Urgency authority to hear Constitutional Complaint in the Constitutional Court of the Republic of Indonesia as an effort to protect the rights of citizens is needed. The granting of the authority to hear Constitutional Complaint in the Constitutional Court of Indonesia was to ensure that there are no loopholes in the law enforcement efforts to protect the constitutional rights of citizens

    Beberapa peraturan terkait UMKM memberikan beberapa perubahan yang mempengaruhi terciptanya percepatan bagi pelaku usaha UMKM, dimana yang paling berdampak khususnya adalah Usaha Mikro yang mengalami percepatan pertumbuhan akibat peraturan yang mempengaruhi pertumbuhan sektor mikro. Pada awalnya sektor mikro dianggap sebagai sektor usaha yang paling tidak berpengaruh namun kini memberikan kontribusi nyata terhadap sektor riil. Karena terciptanya rekonstruksi paradigma baru bagi pelaku usaha mikro, yang awalnya bermodal 50 juta Rupiah kini berubah menjadi 1 Miliar Rupiah. Oleh karena itu, cara pandang yang digunakan adalah sistem kepercayaan fundamental yang melandasi cara pandang para pelaku usaha mikro yang menganggap bahwa hanya usaha nonformal yang bisa menjadi usaha unggulan yang dapat diandalkan, hal ini terlihat jelas pada membaiknya perekonomian pasca Covid-19 yang membuktikan bahwa sektor usaha mikro menjadi salah satu sektor andalan di negeri ini. Namun pentingnya rekonstruksi paradigma pembangunan hukum ini adalah agar para pelaku usaha dapat menyongsong Indonesia Emas pada tahun 2045. Agar usaha mikro dapat menjadi salah satu usaha unggulan yang dapat memberikan kontribusi, khususnya paradigma pembangunan hukum sebagai pandangan mendasar sebagai salah satu aspek terpenting dalam menjalankan usaha maupun dalam berpikir dan bertindak.

This research uses field research, using a qualitative descriptive approach, which is to clearly describe events in the form of moral inculcation and tolerance for families of different religions through the interview process.     Land disputes are legal issues that arise due to conflicts or clashes of interest among parties concerning the control, use, or ownership of land. These disputes have become an inevitable issue in modern society, particularly given the increasing demand for land driven by population growth, urbanization, and economic development. The research method employed in this study is normative juridical, which focuses on the examination of library materials or secondary data. This data includes documents, legislation, and various literatures relevant to the legal topic or issue under investigation. Land disputes often stem from differing interpretations regarding the legal status of certain parcels of land, particularly concerning ownership and usage rights. Several primary factors triggering land disputes can be summarized as follows: (1) The lack of proper land administration in the past; and (2) Structural imbalances in land control and ownership. Efforts to resolve legal issues related to land disputes are explicitly regulated under Presidential Regulation No. 20 of 2015 concerning the National Land Agency (Badan Pertanahan Nasional or BPN). Specifically, Article 3 clauses (3) and (4) of this regulation mandate the Head of the National Land Agency to formulate and implement policies in several strategic areas. The resolution of land disputes is generally pursued through legal means by bringing the case to court. Additionally, land disputes may also be resolved through negotiation or mediation, which offers several advantages compared to judicial proceedings. One of the primary benefits of resolution through negotiation is the efficiency in terms of time, cost, and effort required. The aim of the research conducted by the author is to identify the causative factors and resolution efforts concerning land ownership disputes.Sengketa tanah merupakan permasalahan hukum yang muncul akibat adanya konflik atau benturan kepentingan di antara para pihak terkait dengan penguasaan, penggunaan, atau kepemilikan atas tanah. Persoalan sengketa tanah ini menjadi salah satu isu yang sulit dihindari dalam kehidupan masyarakat modern saat ini, terutama mengingat kebutuhan pada tanah terus mengalami peningkatan sejalan melalui pertumbuhan populasi, urbanisasi, dan perkembangan ekonomi. Dalam bukan penelitian ini dipakai sebuah jenis penelitian yang berupa yuridis normatif dengan dilaksanakan melalui langkah berfokus pada penelaahan bahan pustakanya maupun pada data sekunder. Data ini mencakup dokumen, peraturan perundang-undangan, serta berbagai literatur yang relevan dengan topik atau isu hukum yang sedang diteliti. Sengketa tanah seringkali berakar pada perbedaan pandangan mengenai status hukum tanah tertentu, terutama yang berkaitan dengan kepemilikan dan penggunaannya. Beberapa penyebab utama yang memicu sengketa tanah dapat dirangkum sebagai berikut: (1) Tidak tertibnya administrasi pertanahan pada masa lalu; dan (2) Ketimpangan struktur dalam penguasaan dan kepemilikan tanah. Upaya dalam menyelesaikan berbagai permasalahan hukum yang berkaitan dengan perselisihan atau sengketa tanah telah diatur secara tegas dalam Peraturan Presiden Nomor 20 Tahun 2015 tentang Badan Pertanahan Nasional (BPN). Ketentuan tersebut, khususnya dalam Pasal 3 angka 3 dan 4, menegaskan bahwa Kepala Badan Pertanahan Nasional memiliki tugas dan tanggung jawab untuk merumuskan serta melaksanakan kebijakan di sejumlah bidang strategis. Penyelesaian terhadap sengketa yang berkaitan dengan tanah dalam wujud umum dilakukan lewat jalur hukum, yakni dengan membawa kasus tersebut ke pengadilan. Selain itu dalam menyelesaikan sengketa bisa dijalankan lewat penyelesaian sengketa tanah yang dilakukan lewat tahap perundingan maupun mediasi memiliki sejumlah kelebihan jika dilakukan perbandingan lewat penyelesaian sengketa melalui jalur peradilan. Salah satu keuntungan utama dari penyelesaian melalui perundingan adalah efisiensi waktu, biaya, dan tenaga yang dibutuhkan.     This study aims to look at the interpretation and impact of the decisions of the Constitutional Court relating to the review of laws relating to the State's Right to Control in the management of natural resources. This research is a normative legal research using secondary data which includes primary, secondary and tertiary legal materials. The approach used is a statutory approach. The results of the study found that on the one hand it is a guideline for understanding and interpreting Article 33 of the 1945 Constitution which has been amended. On the other hand, from several Judicial Review made by the Constitutional Court, there are legal uncertainties, one of which is the Oil and Gas Law and the Electricity Law. In addition, the lack of uniformity in understanding natural resources in every decision of the Constitutional Court also causes differences in understanding in interpreting Natural Resources to be included in the law
