(Not) Making “Hexternologous” Fertilization. The Italian ART Law and its paradoxes
The Italian law regulating ART approved in 2004 is at the centre of this conversation, which departs from the book ‘Fecondazione e(s)terologa’ (2012) written by two prominent Italian professionals in the field. The three contributors of this conversation analyse different profiles of the law: the con- tradictions between Catholic moral order and a scientific rationality which is not fully aware of its heteronormativity (Parolin); the macropolitics of infor- mation along Italian history and the moral economy surrounding fertilization techniques (Metzler); Law 40 in the context of the EU landscape of reproduc- tive rights (Schuster). All the three voices of the conversation emphasize the paradoxes of ART in Italy and the perverse effects of the prohibition of heter- ologous fertilization, namely the medical exodus of Italian couples outside of the Italian territory
La rettificazione di sesso: criticità persistenti
Questo lavoro preliminare indaga la prassi applicativa dopo le due importanti sentenze del 2015 della Corte di Cassazione e della Corte costituzionale sulla riattribuzione del genere anagrafico, le quali hanno statuito che l’intervento chirurgico non è una condizione necessaria. Tramite l’analisi di diversi provvedimenti emessi, l’Autore mostra come l’interpretazione della legge n. 164/1982 sia ancora pesantemente influenzata da un approccio patologico e, nella migliore delle ipotesi, medico all’identità di genere. Nonostante spesso si affermi di muovere dalla prospettiva dei diritti fondamentali, i giudici si rifanno quasi esclusivamente alle consulenze mediche e all’aspetto fisico. Così facendo, rifiutano di adottare un approccio rispettoso dell’autodeterminazione e dell’identità personale di ognuno. Lo scritto offre alcuni suggerimenti su come i giudici dovrebbero ricollocare il diritto in gioco in un quadro più ampio e conseguentemente ridefinire gli elementi di prova utili ad accertare l’identità delle persone
Religious practice and observance in the EU Member States
This study analyzes the relationship between freedom of religion and other fundamental rights in the European Union, the European Convention on Human Rights, as well as the constitutions of the Member States by examining the relevant case law in the Court of Justice of the European Union, the European Court of Human Rights, and state constitutional or supreme courts. The study will highlight present sources of conflict, underline best practices and put forward recommendations to promote both religious practice and observance and the respect of human rights
Visualizing diastolic failure: Non-invasive imaging-biomarkers in patients with heart failure with preserved ejection fraction
Heart failure with preserved ejection fraction is an increasing challenge for modern day medicine and has been drawing more attention recently. Invasive right heart catheterization represents the mainstay for the diagnosis of diastolic dysfunction, however due to its attributable risk of an invasive procedure, other non-invasive clinical pathways are trying to approach this pathology in clinical practice. Diastolic failure is complex, and imaging is based on various parameters. In addition to transthoracic echocardiography, numerous novel imaging approaches, such as cardiac magnetic resonance imaging, computed tomography, positron emission (computed) tomography or single photon emission tomography techniques are being used to supplement deeper insights into causal pathology and might open targets for dedicated therapy options. This article provides insights into these sophisticated imaging techniques, their incremental value for the diagnosis of this poorly understood disease and recent promising results for an enhanced prognostication of outcome and therapy monitoring
