The Higher Theological Seminary in Tarnów under the rector of Bl. Fr. Roman Sitko (1936–1941)
No full textSeminarium Duchowne w Tarnowie w ciągu dwóch wieków istnienia szczyciło się wieloma i wielkimi postaciami rektorów, a jeden z nich, ks. Roman Sitko, został wyniesiony do chwały ołtarzy. Osoba błogosławionego Rektora wciąż inspiruje, nie tylko kapłanów i alumnów WSD w Tarnowie czy WSD w Rzeszowie, ale także osoby świeckie. Jego całkowite oddanie sprawie powołań i dobrej formacji nowych kapłanów zasługuje na opracowanie. W artykule tym został ukazany fragment historii tarnowskiego seminarium, kiedy urząd rektorski sprawował ks. Sitko – skład kadry wychowawczej i profesorskiej, liczby alumnów i nowo wyświęconych kapłanów. Nie pominięto też wręcz ojcowskich relacji pomiędzy rektorem i alumnami, co sprzyjało dobrej atmosferze formacji. Cenne są tu przywoływane fragmenty świadectw ówczesnych kleryków. Zaprezentowano także sytuację seminarium w trudnym czasie II wojny światowej, kiedy jego budynek został zajęty przez Wehrmacht. Nie przeszkodziło to jednak w kontynuowaniu formacji kleryków. Rektor Sitko zorganizował ośrodek w Błoniu koło Tarnowa, gdzie podjął się przygotowania kleryków do święceń kapłańskich. Ostatecznie został za to aresztowany i osadzony w więzieniu. Po roku aresztu trafił do obozu Auschwitz, gdzie ukoronował całkowite oddanie sprawie tarnowskiego seminarium i kleryków męczeńską śmiercią.During the two centuries of its existence, the Seminary in Tarnów boasted many great rectors, including Fr. Roman Sitko, who was elevated to the glory of the altars. The blessed person of the rector still inspires not only priests and graduates of the Major Seminary in Tarnów or the Major Seminary in Rzeszów, but also lay people. His dedication to the question of vocations and the good formation of the new priests deserves to be taken into account. This article presents a fragment of the history of the seminary in Tarnów, during which the rector's office was held by Fr. R. Sitko – the composition of the educational and professorial staff, the number of alumni and newly ordained priests. The paternal relationship between him as the rector and the seminarians is shown, which facilitated an atmosphere of good formation. The quoted fragments of testimonies of seminarians of the time are valuable here. It also shows the situation of the seminary during the difficult time of the outbreak of World War II and the occupation of the building by the Wehrmacht. However, this did not prevent the continuation of the formation of seminarians. Rector Sitko organized a center in Błonie near Tarnów, where the process of clerical preparation for priestly ordination continued. He was soon arrested and imprisoned for that. After a year of arrest, he ended up in Auschwitz, where he confirmed his absolute devotion to the case of the Seminary and seminarians with a martyr's death
Parent Material Effect on Soil Organic Carbon Concentration under Primeval European Beech Forests at a Regional Scale
No full textThe research presented herein explores soil organic carbon concentration (SOCC) under monodominant primeval forests of European beech trees and their association with parent material on a regional scale. Soil sampling to a maximum depth of 0.8 m was conducted in six localities in the West, East, and South Carpathians, Eastern Albanides, and Central Apennines, situated on different parent materials. Samples were analysed for SOCC by the dry combustion method. The average SOCC values representing individual localities ranged from 12.5 g kg−1 to 154.8 g kg−1 with a 99.7% coefficient of variation. SOCC association with climatic variables and forest stand volume data available from the literature were assessed by a Pearson correlation coefficient. Differences in SOCC among localities caused by site conditions were treated as a fixed factor in Welch’s ANOVA and found to be significant (p < 0.05) in the majority of cases. The associations between SOCC and climatic variables or stand volume were nonsignificant or perturbed. Since they validly explained less than 10% of the overall SOCC variance, the results of multiple comparison tests were assessed and interpreted in view of distinct parent materials
Protection of a famous person’s surname in the light of the European Union trade mark regulation
No full textPURPOSE: The main goal of the paper is to analyse the possibilities and rules of
management of the protection of a famous person’s surname based on the provisions of the
Regulation 2017/1001 of the European Parliament and of the Council of 14 June 2017 on
the European Union trade mark (EUTMR). Moreover, the author aims at exploring
whether the general principles of European Union trade marks protection are modified in
view of the relation between a trade mark and a famous person in the case of the conflict
between a trade mark containing a famous person’s surname and a similar trade mark of
another person.DESIGN/METHODOLOGY/APPROACH: The author analyses and interprets legal provisions of
EUTMR and a variety cases concerning the problem of a famous person’s surname
protection based on the EUTMR provisions.FINDINGS: A specific theory of a trade mark neutralization is applied in the case of a
conflict between a trade mark containing a famous person’s surname and a similar trade
mark of another person. Furthermore, in such a conflict the general rule formulated by the
Court of Justice of the European Union (CJEU) in the SABEL case (“the more distinctive
the earlier mark, the greater will be the likelihood of confusion”) tends to be modified by
CJEU.PRACTICAL IMPLICATIONS: The paper is addressed to both lawyers dealing with the protection
of intangible assets (particularly personal names and trade marks) and managers of
famous persons.ORIGINALITY/VALUE: The article contains a comprehensive analysis of the subject matter. The
possibilities and principles of protection of a famous person’s surname on the ground of
the EUTMR are discussed in the context of specific cases, including the latest ones, to
enable the author to detect the specific approach to the matter that tends to be applied by

No full textThe article presents Stadło małżeńskie by Jan Płoczywłos Mrowiński (1514–1580) as one of the inspirational sources of Kazanie przy przyjmowaniu świątości małżeństwa by Józef Wereszczyński (b. after 1531, d. 1598). In the latter work, the quotations taken from the first work on marriage in the Polish language are intertwined with excepts from Żywot człowieka poczciwego [Life of an Honest Man] by Mikołaj Rej (1505–1569). As an author of the sermon in question prepared for the occasion of Stanisław Piotrowski’s betrothal, Wereszczyński rarely utilised the excerpts from Mrowiński’s treatise mechanically. He rather tends to abbreviate the fragments of Stadło małżeńskie, translocate them, develop on their pattern, and device substitution (e.g. by replacing biblical quotes with proverbs). Social media can be used by both institutions and private individuals – especially influencers who reach a wide audience with their message. The article discusses the issue of the promotion of veganism by (social) influencers. The author analyses, in a form of a case study, selected Instagram profiles in terms of content and form of messages in order to do this. The starting point for the considerations is the characteristics of social media (with particular emphasis on Instagram) and the explanation of the term influencer and other related issues. The article also introduces the issue of the multidimensionality of veganism
Types of infringement of a right to trade marks with reputation in Polish and EU jurisprudence
No full textThis article aims at examining the extent to which the Polish and European Union adjudication bodies apply the EUCJ guidelines regarding determination of each type of the right to a trade mark with
reputation (TMwR) infringement. The author analyses and interprets legal provisions of EUTMR and argumentations of variety decisions of European Union and Polish adjudication bodies concerning the problem of an infringement of a right to a TMwR. A close analysis of the latest judicial decisions concerning the TMwR protection indicates that, in principle, detailed guidelines regarding the occurrence of each form of the TMwR infringement are already in place. However, there are still some deviations from these guidelines, most notably in the Polish jurisdiction, since adjudicating bodies tend to see parasitism in the probability of association of juxtaposing trade marks alone. Thus, it happens that a three-step test on the likelihood of transferring trade mark with reputation associations onto goods/services designated with a third party mark (as described below) is omitted. This is especially significant where a later sign is used for goods/service that are not similar to those that are signed by the TMwR. Furthermore, an enhanced evidentiary standard applied in the Intel case seems to be frequently absent in the practice of law application. Changes in the economic behaviour of the average consumer or a serious likelihood that such a change will occur are hardly ever taken into account in the assessment of the activity detrimental to the distinctive character or the repute of a TMwR. Although many years have passed since key preliminary rulings were issued by the EUCJ, which shaped the principles of examining the evidence that pointed to the possibility of an infringement of a right to a TMwR, some negligence and shortcomings in the application of the law in this respect have not been entirely eliminated. No full textFather Adam Kaźmierczyk (1920-2004), as a student of the first year of the Seminary in Tarnów, was one of the people arrested on April 22, 1941 by the Nazis in Błonie near Tarnów. He was thus an eyewitness to the beginning of martyrdom of the rector, Fr. Roman Sitko – now blessed. This article has cited the memories of Fr. Adam concerning his seminary formation, which was interrupted for 100 days due to his arrest and imprisonment in Tarnów. These facts may partly be revealed in the previously published interviews of Fr. Kaźmierczyk, or known for a certain group of people from his oral tradition. Some events can be aligned with the memories of the witnesses of Fr. Roman Sitko’s arrest, available in the publications devoted to the Blessed Father. Any such information is valuable and sheds light on the issue of repression against the Church in Tarnów by the Nazis during World War II and the heroic attitude of the priests at the time. This article contains excerpts of the archival manuscript by Fr. Tekst porusza kilka wątków, wśród których głównymi są: przedstawienie osoby Gustawa Zielińskiego (1809–1881) – poety, powieściopisarza, bibliofila, działacza społecznego, sybiraka oraz ukazanie w zarysie dziejów biblioteki skępskiej i Towarzystwa Naukowego Płockiego. Autor pokrótce przedstawia skomplikowane dzieje sprowadzenia biblioteki skępskiej do Płocka, a na podstawie źródeł odtwarza historię przekazania dubletów biblioteki Gustawa Zielińskiego przez Towarzystwo Naukowe Płockie do Biblioteki Publicznej im. H. Łopacińskiego w Lublinie, w której znaczącą rolę odegrał Aleksander Jaworowski – ówczesny prezes Towarzystwa Biblioteki Publicznej im. H. Łopacińskiego. Ważną część pracy stanowi także charakterystyka fragmentu skępskiego księgozbioru, który pod koniec 1913 r. trafił do zbiorów Biblioteki Publicznej im. H. Łopacińskiego w Lublinie.This article has become an integral part of the research on the collection of the Library in Lublin. The text raises several issues, the main ones being an exposition of Gustaw Zieliński (1809–1881), poet, novelist, bibliophile, social activist, and Siberian deportee, and a presentation of an outline history of the library in Skępe and the Scientific Society of Płock. The author briefly presents the complex history of bringing the Skępe library to Płock, and, based on various sources, recreates the history of the handing over of duplicate copies from Gustaw Zieliński's library by the Scientific Society of Płock to the Hieronim Łopaciński Regional Public Library in Lublin, a significant role in which was played by Aleksander Jaworowski, the then President of the Society of the Hieronim Łopaciński Regional Public Library. An important part of the work is also the characteristics of a section of the library in Skępe, which at the end of 1913 made it into the collection of the Hieronim Łopaciński Regional Public Library.Статья вписывается в круг научных интересов фонда люблинской библиотеки. В статье рассматриваются темы: жизнь и творчество Густава Зелинского (1809-1881) – поэта, писателя, библиофила, общественного деятеля, сибиряка, а также исследования по истории скемпской библиотеки и Плоцкого Научного Общества. Автор вкратце описывает сложную историю скемпской библиотеки, которую привезли в Плоцк. На основе источников, восстанавливает историю дублетов библиотеки Густава Зелинского, которые были переданы Плоцким Научным Обществом в Публичную Библиотеку им. Херонима Лопацинского в Люблине. Значимую роль в этом деле сыграл Александер Яворовси – тогдашний председатель Общества Публичной Библиотеки им. Х. Лопацинского.
Важным является также описание той части скемпского фонда, который в конце 1913 г. стал частью фонда Воеводской Публичной Библиотеки им. Херонима Лопацинского в Люблине
