóricas de justiça utilitarista de Jeremy Bentham e libertária de Robert Nozick, esta servirá como “aporte” para compreensão do significado de liberdade em Kant, aquela, por sua vez, servirá para “explicar” a justificativa da política extremista de combate ao terrorismo perpetrado pelos Estados Unidos da América (EUA). Ambas serão contrastadas com a teoria moral de Immanuel Kant, abordadas na obra de Sandel. Além disso, serão apresentados alguns esclarecimentos sobre a teoria Kantiana, feitos por Sandel. Na segunda parte, faz-se uma descrição de como os EUA têm identificado seus inimigos públicos em casos análogos ao de Snowden, bem como fora feita tal identificação no caso em estudo. Ademais serão expostos os mecanismos de defesa utilizados contra Edward Snowden, bem como o modo como os EUA o perseguiu. Ao final, será analisada a conduta de Edward Snowden com base nas contribuições das teorias estudas no primeiro capítulo para a solução de seu caso. Por fim, buscar-se-á aferir e justificar a escolha feita pelo delator a partir da teoria moral kantiana no que se refere ao imperativo categórico e responder ao questionamento dantes suscitado
New Ways of Working Reveal Old Errors in Medicine Management

New Ways of Working (NWW) encourages extension of traditional caring roles. This paper discusses the impact of one of those extended roles: mental health nurse prescribing, in order to assess to what extent it meets the principles of NWW.
Method
Primary data was presented to two conferences on mental health nurse prescribing in 2008. The primary data constituted a grounded theory of the impact of mental health nurse prescribing in NHS Greater Glasgow and Clyde. This paper reports on verification of this theory from practising mental health nurse prescribers in England and Scotland.
Results
Thirty two practising nurse prescribers completed a questionnaire on the credibility of the theory. This feedback showed that the theory is a coherent representation of how nurses develop competence in prescribing.
Analysis
The process nurses go through to become competent closely mirror the principles of NWW. This offers practical support for the principles inherent in NWW and raises specific issues for the wider workforce.
Discussion
A consequence of analysing how high level nurses operate is to consider what happens to those nurses who do not operate at this level. In this instance deficits in medicine management can be seen as a function of old ways of working. Recommendations are made regarding structured education in medicines management from pre to post registration mental health nursing to address these deficits

This paper addresses a number of ethical dilemmas and practical consequences of the revelations of Edward Snowden about massive electronic surveillance of telephone calls, emails, social media posts and other “Signals Intelligence” (or SIGINT) across the entire world, but especially including domestic American communications formerly thought immune to such surveillance unless authorized by judicial warrant. Practical consequences matter for all “utilitarian” ethical judgments. The author concludes that by far the largest issue is whether US intelligence professionals regard the US Constitution as supreme law in America, or non-disclosure contracts with individual agencies or the US government. Reactions to Snowden follow this pattern, with security cleared insiders generally considering him a traitor, and ordinary people generally considering him a hero for telling the public about illegal activity within the National Security agency directed against fundamental, and constitutionally protected civil liberties like freedom of speech.Andregg, Michael M..
