    Childbirth Injuries: an issue fraught with risks from the health care and medicolegal perspectives

    Birth injuries caused by medical negligence are a real threat for mothers and their children, which can entail catastrophic, life-changing consequences, permanent disability, or even death. Families almost always seek redress from doctors and/or facilities, but in order for a birth injury malpractice claim to be successful, it needs to be proven that the medical care providers owed a duty to the child and that they were derelict in that duty and did not meet the proper standard of care; Furthermore, a causal relationship needs to be established between injury sustained by the child and the physician’s or provider’s breach of duty to the child. Relevant scientific articles have been collected by drawing upon medical search engines and archives such as Medline, Cochrane Central, Scopus, Web of Science, Science Direct, EMBASE and Google Scholar, through December 2019, using keywords such as “birth injuries”, “malpractice”, “claims”. Moreover, the Authors have delved into legal databases (Justia, Lexis, De Jure, Leagle), identifying 6 meaningful instances of court cases centered around birth injuries with severe consequences, all stemming from malpractice and negligence. Ultimately, it can be concluded that demonstrable and ad- equately documented compliance with well-established guidelines and/ or best practices are a determining factor in the legal defence of health care operators; that in turn can go a long way towards discouraging meritless claims and frivolous lawsuits, which constitute a challenging issue raising health care costs in many countries

    Se han identificado una gran variedad de fotorreceptores en bacterias quimiótrofas y que la luz que perciben estos fotorreceptores gobierna su modo de vida, como por ejemplo vida unicelular móvil versus comunidades bacterianas adheridas a superficies o vida libre versus vida simbiótica o parasitaria.     Dr. Del Rio-Roberts is an Assistant Professor within the Department of Justice and Human Services, within the College of Arts, Humanities, and Social Sciences at NSU. She is also the Program Director for the Masters of Science in Developmental Disabilities Dr. Del Rio-Roberts teaches courses in developmental disabilities, child protection, recreational therapy, human services administration, and mental health counseling. Furthermore, she is a Licensed Florida Psychologist who specializes in the areas of developmental disabilities, clinical child psychology, infant mental health, and psychological evaluation. Dr. Del Rio-Roberts has been the principal and co-principal investigator on numerous university-based grants related to developmental disabilities. She is the author of The Playful Minds Coping Skills Program: A Treatment for Pediatric Oncology Patients and several articles related to qualitative research. In the community, Dr. Del Rio-Roberts is a Clinical Director for the Strong Minds, Strong Bodies program for the Special Olympics of Florida and has appeared as a consultant on several television and radio programs

    Nootropics use in the workplace. Psychiatric and ethical aftermath towards the new frontier of bioengineering

    OBJECTIVE: The authors have sought to expound upon and shed a light on the rise of nootropics, which have gradually taken on a more and more relevant role in workplaces and academic settings. MATERIALS AND METHODS: Multidisciplinary databases have been delved into by entering the following keys: "nootropics", "cognitive enhancement", "workplace", "productivity", "ethics", "bioengineering". In addition, a broad-ranging search has been undertaken on institutional websites in order to identify relevant analysis and recommendations issued by international institutions and agencies. Papers and reports have been independently pored over by each author. This search strategy has led to the identification of 988 sources but only 64 were considered appropriate for the purposes of the paper after being selected by at least 3 of the authors, independently. RESULTS: The notion of an artificially enhanced work performance - carried out by the 'superworker' - is particularly noteworthy and resonates with the conception of contemporary work on so many different levels: the rising need and demands for higher degrees of flexibility and productivity on the job, the implications of a '24/7' society, where more and more services are available at any time, the ever greater emphasis on entrepreneurial spirit, individual self-reliance and self-improvement, and last but not least, the impact of an ageing society on economic standards and performance. CONCLUSIONS: Moreover, it is worth mentioning that human enhancement technologies will predictably and increasingly go hand in hand with gene editing, bioengineering, cybernetics and nanotechnology. Applications are virtually boundless, and may ultimately affect all human traits (physical strength, endurance, vision, intelligence and even personality and mood)

    Do desamparo à dor de existir na poesia de Flobela Espanca: alguns apontamentos

    Dissertação (mestrado) - Universidade Federal de Santa Catarina, Centro de Filosofia e Ciências Humanas, Programa de Pós-Graduação em Psicologia, Florianópolis, 2014.A questão central dessa pesquisa é se a dor que Florbela descreve em seus versos poéticos tem como motivo o que Freud denominava desamparo. Trabalhamos aqui as relações do desamparo freudiano com a dor de existir na perspectiva teórica psicanalítica. A poesia de Florbela Espanca apresentada ilustra as relações do desamparo com a dor de existir. Utilizou-se do método de análise discursiva de base psicanalítica, extraindo dos trechos poéticos sentidos coerentes com essa perspectiva de análise. Realizamos uma revisão bibliográfica do tema do desamparo na teoria freudiana. Examinando os poemas escritos de 1903 a 1917, constatamos que o desamparo e a dor de existir apresentam-se na posição melancólica nas personagens da poesia de Florbela Espanca.Abstract : This text aims to discuss some effects of "Helplessness" (the Freudian idea of "Hilflosigkeit") in Florbela Espanca's poetry. Examining the author's discourse from a psychoanalytic point of view, the work tries to make the pain that the Portuguese author often describes in her verses understandable. The main conclusion is that Florbela's characters show helplessness and existential pain in a way that is typical of the melancholic position

    Liability arising from restraint use in psychiatry [Responsabilità professionale derivante dall’uso della contenzione in psichiatria]

    Lo scopo del presente articolo è quello di valutare se e quando l'uso della contenzione può essere giustificato in psichiatria. Gli autori espongono i vari tipi di costrizione e i rischi che tali mezzi comportano per il benessere psicofisico del paziente, soffermandosi ad analizzare se tali pratiche costituiscano realmente forme di cura sanitaria. Infatti, una risposta negativa a tale domanda comporterebbe che la contenzione non è mai obbligatoria e può essere eseguita solo in stato di necessità. Una risposta affermativa, invece, significherebbe che condizioni straordinarie potrebbero rendere obbligatoria la contenzione. Di conseguenza, i medici possono essere ritenuti legalmente responsabili se non usano la contenzione quando necessario per impedire ai pazienti di compiere atti di autolesionismo o danni ad altri. Poiché la contenzione di per sé comporta pesanti limitazioni alla libertà personale (art. 13 Cost.) e gravi rischi per la salute (art. 32 Cost.) essa può considerarsi obbligatoria solo se sono rispettati i criteri dello stato di assoluta necessità (ex art. 54 Cost. della legge penale italiana). Tali parametri dovrebbero essere fissati a livello nazionale e non locale.This article aims to lay out an assessment of whether and when restraint use may be warranted in psychiatry. The authors lay out various types of restraints and the risks posed by such means for the patient’s psychophysical well-being, wondering whether such practices really constitute forms of health care treatment. A negative response to that question would entail that restraint is never compulsory and can only be performed under the state of necessity. An affirmative answer, on the other hand, would mean that extraordinary conditions could make restraint mandatory. As a consequence of that, doctors may be held legally liable whether they fail to use restraint when necessary to keep patients from engaging in self-harm or harm against others. Since restraint per se entails heavy limitations to personal freedom (art. 13 Cost.) and serious risks for health (art. 32 Cost.) it can only be considered compulsory if the standards of an absolute state of necessity are met (under article 54 of Italian criminal statutes). Such parameters should be set on a national, rather than local, level. © 2021 Author(s)

    A POÉTICA n’AS CURVAS DO RIO: A IMAGINAÇÃO GEOGRÁFICA NO RIO CACHOEIRA

    O objetivo deste artigo é interpretar o espaço geográfico do rio Cachoeira no romance As Curvas do Rio, de José Cândido de Carvalho Filho, identificando-o como uma realidade geográfica concreta e também como uma paisagem imaginada e descrita pelo autor. O referido rio permeia como ator principal e também como cenário das paisagens vivenciadas nos diálogos que acontecem entre quatro amigos no alpendre da casa-sede de uma fazenda de cacau, no Sul do estado da Bahia. Através destes quatro personagens, o autor descortina “um mundo do cacau”, vívido, sentido, amado e imaginado, em que o importante rio Cachoeira torna-se povoado de desejo... devaneio... imaginação... e criatividade.... Ter imaginação significa ter liberdade de apreender o espaço, para pensar... para devanear... para escrever uma obra que leva o leitor à história e à memória da Região Cacaueira da Bahia. Os diálogos acontecem para que os personagens exponham seu entendimento pessoal sobre qualquer um dos temas debatidos, inclusive sobre a imaginária semelhança entre os rios e os homens. Não temos a intenção de substituir a análise científica pela criação literária, mas, apenas, retirar da literatura novos sentidos de interpretação, reconhecendo-a como uma via de enriquecimento do conhecimento do espaço geográfico do rio Cachoeira. Imaginação geográfica The poetry in “As Curvas do Rio”: the geographical imagination of cachoeira river The objective of this paper is to interpret the geographical space of Cachoeira River in the novel As Curvas do Rio by José Cândido de Carvalho Filho, identifying it as a concrete geographical reality and also as a landscape that was imagined and described by the author. The named river permeates as the main actor and also as a setting of the landscapes lived in the dialogues that take place among four friends in the porch of the main house of a cocoa farm in the South of Bahia State. Through these four characters the author uncurtains a vivid “cocoa world”, felt, loved and imagined, in which the important Cachoeira River is full of desire... reverie... imagination... and creativity... To have imagination is to have freedom to learn the space, to think... to wonder... to write a piece that takes the reader to the history and the memory of Bahia’s Cocoa Region. The dialogues take place to allow the characters to express their personal understanding about any of the debated topics, including the imaginary similarity between the rivers and the men. We do not have the intention to replace the scientific analysis by the literary creation, but only withdraw from the literature new senses of interpretation, recognizing it as a way to enrich the knowledge about the geographical space of Cachoeira River.     The only interventions deemed ethically acceptable are those that serve the "objective interest" of the minors involved from the standpoint of and conducive to sound mental health and balance in a patient's teenage years; by the same token, disproportionate interventions (e.g. overly invasive or pointlessly risky), or all those deemed unsuitable with regards to a poor cost-benefit ratio are viewed as unacceptable. In the process of considering the best interest of the minors involved, a wide array of factors come into play, such as: age, maturity, psychological and emotional conditions, motivations put forth by the underage patient, the opportunity to procrastinate the operation: parents, who are naturally entitled to give consent to the surgical procedures, and physicians are primarily liable to safeguard and act in the minor's best interest.
