The protection of the socio-environmental function of property in the property registration service
No full textA dissertação destina-se à análise da tutela da função sociaoambiental da propriedade pelo serviço de registo de imóveis. Serão esmiuçados os institutos jurídicos inerentes ao serviço público de registros imobiliário, cujo exercício é outorgado aos particulares por delegação, além das especificidades do regime jurídico e desenvolvimento da atividade, elucidando sobre a sua caracterização como sui generis, ante a sua atipicidade dentro do ordenamento jurídico. Superada a qualificação das atividades exercidas pelos delegatários dos serviços públicos de registros imobiliários, o foco será o regime jurídico da publicidade dos atos registrados nos assentos do serviço de registro de imóveis, e como isso pode contribuir para o fim de manter o ambiente ecologicamente equilibrado. Por método indutivo e dedutivo, partindo da compreensão do Registro de Imóveis como repositório de informações seguras, que traduzem a verdadeira situação jurídica dos bens imóveis, a pesquisa aborda como as notícias ambientais são tratadas e potencializadas a partir do seu ingresso no repositório público imobiliário. Sob uma análise histórica, se discorrerá sobre como o Registro de Imóveis veio a se tornar um importantíssimo fator de consecução de paz social e de desenvolvimento econômico, cuja publicidade passa também a cumprir o nobre mister de proteção aos direitos não-proprietários. Finalmente, são abordados, especificamente, alguns atos já praticados pelos registradores imobiliários, demonstrando que, concretamente, tal atuação já pode ser observada. A pesquisa permitiu a conclusão que a delegação dos serviços de registros de imóveis é sui generis encontrando fundamento em dispositivo constitucional próprio. Indo além, que publicidade de situações jurídicas, ante a prática de atos pelo registrador de imóveis pode se apresentar como um fio condutor da dimensão socioambiental do registro público e sua função orientadora de política pública. Finalmente, que o Registro de Imóveis, na conjuntura atual, tem um papel importantíssimo a serviço da materialização da função social da propriedade, repercutindo na preservação do meio ambiente.The study is aimed at analyzing the protection of the socio-environmental function of property by the property registration service. The legal institutes inherent to the public service of real estate registrations, whose exercise is granted to individuals by delegation, will be detailed, in addition to the specificities of the legal regime and development of the activity, elucidating its characterization as sui generis, in view of its atypicality within the legal system. Moving forward from the qualification of the activities carried out by the delegates of the public services of real estate registration, the present work on the legal regime of the publicity of the acts registered in the seats of the real estate registration service, and how this can contribute to the end of maintaining the ecologically balanced environment. By inductive and deductive method, starting from the understanding of the Real Estate Registry as a repository of secure information, which translates the true legal status of real estate, there will be a detailed study on how environmental news is treated and enhanced from its entry into the public repository. Under a historical analysis, it will discuss how the Real Estate Registry came to become a very important factor in achieving social peace and economic development, whose publicity also fulfills the noble mission of protecting non-proprietary rights. Finally, some acts that are already practiced by real estate registrars will be discussed, demonstrating that, concretely, the action can already be observed. It was concluded that the delegation of property registration services is sui generis based on its own constitutional provision. Going further, what publicity of legal situations, in view of the practice of acts by the real estate registrar, can present itself as a guiding thread of the socio-environmental dim. ension of the public registry and its guiding function of public policy. Finally, that the Real Estate Registry, in the current situation, has a very important role in the service of materializing the social function of property, with repercussions on the preservation of the environment

Going Beyond Counting First Authors in Author Co-citation Analysis
Get PDFThe present study examines one of the fundamental aspects of author co-citation analysis (ACA) - the way co-citation
counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings
are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that
only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into
account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed. Reasons for these effects are discussed
Variations on the Author
Get PDF“Variations on the Author” discusses two of Eduardo Coutinho’s recent films (Um Dia na Vida, from 2010, and Últimas Conversas, posthumously released in 2015) and their contribution to the general question of documentary authorship. The director’s filmography is characterized by a consistent yet self-effacing form of authorial self-inscription: Coutinho often features as an interviewer that rather than express opinions propels discourses; an interviewer that is good at listening. This mode of self-inscription characterizes him as an author who is not expressive but who is nonetheless markedly present on the screen. In Um Dia na Vida, however, Coutinho is completely absent form the image, while Últimas Conversas, on the contrary, includes a confessional prologue that moves the director from the margins to the center of his films. This article examines the ways in which these works stand out in the filmography of a director who offers new insights into the notion of cinematic authorship
Appropriate Similarity Measures for Author Cocitation Analysis
Get PDFWe provide a number of new insights into the methodological discussion about author cocitation analysis. We first argue that the use of the Pearson correlation for measuring the similarity between authors’ cocitation profiles is not very satisfactory. We then discuss what kind of similarity measures may be used as an alternative to the Pearson correlation. We consider three similarity measures in particular. One is the well-known cosine. The other two similarity measures have not been used before in the bibliometric literature. To increase the tax collection in the Fiscal State, on January 10, 2018, with the Federal Law 13.606, a new form of extrajudicial collection of federal tax credit is created, called pre-enforceable registration, which grants the National Treasury Attorney the prerogative of, in the event of default by the taxpayer, determining the unavailability of assets and rights even before tax enforcement. PGFN Ordinance 33/2018, which in turn regulates the registration institute, seeks to minimize the discomfort inherent in the unavailability for the taxpayer.A manutenção da máquina estatal e a promoção dos direitos sociais dependem de recursos que, cada vez mais, decorrem da tributação. Para o incremento da arrecadação tributária no Estado Fiscal, em 10 de janeiro de 2018, com a Lei federal n. 13.606, é criada uma nova forma de cobrança extrajudicial de crédito tributário federal, denominada de averbação pré-executória, que concede à Procuradoria da Fazenda Nacional a prerrogativa de, no caso de inadimplemento do contribuinte, determinar a indisponibilidade de bens e direitos, antes mesmo da execução fiscal.
