Regional Government Policy in Protecting Customary Land Rights: A Case Study of the Toba Batak Indigenous Community
This study aims to examine the mechanism of recognition and implementation challenges concerning the Indigenous Peoples of Batak Toba Samosir, particularly in the protection of customary land rights, as regulated in Regional Regulation No. 1 of 2020 of Toba Samosir Regency. This research is significant considering that the protection of collective rights of indigenous peoples is a constitutional mandate often hindered by administrative and political constraints at the local level. Employing a normative juridical approach with a qualitative design, the unit of analysis comprises Regional Regulation No. 1/2020 and related legal frameworks. Data were collected through library research involving primary legal materials (legislation), secondary sources (academic literature), and tertiary sources (legal dictionaries and encyclopedias). The findings reveal that the recognition of customary territories is based on the principles of ripe-ripe (communal rights) and pangumpolan (individual rights), yet faces technical and administrative obstacles. These include the absence of a Regent Regulation (Perkada) as an operational guideline, the lack of valid spatial and historical data, and limited participation of indigenous communities in the verification process. This situation leads to inconsistencies between written legal norms and field implementation. The study highlights the need for regulatory synchronization between central and local governments, as well as the urgency of formulating an inclusive and implementable Perkada. KONSISTENSI PEMBENTUKAN PERATURAN DAERAH BERDASARKAN HIERARKI PERUNDANG-UNDANGAN DALAM PRESPEKTIF POLITIK HUKUM
Pemerintah daerah merupakan perpanjangan tangan dari pemerintah pusat untuk menjalankan rodal pemerintahan guna mencapai tujuan bernegara. Dalaml mewujudkan pemerintahan daerah yangl efektif dan harmonis diperlukan peraturan daerah yang sejalan dengan substansil materi, hak asasi manusia, kepentingan umum dan tidak bertentangan dengan peraturan lain diatasnya. Terdapat bentuk hubungan komunikasi, konsultasi,klarifikasi Raperdal yang diterapkanl antara instansi Pemerintah dengan aparat didaerah yang selama ini masih kurang efektif, selainl itu optimalisasi yang miniml dari peran Gubernur dan Anggota Dewan dalam membinal dan mengawasi penyelenggaraan pemerintahan kabupaten/kota adalah salahl satu faktor yang menjadikan Perda tidak memiliki substansi yang jelas dan sesuai dengan kemanfaatannya. Disharmonisasi antarapemerintah pusat dan pemerintah daerah juga merupakan faktor penting di mana langkah pembinaan yangl dilakukan olehl instansi pusat kepada aparatur pemerintah daerahl dalam penyusunan Perda masihl dikatakan belum optimal danl merata sertal tidak adanya kerangka acuan yang jelasl bagi daerah mengenai tatal laksana harmonisasi Raperda sebagail salah satul instrumen pentingl dalam rangkal menjaga harmonisasi Perda denganlPeraturan lainnya. The Design Of The Idea Of Judicial Preview Authority Of The Constitutional Court In The Indonesian Constitutional System
Adopting the authority of judicial review in the context of testing laws against the Constitution carried out by the Constitutional Court should be welcomed as positive progress for institutionalizing the authority of judicial review itself. In its implementation so far, the authority of judicial review has received serious attention, as evidenced by the number of laws submitted for review in the Constitutional Court. To streamline the authority to review regulations by the Constitutional Court, it is necessary to adopt a model of judicial preview authority, namely testing draft laws, so that when they are passed, they are no longer legally problematic. This research is normative juridical research using various literature materials as the main study. The results show that the idea of adopting the authority of judicial preview is urgently needed. It is based on the consideration that so many laws are problematic both in terms of content and formation process. On the other hand, the authority of the Constitutional Court is only limited to the authority of judicial review, making it less appropriate in the context of the efficiency of judicial review of laws. Given the urgency of the application of judicial preview authority by the Constitutional Court, it is necessary to consider efforts to amend the 1945 Constitution by adding the phrase “testing draft laws against the Constitution†in the article governing the authority of the Constitutional Court as practiced in other countries such as France
Peran Kelembagaan Kantor Wilayah Kementerian Hukum dan HAM Dalam Upaya Optimalisasi Fungsi Lembaga Pemasyarakatan
The aim of this research is to find out more about the institutional role of the Regional Office of the Ministry of Law and Human Rights in efforts to optimize the performance and implementation of the main functions of correctional institutions. As is known, over time, the growth rate of inmates in correctional institutions is getting higher and higher. Meanwhile, on the other hand, it is highly hoped that correctional institutions can develop all prisoners to become complete individuals, realize their mistakes, improve themselves, and avoid criminal behavior in the future. In the end, prisoners are expected to be able to reintegrate into society, actively contribute to development and live a law-abiding life. This research methodology uses a normative approach by examining a number of related documents and legal regulations. Data is collected through library research to search for publications and other relevant materials related to the research topic, so as to increase the accuracy of the research materials collected. Of course, it is highly hoped that the institutions of the Regional Office of the Ministry of Law and Human Rights in each region can carry out optimal performance by fully supporting the implementation of the functions and duties of Correctional Institutions through developing the personality and independence of inmates, including the development of religious, national and state awareness, intellectual capacity, legal awareness, healthy reintegration into society, and physical and mental health. The work service activity program needs to be offered and built from the start through a pattern of developing independence through providing work skills based on groups and talents identified while the prisoner is in a correctional institution
Pertanggungjawaban Hukum Notaris Pengganti dalam Pembuatan Akta Melampaui Kewenangan di Indonesia
A substitute notary is a temporary official appointed to perform the duties of a primary notary during their absence, such as during leave or illness. Under Law No. 2 of 2014 concerning the Notary Office, a substitute notary holds the authority to create authentic deeds and manage protocols, similar to a primary notary. However, exceeding this authority poses significant legal risks, potentially invalidating deeds and leading to serious legal consequences. This study examines the legal responsibilities of substitute notaries in ensuring the validity of deeds they produce, emphasizing the importance of adhering to their defined authority and professional ethical standards. It aims to analyze the implications of substitute notaries exceeding their authority in drafting deeds, particularly in terms of deed validity and legal accountability. Furthermore, the research highlights the necessity of limiting substitute notary authority and implementing strict supervision to uphold the integrity of notarial practices. Using a normative legal method (juridical-normative), the study analyzes laws and regulations through a literature review and qualitative analysis of primary, secondary, and tertiary legal sources. The findings reveal that the legal liability of substitute notaries for deeds made beyond their authority encompasses civil, criminal, and administrative aspects. Such actions can render deeds invalid and cause harm to the parties involved. This research contributes to the field by providing a comprehensive understanding of the legal and ethical boundaries that substitute notaries must respect, offering insights for policymakers to enhance regulatory frameworks and supervision mechanisms. It also serves as a reference for legal practitioners and scholars to identify preventive measures and solutions to mitigate the risks associated with notarial misconduct
