    Is Lara the Answer to Implicit Divestiture?: A Critical Analysis of the Congressional Delegation Exception

    This work concerns the Supreme Court’s 2004 Indian law decision United States v. Lara, in which the Court held that Congress could enlarge tribal sovereign authority through federal legislation. Proponents of tribal sovereignty generally consider the decision a victory; however, Lara also contains a large amount of dicta in which the Court hints that external limits may circumscribe Congress’ ability to restore tribal sovereignty. The author attempts to explain this discontinuity, and warns that Lara may not represent an unqualified victory for Indian Country. Specifically, the author argues that Lara’s comments could indicate the Court considers tribes divested of the authority to act in certain sovereign capacities by virtue of their “discovery” by European colonialists

    Richardson, Barbauld, and the construction of an early modern fan club

    MPhilMuch has been written about the life and long works of the eighteenth century epistolary novelist, Samuel Richardson, but the prospect of his position as the first celebrity novelist – responsible for courting his own fame as well as initiating his own fan club – has largely been ignored. The body of manuscripts housed at the National Art Library in the Victoria and Albert Museum in London provides the modern scholar with evidence of the skeletal beginnings of an early fan club. This thesis aims to show how these manuscripts were turned into a saleable commodity by the publisher and entrepreneur Richard Phillips, while under the guiding hand of another, slightly later, literary celebrity, Anna Laetitia Barbauld. In order to restore Richardson’s reputation amongst a new nineteenth century audience, Barbauld was required to construct her own idea of him as an eighteenth century celebrity author, and in doing so the insecurities of a self-professed, apparently diffident man, are revealed. Barbauld’s capacious, but heavily edited selection of letters is analyzed in this thesis, providing ample evidence that Richardson’s correspondents were more than just eager letter writers. By using Barbauld’s biography of Richardson this thesis aims to show how she manipulates the genre of life writing in her construction of him. This thesis offers an alternative reading of how the Richardson manuscripts are viewed, redefining them as not simply a collection of letters, but as a collective entity, deliberately selected and archived as evidence of an early modern fan club, and its celebrity managing director

    The case of Anna O. has been commented extensively by scholars and historians interested in the history of psychotherapy and psychoanalysis. It is widely acknowledged that this case inspired Freud in his early formulations of a dynamic unconscious and the treatment of hysteria. In fact, in the last two decades a formidable number of scholars have written extensively about this patient and about the manner in which Breuer and Freud presented to the scientific world the clinical evidence. In this article, the author critically reviews a number of recent documents and data that sustain the view that Breuer and Freud distorted in considerable ways the clinical situation of Anna O. and the treatment itself. Finally, the author reviews a variety of diagnostic labels that have been suggested to explain the phenomenology of Anna O

Programa de Pós-graduação em FilosofiaDesde seus primeiros escritos Nietzsche se ocupou de questões relacionadas ao conhecimento e à verdade, ocorre, porém, que seu objetivo não é formular uma nova teoria do conhecimento ou reformular as concepções tradicionais, mas questionar a valor da verdade, indicando que os filósofos jamais a colocaram em questão. Em conseqüência dessa superestimação da verdade está o ódio instintivo contra a vida e seus pressupostos: tudo o que é transitório e efêmero foi negado em nome do conhecimento racional e objetivo. A proposta de Nietzsche é que a interpretação metafísica - que nega e falsifica a vida- seja substituída por uma interpretação afirmativa, com conceitos leves e dançantes, que se reconhece como interpretação provisória. O eterno retorno diz à vida o grande Sim, aceita o destino e deseja o seu retornar eterno. É um sim dionisíaco, que deseja o que a vida tem mais exuberante e belo, mas também o que ela tem de mais horrível e miserável

    Fear and stress that Anna Fox, a lady, experiences. She worked as a child psychologist before going through this fright and stress, but she was forced to leave her position as a result of the factors causing her to stay at home. The novel The Woman in the Window by A. J. Finn served as the research's data source. This book is a work of fiction that was motivated by reading a book that employed psychology as its central issue. The goal of this study is to examine the reasons behind the main character's experiences with stress and anxiety. Anna experiences these things because of the trauma of losing her family. The consequences of Anna's stress and worry are felt on a physical, emotional, and social level. In this study, the author applies Jacquelyn Ekern's theory by analyzing data using a descriptive qualitative approach. The authors also used library research to gather the data they needed for this project and chose quotes from The Woman in the Window

O primeiro tema citado é tão relevante em sua obra que ensejou a seguinte questão norteadora desta dissertação: como o corpo é apresentado em poemas selecionados dessa literata? Partindo das reflexões da pesquisadora de literatura polonesa Beata Przymuszala e do pensador português José Gil, é realizada a leitura da obra da autora polonesa e faz-se a seleção de poemas utilizando as palavras-chave: corpo, mão, cabeça e barriga. Antes de passar à discussão da referida problemática, é feita breve apresentação da autora, da recepção de sua obra na Polônia e no Brasil e o referencial teórico acerca da escrita feminina e do tema corpo. Apresenta-se, entre outras, ideias de Hélène Cixous, Katarzyna Szopa, Anna Nasilowska e Agnieszka Stapkiewicz, para então analisar esse tema na obra poética de Swirszczynska. A análise considera que o corpo representa a problemática de vida e morte e a percepção somática do mundo. Nesse último tópico discute-se mais pormenorizadamente as questões de relacionamento do corpo e alma, a animalidade do corpo e a premissa de como o corpo representa sofrimento e felicidade. Os poemas e/ou trechos são reproduzidos e discutidos, com base nos textos críticos sobre a obra da autora, para destacar as diferentes facetas do corpo na sua obra.Abstract: This text focuses on the lyrical work of Anna Swirszczynska (1909 –1984), a Polish poet who found her poetic language in her maturity, working on themes such as the body, the woman's point of view and the option of giving voice to people who are made invisible. The first theme mentioned is so relevant in her work that it gave rise to the following guiding question for this dissertation: how is the body presented in selected poems written by this writer? Based on the reflections of Polish literature researcher Beata Przymuszala and Portuguese thinker José Gil, the work of this Polish author is read and poems are selected using the keywords: body, hand, head, and belly. Before going on to the discussion of the above-mentioned issue, a brief presentation of this female author is made, as well as the reception of her work in Poland and Brazil, the theoretical framework regarding female writing and the theme of the body. Ideas of the authors such as Hélène Cixous, Katarzyna Szopa, Anna Nasilowska and Agnieszka Stapkiewicz are discussed and then an analysis of this theme in Swirszczynska's poetic work is performed. The analysis considers that the body represents the question of life and death and the somatic perception of the world. This last topic discusses in more detail the issues of the relationship between body and soul, the animality of the body and the premise of how the body represents suffering and happiness. The poems and/or excerpts are reproduced and discussed, based on critical texts on the author's work, to highlight the different facets of the body in her work

    Anna Maria beyond Niemeyer: National Congress furniture (1957-1977)

    O Palácio do Congresso Nacional, em Brasília, DF, possui coleções mobiliárias tão primorosas quanto sua arquitetura modernista. A arquiteta e designer Anna Maria Niemeyer, entre fins da década de 1950 e 1970, conduziu esses projetos personalizados próprios para o programa palaciano legislativo. A justa notoriedade do arquiteto Oscar Niemeyer, pai de Anna Maria, enquanto autor do projeto de arquitetura, maculou a valiosa colaboração de outros profissionais determinantes para a concepção do palácio-patrimônio. Este artigo objetiva trazer à luz a contribuição da designer por meio das coleções mobiliárias desenvolvidas para o Congresso Nacional  nessas décadas. Metodologicamente, a investigação historiográfica desse mobiliário moderno se vale dos  projetos originais (arquitetura e mobiliário), processos administrativos e artigos de Anna Maria Niemeyer na revista Módulo. Tal exame revelou dois tempos interiores: o momento singelo de inauguração em 1960, povoado por mobiliário correspondente, e o momento de revisita  destes interiores com o mobiliário-arte de fins da década de 1970. Se a arquitetura exterior de Oscar Niemeyer se manteve monumental no curso destas duas décadas iniciais, o espaço interior monumentalizou-se tendo o mobiliário como um dos protagonistas. É necessário localizar a designer Anna Maria Niemeyer na historiografia do móvel moderno brasileiro e, como afirma Maria Cecília Loschiavo (2017), fazer a devida reparação histórica em sua contribuição.The National Congress Palace in Brasília has furniture collections as exquisite as its modernist architecture. Between the late 1950s and 1970s, Anna Maria Niemeyer led these personalized projects for the legislative palace program. The well-deserved notoriety of architect Oscar Niemeyer, Anna\u27s father, as the author of the architectural project, tarnished the valuable collaboration of other professionals who were instrumental in the palace\u27s heritage. This article aims to shed light on the designer\u27s contribution through the furniture collections de-veloped for the National Congress in these decades.  Methodologically, the his-toriographical investigationof this modern furniture uses the original projects (architecture and furniture), administrative processes and articles by Anna in the magazine Módulo. This examination revealed two interior periods: the sim-ple moment of inauguration in 1960, populated by matching furniture,  and the moment of revisiting these interiors with the art furniture of the late 1970s. If Oscar\u27s exterior architecture remained monumental over the course of these two initial decades, the interior space became monumentalized, with furniture playing a leading role. It is necessary to locate designer Anna Maria Niemeyer in the historiography of modern Brazilian furniture and, as Maria Cecília Loschiavo (2017) states, to make due historical reparation for her contribution
